คำนำ

ตามท่ีที่ประชุมสภาประธานศาลสูงสุดอาเซียน คร้ังท่ี 6 และที่ประชุมคณะกรรมการ
บรหิ ารและคณะกรรมาธกิ ารถาวรของสมาคมกฎหมายอาเซยี น ครงั้ ที่ 40 ไดม้ ีมตเิ หน็ ชอบให้ประเทศไทย
เป็นเจ้าภาพจัดประชุมสภาประธานศาลสูงสุดอาเซียน ครั้งท่ี 7 และการประชุมคณะกรรมการบริหาร
และคณะกรรมาธิการถาวรของสมาคมกฎหมายอาเซียน ครั้งท่ี 41 ประจาปี พ.ศ. 2562 สานักงาน
ศาลยุติธรรมจึงได้ดาเนินการจัดประชุมสภาประธานศาลสูงสุดอาเซียน ครั้งที่ 7 และการประชุม
คณะกรรมการบรหิ ารและคณะกรรมาธกิ ารถาวรของสมาคมกฎหมายอาเซยี น ครั้งท่ี 41 ประจาปี 2562
ระหวา่ งวนั ที่ 19 - 24 พฤศจกิ ายน 2562 ณ จงั หวดั ภเู ก็ตและกรุงเทพมหานคร โดยมวี ัตถปุ ระสงค์ ดงั นี้

1) เพื่อสร้างความสัมพันธ์ ตลอดจนเพ่ือส่งเสริมและขยายความร่วมมือระหว่าง
นกั กฎหมายไทยและนักกฎหมายในกล่มุ ประเทศอาเซยี น

2) เพอ่ื ความร่วมมือกนั ในภูมิภาคเก่ยี วกบั การทาการศึกษาและวิจยั เพอื่ ใหก้ ฎหมายของ
กลุ่มประเทศอาเซยี นมคี วามสอดคล้องต้องกนั เพ่ือประโยชน์ในการพัฒนาทางดา้ นเศรษฐกิจและสงั คม

3) เพอื่ แลกเปลย่ี นข้อมูลการพฒั นากฏหมายแตล่ ะสาขาของประเทศสมาชิกอันจะสง่ ผล
ให้ประเทศสมาชิกนาข้อมูลน้ันไปปรบั ใช้ใหเ้ หมาะสมกบั ประเทศของตนเพ่ือให้สอดคล้องต้องกัน อันจะ
กอ่ ให้เกดิ ผลตอ่ ความรว่ มมอื ทางด้านอน่ื ๆ ทง้ั ทางด้านการคา้ เศรษฐกิจและสังคม

บัดนี้ สานักการต่างประเทศ สานักงานศาลยุติธรรม ได้จัดทาเล่มรายงานสรุปโครงการประชุม
สภาประธานศาลสูงสุดอาเซียน คร้ังที่ 7 และการประชุมคณะกรรมการบริหารและคณะกรรมาธิการ
ถาวรของสมาคมกฎหมายอาเซียน คร้ังท่ี 41 เรียบร้อยแล้ว และหวังเป็นอย่างยิ่งว่ารายงานสรุป
โครงการฯ จะเป็นประโยชน์และสามารถนามาปรบั ปรงุ พัฒนาในการจัดโครงการครงั้ ตอ่ ไป

