POSITION OF THE CASES IN THE COURT STATUS OF CASES ENTRUSTED TO ANIL K G ADVOCATE. 1. O.S.No.69/2019 filed by Jibu Edamana against IMA, Kerala State Branch and 5 others before the Principal Munsiff Court, Kannur. In this matter the Indian Medical Association National Headquarters and Indian Medical Association Kerala State Branch 5th and 6th defendant’s I have appeared and filed Written Statement and counter to Interlocutory Application for the 5th and 6th defendants. The plaintiff/applicant though filed an Interlocutory Application for Interim Injunction, against the defendants/ respondents, the plaintiff appears not presently interested in hearing the Interlocutory Application and hence the matter is proceeded with the pre-trial proceedings. 2. W.P.[C]No.19088/2017 before the High court of Kerala filed by M.G. Sajeev. The Indian Medical Association, Kerala state Branch got impleaded in the Writ Petition to protect the right to practice of modern medicine exclusively for registered practitioners for modern medicine and has also filed counter in the matter. The Writ Petition is awaiting counter by the Union of India especially from the Indian Council of Medical Research. In the meanwhile the Indian Medical Council Act got replaced by the National Medical Commission Act 2019 and this resulted in the delay of filing counter due to the drastic change of circumstances. The pandemic of Covid-19 also contributed to the delay in filing of counter by the Union of India and ICMR. There is a delay in filing Counter by the union of India is due to change of Status of the Medical Professionals Regulatory Bodies. No counter is yet filed by the Union of India in the Matter. 3. W.P.[C]No.29353/2019 before the High Court of Kerala filed by Indian Medical Association Kerala State Branch, challenging certain provisions in the Kerala Clinical Establishment Act. The matter is admitted and notice was issued to the respondent and the matter is posted along with a similar matter W.P.[C]No.1365/2019 filed by Kerala Private Hospitals Associations. There is a change of circumstances after filing of the Writ Petition and IMA Kerala State Branch has filed application for amending the writ petition incorporating the current circumstance as suggested by the core committee. This application for amendment is allowed and after production of the amended copy of the Writ Petition, the matter was not taken up for hearing. The Government of Kerala is currently not pressing for hearing of the matter and it will come up for hearing as and when interested parties bring up the matter for hearing. The status continues as it is though listed a few times recently and adjourned the hearing on 16.02.2024. 4. W.P.[C]No.7867/2018 and connected matters before the High Court of Kerala filed by Jim Gopalakrishna and others. This Writ Petition, filed by physiotherapist challenging the prohibitory order of medical practice without proper medical qualification in modern medicine passed by the Government of Kerala. The matter has not come up for hearing after admission due to feeble chances of getting an interim order. Subsequently new Central Laws like the National Medical Commission Act 2019 and the National Commission for Allied and Health Care Professions Act 2021 took the place. This matter was listed lastly for hearing on 25.10.2022 in the list but was not taken up due to lack of time and will come for hearing later. Not listed for hearing thereafter. 5. IMAGE 1. Filed SLP [Civil] No.2088/2022 with Hon’ble Supreme Court. 2. Filed SLP [Civil] No.2364/2022 with the Hon’ble Supreme Court. 3. Filed SLP [Civil] No.20445/446/2021 at the Hon’ble Supreme Court. All these cases are clubbed together by the Hon'ble Supreme Court and waiting for further hearing. 6. IMA KSB - GST IMA KSB has filed a writ petition in Kerala High Court (case no. 21297 of 2023) challenging the constitutional validity of section 7 (1) (a a) & 2 (17) (e) of GST Act on 30.06.2023. Also, another Writ Petition has been filed in Kerala High Court on 21.07.2023 challenging section 83 of GST Act - Writ Petition against provisional attachment of properties stating that it is arbitrary unguided & disproportionate. Senior Advocate Shri. Aravind P Datar appeared on video conference mode and argued on our behalf on 30.06.2023, 04.07.2023, 10.07.2023 & 21.07.2023. The Hon. High Court of Kerala has passed an interim order restraining GST department from provisionally attaching the immovable properties of IMA KSB on the condition that IMA KSB will not alienate/transfer/encumber it's immovable properties without the leave of the court. IMA has filed the same undertaking in the Kerala High Court on 27.07.2023. A Show Cause Notice (SCN) has been received from DGGI, Calicut on 18.08.2023 quantifying a portion of tax liability from July 2017 to March 2023 as Rs. 267.37 lakhs towards CGST & SGST; in addition to the demanded amount, it is stated in the SCN that IMA KSB may be held liable for interest and penalties as per the Act. IMA KSB has sent a reply to the SCN on 15.09.2023 stating the fact that we have filed two Writ Petitions – one for challenging Constitutional Validity of GST provisions & the other WP not to attach immovable properties of IMA KSB; also IMA KSB has further stated in the reply to the SCN that piecemeal replies at different stages of investigations would also not be expedient. Next hearing at High Court, Cochin will be on 27.02.2024. VICE PRESIDENT/JOINT SECRETARY’S REPORT Vice President, South Zone 12.11.2023: Selected as Vice President (South Zone) in the Annual State Conference of IMA KSB at Thiruvalla. 16.11.2023: Cabinet meeting & meeting with Past Presidents and senior leaders. Mutual communication and ideas of old leaders and new leaders were their Dr. Joseph Benaven, Dr. K. Sasidharan, Dr. A. Marthanda Pillai, Dr. T.N. Babu Ravindran, Dr. R.V. Asokan gave their views. 26.11.2023 Cabinet meeting at IMA Periyar House, Aluva. So many Schemes and priority ideas were discussed. The first priority has to increase have the membership to 50000 by canvassing and reducing the fees for 2-3 months. Other schemes like Tribal Health, Mental Health Palliative Care, and Senile Health was discussed. Nine members attended 02.12.2024: Went to IMA Periyar House, Aluva participated in detailed meeting of Branch Presidents and Secretaries and other leaders. Main issue was membership coordination and all other activities. Activity of Cabinet and other leaders for membership coordination and elderly care under the presidentship of Dr. Joseph Benaven. Attended zoom district committee meeting held on 22nd December to discuss the planning and execution of various IMA programs of the District Committees. Engaged in regular communication with other office bearers and members through phone calls and emails to discuss upcoming events and initiatives. Coordinated with the district committees to ensure smooth functioning of various IMA activities. Contributed articles and opinions on healthcare issues for IMA. Collaborated with other healthcare organizations and NGOs to organize medical camps and awareness programs. Participated in online workshops and conferences organized by the state branch for continuous medical education. Continuously monitored and addressed members' concerns and grievances to ensure their satisfaction. Actively participated in the decision-making process and implementation of projects and programs of IMA KSB. Provided guidance and support to the branch President and Secretaries in their respective roles and responsibilities. This letter aims to draw your attention to the concern raised by the 2018 batch of MBBS students at Government Medical College, Kannur, currently undergoing house surgeoncy. Following the government takeover of ACME Pariyaram, the college, which used to fund stipends through student fees, faced financial constraints. As a result, the 2018 batch was required to submit affidavits stating the non-availability of stipends until a Government Order or Supreme Court directive (Ref.No.1) is issued before commencing their internship. Despite four and a half months of regular internship and two weeks for an additional batch, these interns have not received stipends due to the absence of a Government order. In contrast, the 2017 batch, even with pending dues, is receiving stipends during their internship as per a government order (Ref.No.2). Approximately 85% of the interns from the 2018 batch are currently without stipends, despite NMC regulations advocating for stipend disbursement.
