Taken Acknowledged it, but now Denies and Refuses to tell
to what Regiment he belongs.

Acknowledges he is a Deserter, it is known that he Enlisted in

Baltimore County, when first Taken said he Marched with the
Militia from Baltimore, then said he belonged to the Virginia
Line and now says he belongs to the Pennsylvania Line.

RESOLVES OF CONTINENTAL CONGRBSS, 3 OCTOBER, r78o.

" Rcsolued, That such of the sixteen additional regiments as have

not been annexed to the line of some particular state, and all the separate

light corps of the army, both of horse and foot, and also the German
battalion, be reduced on the rst day ofJanuary next: that the non-com-

missioned officers and privates in those several corPs, be incorporated
with the troops of their respective states, and that such of them as do

not belong to any particular state, be annexed to such corPs as the

commander in chief shall direct.
That the regular armyof the United States, from and after the rst

day of January next, consist of 4 regiments of cavalry or light dragoons ;

4 regiments of artillery; 49 regiments of infantry, exclusive of colonel
Hazen's regiment, hereafter mentioned; r regiment of artificers:

That the several states furnish the following quotas, viz. . .
Maryland, 5 regiments of infantry:

That the states shall select from the line of the army a Proper
number of officers to command the several regiments to them resPec-
tively assigned, taking notice that no new appointment is to be made of

a higher rank than that of a lieutenant-colonel commandant:

And whereas, by the foregoing arrangement, many deserving

officers must become supernumerary, and it is proper that regard be

had to them:

Resolaed, That from the time the reform of the army takes place,
they be entitled to half pay for seven years, in specie, or other current
money equivalent, and also grants of land at the close of the war,
agreeably to the resolution of the l6th of September, r776."

MARYLAND ACTS, OCTOBER, r78o.

,,An ACT to draught the non-commissioned officers and privates of
the regiment extraordinary into the battalions of the quota of this state,
and to recal the commissioned officers of the said regiment.

WnnnBeS congress have recommended to this state to reduce the

number of their regiments in the continental service, and the commander

in chief has most earnestly called upon this state to complete the
number of men in said battalions without delay: And whereas it is

deemed impracticable to comply with said requisition, so as to have the
quota of men in the field at the time required, without draughting the

non-commissioned officers and privates of the regiment extraordinary.

Be it therefore enacted, fur the General Assembty of Maryland,

That the non-commissioned officers and privates of the regiment extra-
ordinary be draughted into the old battalions of the quota of this state
in the continental service, and that the field and commissioned officers

of said regiment be recalled.

And be it enacted, That the said field and commissioned officers

shall be reimbursed the extraordinary expence they may have incurred,

and over and above the pay that may be due to them at the time of
their discharge, shall receive one year's pay,.deducting therefrom the

money and value of the cloathing and other necessaries by them

received; provided always, that lieutenant-colonel Alexander Lawson

Smith, of the said regiment extraordinary, do hold the rank of lieu-

tenant-colonel, as a supernumetary officer of this state in the continental
service, he having resigned his commission in the continental service for
the purpose of accepting the command of the said regiment, and being
entitled in course to the rank of lieutenant-colonel.',

,'An ACT to procure recruits.
WupnBas this general assembly are earnestly called upon by
several requisitions from congress, and letters from general Wash-

ington, to recruit the quota of troops of this state :

Be it enacted, fu the General Assembfir of Marytland, That one

thousand men be forthwith raised to serve in the regiments of this state

in the continental service for three years, if not sooner discharged, by

an equal assessment on all property within this state.

And be it enacted, That the lieutenant of each county shall, as soon
as may be after notice of this act, divide and apportion all the property

last assessed in his county into classes of sixteen thousand
pounds each, . . and each class shall, within twenty days after

elassing as aforesaid, find an able bqdied recruit, between sixteen and

forty-five years old, to serve for three years, if not sooner discharged,

and the same recruit deliver to the lieutenant of the county, to be by

him passed.

And be it enacted, That any able bodied slave, between sixteen

and forty years of age, who voluntarily enters into the service, and is
passed by the lieutenant, in the presence and with the consent, and

agreement of his master, may be accepted as a recruit.

