National Consumer Disputes Redressal Commission,
New Delhi

MR DINESH SINGH Consumer Protec on Act, 1986 - Sec on 21(a)(ii); Sec on 2(1)(d) - Automobile - Car -
Presiding Member Suddenly stopped running. Hence, return of car in roadworthy condi on or refund along with
damages claimed - State Commission dismissed the complaint on the ground that the
M/s RDS Project Ltd – Complainant is not the "person" under CPA, and that the car was being used for "commercial
Appellant purpose". The vehicle was travelled for 91000 kms within 38 months from date of purchase,
Hence, appeal dismissed.
Versus
Result: Appeal dismissed.

Skoda Auto India Pvt Ltd IMPORTANT POINT: The vehicle used by any company will be outside the purview of the
& Anr. – Respondents CPA unless proved that it was for personal use of its office bearers.
