Thursday, January 10, 1980

Mayor Hall called the meeting to order at 8:00 P.H.

Present: Eayor Hall, Treasurer Robinson, Councilmen Jenkins, :ctaum, Hoberts, Robinson
and Strong.

Absent: Councilman Lf· Hall.

The minutes of the December meeting were read and approved as read.

License: Hr. Strong advised that :the Special Committee to inspect the various
business places had not completed :their report and stated that they hoped to
complete on Saturday, All license ren~wals being held until clerk received the

that he was working on the house and. appeared to be almost finished.

Fublic Safety - Mr. Raumadvised that 49 ca.Las were recieved arid answered for January.
He further advised that Officer Calalrell 'had resigned effective 12-31-79 due to
L- a conflict with his other job.

Hr. Raumadvised that he would like to recommendthe hiring of two pa:r:t time officers,

he had interviewed: Carl Powell, 36 years old, trained and experienced, 1 year over

legal age, however, could get waiver "for part time work; a.nd Jim Ferider, Jr., who
is untrained, He stated that he would lil~e to have men on standby since the department
is done to three men, 2 trained and 1 untrained. He said trainh1g courses were coming
up and will need men to fill in schedules. He further advised that Towncould use
untrained manfor 1 year.

I'.r. Raummovedthat Powell and Fender, Jr. be hired as temporary part time men.
Motion seconded by Er. Robinson. Notion carried.

Sanitation no report.

A letter was read from lir. Cochran re: increased costs for sludge removal due to

increase of gasol ne and oil. He requested an increase of $~.50 per 2200 gals,

total :t53 .46.

:Mr, Roberts movedto accept the increased cost as a j stified one. Eotion seconded
y Hr. Raum, Eotion carried.

The Council was advised that the tires forthe dumptruck had been ordered by Sherberts
but had not been received yet. Two now tires were put on pick up truck.

:MayorHall advised that he had attended meeting on the Twin Beach Sewer Facility with

M:r. Raum. He briefed the Council on the meeting explaining tha i the survey for Step 2

of the project was apprsaching. The cost for Step 2 survey - $18,600. He explained

that North Beach and the county wruld - pay higher percentage than Chesapeake Beach of

this amount since our use would be greater than Ches. Beach of the new facility.

Eayor Hall stataed that the contract had been received but he had numerous questions

which must be answered before he ·would consider signing it - who will bear burden to

up date our spumping stations (#1 needs major work done on it, never had m1ty major

repairs other than t¥2 and #3). -

MayorHall also stated that he would like to purchase land from K, Spasaro to bring

#1 station above ground. He added that he would consult with H. Sturdevant, our engineer

before making any decision.

WhenEr. Strong asked if it looked beneficial to become part of the - regio:nal sewerage

system, JvTayor Hall advised that due to the number of violations received it is impossible

to up date our plant to meet the standards of the state ,

Questions of the fees to be charged to the property ownersis one of the questions yet

to be answered. He suggested setting-a meeting up with H, Sturdevant as soon as possible ...

(To be next week - day undetermined).

MayorHall advised tra t he and Nr. Raumattended a meeting on the 1980 census and

advised that it is our duty to stress the-importance of each and every citizen to

fill out and return the census forms which we will be receiving in the mail soon.

Our revenues from federal, state and county government are all based on an accurate

head count. He further stre:esed that the Census Bureau is only department where the

information is 100% confidential - records cannot be impounded,

The clerk waas asked to place an ad in the county paper - 1975 Flymouth, etc.

Special Meeting, Town Council
January 15, 1980

I>:aybr Hall called the meeting to order for the :purpose of discussing the Twin Beaches
Regional Sewer Pl.an with Engineer H. Sturdevant·.
Fresent: Mayor Hall, Treasurer Robinson, Councilman enkins, Raum and Robinson,
No quorumwas present due to the absent of Hr. D, Hall, Roberts and Strong.

Lr. Sturdivant advised the council that a Federal grant had been applied for by LES
for project. 1~uestions of overall costs? to 'I'oun? and Fer dwelling? etc? still
remain to be answered. Lr. Sturdivant looked at the contract received from Klein
a t termey for Ches. Beach, and ad.vised that the Town not sign anything until ques t.Ions
are answered and more facts are available.