And be it enacted, That the lieutenants aforesaid, and the field and

commissioned officers of the militia in each county, shall, within five days

after the expiration of the said twenty days, meet . . . . and shall

proceed to examine whether each class hath found a proper effective

recruit according to this act, and if any class hath not found such
recruit, they shall cause lots to be cast and the person to

whose lot it shall fall shall be from thenceforth, to every intent and pur-
pose, considered as an enlisted soldier, to serve until the tenth day of
December seventeen hundred and eighty-one, in the quota of this state

of the continental troops, but if such person shall, within twenty

days thereafter, provide a good and sufficient recruit, to serve until the

said tenth day of December in his stead, he shall be discharged; or if
he shall at any time afterwards find a good and sufficient recruit in his
stead, to serve for three years unless sooner discharged, he shall be

discharged

And be it enacted, That all recruits raised in virtue of this act

shall be carried before the lieutenant of the county in which the recruits

are or shall be raised, to pass muster, but no imported convict

who hath not served his full term of seven years' or British deserter,

shall be passed as a recruit within this act.

And, for the discovery of deserters, and the punishment of those

who entertain, harbour, or conceal them,

Be it enacted, That if, after the first day of March next, any free

male person shall entertain, harbour, or conceal, any deserter, knowing
him to be such, such person shall, upon such conviction,be considered as
an enlisted regular soldier for the term of three years, and may be taken

as such by any officer of the Maryland line ; and if any free male person'

convicted as aforesaid, shall be the father of such deserter, or of or above
forty-five years of age, or unfit for the service, he shall furnish an able-

bodied recruit for the war, and deliver him to the lieutenant of his
county within ten days after conviction, and in case of neglect shall be
liable to pay thirty-five pounds in specie, or the value thereof, to the

lieutenant of his county, and if any female,-the mistress of any

family, shall entertain, harbour, or conceal, any deserter, and shall be
thereof convicted as aforesaid, she shall furnish and deliver an able
bodied recruit as aforesaid, or be liable to the payment of the same

penalty as aforesaid, . . and if any person, liable to such penalty for

not procuring a recruit as aforesaid, shall be unable to pay the same,
the lieutenant of the county may commit such person, for any time not

Agreeable to the assessment we made out thirty-nine Classes of

sixteen 'I'housand pounds each & every Class, (excep[ one), has
furnished a recruit for three years according to the above list. The
deficient Class was drafted on the fifth day of May & I hope that a

recruit for three years will be produced for that Class. Alexander

Boys passed by Class No. 35, we discovered was subject to fits; who

we have since discharged, the Class agreeing to pay their proportion to

the State. The said Boys having received but a small sum.

RESOLVES OF CONTINENTAL CONGRESS-3I MAY, r78r.

" Whereas the British king, regardless of the rights of mankind,

and of the United States in particular, continues the ravages of war with

relentless fury i . . . . and whereas the deficiency of the continental
regular lines, makes it absolutely necessary to call forth a respectable
body of militia, till those lines be completed; . . . . It is also earnestly
recommended to the state of Maryland, immediately to raise, arm,

equip and accoutre for the field, two battalions of infantry, consisting of
nine companies of 64 rank and file each; and a corps of cavalry of. 64

troopers; .. . . And it is further recommended . . . . to cause the said
troops, as soon as raised, to be marched . . . to such place or

places as the commander-in-chief shall direct, to remain in the service

for and during the space of three months, unless sooner dis-

charged by Congress or the commander-in-chief, and to be subject to

the orders of the commander-in-chief."

MARYLAND ACTS-MAY, r78r

"An ACT to raise two battalions of militia for reinforcing the conti-
nental army and to complete the number of select militia.

Wnpnnes it hath been earnestly recommended by congress to call ?

forth two battalions of militia in this state, for the purpose of aiding and

assisting our friends, now actually invaded, in the southern states, and

this present general assembly have thought it reasonable and neces-

sary to comply with the said recommendation:

Be it tlaerefore enacted, by th.e General Assembly of Maryland,

That thirteen hundred and forty effective men, to compose the non-

commissioned officers and privates of two battalions of militia, to be

officered according to the resolutions of congress of the third and

twenty-first days of October last, be immediately raised in this state,

in manner hereafter directed, to act in conjunction with the continental

army until the tenth day of December next.

And be it enacted, That the said two battalions be apportioned

upon and raised in the several counties, according to the number of

militia in each county.

And be it enacted, That proper persons shall be appointed in each

county by the governor and council, to procure the said number of

militia men on or before the r6th of July next, by voluntary enrollment,
and where several persons
are appointed to recruit in any

county, he that shall procure the highest number of recruits exceeding

twenty, shall be entitled to a commission as lieutenant . . . and he

that shall procure the next highest number of recruits exceeding ten,

shall be entitled to a commission of an ensign in one of the companies

of said battalions.