หลกั การและเหตุผล

สมาคมกฎหมายอาเซียนเป็นสมาคมของนักกฎหมายจัดตั้งข้ึนตามมติท่ีประชุม
การพฒั นากฎหมายของประเทศในกลุ่มอาเซยี น ณ กรงุ จาการ์ตา ประเทศอินโดนีเซยี เม่ือปี พ.ศ. 2522
มีฐานะเป็นองค์กรระหว่างประเทศ โดยมีวัตถุประสงค์ที่จะส่งเสริมความสัมพันธ์ ความร่วมมือ
และความเข้าใจซึ่งกันและกันในระหว่างนักกฎหมายของประเทศในกลุ่มอาเซียน ตามธรรมนูญและ
ข้อบังคับของสมาคมระบุให้มีการจัดตั้งคณะกรรมการแห่งชาติของสมาคมขึ้นในแต่ละประเทศ
เพื่อทาหน้าท่ีบริหารงานของสมาคมภายในประเทศ คณะกรรมการแห่งชาติประกอบด้วยผู้แทนจาก
ตุลาการ นักกฎหมายของรัฐ ทนายความ อาจารย์ผู้สอนวิชากฎหมาย นักกฎหมายและบุคคลอื่นๆ
สาหรับประเทศไทยนัน้ คณะรัฐมนตรไี ดม้ ีมตเิ มื่อวันที่ 26 กุมภาพันธ์ 2523 ให้ผู้แทนจากหน่วยราชการ
ต่างๆ ร่วมอยู่ในคณะกรรมการแห่งชาติสมาคมกฎหมายอาเซียน โดยมีข้าราชการฝ่ายตุลาการ
ศาลยุตธิ รรม ผแู้ ทนสานักงานอัยการสงู สดุ ผ้แู ทนสานกั งานคณะกรรมการกฤษฎีกา ผู้แทนกระทรวงการ
ต่างประเทศ ผู้แทนกระทรวงยุติธรรม ผู้แทนสภาทนายความ ผู้แทนเนติบัณฑิตยสภา คณบดีคณะ
นิติศาสตร์ มหาวิทยาลัยธรรมศาสตร์ จุฬาลงกรณ์มหาวิทยาลัย มหาวิทยาลัยรามคาแหง และ
มหาวทิ ยาลัย สุโขทยั ธรรมาธริ าช รว่ มเป็นคณะกรรมการ

สมาคมกฎหมายอาเซียนมีการจัดองค์กรแบ่งเป็น 4 ส่วน ได้แก่ ส่วนแรกคือ ที่ประชุม
ใหญ่ (General Assembly) ส่วนท่ีสองคือ คณะกรรมการบริหารชุดใหญ่ (Governing Council) ส่วนที่สามคือ
สานักเลขาธิการฯ (The Secretariat) และส่วนท่ีสี่คือ คณะกรรมการแห่งชาติ (National Committee)
ประจาแตล่ ะประเทศ เพื่อทาหน้าที่บรหิ ารงานของสมาคมกฎหมายอาเซียนในประเทศของตน ปัจจุบนั
สมาคมกฎหมายอาเซียนประกอบไปด้วยประเทศสมาชิก จานวน 10 ประเทศ ได้แก่ อินโดนีเซีย
มาเลเซีย ฟิลิปปินส์ สิงคโปร์ บรูไน-ดารุสซาราม ลาว เวียดนาม กัมพูชา เมียนมา และประเทศไทย
สาหรับการประชุมน้ัน สมาคมกฎหมายอาเซียนได้จัดให้มีการประชุมคณะกรรมการบริหารและ
คณะกรรมาธิการถาวรเป็นประจาทุกปี โดยประเทศสมาชิกจะสับเปล่ียนหมุนเวียนกันเป็นเจ้าภาพใน
แต่ละปี รวมทั้งจัดให้มีการประชุมใหญ่ทุก ๓ ปี ซึ่งเป็นการประชุมทางวิชาการดา้ นกฎหมายสาขาต่างๆ
สาหรับประเทศไทยน้ันนอกจากหน่วยงานต่างๆ รวมทั้งสานักงานศาลยุติธรรมจะส่งผู้แทนเข้าร่วม
ประชุมคณะกรรมการบรหิ ารและคณะกรรมาธิการถาวร ตลอดจนการเข้ารว่ มประชมุ ใหญท่ กุ ครั้ง โดยท่ี