Nr. Sturdivant requested an· agreement whereby we recognize him as our engineer to
speak for us on matters concerning the sewer facility.

Mayor Hall called the regular February meeting to order at 8:05 F.h.

Present: Mayor Hall, Treasurer Hobinson, Councilmen .Ienk i.na , Raum, Roberts,

Hobinson and Strong, and Attorney Sheridan,. who arrived at 9:30 F.L.
Absent: Councilman D. Hall.

The minutes of the January meeting well'.'.'.e read • Sin:ee a 'quorum was not present
for the Special 'Meeting on January 15, 1980, no meeting was held. However, since

Mr. Sturdivant, consulting engineer, was present, the members of the Council discussed
the,-c-orrtra.ct from Chesapeake Beach on the regional seHer facility to be constructed

in Chesapeake Beach. Hr. Sturdivant advised that we request changes in the contract.

Mr. Robinson moved that the minutes be approved as read. hr, Raum seconded tee
motion, Hot.i on carried.

Mr. Robinson moved to recognize Hr. Sj_urdivant as consulting engineer to represent
the Town with MES and Chesapeake Beach: on the regional sewer facility. I":r. R"'um
seconded the motion. Motion carried"

but he ·did have a report by the Special Co.lll.i~ittee(Strong, Hall and Roberts). He

advised that various businesses were not being recommended for license renewal until

they took steps to clean up their property and make certain repairs as noted, List

of 18 businesses and the reco:rmnendations were read.

Hr. Roberts moved to have the Town Attorney take legal action to close these

estab'l.Lshaerrts until the recommendations of the Commti.t.ee are met. Lotion

seconded by Mr. Strong.

renewal applications had been held up waiting for the report of the committee to be

removed from the property which would only take one or hio days to remove. He

recommended closing the businesses for one day until clean up was made,

Fr. Raum suggested that we wait until the attorney arrived for an opinion from him.

Hr, Roberts withdrew his motion until the arrival of the attorney,

Ifr, Raum advised that Off, Fendf)r had been acting chief for 90 days and moved. that

he be made Qh1tl with ~ther. salary. increase, and that Off. Jarnigan be

made Corporal with additionaJ.lli.20 per hour. Eotinn seconded by Er. Roberts. Motion

Yir, Raum advised that he had an applicatmon for police officer from john Walter \{§:;r.d

31 years old, 3 years ex:p'?.:;:iencewith Sheriff's office, has had police training.

Mr.·Raum moved that Hr, Ward be hired as a full time man, 1 year probationary period.,

$5,30 per hour. Hotion seconded by l'.r. Robinson. Notion carried,

probationary period, be given an increase up to $5.00 per hour. ·:r. H um seconded

Nayar Hall advised that the Corp of Engineers had cited the Town for violations of

been pulled back and spread evenly, nowhe will call the Corp to comean inspect the
area to see if requirements have been raet.

r:r, Strong suggested that anyone having large appliances to be removed, call the
county and they will comeand remove these large items. (l:umber to call is on Green

boxes).

r·~ayor Hall advised that with the man hours involved, increased costs of oil and gas,

distance to the county dump(23 miles), the trash renoval for the town was becoming
too expensive without consideration being given to an increased rate. He further
advised that bagging of all leaves and trash would help.

A complaint was heard from Er. Roger Shipe about leaves not being reli1ovedthat he

had raked from his property and others being picked up from the Eayor' s daughters' .
I·Iay9rHall advised that he would find out why Lr. Shipe 1 s leaves had not been removed.

I:r, Roberts advised that all leaves are supposed to be bagged according to Town
ordinances. r.:r, Strong recornmendedthat flyers be distributed advd sbng the property
owners to bag their leaves or trash.)otherwise the Townwill not remove them.

) License application was submitted by Hr. GlickfielG. for the Key Club; for approval

~':r. Roberts stated that he did not think the Townneeds anymore liquor licenses and

suggested~~ some of the licesses where more than two police calls are made in a

month. He said Er. Koch (former operator of Key Club, nowdeceased) ran an excellent

place - oril.y l:ickey "s and Key Club did not create prob.Lensfor the Town.