And be it enacted, That the governor and council shall be and are

hereby authorised and requested to appoint fit and proper officers out
of the Maryland line, not engaged in actual service the present cam-

paign, down to captains inclusive, to command the said battalions and

companies, . . . . and if such officers cannot be had, then to appoint

such officers as may be wanted out of those best qualified,

And, Whereas there are many idle and disorderly persons in the

several counties in this state, who pursue no visible means to obtain an

honest subsistence, but spend their time in such a manner as to render

no service to the commqnitv by which they are protected :

Be it eruacted, That every such free male idle person above sixteen

years of age, and who is able bodied and effective, and hath no farnily,

nor any visible method of getting an honest livelihood, and who may

be adjudged by the lieutenant of the county to come under the above

description of a vagrant, shall, from and after such adjudication, be con-

sidered as a soldier enlisted, and shall have it in his choice whether he

will serve until the tenth of December, or enlist for three years or during

the war; . . . . provided that no person who hath served in the conti-

nental army as a regular soldier, and hath been discharged, shall be

deemed a vagrant under this act.

And be it enacted, That in case the number of militia be not pro-
cured in the several counties by voluntary enrollment, or by enrolling

vagrants in manner as above mentioned, on or before the sixteenth day

of July next, it shall and may be lawful for the lieutenant of the county,

to call together the field officers of each county respectivel/, and

cause the militia in their respective counties to be distributed

into as many classes as men may be wanted, and each class shall,

within five days, find a recruit to serve until the tenth day of December
next, or shall cause such class as doth not find a substitute . .

to be draughted, and two persons to be selected therefrom by lot, and

such person of the two as the lieutenant . . shall direct and appoint,

shall be deemed a militia man enrolled to serve until the tenth day of

December next, and shall accordingly march, unless he find a substitute,

to be approved by the lieutenant within five days after such

appointment shall be notified unto him; and any nonjuror who shall

voluntarily enlist and serve, orif draughted or procured as a substitute

shall serve during the time aforesaid, such nonjuror shall be restored to

all the rights and privileges of a free citizen of this state without excep-

tion.

Anrl be it enacted, That the said recruits and militia men, draughted

or otherwise procured to go in the above battalions, shall be subject to

the continental articles of war; and all freemen, although blacks or

mulattoes, who are not deemed vagrants or enlisted as such, shall be
taken into the militia and be subject to a draught as above directed.

And be it enacled, That where any three persons, to be appointed

by the governor and council as herein before directed, shall enlist the

whole number of men wanted for that county before the sixteenth of

July next, if the number be equal to that of a full company, to consist of

seventy-four non-commissioned officers and privates, such persons shall
be entitled to commissions as captain, lieutenant, and ensign."

Sir:

I have lately received several Letters from you, two of which relate
to the forwarding the recruits to Annapolis, those raised in consequence
of the Law passed last October, have been long since at Annapolis, &
that part of the Law empowering the Lieutenants to excuse any indi-

gent person drafted, who has a wife & children, we have nothing to

do with, having hired recruits for three years. Your appointment as

purchaser of cloathing I have received with an enclosed Law to seize

all articles suitable for that purpose. The dificulty of purchasing with-
out anything to purchase with, must be very apparent to your Excel-

lency & to seize those articles from merchants, who have very few

goods, and nothing else to depend on, will prove their ruin i let I am

fully convinced of the necessity of supplying the Soldiery with cloathing;

& was it in my power to forward this business with any degree of
propriety, I would undertake it, notwithstanding I am of opinion that

Lieutenants of Counties are very improper persons to execute Laws of

this Nature. Should you think it necessary to have seized, the few

goods in our Town, you will please to appoint some other person for

that purpose, as I am already fully employed. I have enclosed a list of

the recruits obtained by virtue of the Law passed last Session, & have

engaged Capt. Kemp to carrythem to Annapolis in his Vessel from our

Town, the drafted men are endeavouring to procure substitutes which

I will send with all possible dispatch, those who do not get recruits

may be very dificult to collect, a few of them are poor men with Fami-

lies. The zTth battalion have furnished their proportion of select

militia, the r 3th battalion is Classed for the purpose of Drafting. Mr.
George Hanson who was appointed collector of horses refused to Act,

he being Lieut. in the troop of Light Horse, had not time to execute

the Law. On his refusal, I appointed Capt. George Hartshorn who

has been very unsuccessful, he has brought for examination about six

horses, & tells me that the nonjurors have not horses fit for the

purppse. I have done all in my power to spur him to execute the Law

with dispatch & have requested him to call on the commissioners for
their direction. I am apprehensive that I shall not be able to send all

the recruits agreeable to my list, some of them being in the Country

without permission.
