j. Khusus untuk penyakit menular yang mendapat prioritas
tinggi dalam pembangunan kesehatan – seperti program TBC
dan HIV/AIDS - pembiayaannya bisa seluruhnya ditanggung
oleh pemerintah (tidak oleh dana iuran BPJS). Porsi anggaran
tersebut untuk kegiatan UKM dialokasikan kepada instansi
yang sesuai (Bidang Pengendalian dan Pencegahan Penyakit
Dinkes Provinsi dan Dinkes Kabupaten/Puskesmas). Porsi
dana yang untuk kegiatan UKP dipertahankan di Kementerian
Kesehatan dan Dinkes Provinsi. Kemudian BPJS berperan sebagai
TPA (Third Party Administrator); melakukan verifikasi pelayanan TBC
yang dilaksanakan oleh fasilitas kesehatan. Kemudian faskes
mengajukan klaim ke Kemenkes dan/atau Dinkes Provinsi (yang
merupakan perpanjangan tangan pusat/Kemenkes).

k. Dalam aplikasi 8 kriteria yang disampaikan dalam naskah ini,
ada 3 kriteria yang belum bisa diterapkan seluruhnya;
yaitu “unbearable risk”, pelayanan terstandar, kriteria cost
effectiveness.

1. Pertama adalah kriteria “bearable-unbearable
risk” yang mengarahkan untuk mengeluarkan
pelayanan kesehatan yang biayanya masih terjangkau
oleh peserta (sesuai dengan hasil analisis kemampuan
membayar atau ability to pay (ATP) pada manfaat jaminan
kesehatan program JKN atau menerapkan urun biaya
terhadap utilisasi pelayanan bersangkutan. Namun,
penerapan urun biaya belum bisa dilaksanakan pada
dasar perhitungan ATP, karena menurut UU No. 40
tahun 2004 urun biaya hanya bisa diberlakukan untuk
pelayanan yang potensial disalahgunakan. Padahal
potensi penerapan urun biaya sesuai perhitungan ATP
cukup besar dan meringankan beban pembiayaan JKN
serta tidak menyebabkan pemiskinan (impoverishment)
terhadap peserta. Oleh sebab itu, tim penyusun
menyarankan untuk dilakukan revisi (amandemen)
pasal 22 UU No. 40 tahun 2004 tersebut sehingga
urun biaya berdasarkan analisis ATP juga bisa
dilakukan.

2. Kedua, kriteria tentang adanya standar pelayanan
adalah ketentuan UU; namum masih banyak pelayanan
kesehatan yang masih ditetapkan standarnya. Oleh
sebab itu, disarankan untuk mengumpulkan semua
standar pelayanan (PPK) yang ada, yaitu yang disusun
oleh banyak RS. Kemudian ditunjuk beberapa Tim
Ahli untuk menyempurnakan dan menyeragamkan
standar pelayanan tersebut. Hasilnya ditetapkan
melalui sebuah regulasi (seperti Permenkes). Dengan
demikian paling tidak penyelenggaraan JKN semakin
sesuai dengan ketentuan peraturan perundangan.
Sebagai catatan, standar pelayanan tersebut bisa
terus disempurnakan sesuai dengan kemajuan ilmu
dan teknologi kedokteran.

3. Ketiga adalah kriteria “cost effectiveness” yang
ditetapkan atas dasar hasil PTK (atau HTA). Karena belum
banyak PNPK dan PPK dilakukan untuk menapis pilihan-
pilihan pelayanan kesehatan, disamping terus memacu
kegiatan PTK, juga bisa dilakukan adopsi hasil penilaian
teknologi kesehatan di luar negeri yang sudah diakui;
misalnya sudah dipublikasikan di jurnal internasional
terakreditasi dan sudah diadopsi oleh negara lain.
Kemudian, dilakukan telaah mendalam oleh tim PTK
untuk dapat diterapkan.

l. Perhitungan implikasi biaya juga dilakukan pada klasifikasi
diagnosis dengan algoritma baru pada butir "i" yang
diperbaharui pada bulan November 2020. Dari hasil
pemetaan, terdapat efisiensi biaya sebesar Rp 14,1 Triliun
untuk skenario 1 (pada kode O daftar negatif hanya untuk
persalinan normal tanpa komplikasi di FKTRL/FKTP) dan
sebesar Rp 35,0 Triliun untuk skenario 2 (seluruh kode O
dimasukkan sebagai daftar negatif) dari total biaya klaim
FKTRL JKN tahun 2017 s.d 2019 sebesar 241,4 Triliun,
jika kelompok ICD 10 yang bisa diinput sebagai diagnosis
utama (kelompok List Benefit A - KLBA) dan merupakan
daftar negatif, tidak termasuk penjaminan JKN. Namun,
hasil perhitungan Budget Impact ini baru menghitung biaya
pelayanan kesehatan di FKTRL saja.

m. Implikasi lain dan penentuan paket pelayanan JKN adalah
“shifting” beban biaya ke program-program UKM. Maka perlu
dilakukan pembahasan bersama antara BPJS Kesehatan
dengan masing-masing pengelola program yang bersangkutan,
sehingga pengelola program tersebut bisa menyesuaikan
perhitungan kebutuhan biaya program bersangkutan.

n. Oleh sebab itu ketentuan tentang standar pelayanan tersebut
perlu membuka peluang penyempurnaan; sehingga standar
yang ditetapkan tersebut adalah semacam “living document”
yang terbuka untuk perbaikan.


