n Wenger Warranty

Wenger Corporation warrants that the Strata Decks (pit filler) purchased by Berglund
Construction, and delivered to Francis W. Parker School, located in Chicago, IL, under normal
use and service, be free from defects for five(5) years from date of substantial completion, which
is February 24, 2009.

Wenger's duty under this warranty is limited to repair or replacement, without
charge to the purchaser during the period of this warranty, of such parts as
shall be acknowledged by Wenger to be defective.

This warranty shall apply only if the product has been operated in accordance with
procedures recommended by Wenger. It shall not apply ifthe product has been subject to
misuse, negligence, accident, or vandalism, nor if it has been altered or repaired outside
Wenger's place of business in a manner that, in the determination of Wenger, shall
have affected its performance, stability or reliability.

Any implied warranty of merchantability or fitness is limited to the duration of this express
warranty.

Wenger shall not be liable for any direct, indirect, incidental or consequential damages arising
out of failure of a Wenger product or any of its parts, except for personal injuries and/or
property damage resulting directly from such failure. Wenger shall never be liable for breach
of warranty, whether express or implied, including any implied warranty of merchantability or
fitness, in an amount greater than the purchase price of the product described by this warranty.

Before Wenger will repair or replace any product claimed to be defective, the purchaser must
notify Wenger at the address below and permit examination by Wenger, which must establish
satisfactory proof of defect in material or workmanship. Ifthe examination establishes defects,
Wenger will repair or replace the defective parts.

The terms ofthis warranty constitute the purchaser's sole and exclusive remedy.

The elevator was accepted for public use on 2/5/09 thus begins the 1 year warranty. (see attached}

Should the Owner want the 1 year warranty to begin on 2/24/09 then additional costs will be required to compensate
for the "temporary use" of the elevator between 2/5/09 and 2/24/09.

Pursuant to our proposal, the monthly costs for temporary use are $800 per month therefore added costs for this
instance would be approximately $600 dollars. (see attached, page 2)

PLEASE NOTE ..... In speaking with our service department concerning the warranty, they indicated the possibility that
should a maintenance agreement be signed with ThyssenKrupp Elevator that our service department would be willing to
cover the additional warranty at no charge within the signed agreement. If this option is desired, please have the
Owner contact Sarah Sepe at 708-932-9283 to discuss maintenance options.

INSTALLATION & DESIGN CRITERIA:

• Proposal price does NOT include stage lifts. ThyssenKrupp Elevator does not manufacture or install stage lifts.

• Electrical information of building has not been reviewed. Elevator will utilize a 50 H.P. motor with solid state

starting. Proper power supply and circuit protection to be provided by others.

• Proposal price is based upon utilizing a indoor drill rig. Adequate space and floor support (if required) must be
provided by others. A 10,000 lb. capacity hoistbeam must be provided. Street parking is to be provided by
others within 75' of hoistway access. Any permits are to be paid by others. Spoils shall remain on-site just
outside of building. Spoils are to be removed by others.

• Proposal price does NOT include hall lanterns. See ALTERNATES, if equipment is desired.

• Adequate storage must be provided adjacent to the hoistway at ground level. If storage is not available, a
storage container is required to be provided by others. If a storage container is utilized, double handing costs
will apply and additional charges will follow.

• If a drywall shaft is to be utilized, adequate rail bracket support (tube steel) is to be provided by others, in
locations determined by ThyssenKrupp Elevator.

1. Pricing is based upon architectural plans dated 10/02/06 and elevator specifications. Final

pricing is contingent upon review of complete project plans, project manual and contract