Ifr. Glickfield asked what's wrong with Key Club and whydoesn't he want him to get a

license? He saated taat he had been in business all his lifet had a license 35 ye~rs,

Er. Roberts advised that he was against any more liquchr licenses in Town.

Nr. Jenkins movedto approve the license pending approval from I.iquor Board. Hotion
seconded by Mr, Robinson. Vote: Hays - Strong, Rob~n, ayes - Jenkfuns, Robinson,
Raum. Hotion carried.

A request was made to ask the LiquorBoa::rd. to conduct the fublic Hearing at the Town

Hall and The l'iayor advised that this· is the policy of the Liquor Board to hold the
hearings in the area of the license in question, (Hearing scheduled for l'larcn :2(J, 1980,

.Attorney Dan Sheridan arrived and his opinion was asked on the licenses for the
business places which had received. notices that they could not renew their license

until certain recommendations of the Special Committee were met, He aas advised that
letters were sent to all business license holders in the Townon July 1, 1979 informing
\__ hem that certain standards must be met before their licenses would be renewed in
Jaruary 1980 (i.e. cleaning up exteriors of businesses, repairs and painting was requested);
A follow-up certified letter was sent Kovember12, 1979, to those business places where

which does not permit expansion of a non conforming use. He also stated that Er. Soper

Mayor Hall advised that the pumping station was working fine according to who is

bad reports were recieved from samples taken once a month by State. He further

plant. He advised that Er. Rymer is reviewing the ggreement, new contract, and

The proposed budget was submitted for review. The Treasurer stated tha tthe Anti-
Recession Fund would have to be included in the budget.
The proposed budget for ~e FY1981 includes an increase in the trash and garbage
collection fee of $15.00 per residence, to off-set increased costs of opera t.Lon,
an increase in the sewer service charges of $10.00 and an increased tax rate of
~1.50 per hundred dollars assessed value.

A letter from the Sia te Planning Department was submitted for discussion. It advised
of a grant for monies for providing public access to waterfront area technical studies.
The grant of :)27, 000. would either be divided two or four ways depending on which
\____ projgects are selected for award. The county is interested in applying for 'the grant
if Horth Beach is not interested and they wanted an answer. Lr. leon Etzler had called
concerning the matter and suggeste that the Townmakeapplication advising that l\r.

Publl:C Safety: Mr. Raum advised that 66 calls had been received and answered.

Mr. Raum moved that the Town purchase another gun (Bay Sporting Goods-
in the amount:·of $171.40 for the police department to replace a gun

which is in bad condition, and which will be repaired at a later date.

Permits Commi~te~: Mr. Strong advised that he had written a letter to the Building

Inspectors of Calvert County asking if they would be willing to assume sesponsibility

of the buidding inspections in the Town. He a.dvised•that they were favorable and

willing to discuss the matter. ·

Mr. Strong further advised that he had never received a letter from Julius Sherbert
concerning laws governing them being allowed to store and hold cars placed on the
property by the State.

Attorney Rymer advised that he had two completely revised ordinances ready to be
introduced, ordinance on "Taxes & Assessments and Traffic, etc. Both ordinances
were read. He further advised that he had the ordinance on Fire Regulations, but
wanted to hold it until he checked out several things, burning of leaves, etc,

Resolution #3-80, Article II, Committees which was introduced March 13, 1980 was
read again.
Mr. Roberts moved that Resolution #J-80, Article II, Committees be adopted. Motion

Letter, State Health Dept, re sewer violation, req, that no sewer permits be issued;

Mayor Hall r_equested tpat the Town Council meet with him Sunday, April 13, 1980, to

inspect0the area. He further advised that before these houses were constructed, he
had advised the builder to -install. underground. drain tiles.

Further complaints were heard from C. Buckmaster concerning the drainage problem

further down 4th Street behind her home, where water settles and 5mells.

Attorney Rymer advised that the County should take some responsibility for the
s~rm water draining into Town.

Copy of letter to Mr. Robert Callis from the Crunty Commissioners concerning the

draimage problem he is having, also from the out-·.of Town 4th and 5th Street areas.

