(2) In the case of rendering awards on agreed terms when arbitral proceedings have been already conducted, the parties shall place the arbitrator’s fee on the date of rendering such awards, in the amount determined by the Executive Director of TAI, which will be in the following rates: Dispute amount not exceeding 10,000,000 Baht 4,500 – 15,000 Baht/ time Dispute amount exceeding 10,000,001 Baht 15,000 – 45,000 Baht/ time Note The Executive Director of TAI may determine the arbitrators’ fee differently from those specified in Table 1 and Table 2 in the following cases: (a) If the disputed amount as specified in the Statement of Claims is greatly different from the disputed amount specified in the Counter-Claims, as deemed appropriate, the Executive Director may require the parties to place the arbitrators’ fee as a guarantee according to the amount claimed by each party.

สถาบันอนุญาโตตุลาการ T h a i A r b i t r a t i o n I n s t i t u t e The Announcement of the Offi ce of the Judiciary on the Thai Arbitration Institute Arbitrator Fee ๑๕๓ (b) In the case where arbitral proceedings are conducted in foreign language (s) and/or the nature of the dispute is so complicated that the duration of the proceedings is likely to be exceptionally long, the Executive Director may require the parties to place the arbitrators’ fee according to Table 1 multiplied by 1.5 to 5 times. (c) In the case where some proceeding has been conducted, and it later appears that the case become more complicated and the duration of the proceedings is likely to be exceptionally long, the Executive Director may require the parties to place additional amount of arbitrators’ fee as a guarantee.

T h a i A r b i t r a t i o n I n s t i t u t e สถาบันอนุญาโตตุลาการ ประกาศสํานักงานศาลยุติธรรม เรื่อง อ ัตราคาใชจายสําหรับการดําเนินการขอพิพาทของสถาบันอนุญาโตตุลาการ สํานักงานศาลยุติธรรม พ.ศ. ๒๕๖๓ ๑๕๔ ประกาศสํานักงานศาลยุติธรรม เรื่อง อ ัตราคาใชจายสําหรับการดําเนินการขอพิพาท ของสถาบันอนุญาโตตุลาการ สํานักงานศาลยุติธรรม พ.ศ. ๒๕๖๓ _________________ โดยที่เปนการสมควรปรับปรุงอัตราคาใชจายใ นการดําเนินกระบวนพิจารณา อนุญาโตตุลาการ ของสถาบันอนุญาโตตุลาการ เพื่อใหเหมาะสมและสอดคลองกับ สถานการณในปจจุบัน อาศัยอํานาจตามความในมาตรา ๔๗ แหงพระราชบัญญัติอนุญาโตตุลาการ พ.ศ. ๒๕๔๕ เลขาธิการสํานักงานศาลยุติธรรม ออกประกาศไวดังนี้ ขอ ๑ ประกาศนี้เรียกวา “ประกาศสํานักงานศาลยุติธรรม เรื่อง อัตรา คาใชจายสําหรับการดําเนินการขอพิพาทของสถาบันอนุญาโตตุลาการ สํานักงาน ศาลยุติธรรม พ.ศ. ๒๕๖๓” ขอ ๒ ประกาศนี้ใหใชบังคับตั้งแตวันที่ขอบังคับสํานักงานศาลยุติธรรม วาดวยอนุญาโตตุลาการ สถาบันอนุญาโตตุลาการ (ฉบับที่ ๓) พ.ศ. ๒๕๖๓ มีผลใชบังคับเปนตนไป

(2) In case where the Arbitral Tribunal has rendered an Award on agreed terms or an Order to dispose the case, and the arbitration has been partly proceeded, the Arbitral Tribunal shall determine fees of the Assistants or Representatives in arbitral proceedings in such Award or such Order to dispose the case as deemed appropriate and in line with the rate specified in Table 3.2. (3) Each party shall deposit, together with arbitrator’s fees, a security for such party’s fees of the Assistants or Representatives in arbitral proceedings at a maximum rate specified in Table 3.3. (4) Assistants or Representatives in arbitral proceedings are able to file a request for payment of such fees from the date that the Arbitral Tribunal has rendered an Award or an Order to dispose the case.