5. Specification 14240-1 1.1 B- Equipment in "related sections" are to be provided and installed by others, with
the exception of inserts (if CMU shaft) for guide rails. These will be supplied by TKE and installed by others. If a
drywall shaft is utilized, rail bracket support (tube steel) is to be provided and installed by others.
6. Specification 14240-1&2 1.3 B & E-We are providing our standard shop drawings. These do not indicate
variations from specified equipment. Variations are listed in this proposal. We are providing our OST (on-board
service tool) for diagnostic purposes. We are not providing any additional diagnostic or monitoring equipment
which may be available to our installers or maintenance personnel.
7. Specification 14240-4 2.4 B- We are providing our standard car control station. This is not "semi-recessed".
8. Specification 14240-5 2.4 D- We are not providing a fireman's phone jack. This equipment is outdated.
9. Specification 14240-5 2.4 G - See alternates, if desired.
10. Specification 14240-6 2.6 A 6 -We are providing our standard suspended ceiling as later specified. We are
not providing a polished metal ceiling.
11. Specification 14240-6 2.7 B-We are providing our standard bolted stainless steel #4 frames & doors. These
do not contain welded corners.
12. Specification 14240-7 2.8 A 5 c - We are providing a battery powered lowering system as "standby powered
lowering". Additional dry contacts are to be provided by electrical is elevator disconnect.
13. Specification 14240-8 3.2 A 1-We are providing a steel casing to retain well hole. This is not waterproof.
14. Specification 14240-9 3.5 - Temporary use can be provided for additional costs and by signing ThyssenKrupp
Elevators temporary acceptance form. Protective coverings are to be provided and installed by others.
ThyssenKrupp Elevator will not be responsible for damages caused by others trades. Refurbishment can be
provided for additional costs on a T& M basis. Our standard billing rates shall apply.
15. Specification 14420 -We are not providing our installing this equipment. This equipment is to be by others.

ALTERNATES:
);:> ADD $2A50 dollars to proposed price if hall lanterns are to be utilized in lieu of our standard car riding
lantern.
);:> ADD $800 dollars (PER MONTH) for temporary construction use of the elevator. Price does NOT include
operator time, refurbishment or temp communication system.
);:> ADD $109 dollars (PER HOUR) for an operator to run the elevator during temporary use.

CLARIFICATIONS:

• Installation of elevators will commence upon turnover of enclosed hoistway for our uninterrupted use, and a

code compliant machine room equipped with 3-phase power of 208/480 volts.

• We have provided a 200-pound flooring weight allowance. Should actual floor weight or additional cab weight

exceed 200 pounds, additional costs may follow. Finished floor by others.

• Hoistway entrance wall thickness can not exceed 12". If entrance wall thickness exceeds 12", additional costs

will follow due to frame modification.

• Our hoistway entrances do not require steel angle supports for the door sills. ThyssenKrupp Elevator utilizes an

entrance arrangement that eliminates the need for this angle and the associated material I labor costs. Our sills

do not require grouting under the sill, but may require grouting between the face of the sill and the finished floor

(grouting by others). ,

• We have not reviewed the construction schedule. Should special measures need to be taken, additional cost

may follow.

• On site storage, approximately 25' X 25' per elevator adjacent to the hoistway at grade level is required.

• If off-site storage is necessary, you will be charged additional costs to cover additional material handling,

transportation and storage.

• There will be additional charges for labor incurred for extra loading and unloading (double-
handling) plus monthly charges for storage if contractor is not ready for us on requested ship
date.

• There will be a remobilization charge if we have to pull off the job and return.
• This proposal is based upon 1998 ASME, Al 7.1 code. Should 2000 ASME, Al 7.1 code be required, additional

costs will follow.

This quotation is subject to the following conditions:
1. Our price will remain effective for thirty (30) days.
2. Pricing is based upon elevator installation completed by December 31, 2008. If elevator installation shall