การเป็นเจ้าภาพจัดประชุมคณะกรรมการบริหารและคณะกรรมาธิการถาวร ถือเป็นเกียรติแก่วงการ
นักกฎหมายไทย อีกท้ังจะเป็นประโยชน์อย่างย่ิงในการสร้างความสัมพันธ์ การส่งเสริมและขยายความ
ร่วมมือระหว่างนกั กฎหมายทั้งในประเทศและกลมุ่ ประเทศอาเซยี น ตลอดจนได้รว่ มกนั แลกเปลย่ี นความ
คิดเหน็ ประสบการณ์ และความเคลอื่ นไหวของกฎหมายในประเทศต่างๆ เพอ่ื ให้การพัฒนากฎหมายใน
ภูมิภาคเปน็ ไปในทศิ ทางเดยี วกัน นอกจากนี้ ในการจดั ประชมุ สมาคมกฎหมายอาเซยี น ไมว่ า่ การประชมุ
ใหญ่หรือการประชุมคณะกรรมการบริหารและคณะกรรมาธิการถาวรของสมาคมกฎหมายอาเซียนทจ่ี ดั
ข้ึนในประเทศไทยทุกครั้ง หน่วยงานหลักท่ีเป็นเจา้ ภาพในการจัดประชมุ คอื สานักงานศาลยุตธิ รรม ดงั นั้น
จึงเห็นสมควรท่ีสานักงานศาลยุติธรรมจะดาเนินการจัดประชุมคณะกรรมการบริหารและคณะกรรมาธิการ
ถาวรของสมาคมกฎหมายอาเซยี น คร้ังท่ี 41 ประจาปี 2562 ในคร้งั น้ี

วัตถุประสงค์
1. เพ่ือสร้างความสัมพันธ์ ตลอดจนเพื่อส่งเสริมและขยายความร่วมมือระหว่างนัก

กฎหมายไทยและนักกฎหมายในกลุ่มประเทศอาเซียน

2. เพ่ือความรว่ มมอื กันในภมู ภิ าคเกี่ยวกบั การทาการศึกษาและวิจยั เพอ่ื ให้กฎหมายของ
กลุ่มประเทศอาเซียนมคี วามสอดคลอ้ งต้องกนั เพื่อประโยชน์ในการพฒั นาทางดา้ นเศรษฐกิจและสังคม

3. เพือ่ แลกเปลย่ี นข้อมลู การพัฒนากฏหมายแตล่ ะสาขาของประเทศสมาชิกอนั จะส่งผล
ให้ประเทศสมาชกิ นาข้อมูลนั้นไปปรับใช้ใหเ้ หมาะสมกบั ประเทศของตนเพื่อให้สอดคล้องต้องกนั อันจะ
ก่อใหเ้ กิดผลต่อความรว่ มมือทางด้านอน่ื ๆ ทง้ั ทางด้านการคา้ เศรษฐกิจและสงั คม

การประชมุ คณะกรรมการบริหารและคณะกรรมาธกิ ารถาวรของสมาคมกฎหมายอาเซียน จะมีการแบง่
การประชุมออกเป็น 3 ช่วง คือ

- ช่วงแรกเปน็ การประชุมคณะกรรมการบริหารเพอื่ พิจารณากิจการของสมาคม

- ช่วงท่ีสองเปน็ การประชมุ คณะกรรมาธกิ ารถาวรของแตล่ ะคณะเพอื่ หารอื กจิ กรรมทาง
วิชาการและความรว่ มมือด้านต่างๆ ระหว่างประเทศสมาชกิ

- ช่วงท่ีสามเป็นการประชุมคณะกรรมการบริหารอีกครั้งเพื่อสรุปผลการประชุมของ
คณะกรรมาธิการถาวรคณะต่างๆ

In accordance with ALA tradition, the host, Office of the Judiciary of Thailand will
provide and pay for the accommodation from 19 to 21 November 2019 (3 nights) of
the VIP guests, namely –

Travel All delegations are kindly requested to make their own travel arrangements to and from
Arrangements Thailand.

Airport Delegations are responsible for their return air travel booking confirmation.
Facilitation –
Arrival and Passports must be valid for at least 6 months from the date of arrival, and all arriving
Departure passengers must have outbound tickets. Delegates are enjoined to print and use the
Liaison Officers ALA baggage tags that will be sent to facilitate the identification of baggage.

Transport All delegates will be received upon arrival at the airport by ALA (Thailand) officials,
liaison officers and support staff, who will assist with the clearance at the immigration
and custom check points, and the handling of baggage.

Liaison Officers will be provided for the President of ALA, Secretary-General of ALA
and all delegations during the meeting. The Liaison Officers will be at the airport to
meet delegates during the arrival and will be with their respective assigned delegations
at most times to attend to the needs of the delegations.