By virtue of Section 47 of Arbitration Act B.E. 2545 (2002), the Secretary-General of the Office of the Judiciary announces as follows: Rule 1 This Announcement shall be called “Announcement of the Office of the Judiciary on Expense Rates for Arbitral Proceedings of the Thai Arbitration Institute, Office of the Judiciary (No.2) B.E. 2564 (2021)” Rule 2 This Announcement shall enter into force from 1st October 2021 (B.E. 2564).

สถาบันอนุญาโตตุลาการ T h a i A r b i t r a t i o n I n s t i t u t e ประกาศสํานักงานศาลยุติธรรม เรื่อง อัตราคาปวยการอนุญาโตตุลาการ และอัตราคาใชจายสําหรับการดําเนินการ ในกระบวนการอนุญาโตตุลาการแบบเรงรัดของสถาบันอนุญาโตตุลาการ สํานักงานศาลยุติธรรม พ.ศ. ๒๕๖๔ ๑๘๙ ขอ ๓ ในการดําเนินการอนุญาโตตุลาการแบบเรงรัด ใหคูพิพาทวางเงิน ประกันคาใชจายเบื้องตนฝายละ ๓,๐๐๐ บาท โดยใหผูเรียกรองวางเงินประกันคาใชจาย เบื้องตนในวันที่ยื่นคําเสนอขอพิพาทหรือภายในวันที่สถาบันกําหนด สวนผูคัดคาน ใหวางเงินดังกลาวในวันที่ยื่นคําคัดคาน หรือภายในวันที่สถาบันกําหนด ในกรณีที่เงินคาใชจายที่เรียกเก็บไวเบื้องตนไมเพียงพอ สถาบันอาจเรียกเก็บ เพิ่มเติมได ขอ ๔ คาใชจายในชั้นอนุญาโตตุลาการใหเปนไปตามรายการ และอัตราที่ สถาบันประกาศกําหนด ขอ ๕ คาปวยการอนุญาโตตุลาการ ใหคํานวณจากทุนทรัพยตามขอเรียกรอง รวมกับขอเรียกรองแยง คาปวยการอนุญาโตตุลาการ ในการดําเนินกระบวนพิจารณาชั้น อนุญาโตตุลาการแบบเรงรัดใหเปนไปตามตารางนี้ จํานวนทุนทรัพย อนุญาโตตุลาการคนเดียว ไมมีทุนทรัพย หรือทุนทรัพยไมเกิน ๑,๐๐๐,๐๐๐ บาท ๑๐,๐๐๐ บาท ๑,๐๐๐,๐๐๑ ถึง ๒,๕๐๐,๐๐๐ บาท ๑๐,๐๐๐ +๑% สวนที่เกิน ๑ ลานบาท ๒,๕๐๐,๐๐๑ บาท ถึง ๕,๐๐๐,๐๐๐ บาท ๒๕,๐๐๐ + ๒% สวนที่เกิน ๒ ลาน ๕ แสนบาท ขอ ๖ ผูอํานวยการบริหารสถาบันอนุญาโตตุลาการอาจกําหนดจํานวน คาปวยการอนุญาโตตุลาการแตกตางจากตารางขางตน ในกรณีดังตอไปนี้ ในกรณีที่จํานวนทุนทรัพยเกินกวา ๕ ลานบาท หรือกรณีที่เปนการชี้ขาด ตามสัญญาประนีประนอมยอมความในกระบวนการอนุญาโตตุลาการแบบเรงรัด ผูอํานวยการบริหารสถาบันอนุญาโตตุลาการอาจกําหนดจํานวนคาปวยการแตกตาง

