MARYLAND ACTS, OCT., t777.

"An ACT for recruiting the quota of troops of this state in the
American army, and furnishing them with cloathing and other neces-

saries.

Whereas an enlistment of volunteers on bounty is the most eligible

mode to furnish two thousand men for recruiting our quota of- the

American army;

Be it enacted, by the Gerueral Assemb$t of Maryrtand,-firat the said

two thousand men be apportioned amongst the several counties, accord-
ing to the number of militia in each county

Be it enacted, That every recruit, at the time of his enlistment
shall have his choice of the regiment or company in which he will
serve, provided such regiment or company be noi full, and if full, he

may choose any other regiment or company, which shall be entered
against his name, and returned to the officer appointed to receive such

recruit.

And be it enacted, That the recruits aforesaid shall be carried by

the recruiting officers respectively before the lieutenant of the county in
which such recruits are raised, to pass muster,,,

"An ACT to procure troops for the American army.
Whereas it has been represented by congress as absolutely neces-
sary to use the most vigorous exertions to bring a powerful army into
the field the ensuing campaign, and it appearing to this assembly to be
the indispensable duty of this state to adopt the most effectual means
to attain that end,

Be it th.erefore enacted, by the General Assemb$t of Maryland,

That two thousand nine hundred and two men be raised, including the

two artillery companies already marched to camp, and such volunteers
as have been already obtained by recruiting; and that one hundred and
sixty men being d'educted for the said two artillery companies, the
remaining two thousand seven hundred and forty-two men be appor-
tioned among the several counties, according to the number of militia
in each county.

Out of which number, so apportioned, each county shall have a
deduction for all able bodied men heretofore enlisted in virtue of the
act, entitled, An act for recruiting the quota of troops of this state, in
the American army, and furnishing them with cloathing and other

necessaries.

And be it enacted, That every idle person above eighteen years of

age, who is able bodied and hath no fixed habitation, nor family, nor
any visible method of getting an honest livelihood, and who may be
adjudged by the lieutenant of the county, or any field officer, to come
properly under the above description of a vagrant, shall from and after

such adjudication, be considered as a soldier enlisted, and have it in
his choice, whether he will serve for nine months, or enlist for three

years or during the war.
Proaided neaertheless, That the governor and council shall have

full power and authority, to discharge any person adjudged a

vagrant, if in their judgement such person does not answer the above

description.

Ancl be it enacted, That no British prisoner or deserter, nor any

convict, until his original term of service is expired, shall be enlisted or
deemed a proper recruit, nor any servant whatever, until emancipated
and set at liberty

And be it enacted, That all recruits, in virtue of this or the before

recited act, shall be carried before the lieutenant of the county or some

field officer in which the recruits are or shall be raised, to pass muster "

MARYLAND ACTS-NOV., 1779.

"An ACT for recruiting the quota of troops of this state in the

American army.
Whereas an enlistment of volunteers on bounty is the most eligible

mode to furnish fourteen hundred men for recruiting our quota of the

American army;

Be it enactcd, 0y the General Assemb$t of Maryland, That the

said fourteen hundred men be apportioned amongst the several

counties according to the number of militia in each county.

And be it enacted, That every recruit, at the time of his enlistment,

shall have his choice of the regiment or company in which he will serve,

provided such regiment or company be not full, and if full, he may

chuse any other regiment or company not being full, which shall be

entered against his name.

Arud be it eruacted, That the recruits aforesaid shall be carried by the

recruiting officers respectively before the lieutenant, or any field officer,
of the county in which such recruits are raised, to pass muster."

Inclos'd you have certificates for Eleven men authenticated by Mr.

Christopher Lowndes. The men comes under the command of Ser-

jeant Mantle who makes the number mentioned. I have three or four
others who, not being certify'd, is obliged to remain behind. If your

Excellency thinks proper Serjeant Mantle & Wm. Harriss will return,

as their presence with me is very essential. No doubt your Excellency

will think proper to cloth the recruits immediatly, it being a part of

their Bounty.

N. B. The Serjeant brings 14 Men I have the Honor to be

"An ACT to procure recruits to complete the battalions of this state
in the service of the United States, and io raise an additional regiment,
if necessary.

whereas it has been represented by congress,'and by letters from

general Washington and the committee of co-operation, that it is abso,
lutely necessary to bring
a powerful army into the field this campaign ;
and it appearing to this general assembly their indispensable autf to

make the most vigorous exertions to recruit the quotatf troop. of itris
state :

Be it therefore enacted, by the Gcnerar Assembry of Marltland,
That fourteen hundred men be
apportioned among the several forthwith raised, and that the same be
of which number,
counties. out

so apportioned, each county shall have a deduction for all able bodied
men heretofore enlisted in virtue of the act passed at November session,

seventeen hundred and seventy-nine, entitled, An act for recruiting the
quota of troops of this state in the American army.

And be it enacted, That the lieutenant of the county, and the

several field officers, together with the commissioners of the tax in each

county, are hereby required, to meet . . . on the fifteenth day of July

next, to class all the property last assessed in their respective counties

into as many equal classes as there may be men wanted for such county,
and each class shall, within ten days thereafter, find an able bodied

recruit to serve during the war, or take up a deserter enlisted to serve

during the war.

And be it enacted, That all recruits, raised in virtue of this act,

shall be carried before the lieutenant of the county, or some field officer
in which the recruits are or shall be raised, to pass muster.

Ad, Whereas this assembly has proposed to the commander in

chief to raise a regiment of five hundred and thirty one men, to jointhe

army in lieu of the militia required from this state:

Be it enacted, That the governor and council shall have full Power

and authority, upon notice that the commander in chief accepts the
proposal, to order the following proportions of the said number of five
hundred and thirty one men, to be raised by the several counties (in

addition to the number by the first part of this act apportioned)
and the governor and council shall appoint such officers as they may

think proper and necessary to command such regiment, and the first

five hundred and thirty one men which are raised shall be incorporated
into a regiment and forthwith sent forward to join the army under the
commander in chief."

,.An ACT to expedite the raising an additional battalion of

regulars.

Whereas his excellency general Washington and the committee of
co-operation have thought proper to accept the proposal made by the
legislature of this state, to raise an additional battalion of regulars in
lieu of the two thousand two hundred and five militia, at first requested

to be furnished by this state, provided the same be raised so as to reach

the plhce of rendezvous by the last of July, and it is thereupon become
necessary to expedite the raising the said battalion :

Be it enacted, fur the General Assemb$t of Marytland,That the lieu-

tenants and field officers of the respective counties, shall immediately
on receipt of this act, and of the acts of assembly passed this session,
entitled, An act to procure recruits to complete the battalions of this

Sir:

The above is a Roll of the men furnished by the Classes for filling up

the Old Regiments, together with Two men I recruited, for which I was
obliged to pay three thousand pounds each. As some of those classes

neglected furnishing Substitutes, I had employed men to recruit, but

finding that the extraordinary pay I was oblige to advance to them, and
the exorbitant Bounty I should be oblige to give for recruits, (especially
after the Virginians began to give such extravagant Bounties for men
to serve only 18 Months), would far exceed the 15 pr. Ct.,I therefore
thought it most prudent to desist from employing persons to recruit,
till I received your farther orders on that head. When, on receiving
your letter relative to the peoples bringing in Wheat at Sixty Dollars

pr. Bushell in Lieu of the Substitutes or money I advertised them

thereof, and allowed them four weeks for so doing. The time is now

expired, and neither wheat nor money brought in. I am therefore now

about issuing warrants to the Sheriff for distressing all those who have

not complied with the Law, or your orders respecting the grain.
