THE IMPORTANCE OF MAKING YOUR WILL

By : Rtn Nar Chin Keow

Benjamin Franklin once said
“In this world nothing can be said to be certain except death and taxes”.

S ince death is a certainty and only a matter of time for everyone, one would have
thought that most people especially entrepreneurs and professionals would
definitely have written their wills. However recent statistics show that in Malaysia
less than 10% of our population has a written will. There are many compelling reasons for
one to have a written will and a few of these reasons are as follows:

1.You get to decide how your assets are distributed among your loved ones after your death.
If you don’t determine this by way of a will, the law will decide for you and that may not
necessarily be what you want. In Sabah, the Intestate Succession Ordinance 1960 which
applies to non-muslims and non-Natives only will determine how an intestate’s estate will
be distributed. With a valid will, you can avoid any part of your estate going to someone
that you never intended to inherit. Having a will ensures that your intended desires on the
distribution of your assets will be carried out.

Warren Buffet once said – “I want to leave my children enough so that they think they can

do anything but not too much so that they do nothing. “

2.The loss of a loved one is already a difficult time and making sure that your affairs are
in order and can be speedily settled as quickly as possible after your demise will make an
already difficult time a little less stressful for your loved ones.

3.Your dependents will need to have continued access to funds to carry on their daily life
especially if they have already lost the breadwinner of their family. Leaving a valid Will
avoids a lengthy court process that will tie up funds of the deceased for a long period of time.

4.The court process for the administration of an intestate (i.e. absence of a valid will) estate
will take a longer time and will also be much costlier. In fact such process may even hit a
snag if the value of the deceased’s estate is very high and the deceased’s next of kin are
unable to procure the sureties qualified to provide the administration bond required by the
court. Such sureties have to show the court proof that the net value of their total assets is
not less than the total net value of the estate in question.

5.If you have children who are minors, you can decide through your will who will be a
guardian for them should your spouse predecease you.

6.Needless to say, a written will can avoid dispute and litigation in most cases. “Death is not

the end. There remains the litigation over the estate.” – Ambrose Bierce