สถาบันอนุญาโตตุลาการ T h a i A r b i t r a t i o n I n s t i t u t e Announcement of the Offi ce of the Judiciary on Arbitrator Fee and Expense Rates for Expedited Arbitral Proceedings of the Thai Arbitration Institute, Offi ce of the Judiciary B.E. 2564 (2021) ๑๙๑ Announcement of the Office of the Judiciary on Arbitrator Fee and Expense Rates for Expedited Arbitral Proceedings of the Thai Arbitration Institute, Office of the Judiciary B.E. 2564 (2021) _______________________ Whereas it is deemed expedient to adjust arbitrator fee and expense rates for expedited arbitral proceedings of the Thai Arbitration Institute in order to be appropriate and be in accordance with the current situation. By virtue of Section 47 of Arbitration Act B.E. 2545 (2002), the Secretary-General of the Office of the Judiciary announces as follows: Rule 1 This Announcement shall be called “Announcement of the Office of the Judiciary on Arbitrator Fee and Expense Rates for Expedited Arbitral Proceedings of the Thai Arbitration Institute, Office of the Judiciary B.E 2564 (2021)” Rule 2 This Announcement shall come into force from the date on which the Arbitration Rules, the Thai Arbitration Institute, Office of the Judiciary (No.4) B.E. 2564 (2021) comes into effect.

T h a i A r b i t r a t i o n I n s t i t u t e สถาบันอนุญาโตตุลาการ Announcement of the Offi ce of the Judiciary on Arbitrator Fee and Expense Rates for Expedited Arbitral Proceedings of the Thai Arbitration Institute, Offi ce of the Judiciary B.E. 2564 (2021) ๑๙๒ Rule 3 In expedited arbitral proceedings, each party to the dispute shall pay security deposit for expenses in the amount of 3,000 baht. The Claimant shall pay such a security deposit on the date that the Statement of Claim is submitted or within a date determined by the Institute. As for the Respondent, such a security deposit shall be paid on the date that the Statement of Defense is submitted or within a date determined by the Institute. In case where the initial payment is insufficient, the Institute may request for additional security deposits. Rule 4 Expenses in arbitral proceedings shall be as listed and at the rate determined by the Institute. Rule 5 Arbitrator fees shall be calculated from the aggregate disputed amount of the claim and counterclaim. Arbitrator fees in expedited arbitral proceedings shall be as specified in the following table: Disputed Amount Sole Arbitrator Non-Monetary Claim or not exceeding 1,000,000 baht 10,000 baht 1,000,001 baht - 2,500,000 baht 10,000 baht + 1% of the amount exceeding 1 million baht 2,500,001 baht - 5,000,000 baht 25,000 baht + 2% of the amount exceeding 2.5 million baht

