men incorporated with Brodhead's regimentof Pennsylvania roops,but
some of them have since deserted and joined the Maryland line; Ger-
man, 4, now attached to the Maryland line about one company, deser-
tion and term of service expiring must account for the remainder; Fore-
man's, 2 ot 3, attached tothe Jersey troops;Patten's, z, attached to the

Pennsylvania line; artillery, 3, incorporated with Harrison's Virginia

Your committee are informed, that many of the men in the said
companies were enlisted for the war, and now remain in such of the
above corps as have been continued on the establishment, and others of
the reduced corps are now attached to the line'of the state in which
they have respectively served; and your committee are of opinion, that

congress should be requested to order, that all the men, now in service,

raised in this state for any of the above companies, be returned and

annexed to the line of this state."

This Regiment was intended to be raised in Canada and for some
time was called the znd Canadian. Later it was recruited in the United
States. It was also called 'Congress Own.'

RESOLVES OF CONTINENTAL CONGRESS r9 APRIL, r78r

" Resolaed, That it be, and hereby is recommended to the states of
Rhode-Island and Providence Plantations, New-York, New-Jersey,
Pennsylvania, Delaware, Maryland and Virginia, to make good the

depreciation of the monthly pay of the officers and.soldiers belonging to

colonel Moses Hazen's regiment that are considered as a part of the
quota of the respective states aforesaid, in the same manner they have
made good the depreciation to the officers and soldiers in the battalion

belonging to the lines of those states respectively."

Delaware Line.

RESOLVES OF CONTINENTAL CONGRESS-t5 IULY, 1776,

"Resolaed, That the battalion for the defense of the western fron-

tiers, be raised in the counties of Westmoreland and Bedford, in the
following proportions, to wit: seven companies in Westmoreland, and

one company in Bedford."

Ihis Regiment was raised for the defence of the frontier. Capt.

Moorhead's Independent Company was attached to this Regiment.

Some Maryland roops were sent to Fort Pitt and Col. Brodhead
tried to increase his Regiment, at Maryland expense, by discharging
Maryland officers and enrolling the men in his own Regiment. Many

of these men deserted him and returned to the Maryland Line.

Sir,

I want to form a company for my guard. In doing this I wish

to be extremely cautious, because it is more than probable, that, in the

course of the campaign, my baggage, papers, and other matters of great

public import, may be committed to the sole care of these men. This
teing premised, in order to impress you with proPer attention in the
choice, I have to request, that you will immediately furnish me with four
men of your regiment; and, as it is my farther wish, that this company
should look well and be nearly of a size, I desire that none of the men

may exceed in stature five feet ten inches, nor fall shortof five feet nine

inches, sober, young, active, and well made. When I recommend care
in your choice, I would be understood to mean men of good character
in the regiment, that possess the pride of appearing clean and soldier
like. I am satisfied there can be no absolute security for the fidelity of
this class of people, but yet I think it most likely to be found in those
who have familylonnexions in the country. You will therefore send

me none but natives, and men of some propertl, if you have them. I

must insist, that, in making this choice, you give no intimation of my

preference of natives, as I do not want to create any invidious dis'

iinction between them and the foreigners. I am, yours &c.

An ACT for the defence of the bay

"Be it enacted, fur the General Assembly of Marltland,Thatthe

governor and council be authorised and requested to purchase (or
cause to be built) and fitted with sails and oars, and *ann.d as soon as

possible, four large barges or row-boats, capable of carrying swivels and

twenty five men at least; and that the gor"rno, and council be also
authorised and requested to purchase (oi cause to be built) as soon as
possible, one galley, capable of carrying two eighteen and two nine
pounders, with swivels; and one sloop oischooneri capable of carrying
ten four pounders, and procure them to be well found, fitted, ar-.a]

and manned.

And be it enacted, That the governor and council be authorised

and requested to appoint and commission a proper number of brave,

experienced, and able seamen and officers, to command the said galley

and sloop or schooner

Arud be it enacted, That a company of one hundred men be imme-

diately raised to serve as marines on board the said galley and sloop

or schooner, and occasionally on board the said barges or row-boats;

and that the governor and council be authorised and requested to

appoint and commission one captain and two lieutenants to command

the said company of marines, and to direct such officers to procure by

enlistment as soon as possible, the said number of healthy able bodied

men, including two sergeants and two corporals, to serve in such com-

pany for the term of three years, unless sooner discharged.