ALA Golfers, and
ALA Friends,

We all know that ASEAN was originated from “sports-shirt diplomacy” when five
Foreign Ministers finessed their way through their differences as they lined up their shots
on the golf course. Such tradition has become a part of us and I think it also represents
our ASEAN way, the way we get consensus for our cooperation. Thanks to our friend,
Ave, the Chairman of ASEAN Law Institute and the ex-President of ALA, who initiates the
Golf Chapter for our ALA community to promote fellowship and to foster interaction and
mutual cooperation among lawyers and judges in ASEAN countries. [Unfortunately, he
cannot join with us in the today game because of the afternoon meeting. But I ensure
you that it is not a meeting initiated by Thailand.]

We may be luckier than the governmental bodies because we don’ t need to
discuss about any difficult issues in the golf course. So, the Golf Chapter is not a game
for us to deal with diplomatic thing or to compete for the trophy, but it is a memorable
event that we can focus on our shots, exchange our swing, and significantly share our
laugh and enjoy our discussion. I’ m sure that the game today has already served its

purpose to unite us, to strengthen our ties and to give us fond memories. I hope that
you all have enjoyed the game today and I wish you will enjoy your time in this scenic
city of Thailand.

an official gathering among leading jurists of ASEAN countries which is evident of a long

officially presiding over this prestigious Governing Council meeting.

ALA has been a key organization since 1979 in spearheading cooperation of various legal
issues amongst ASEAN nations, and unifying laws in the region, in order to create more
effective legal enforcement and to ensure highest quality of legal practices.

ALA today does not only aim to promote cooperation and mutual understanding
amongst lawyers, judges and legal practitioners in the ASEAN countries, but also intend
to cooperate with international, regional, and national organizations to further its

objectives as we can notice from participation of HCCH or the Hague Conference on
Private International Law today. As a non-profit organization having extensive network of
legal professionals, we will also continue to strive on being a leading organization in the
region to advocate ASEAN legal academic activities.

May I share with you some illustration? Thailand last hosted The 33rd Governing Council
Meeting in 2011. At the meeting, the ALA Task Force presented a paper on alternative
dispute resolution (ADR) between private parties in ASEAN in commercial matters, with
a focus on arbitration and other mechanisms such as mediation. The paper contained
a recommendation that the Governing Council consider appointing a special committee
to compose and finalise guidelines that would constitute best practices for the
enforcement of arbitral awards in ASEAN. The said guidelines then were approved in
the following year in Bali and tabled before ASLOM. Unfortunately, they have not yet
been considered thoroughly by ASLOM. As proposed by ALA Singapore to re-put this
paper, we will consider reviving the guidelines today in Thailand, the country where it
was originally born.

Another significant pace of our ALA community was the recent establishment of ASEAN
Law Institute as approved in our previous meeting. The Institute is not only a section in
ALA, but also an evidence of our amicable collaboration and our determination to be a
legal think tank of ASEAN. I am confident that it will contribute proactive roles in
supporting ALA to be in the leading position of global legal community.

Today, this Governing Council meeting will again serve as a platform for us to exchange
ideas and information that will benefit all members as we have been achieving in doing
so during the past meetings.

both of them have contributed a lot for ALA. I can say that this meeting is very special

determination towards achievement of ALA. We could not have done it without you.

Success of our meeting today is just another single step of progress. However, very
long path is still waiting for us to move forward and the next move may require more
speed to keep pace with dynamic change of the world. I wishes that our mutual
understanding, our friendship, and our unity will help us to be ready for the change
and we will together achieve our goal. And I wish that we will together go far beyond
our expectation.

First of all, may I express my sincere gratitude to you all for your kind support on electing
me to be Chair of the Council. I would also like to express my deep appreciation to our
former Chair, Honourable Chief Justice Sundaresh Menon of Singapore, for your
dedication throughout your term of Chair. I will do my best to continue your
determination.

Next, may I express my sincere thanks to Excellency Mr. Robert Matheus Michael Tene ,
Deputy Secretary General of ASEAN. Your presence today is really meaningful for us as
an organization under ASEAN charter.

It is my pleasure to welcome you all to the 7th Council of ASEAN Chief Justice Meeting.
Your presence makes this meeting a memorable event for Thailand Court of Justice for
two reasons.

First, this meeting fulfils Thailand’s determination to host ASEAN events this year. As
you know, the Thai Government hosted ASEAN summits in June and this month. Several
ministerial meetings have subsequently been held in Thailand. For the parliamentary
side, the 40th AIPA meeting was held in August. Now it is our turn as a Judiciary. This
meeting therefore highlights significance of our judicial branch as one of sovereign power
branches.