สถาบันอนุญาโตตุลาการ T h a i A r b i t r a t i o n I n s t i t u t e Announcement of the Offi ce of the Judiciary on Arbitrator Fee and Expense Rates for Expedited Arbitral Proceedings of the Thai Arbitration Institute, Offi ce of the Judiciary B.E. 2564 (2021) ๑๙๓ Rule 6 The Executive Director of the Thai Arbitration Institute may determine the Arbitrator fees differently from those specified in the above table in the following cases: In the case where the disputed amount exceeds 5 million baht or where an arbitral award on agreed terms is made, the Executive Director may determine the Arbitrator fees differently from those specified in the above table. In this case, the Executive Director may apply arbitrator fee rates specified in the Announcement of the Office of the Judiciary on the Arbitrator Fees, mutatis mutandis. In the case where arbitral proceedings are conducted in a foreign language, the Executive Director may determine the amount of the security deposit by multiplying arbitrator fees specified in the above table by 1.5 to 3. T h a i A r b i t r a t i o n I n s t i t u t e สถาบันอนุญาโตตุลาการ ๑๙๔ ประกาศสํานักงานศาลยุติธรรม เรื่อง การรับรองคุณสมบัติของบุคลากรดานการระงับ ขอพิพาททางเลือกสําหรับการตรวจลงตราประเภทคนอยูชั่วคราว เปนกรณีพิเศษ (Smart Visa) โดยที่เปนการสมควรกําหนดวิธีการรับรองคุณสมบัติของบุคลากรดาน การระงับขอพิพาททางเลือกสําหรับการตรวจลงตราประเภทคนอยูชั่วคราวเปนกรณี พิเศษ (Smart Visa) เพื่อสงเสริมและอํานวยความสะดวกแกชาวตางชาติผูเชี่ยวชาญ ดานการระงับขอพิพาทโดยวิธีอนุญาโตตุลาการ สํานักงานศาลยุติธรรม จึงออก ประกาศไวดังนี้ ขอ ๑ ประกาศนี้เรียกวา “ประกาศสํานักงานศาลยุติธรรม เรื่อง การรับรอง คุณสมบัติของบุคลากรดานการระงับขอพิพาททางเลือกสําหรับการตรวจลงตรา ประเภทคนอยูชั่วคราวเปนกรณีพิเศษ (Smart Visa)” ขอ ๒ ประกาศนี้ใหใชบังคับตั้งแตวันประกาศเปนตนไป ขอ ๓ ในประกาศนี้ “ผูเชี่ยวชาญทักษะสูง” หมายถึง บุคคลผูมีความเชี่ยวชาญในสาขาที่เกี่ยวของ กับการ ระงับขอพิพาทโดยวิธีอนุญาโตตุลาการ และเขามาในราชอาณาจักรเพื่อปฏิบัติ ภารกิจในการระงับขอพิพาทดวยวิธีอนุญาโตตุลาการผานทางสถาบันอนุญาโตตุลาการ สํานักงานศาลยุติธรรม เชน อนุญาโตตุลาการ คูพิพาท ผูรับมอบอํานาจ ผูวาตาง แกตางในชั้นอนุญาโตตุลาการ ผูสนับสนุนงานของคณะอนุญาโตตุลาการ วิทยากร ที่ปรึกษาของสถาบันอนุญาโตตุลาการ เปนตน “ผูยื่นคําขอ” หมายถึง คนตางดาวผูยื่นแบบคําขอรับรองคุณสมบัติสําหรับ การตรวจลงตราประเภทคนอยูชั่วคราวเปนกรณีพิเศษ (Smart Visa) ตามประกาศ สํานักงานคณะกรรมการสงเสริมการลงทุนที่เกี่ยวของ “คําขอ” หมายถึง แบบคําขอและบรรดาเอกสารที่แนบมาพรอมกับแบบ คําขอตามประกาศสํานักงานคณะกรรมการสงเสริมการลงทุน ประกาศสํานักงานศาลยุติธรรม เรื่อง การรับรองคุณสมบัติของบุคลากรดานการระงับขอพิพาททางเลือก สําหรับการตรวจลงตราประเภทคนอยูชั่วคราว เปนกรณีพิเศษ (Smart Visa)