exceed completion date, we shall have the right to adjust our labor rates according to Local 2 union wage
increase.
3. We have not included any special equipment to meet any seismic zone (code) requirements.
4. It is expressly understood that we are not obligated to accept a contract at the quoted price, unless a mutually
satisfactory schedule can be established prior to the execution of a contract.
5. A hoist beam is required in each elevator overhead for hydraulic elevators and each elevator machine room for
traction elevators. It must be designed for an 8,000-pound center point load for hoisting. This beam is not
included in our proposal.
6. ThyssenKrupp Elevator, Central Region, will perform work per the approved contract. The unit/units shall not be
released for use until all code requirements are satisfied, and the approval of and necessary permits from the
responsible inspection authority have been obtained.
7. Proposal includes union labor only. No MBE, LBE, WBE, DBE, Residency or similar requirements.
ThyssenKrupp Elevator will not be held accountable for any associated costs or damages.
8. This proposal is contingent upon ThyssenKrupp Corporation's legal department reviewing and approving
general and special conditions for the project, as well as the final contract document.
9. In the event ThyssenKrupp Corporation is required to afford additional insurance coverage pursuant to the
terms and conditions of the subcontract - contract of any other contractual documents, the additional insurance
coverage shall not include for the acts, actions, omissions, or neglects of the additional insured.
10. We must have a change order signed by an authorized representative of your company in order to proceed with
any additional work beyond the contract scope.
11. ThyssenKrupp Elevator will perf.orm its own cleaning on the job-site. We will not accept any additional cleaning
· cost. If our cleaning is not adequate, we must be notified in writing so we may take corrective action.
12. Terms of payment: Payment be shall due th~ first day of each month for 90% of material and labor incorporated
in the work including material suitably stored at the site or other agreed upon location. Upon completion of 50%
of our work, the retention shall be reduced to 5%. Before the "Final Acceptance" of the elevator(s),
ThyssenKrupp must have received 95% of all payments due (including any change orders). ThyssenKrupp
must be provided final payment (retention) within (30) days of the "Final Acceptance".
13. ThyssenKrupp Elevator shall not be held responsible for delays caused by other trades.
14. We shall not be required to attend weekly project meetings. We will attend on an as needed basis only.
15. This proposal and our "work not included" sheet will be amended to all subcontracts.

);>- Three (3) to Four (4) weeks for elevator submittals after a letter of intent or contract is reviewed.

NEW INSTALLATION & EXISTING BUILDING
WORK NOT INCLUDED

A legal hoistway, properly framed and enclosed, and including a pit of proper depth provided with ladder, sump pump,
lights, access doors and waterproofing, as required. Dewatering of pit(s). Legal machine room, adequate for the elevator equipment, including
floors, trap doors, gratings, foundations, lighting, ventilation and heat to maintain the room at an ambient temperature of 50 degrees. Fahrenheit
minimum 90 degrees Fahrenheit maximum, non-condensing. Adequate supports and foundations to carry the loads of all equipment, including
support for guide rail brackets. Adequate bracing of entrance frames to prevent distortion during wall construction. When required, divider
beams at suitable points shall be provided for guide rail bracket support.

It is agreed that in the event asbestos material is knowingly or unknowingly removed or disturbed in any manner at the jobsite, you will monitor
our work place and prior to and during our manning of the job, you will certify that asbestos in the environment does not exceed .01 fibers per cc
as tested by NIOSH 7400. In the event our employees or those of our subcontractors are exposed to an asbestos hazard, PCP's, lead or other
hazardous substances, you agree to indemnify, defend, and hold us harmless from all damages, claims, suits, expenses, and payments resulting
from such exposure. Identification, notification, removal and disposal of asbestos containing material, PCP's lead or other hazardous substances
is the responsibility of the contractor.

All sill supports, including steel angles where required, and sill recesses (if sill angles not supplied by Elevator Contractor) and the grouting of
door sills. Provide O.S.H.A. compliant removable temporary enclosures or other protection (barricades and kickboards) from open hoistways
during the time the elevator is being installed (protection must allow clearance for installation of entrance frames). The Contractor agrees to
indemnify, defend and hold us harmless from any OSHA citations we may receive as a result of contractor's non-compliance with OSHA
standards. Proper trenching and backfilling for any underground piping and/or conduit. Cutting and patching of walls, floors, etc., and removal of
such obstructions as may be necessary for proper installation of the elevator. Setting anchors and sleeves. Pockets or blockouts for signal
fixtures. Structural steel door frames with extensions to beam above if required on hoistway sides and sills for freight elevators, including finish
painting of these items.

