access a car after visiting. There are two designated pick-up locations – one on Windy
Ridge Parkway west of the ballpark for UberX and one on Battery Avenue north of Heritage

Access control to The Battery Atlanta’s non-common areas (back hallways, telephone/
electrical rooms, roof, etc.) and BDC common areas before/after operating hours are critical
safety measures for our property. We are asking your cooperation to ensure that these
procedures are enforced and operate efficiently.
Contractors are required to report to the Security Command Center or the BDC
Management Office to sign in and be escorted to the location where access is requested.
BDC Management will always plan in advance if contractors need to enter your store to
complete BDC work.
Failure to comply with these requirements will result in the contractor not being granted
access. Any contractor found in any BDC area who is not signed in will be required to sign
in. If they refuse they will be asked to leave the property. In the event they refuse to leave,
they will be charged with criminal trespass, and not permitted in nonpublic areas of the

property. Lengthy time on the roof may require additional security to be provided, at your
store’s expense, and must be arranged two business days in advance.
DELIVERY INFORMATION
All deliveries must be made in designated service areas, receiving areas, and loading zones
as outlined by BDC outside of the normal operating hours of The Battery Atlanta. If doors
are present in the loading area, they should be kept closed during loading/unloading to

GREASE REMOVAL/GREASE TRAPS
Grease Removal is required on a monthly basis. The manifest is due no later than the 5th
of the following month of service. (ex: June’s report is due no later than July 5th ). Grease is

charge for common area space utilized as well as for additional security, if deemed
necessary by management.
LOST PERSON/VEHICLE
Pease contact the Security Command Center in cases involving lost persons or vehicles.
Either circumstance can be a traumatic experience for customers. Security Command
Centers are available to assist customers and can be reached through Security Dispatch.

Items that are lost in stores will not be accepted but you may call (404) 614-2112 to have
the item and your store recorded into the Lost and Found Log. If a customer reports losing

EMPLOYEE PARKING
Employee parking cards are administered through LAZ Parking per the terms outlined

PREPARIS NOTIFICATION SYSTEM
In addition to our Public Address system throughout the property, The Battery Atlanta
utilizes a web-based mass emergency notification system called Preparis. This service
allows personnel to send a single message to all registered tenants via all their familiar
communication devices (cellphone, text and email). The Battery Atlanta can send messages
within minutes to the property’s entire tenant contact list, or selected names on a list. Those
individuals will receive a notification message through their registered numbers indicating
the type of event and what actions should be taken.
In order to ensure the highest quality service, The Battery Atlanta will periodically conduct
“live” practice tests, similar to a fire drill. All tenants on the contact list will receive an

automated email or phone message with the subject “test.” During the test mode, it is not
necessary to respond to this message.
It is important to notify and update The Battery Atlanta Management Office with additions
and deletions of contact information as it becomes available.

SIGNAGE
Permanent signage should be kept in good repair, with functioning lights and no obvious
defects.
In order to keep a clean and orderly common area as designed, the following lists a general

No paper or cardboard, or anything temporary in nature.
No stickers or decals, outside of hours of operation, credit card acceptance, phone

STORAGE
Store merchandise, fixtures or supplies may not be stored at any time in The Battery
Atlanta’s common area spaces. Unauthorized storage is subject to removal and disposal
without notice. Violations will be subject to fines and being in default of your lease.
Contact the BDC office if you need leasing storage space. Storage leases can range from 1
month up to 1 year in length. Storage is at a premium at BDC, so plan early for your need.
TRASH REMOVAL
Tenants are responsible for storage of trash inside their premise prior to its disposal in a
compactor located in the closest dock/service areas.