And be it enacted, That if any officer, soldier, or marine, shall lose

a limb, or be otherwise maimed or hurt, so as to be rendered incapable

of procuring a livelihood, such officer, soldier, or marine, shall be entitled

to receive the same provision and support as is or shall hereafter be

established by this state for its officers and soldiers in the service of the

A Supplement to the act for the defense of the bay.
"Be it enacted, by the General Assembfit of Maryland,That for the

immediate defense of the bay, . . . the governor and council be

authorised and empowered to purchase, at such price as they may think

reasonable, the galley now in Baltimore-town, if on examination

by such proper person as they may appoint, she shall be found to be
sound and fit for the service,
and that they have power to

contract for the building another galley, agreeable to the act of assembly

of the last session,and cause her to be completely fitted and manned at

the public expense; both of which gallies to be employed in such manner

as the governor and council shall from time to time direct, for the

defense of our bay and the protection of the trade thereof; ,

Be it eruacted, That the Governor and Council be authorised and

empowered to contract for any number of barges, not exceeding eight,

that they may think necessary for the defense of this bay, and to cause

The State of Maryland to Edward Spedden, Gentleman, Greeting.

Be it known that We reposing especial trust and Confidence in

your Patriotism valour Conduct and Fidelity, do by these presents con-

stitute and appoint you to be Second Lieutenant of the Barge Fear-

nought in the Service of this State, fitted out for repelling every hostile
invasion thereof, and for the Defence of our Liberties. You are there'
fore carefully and diligently to discharge the Duty of Second Lieutenant

of the said Barge by doing and performing all manner of things thereunto
belonging, according to the rules and Discipline of War, and the usage
of the Sea, and the Instructions which may from Time to Time be given

you. And we do strictly charge and require all Officers, Seamen,
Marines, and others under your Command, to be Obedient to your

Orders as Second'Lieutenant of the said Barge and you are to observe
and follow all such Orders and Directions which you shall receive from

the Supreme Executive Power of this State. This Commission to be
in force until Lawfully revoked. Given at Annapolis in Council this
z3rd Day of May, A. D. 1782.

As you have suspended me from officiating the duty of Lt. on
board the Barge Fearnought, I think It a hard case that I have not had
a hearing in my own defence, as there is so many false reports ProPo-

gated to my prejudice, in respect of my Conduct on that day in the action

with the British Barges, Sincerely was this. I was Stationed at the bow

Gun a 6lber. when we came into Action the first fire bursted, as much as

Two feet of the uper part of the Muzzle blew of. I immediatly ac-

arJ quainted the Capt. of the Misfortune his answer was try her again my
Answer was here is at It then and accordingly fired two rounds Shot &
Two rounds Grape before the Comodore's Barge had blew up & It's

said that I Contradicted his Orders when he gave Orders to board the

British Barge then Nearly Along side the Comodore's Barge. I affirm on

the word of a man that I did not hear the Orders given being at tbo
great a distance & the men in Confusion but Expected as the men had

their Oars out that we was to try to board the British Barge & try to

save some of the Comodore's men if possible that was blown Overboard.

I saw our men Confused in rowing some giving way a Head & Others
backing water I called to them & told them to give way all together &
not to be so Confused and as for leaving my Station I never left It till
we where Oblidged to make our retreat & all Sails Set. Then I went Aft
& told.the boy at the Helmn to let me have the Helmn as I thought I

could Steer better myself. & If Capt. Speddin wanted me forward I

would gone at the first word.

RESOLVES OI- CONTINENTAL CONGRESS zo IIJNE, t777.

"Resolaed, That a corps of invalids be formed, consisting of eight
companies, each company to have one captain, two lieutenants, two
ensigns, five serjeants, six corporals, two drummers, two fifers, and one
hundred men. This corps to be employed in garrison, and for guards in
cities and other places, where magazines or arsenals, or hospitals are
placed; as also to serve as a military school for young gentlemen, pre-
vious to their being appointed to marching regiments; for which pur-

pose, all the subaltern officers, when off duty, shall be obliged to attend a

mathematical school, appointed for the purpose, to learn geometry,

arithmetic, vulgar and decimal fractions, and the extraction of roots; and

that the officers of this corps shall be obliged to contribute one day's
pay in every month, and stoppages shall be made of it accordingly,

for the purpose of purchasing a regimental library of the most approved

authors on tactics and the petite guerre: That some officers from this

corps be constantly employed in the recruiting service in the neighbor-

hood of the places they shall be stationed in ; that all recruits so

raised shall be brought into the corps and drilled, and afterwards

draughted into other regiments as occasion shall require.