Suitable connections from the power main to each controller and. signal equipment feeders as required, including necessary circuit breakers and
fused mainline disconnect switches per NEC. Wiring to controller for car lighting. (Per N.E.C. Articles 620-22 and 620-51). Electric power
without charge, for construction, testing and adjusting of the same characteristics as the permanent supply. A means to automatically disconnect
the main line and the emergency power supply to the elevator prior to the application of water in the elevator machine room will be furnished by
the electrical contractor. This means shall not be self-resetting. Wiring and conduit from life safety panel or any other monitor station to elevator
machine room or suitable connection point in hoistway. The contractor will provide a temporary 220 FAC - 30 amps single phase terminal with
disconnect for each traction elevator in the machine room(s) and within 50 feet of the machine room(s) for hydraulic elevators at the start of the
job for temporary operation of work platform.

Heat and smoke sensing devices at elevator lobbies on each floor, machine room, and hoistways (where applicable), with normally open dry
contracts terminating at a properly marked terminal in the elevator controller. Telephone connection to elevator controller (must be a dedicated
line and monitored 24 hours - instrument in cab by others). One additional telephone line per group of elevators for diagnostic capability wired to
designated controller.

Emergency power supply with automatic time delay transfer switch and auxiliary contacts with wiring to the designated elevator controller.
Electrical cross connections between elevator machine room for emergency power purposes is to be provided by others. Any governmentally
required safety provisions not directly involved for elevator installation. All painting, except as otherwise specified. Temporary elevator service
prior to completion and acceptance of complete installation. Furnishing, installing and maintaining the required fire rating of elevator hoistway
walls, including the penetration of fire wall by elevator fixture boxes, is not the responsibility of the elevator contractor. Flooring and/or installation
of flooring by others.

Owner/General Contractor to provide a bonded ground wire, properly sized, from the elevator controller(s) to the primary building ground.

Remote wiring to outside alarm bell as requested by the Safety Code for Elevators and Escalators (ASME 17.1) (where applicable).

Costs for additional inspections of the elevator equipment by code authorities after the initial one fails due to items that are the responsibility of
the contractor, or for assisting others inspecting equipment installed by others.

The contractor agrees to provide a dry and secure area adjacent to the hoistway(s) at ground level for storage of the elevator equipment at the
time of delivery. Adequate ingress and egress to this area will also be provided. Any relocation of the equipment as directed by the contractor
after its initial delivery will be at contractor's expense.

The contractor agrees to provide at no cost a crane to hoist elevator equipment as needed.

Composite clean up crews will not be provided. Elevator contractor will be responsible for own housekeeping.

All existing equipment removed by company shall become the exclusive property of company.

HYDRAULICS ONLY

A 30" X 30" blackout, or as otherwise indicated on shop drawings, in pit floor for jack hole properly located from building lines (if pit not installed)
with adequate ingress and egress for mobile well drilling equipment. Access to pressurized water supply within 100 feet of hole (To be field
coordinated). Removal of all dirt and debris accumulated during excavation of the jack hole to be by the General Contractor. Grouting and water
proofing of blackout after jack is installed.

Owner/General Contractor agrees to provide a 4' X 4' opening in the elevator hoistway overhead, at the request of the local field office.
Should unusual conditions be encountered during excavation of jack hole, contractor will be notified immediately and written authorization to
proceed shall be obtained by Subcontractor. the contract price shall be increased by the amount of additional labor at Subcontractor's usual
billing rates, and the actual co~ of any additional material plus 15%.

LETTER OF GUARANTEE

We , the undersigned , herewith guarantee the PROJECTION SCREENS furnished by us,
installed by others, against defects in material and workmanship for a period of one (1) year
commencing February 24, 2009. We agree to correct or replace any defective material
found within this period at no cost to the Owner, provided claim is made in writing and
manufacturers' installation and maintenance instructions have been followed ; improper
usage, neglect or ordinary wear and tear excluded .

Operating and Maintenance Data provided by each manufacturer and placed inside
each carton at the time of shipment.

This guarantee supersedes all previous guarantees, written or implied.

PHOENIX FIRE SYSTEM WARRANTY

WARRANTY STATEMENT:

Phoenix Fire Systems, Inc. warrants to the Purchaser of new fire system product(s)
that during the effective period of the warranty, such products shall be free of defects
in workmanship and material(s).