Secondly, as informed you in last meeting, the reconstruction of building of the Supreme
Court of Thailand at the historic area in Bangkok is now complete. It is therefore a good
opportunity for the Thai Supreme Court to open our house tomorrow to welcome all of
you as our guests of honor. May I personally invite you all again.

It is therefore not just our first time in Thailand to organize the meeting for our judicial
community in ASEAN, but it is also our privilege to have all of you with us in this
memorable year.

Since its institutionalization, our Council has continuously moved forward through a
number of steering groups of people. We start driving this Council with only three
working groups on the first day and now we have six working groups and one study group
together with a secretariat. It is true that sometimes we might confront with some
difficulties in developing cooperation due to different culture, different history and
different system. However, what we are doing is not only strengthening our today
cooperation, but also ensuring future friendship among ASEAN judiciaries by having the
next generation to work together toward the enrichment of ASEAN judiciaries.

It is globally recognized that equitable and effective access to justice is fundamental
right of all members and it is one of focuses of our judicial cooperation as emphasized
in the CACJ’s objectives. Thailand’s Court of Justice has employed all mechanisms to
effectuate these rights of citizens, including implementing “Electronic-Filing System” and
technology for tracking case information. We also establish “E-Justice Conference
Center” to provide remote witness-examination service and translation of 28 languages
via video conference to the requested court nationwide. This project aims to make the
hearing of witness to be swift and time-saving, saving the cost of witness, experts, and

interpreters. Without having to travel to court far from hometown, citizens engaged in
legal proceedings can access justice easier, and this is conducive to efficient legal
proceedings. We would also like to invite other judiciary to consider having an MOU
with us on taking evidence via video conference so that cross-border witness-
examination can be done through this system. In light of the borderless commerce and
investment, judicial cooperation is required to ensure effective access to justice. We
therefore support CACJ in developing the cooperation and mutual understanding.
As the Chief Justice of Thailand and the Chair of this Council, I hope that we all will
achieve our excellent goal together. I am looking forward to our discussion here today
as well as continued support from you all.

I must say that the meeting today was successful because:

First, it has reinforced the importance of our judicial roles in the ASEAN contexts. Second,
it has echoed the power of our cooperation and partnership to handle with borderless
issues. And third, it has identified concrete actions to move our judiciaries towards the
efficient and excellent paradigm of organizations.

Thank you very much for your support and determination. However, our meeting has
not yet finished. The declaration of meeting will be prepared by our liaisons for our
signatures tomorrow in Bangkok. For today, I have a special request to you all.

Honorable Chief Justices,
Ladies and Gentlemen:

It gives me a great pleasure and honor to welcome all of you to the Supreme Court of
Thailand.

Let me give you a brief introduction to our Supreme Court.

The Thai court and laws have been evolved since Sukhothai Kingdom. At that
time, the King adjudicated cases by himself. Later in Ayutthaya Kingdom, cities and
population were expanded and more complex. The trail developed to be more
circumspect. In Rattanakosin Kingdom, the adjudication of cases was scattered in several
ministries and created confusion and complexities. The growth trade between Siam and
other countries had been expanded continually. This required Siam to change and adjust
management system to be more modern. On 21st April B.E. 2425 (1882), King
Chulalongkorn found the Court of Justice on the auspicious occasion of celebrating 100th
year of Rattanakosin Kingdom.

The establishment of the Court of Justice and the Ministry of Justice brought
about the centralization of all Courts of Justice except the Supreme Court, which was
still directly responsible for the King. In the reign of King Rama VI, His Majesty the King
included the Supreme Court into the Court of Justice and had the Chief Justice (อ ธิ บ ดี
ศาลฎกี า) acted as the head of the Judiciary.

The Supreme Court is the highest court in the judiciary and there is only one
Supreme Court, situated in Bangkok. The President of the Supreme Court, also the head
of the Courts of Justice, is the highest ranked administrator who has judicial power across
the whole Kingdom. The Supreme Court has the power to try and adjudicate cases which
are appealed on judgements or orders rendered by the Court of Appeal, the Regional
Courts of Appeal and the Court of Appeal for Specialized Cases. Order and judgement
of the Supreme Court are final.