It is never acceptable for trash, cardboard, pallets, debris, fixtures or shipments to be
stored/or placed in any rear corridor, hallway, or common area. This is a violation of the
building and fire safety codes and the tenant is subject to severe fines from both BDC and
Cobb County.
The center has three types of compactors. In order to operate either compactor, the user
must be age 18 or older

NON-EXCLUSIVE USE OF COMMON AREA RULES AND REGULATIONS
A. Users cannot conduct any activity within the property without having first obtained a permit. A permit will be granted only for use of that area designated as
Common Area.
B. A User may apply for a permit to use the Common Area within the property at the management office during the hours of 9:00 a.m. to 4:00 p.m., Monday through
Friday. Application shall be in the form required by property management and subject to these rules and regulations and should be made no later than 30 days prior
to the day requested by the User for use of the Common Area.
C. In making a determination as to whether a permit to use the Common Area within the property shall be issued, the following points will be considered: The nature of
the activity; the dates, times and duration of the activity; the risk of injury to any person or the property, the risk of unreasonable interference with the primary

gestures or displays which causes or is likely to cause significant public inconvenience, annoyance or alarm. In addition, the User shall not permit
the emission of noise or odor or use any device or paraphernalia, which may constitute a nuisance such as loudspeakers, sound amplifiers, radios,
televisions or phonographs without prior written approval from property management. If use of vehicles is approved, evidence of auto liability in the
amount of $1,000,000.00 combined single limit must be provided.
8. Any person or organization using the Common Area shall not engage in any conduct which might interfere with or impede the use of any other
facilities of the property by any customer, business invitee or employee, employer, or tenant or create a disturbance, attract attention or harass,
annoy, disparage or be detrimental to any of the retail establishments of the property. Management, in its sole discretion, shall determine whether
such objectionable conduct has occurred.
9. The Common Area shall be surrendered in the same condition as it was upon commencement of its use. All expenses incurred to maintain order
and to keep the Common Area free from rubbish will be borne by User.
10. If the Management shall deem the use of the Common Area objectionable, at its sole discretion, it may, without any notice whatsoever, terminate
the rights of the User to use the Common Area.
11. At least 30 minutes before commencing their use, all Users of the Common Area shall check in and notify property management that they are
ready to proceed with the scheduled activity.
12. The User shall not obstruct the free flow of pedestrian or vehicular traffic.
13. Property management may in its sole discretion permit or not permit any person or organization to use the Common Area or require a User to
leave the Common Area and the property without any liability whatsoever for any damages, claims, losses, actions, suits arising from such removal.

14. User agrees that all vehicles parked at or around the Premises by Licensee and its invitees or guests and any contents or other belongings left in
such parked vehicles shall be at the risk of the Licensee, its invitees and guests. Licensee agrees that Licensor (and the Indemnified Parties) shall not
be liable to Licensee, its invitees or guests for any theft, loss or damage to such vehicles, contents, belongings or other property.
15. Insurance Requirements. Throughout the Term of this Agreement, including any extensions thereof, Licensee shall provide and maintain in full
force and effect, without interruption, at its own expense, the following policies of insurance set forth hereinafter, which shall protect Licensee and the
Licensor on a primary basis from and against any and all Claims to persons or property caused by, resulting from, arising out of or in connection with the
Licensee’s occupancy and use of the Common Areas pursuant to this Agreement. In addition, Licensee shall be responsible for ensuring that any and
all subcontractors utilized by Licensee in connection with its use of the Common Areas comply with the minimum insurance requirements set forth

installation, the DRB must approve in writing all signs of any type which are to be
installed or displayed in the Area of Common Responsibility except as otherwise
authorized by this Lease. Unauthorized signs will be removed by Landlord without

adjacent areas including, without limitation, adjacent sidewalks, in a safe, neat, clean
and orderly condition and shall maintain and repair any lighting or signs under any

to muffle noise and which areas shall contain doors that shall remain closed during all
loading zone activities so as to eliminate noise associated with these activities. No
loading zone activities whatsoever for the loading zones that border any residential
areas within or adjacent to The Battery Atlanta shall occur between the hours of
10:00 p.m. and 6:30 a.m.
21. Tenant shall take no action that would violate the Master Declaration or any other
Restrictions or any declaration, operating and easement agreement or any of
Landlord’s contracts, if any, affecting The Battery Atlanta or cause any work
stoppage, picketing or cause any manner of interference with the use and enjoyment