The county suggested that the Town solve the ~r~blem with grant money received

from them,

Mayor Hall advised that all new drain pipes had been imstalled from 5th St. to 4th.

St. to 3rd. Street on Chesapeake Avenue, trying to alleviate the problem, but there

is no grade in this area. Tide is too high, water will not drain off, Swamp area

which even when filled, still sinks. All buildings in area should be on floating

foundations - others keep settling. He hopes the drain pipe will offer some rel~ef;

he does not know what else to do, none of the engineers offered any suggestions

either.

Letter from County Commissioners advising the Town that some of the grant funds

could be used to remodel the Town hall.

Attorney Rymer advised, in reference to letter of Mrs. Jameson, that J. R. lfoCrone _

En~ineers~ is doing.this for some of the small towns and is_probably ~ne of the
best professionals in the state (H. Sturdevant, our engineer).

The clerk advised that Colonial Life Ins. had asked for permission to speak to the
employees about taking out a policy for income protection. It is a group policy
which the Town is not involved in except that the Town Treasurer is requested to
make the payroll deduction for the company. Permission for the company representa-
tive to meet with the employees was given.

Fire Investigator Warren Gott was to be contacted to make fire safety inspections
on several buildings and also for new businesses to be opened.

Mayor Hall advised that yes, he was as soon as get plans, fix allfour pillars. He

Mr. Robinson suggested that the town employees do job (pillars?) when they are not

busy doing something else. He advised that he felt Town should fix up its property

since we are asking.others to do the same.
triayor Hall advised that Mr. Cranford (Owings Lumber Yard) is d:rawing '1P plans for
remodeling the Town Hall, and that he hopes to have the wDrk begun soon.

Public Safety: Mr. Raum asked Chief Fender to give the report. _

Chief Fender advised that )0 calls were received. and answered., 29 reports made and
12 municipal infractions given.
Chief Fender further advised that within the police budet, he would like to make
Officei' Fender a fultime man. He also stated that he would like to make Officer
Ward, Acting Corporal until his probationary period is up, then make him Co;rQoral,
with no monetary changes at this time.
Chief F'ender advised that the department has 50% of iss cases closed out at this time.

Mr. Raum moved that proposal of Chief Fender concerning Officers Fender and Ward be
accepted. Motion seconded by Mr. Robinson. Motion carried.

Chief Fender then called the following people forward for citations:
Mrs. Joan Parales - in recognition of good citizenship for assistance
to the poli9e in a child molestation case.

Mrs. Janet Greenwell - also cited for assistence to police, helped to
close a case.

Trooper Maynard. Miller, Md. State Polll:ce, cooperation and assistance to
Officer Ward in child molestation case, citing him
for dedication and performance of his duties~

Patrolman John Ward - also cited for team effort in assisting Trooper Miller

in child molestation case and was instrumental in
apprehension of cupprit.
Also, Warren- Gott, F'ire Marshal, three arrests were made.

Mayor Hall expressed. his taanks to the }dies and gentlemen officers, needs citizen
participation to solve cases,

IJicense Committee - no report, Soper' s pending, list to Fender of delinquents.
Sanitation - no report.

M:r, Reid Hutchins, Pres. Calvert Historical_ Soc'Le ty, and Mr. Bernard Love'Leas
were introduced, and Mr. Lovelss gave ~n interesting informative talk on the
Railway Museum and rehabilitation of the old railraQd station in Chesapeake Beach.
He expressed the need for volunteers to help, old pictures or other memorabilia
and. financial donations. He advised that the dedication would be held May 24, 1980.
Mrs. Mildred F~nlon and He had prepared an audio vision slide film. He said the
county had given h~lf of funds needed for renovation of station and that they
were trying to get state grant (waiting governor's fl_ignature). He advised that
they must match funds donated by county.

Mayor Hall advised that County Commissio.ners had requested that th6,~3{~~er~~~gdpin·)
the old Firepouse, attend a meeting in Chesapeake Beach to hear about the plans for
our firehouse. It was requested that a meeting be held in North Beach also since
meeting schedule in C, B. was on their regular council meeting night. (Mayor Hall
arranged. a meeting for May 29, 1980, at 8:00 P.M_, in Town Hall).