The warranty period will terminate immediately following the earliest occurrence of
either of the following dates:

'FIRE PROTECTION SYSTEMS'
Twelve (12) months have elapsed following the date of substantial completion of the
system installation.
Eighteen (18) months have elapsed following shipment of any system or subsystem
from Phoenix Fire Systems to Contractor/Owner.

'REPLACEMENT PARTS OR SYSTEM: COMPONENTS'
Twelve (12) months have elapsed following the date of shipment of system
components.

WARRANTY OBLIGATION:

Phoenix Fire System's responsibility under the terms of this warranty shall be to
repair or replace solely at Phoenix Fire System's deten11ination, any system
component which fails to perform as intended during the period of this warranty.
Purchaser is obligated to notify Phoenix Fire Systems in writing within 10 days of
any apparent component failure. Purchaser is further obligated to maintain this
system(s) in accordance with current NFPA Standards. Failure to maintain said
system in accordance with NFPA Standards shall void warranty.

Should service or repairs be perfonned by any person, firm, or corporation other than
Phoenix Fire Systems during the tern1s of this warranty, than said warranty shall be
voided.

Any replacement parts provided shall be warranted only for the balance of the
original warranty period.

WARRANTY EXCLUSIONS:

Labor, travel, or expenses for field service outside of Phoenix Fire Systems' normal
business hours. (No1mal Hours, Monday thru Friday, 7:30 a.m. to 4:30 p.m.)
Failure of components due to external causes such as electrical surges, including
lightning or static electricity, physical damage, contamination, moisture, improper
installation, or component use.
System batteries.
Field labor to repair or replace equipment furnished for installation by others.
Recharging of system due to component failure. Warranty covers repair or
replacement of component(s) only.

damage to finish, fixtures, equipment or furnishings due to our defective work upon

Metropolitan Industries, Inc. warrants to the original purchaser of each Metropolitan product(s) that
any part thereof which proves to be defective in. material or workmanship within one (1) year from date
of installation or 18 months from manufacture date, whichever comes first, will be replaced at no
charge with a new or remanufactured pflrl, F.O.B. factory, provided that the product is properly
installed, maintained, serviced, and operated under normal conditions and according to manufacturer's
instructions. Purchaser shall assume all responsibility and expense for removal, reinstal/ation and
freight. Any item(s) designated as manufactured by others shall be covered only by the express
warranty of the manufacturer thereof. This warranty does not apply to damage resulting from accident,
alteration, design misuse or abuse.

If the material furnished the buyer shall fail to conform to this contract or any of the terms of this written
warranty, Metropolitan Industries, Inc. shall replace such nonconforming material at the original point
of delivery and furnish instruction for its disposition. Any transportation Charges involved in such
disposition shall be for the Buyer's account. The Buyer's exclusive and sole remedy on account or in
respect of the furnishing of material that does not conform to this contract, or its written warranty, shall
be to secure replacement thereof as aforesaid. Metropolitan Industries, Inc. shall not in any event be
liable for the cost of any labor expended on any such material or for any incidental or consequential
damages to anyone by reason of the fact that such material does not conform to this contract or to this
written warranty.

ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTY OF MERCHANTABILITY
AND THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, LIMITED IN
DURATION TO THE SAME EXTENT AS THE EXPRESS WARRANTY CONTAINED HEREIN. Some
states do not allow limitations on how long an implied warranty last, so the above /Imitation may not
appfy to you.

MANUFACTURER EXPRESSLY DISCLAIMS AND EXCLUDES ANY LIABILITY FOR
CONSEQUENTIAL OR INCIDENTAL DAMAGES FOR BREACH OF ANY EXPRESS OR IMPLIED
WARRANTY ARISING IN CONNECTION WITH THIS PRODUCT, INCLUDING WITHOUT
LIMITATION, WHETHER IN TORT, NEGLIGENCE, STRICT LIABILITY CONTRACT OR
OTHERWISE. Some states do not allow the exclusion or limitation of incidental or consequential
damages, so the above limitation or exclusion may not apply to you.

This warranty gives you specific legal rights, and you may also have other rights which vary from state
to state.

NOTE: Metropolitan Industries, Inc. reserves the right to make revisions to its products and their specifications, and to this
bulletin and related information without notice.
