PENGENALAN KEPADA
BASKET OF BRANDS (BOB)

Dalam usaha untuk memastikan hak harta intelek
diberi perlindungan yang terbaik di negara ini,
Kementerian Perdagangan Dalam Negeri, Koperasi
dan Kepenggunaan (KPDNKK) pada 20 Oktober
2011 telah memperkenalkan satu inisiatif baru
yang memberi keutamaan penguatkuasaan kepada
jenama-jenama yang tersenarai dalam Basket of
Brands (BOB) yang mana pemilik cap dagangnya
telah pun memeterai persefahaman untuk
memberi kerjasama bagi membuat pengecaman
dan memberi keterangan di mahkamah.
Dengan cara ini, semua kes yang diambil akan
dapat diselesaikan mengikut kehendak undang-
undang berbanding sebelum ini yang mana KPDNKK
menghadapi kesukaran untuk menyelesaikan kes-
kes berkenaan disebabkan keengganan pemilik cap
dagang membuat pengecaman ke atas barang-
barang yang disita dan memberi keterangan di
mahkamah.
Bagi pemilik cap dagang yang enggan bekerjasama
dan menyertai BOB, tindakan penguatkuasaan oleh
KPDNKK untuk melindungi kepentingan mereka tidak
dapat diambil secara proaktif sebaliknya pemilik cap
dagang jika mahu, masih boleh mengambil tindakan
secara sivil ke atas mana-mana orang yang meniru
jenama mereka.
Pendekatan baru ini juga diharap akan dapat
memberi gambaran jelas kepada orang ramai dan
juga pihak United States Trade Representatives
(USTR) iaitu sebuah agensi yang membuat penarafan
tahap perlindungan hak harta intelek ke atas negara-
negara rakan niaga Amerika Syarikat di seluruh dunia
termasuk Malaysia akan tanggungjawab pemilik
cap dagang sendiri dalam memerangi barang-
barang tiruan dan melindungi kepentingan mereka.

ARTICLE 3:
INTRODUCTION TO THE
BASKET OF BRANDS (BOB)

In an effort to ensure the best intellectual
property protection in the country, the Ministry of
Domestic Trade, Cooperatives and Consumerism
has introduced a new initiative effective 20th
October 2011. This approach gives priority to the
enforcement of the brands listed in the Basket of
Brands (BOB) in which the trade mark owners had
signed an undertaking with the Ministry to give their
cooperation in the verification of the goods seized
and to give their evidence in court.
With this approach, cases concerning counterfeits
will be resolved according to procedures required
by law, compared previously where the Ministry
faced difficulties in resolving cases due to the lack of
cooperation from the trademark owners to provide
verification reports and to testify in court.
For trademark owners who are not willing to
cooperate and participate in the BOB, the Ministry
faces difficulties to undertake proactive criminal
actions on their behalf and to protect their interest.
However, they may still undertake civil actions