The Supreme Court's jurisdiction is pivotal to the economic well-being of the
nation. Corporations, finance, banking, taxation, insurance, bankruptcy, consumer
protection, labor law, maritime law and intellectual property all underpin the success
and health of the country economy and of broader society. The Supreme Court also has
the Research Justice Division consisting of research justices. The primary function of the
Division is to assist justices by examining all relevant factual and legal issues of the cases,
conducting legal researches and discussing with those justices to ensure uniformity and
fair results.

The Supreme Court also has power to try and adjudicate cases that the
Constitution or the law declares to be directly proposed to the Supreme Court such as
cases of persons holding politician positions or election cases enacted in the Organic Act
on the Election of Members of the House of Representatives, B.E.2561.

Besides hosting CACJ meeting in Thailand, the year of 2019 is an auspicious year
to all of Thai citizens. The Royal Coronation of His Majesty King Maha Vajiralongkorn
Bodindradebayavarangkun or King Rama X took place in Bangkok from Saturday 4th to
Monday 6th May 2019. The ceremony marks the first coronation in Thailand in seven
decades. The Court of Justice, the government, civil servants, private sector, personnel,
volunteers and the public cooperated in organizing this auspicious event.

The history of the judiciary dated back has always demonstrated the King as the
fountain of Justice. From ancient period, the Kings decided the cases applying
Dhammasattham jurisprudence and bestow justice upon society. Later, when society
and disputes grew more complex, the King initiated judicial reforms and laws. When
establishing the Court of Justice, His Majesty King Chulalongkorn (or King Rama Five)

aspired to set up a pole to sustain justice system. The Court of Justice has continuously
served public and administered justice since its establishment. Before taking positions,
judges shall swear the oath before His Majesty the King. All Judges and Justices aware
that they perform their duties in the name of His Majesty the King. Cases are carefully
administered and reviewed in accordance with the law.

May I move to another aspect of the court and public trust. During our 137 years
of serving the country, we continue to promote transparency in court proceeding, and
upholding judicial ethics for all court staffs. We believe that the courts are the custodians
of the task of the independent exercise of the protective judicial power. We are
confident to say that throughout centuries, we have been independent from political
intervention. Therefore, the society entrust us with more and more responsibilities
including roles to promote transparency, good governance and accountability in other
government sectors such as politics and officials.

The Criminal Division for Persons Holding Political Positions was set up in the
Supreme Court to act as a trial court in a case where the Prime Minister, a minister,
member of the House of Representatives, senator or other political official is accused of
becoming unusually wealthy, committing malfeasance in office according to the Criminal
Code, performing duties dishonestly, or being corrupted according to other laws.

In trial, a member of the House of Representative or a senator is unable to claim
the immunity provided in the constitution. The quorum of this special division of the
Court consists of nine justices and are elected by a plenary session of the Supreme Court
justices on a case by case basis. A judgment will be made by a majority of votes; provided
that each justice constituting the quorum will prepare the written opinion and make oral
statement to the meeting before making decision. Orders and decisions of the Supreme
Court Criminal Division for Persons Holding Political Positions will be published and final.

Listening to me you might have assume that the Court of Justice has been on
a smooth path. This does not mean that there will be no challenge for us in the future.
We are in a digital age in which criticism is easy. The Court will have to cope with that.
Importantly, how we cope and organize ourselves must be in accordance with the
direction to ensure that the execution of the protective judicial power can be best
achieved. The Court of Justice of Thailand is ready to be a part of promoting regional
cooperation for the benefit of the people in our countries.

We have reached the end of our 7th CACJ meeting. It is time to close the door on lively
and stimulating debate, as well as to bid farewell to our friends. It is a privilege and an
honor to be entrusted with such an undertaking to host the meeting.

It is also privilege and an honor for us to have your presence here tonight at the Supreme
Court of Thailand. This is our first time to welcome and host a special dinner at the
Supreme Court and I hope that you will enjoy tonight event.

[As said in the afternoon,] this year mark the 137th anniversary of the Thailand Court of
Justice. And your presence today are really meaningful as making this year become one
of the most significant years in the Thai judiciary history.