สถาบันอนุญาโตตุลาการ T h a i A r b i t r a t i o n I n s t i t u t e ๑๙๕ “สถาบัน” หมายถึง สถาบันอนุญาโตตุลาการ สํานักงานศาลยุติธรรม “ผูอํานวยการบริหาร” หมายถึง ผูอํานวยการบริหารสถาบัน “ผูอํานวยการ” หมายถึง ผูอํานวยการสํานักอนุญาโตตุลาการ สํานักงานศาลยุติธรรม ขอ ๔ ภายใน ๗ วันทําการ นับแตไดรับคําขอจากสํานักงานคณะกรรมการ สงเสริมการลงทุน ใหสถาบันดําเนินการตรวจสอบความเชี่ยวชาญและการปฏิบัติ ภารกิจของบุคคลผูยื่นคําขอ การดําเนินการตามวรรคหนึ่ง ผูอํานวยการอาจมอบหมายใหเจาหนาที่ของ สํานักอนุญาโตตุลาการดําเนินการตามประกาศนี้ไดตามที่เห็นสมควร เมื่อผูอํานวยการหรือเจาหนาที่ที่ไดรับมอบหมายเห็นวา ผูยื่นคําขอเปน ผูเชี่ยวชาญ ทักษะสูง ก็ใหดําเนินการรับรองความเชี่ยวชาญและการปฏิบัติภารกิจ ของบุคคลดังกลาว ตามแบบหนังสือรับรองทายประกาศนี้ แลวแจงผลการพิจารณา พรอมคําขอและหนังสือรับรองไปยังสํานักงานคณะกรรมการสงเสริมการลงทุนเพื่อ ดําเนินการในสวนที่เกี่ยวของตอไปทันที ในกรณีที่ผูอํานวยการหรือเจาหนาที่ที่ไดรับมอบหมายเห็นวา ผูยื่นคําขอมิใช ผูเชี่ยวชาญ ทักษะสูง ใหดําเนินการแจงผลการพิจารณาพรอมคําขอไปยังสํานักงาน คณะกรรมการสงเสริมการลงทุน เพื่อดําเนินการในสวนที่เกี่ยวของตอไปทันที ขอ ๕ ใหผูอํานวยการบริหารรักษาการตามประกาศนี้ และใหมีอํานาจ ตีความ วินิจฉัยปญหาเพื่อดําเนินการตามประกาศนี้ ประกาศ ณ วันที่ ๑๑ มกราคม พ.ศ. ๒๕๖๒ (นายสราวุธ เบญจกุล) เลขาธิการสํานักงานศาลยุติธรรม ประกาศสํานักงานศาลยุติธรรม เรื่อง การรับรองคุณสมบัติของบุคลากรดานการระงับขอพิพาททางเลือก สําหรับการตรวจลงตราประเภทคนอยูชั่วคราว เปนกรณีพิเศษ (Smart Visa)

สถาบันอนุญาโตตุลาการ T h a i A r b i t r a t i o n I n s t i t u t e ๑๙๗ Announcement of the Office of the Judiciary on the Recommendation for the Qualifications of the Alternative Dispute Resolution Personnel for the Smart Visa Application Whereas it is deemed expedient to specify means for the recommendation of the qualifications of the alternative dispute resolution personnel for the Smart Visa application in order to promote and ease the foreign arbitration experts. The Office of the Judiciary hereby announced as follows: Article 1 This Announcement is called “Announcement of the Office of the Judiciary on the Recommendation for the Qualifications of the Alternative Dispute Resolution Personnel for the Smart Visa Application.” Article 2 This Announcement shall enter in to force from the date of announcement. Article 3 In this Announcement : “Highly-skilled Experts” means an expert who has specialty in the fields related to arbitration, enter into the Kingdom of Thailand to performs arbitration via the Thai Arbitration Institute (TAI), Office of the Judiciary. For example, arbitrator, parties, representative, legal practitioner, secretary of the arbitrator, lecturer and advisor of the TAI; Announcement of the Offi ce of the Judiciary on the Recommendation for the Qualifi cations of the Alternative Dispute Resolution Personnel for the Smart Visa Application

T h a i A r b i t r a t i o n I n s t i t u t e สถาบันอนุญาโตตุลาการ ๑๙๘ “Applicant” means a foreigner who applies for the Smart Visa application according to the Announcement of the Board of Investment of Thailand (BOI); “Application” means application forms and attached documents according to the Announcement of the BOI; “Institute” means the Thai Arbitration Institute (TAI), the Office of the Judiciary; “Executive Director” means the Executive Director of the Thai Arbitration Institute; “Director” means the Director of the Office of Arbitration, the Office of the Judiciary. Article 4 The Institute shall examine the expertise and performance of the applicant within 7 working days after received the application from the BOI. According to the operation in paragraph 1, the Director may assign the staff of the office of Arbitration to perform any operations regarding this announcement as may be reasonable. When the Director or the assigned staff deems that the applicant is considered as a Highly-skilled Expert, the expertise and performance of such applicant shall be certified in accordance with the recommendation form at the end of this announcement. Then notify and sent the result together with the application and the recommendation form to the BOI in order to proceed the subsequence process immediately. Article 5 The Executive Director shall be in charge hereunder and have the power to construe and execute issues subject to this announcement.