Congress proceeded to the election of a colonel of the said corps of
invalids I and, the ballots being taken,

An ACT for the relief of disabled and maimed. officers, sordiers,

marines, and seamen.

"Be it enacted, $r the General Asscmbfu of Maryland, That every

commissioned officer, non-commissioned officer, and private soldiei,
who have or shall Iose a limb, or have been or shall be so disabled in the
service of the United States of America, as to render him incapable of
getting a livelihood, and who, at the time of entering into the service
of the said United States, was or shall be enlisted or recruited by this
state, shall receive during his life, or the continuance of such disability,
the one half of his monthly pay, from and after the time that his pay aj

And be it furtlter enacted, That every commissioned officer, non-
commissioned officer, and private soldier, in the armlr and every com-
mander, commissioned officer, warrant officer, marine, or seaman, of any
of the ships of war or armed vessels belonging to the United States of
America, who have been or shall be wounded in any engagement' so
as to be rendered incapable of serving in the army or navy' though not
totally disabled from getting a livelihood, and who at the time of enter-

ing into the service of the said States, was or shall be enlisted or
recruited by this state, shall receive such monthly sum as shall be
adjudged adequate by the justices of the orphans court of the county
in-which such commissioned officer or private soldier of the army, or
commander, commissioned officer, warrant offiCer, or seaman, of the

navy, shall reside ; provided the same doth not exceed his half pay.
And be it enacted, That the justices of the said courts

are hereby enjoined to cause due entriei to be made in their proceed-
ings, of the name or names of all Persons to whom drafts or orders
shitl Ue given in pursuance of this act ; also of their places of residence,

in what regiment or company they served, the engagement or action in
which they received their wound, and the sums alloted them ; also of

the death of such disabled person, or ceasing of such allowance.

And 0e it further enacted, That all such officers and soldiers, who
may be entitled to the provisions under this act, and shall be found to

be capable of doing guard or garrison duty, ma1l be formed into a corps
of invalids, and subject to the said duty; and all officers, marines, and
seamen, of the navy, who shall be entitled to the same provision, and
shall be found capable of doing any duty on board the navy, of any

department thereof, shall be liable to be so employed."

from Robert Denny, r782.

Sir I enclose returns of the invalid pensioners paid by this State, and I
regret that they have been so long delayed which was owing to many

of the returns being imperfect; indeed, although we have sent to many

of the Counties to get the returns more perfect, they are not so com'

plete as I would wish.
I think proper to make some remarks on the return of officers, and

request that you will inform me which of them, (if any) are excluded

from the half pay of the United States by the Acts of the late or present

Congress, that I may communicate it to the legislature of this State, for

them to determine whether they will continue the pensions to those who

are rejected by the United States.

Perry Benson, James Bruff, Richard Anderson, John Trueman,
John Lynn, James Ewing and James Somervill, have received their 5
years commutation from the United States, and under a particular law

of this State made expressly for their relief have received half pay.

Jehu Bowen was wounded at German Town and afterwards re'
signed, but as the disability occasioned by his wounds still continued,

the Legislature upon application passed a law putting him on a footing, ,
as to his half pay, with other officers. He has not received commutation.

Rignal Hillary and John Levasche died in the service, their widows

have received pensions equal to the half pay of their husbands, under
the laws of this state which I believe is provided for by Acts of the late

Congress.

John Hoskin Stone was wounded aird resigned, but was afterwards
put on the half pay establishment by a law of this State.

Uriah Forrest lost his leg in the action of German 'fown and

resigned the z3rd of Feb., r78r, as will appear by the votes and pro-
ceedings of congress. The state of Maryland advanced him a sum of
money equal to seven years half pay of a Lt.

a ordir. In addition to these, the appendix coutains a list of militia who

served in 1777,which was found among the papers deposited by the Johns

Hopkins University, a list of the Select Militia of t78r, enlisted from

Frederick County, and a roll of the crew of the Ship Defence, compiled

by Mr. Philip D. taird, from papers in the Land office. It has seemed
blst to include all available rolls in this volume, so the muster rolls of

the Flying Camp Companies, and the Eastern Shore Militia Companies

ordered to Virglnia, fi..t printed in Volume XII of the Archives of

Maryland, are reprinted in this appendix.
