98 Guidelines - Domestic Incident
MPD’s Policy in responding to
Domestic Abuse Incident
Protocol to be followed on all cases (arrested & suspect)
coded as: DASLT1, DASLT2, DASLT3, DASTR, DTHRET,
DSTALK, DOMEN, OFPEN, DASLT5, 911INT, POVIOL,
VDNCO, & RORDER, if domestic related.
1. Check for existence of Order for Protection or
Domestic Abuse No Contact Order (NCO) on
every call.
2. Ask Victim if Defendant has access to any
guns or ammunition or if there are any in the
home; Property Inventory if Victim has a safety
concern.
3. Obtain a signed Medical Release with marked
areas completed by Victim, if Victim is seeking
medical treatment.
4. Ask Victim to complete a Victim Supplement.
5. Document in your report the Victim’s answers
to Risk Assessment questions & ask any
follow-up questions.
6. Take photographs. EX: Defendant; Victim; Inju-
ries; Scene, Damaged Property and Evidence
you are collecting.
7. Collect any Physical Evidence.
8. Obtain Contact Information from Witnesses
including name, address, & phone number(s).
9. Question any Witnesses regarding Incident.

10. If Suspect is gone when you arrive, remind
Victim to call 911 again if Suspect returns with
72 hours of the incident.
11. Inform victim of domestic violence resources
on blue card & call to notify 24 Hour Domesitic
Violence Hotline of the incident.
12. Obtain a Mirandized Scales statement from
Defendants on Misdemeanor & Gross
Misdemeanor cases only. (Not on Felonies.)
Sample Questions for Victims
• Who assaulted you?
• What is your relationship to that person?
• What led up to the assault?
• Describe assault. (Ask for specific details)
• What did the suspect say during the assault?
• Were any threats made?
• Describe any property that was damaged.
• Were you afraid during the assault?
• Did you defend yourself? If so, how?
• Do you plan on going to the doctor? If so,where?
• Have you used any drugs or alcohol tonight?
• Has the suspect used any drugs or alcohol tonight?

• How often does this person intimidate or
threaten to assault you?
• Has the defendant ever harmed or threatened
to harm any pets?
• Does this person own or have access to any firearms?
• Do you have an Order for Protection or a No
Contact Order with or against this person?
Reminder: Inform victim of the domestic abuse
advocacy resources located on the Blue Card.
For immediate safety concerns, refer the victim to
the 24 hour statewide domestic abuse hotline at
1-866-233-1111.
Reminder: Pursuant to Minn. Stat. 609.342, a police officer
may arrest a suspect who has left the scene of a domestic
abuse incident anytime within 24 hours of the incident even if
the incident did not occur in the presence of the officer.