A copy of a letter from Mary Harrison, Conunissioner, to Mr. Neil Russell was
read in reference to the many letters he has written takeing the town to task
for things he felt it had not done. She advised that County had not imposed
its priorities upon Town officials since the Town is incorporated. She also
cited good relationship between Town and County.

Letter from Civic League advising that T. Rymer would be speaking at their May
meeting and asking members of Council to attend.

Question was raised if municipal infractions had-been given to Milton Sochor (property
filled with debris and trash) , William Holden (condemned building open to trespass) ,
and Domico's Restaurant (broken windows wtth plate glass hanging precariously and
<il.ngerously). Advised that mun. infrac. had been issued,

Mr. Roberts moved that the council adopt Resolution #7-80, Article III, Assessments
and Taxation, which had been in-t:i!fxiuced at last meeting. Motion seconded by
Mr. Strong. Motion carried.

Mr. Roberts moved that Resolution #8-80, Traffic, Vehicles and Transportation,
Articel VIII, be adopted, it also having been introduced at the last meeting.
Motion was seconded by Mr. Jenkins. Motion carried.

The Treasurer advised that she was submitting a list of delinquent sewer assessments
which are pass due, some for several years. She suggested that they be n<htified that
they would be cut off from service if not paid,
Discussion.
Mr. Jenkins suggested that notices be sent by certified mail and return to sender,
gi-ving property owner 10 days in f!hich to pay or advise them they would be cut off
and that they would be charged the full connection fee to hook on again, and that
all costs would be paid by the property owner for the disconnection.

Discussion on old trash truck. The representative from Truxmore Pakke:r was supposed
to get back to Town with information, however, it was stated that he was interested
in selling a new truck and not repair of old ones, Cost to rebuild~ $18,000,
Mayor Hall advised that body could be put back in working order, that it needed
a larger chasis, body was too large for truck.
Decision to sell :i:arts, get what can.

Mayor Hall advised that mosquito spray would not begin until last May or June 1,
trying to keep costs down - ·estimated for 1980 - $474. for Town.

Mr. Jenkins moved that Mr. Duncan (Mosq_ui to) be contacted to see if they would begin

Roads and Streets: No report, however, during storm, tree on town property fell
on car belonging to .Marie Idarola. Mayor Hall advised her to get two estimates.
He stlted thathe did not know if town's liabilil ty insurance would cover the
damages or not, (To be checked out)

Clerk advised of a work shop on highway safety improvement to be held and the
SHAdm. wan'ted to know who in the Town would be at tendeng , Date and Place to
be set at a later date, after they know who and how many are attending: Centfral
location will be chosen. She advised that per telephone call of Mrs, Wassels,
SHA,there would be no soverign immunity where traffic accidents occured if the
place were one designated with a safety factor which had not been corrected by the
municipality, Clerk advised that she had given them !fir. Robinson's name as member
in charge of roads and streets.
Mayor Hall stated that clerk was to advise them that maybe two members from Town
could attend the workshop - definitely one will attend,

Mayor Hall advised that he had complained to BG&E about street' lights needing repair
and not being taken care of.

Licenses:' Clerk advised that many still had not been renewed. Also, license of
Soper's Garage is still pending.

Sanitation: delinquent sewer payments noted. It was stated that notices for a taxr
sale would be sent on all who owed two years delinquent sewer charges, giveing them
30 days to pay , Then those who did not pay, would be handled the same as any tax__
delinquent pr'opertye tax sale.

Nayor ~all. pr<!>:poS'ed to th~ Town Council that the Town consider the purchase of

j the Glickfield property directly across from the Town Hall. He suggested that
j instead of an office addition to the rear of the Town Hall, that part of this

building across the street be torn down, making room for parking facil:i.ties, and
that the other structure be renovated for offices. He stated that he believed that
he could negotiate a favorable agreement with Mr. Glickfield and that the Town
would benefit by the purchase of this property. He asked that the Council discuss
a:idthink his proposal over. The asking price forthe property - $100,000,, which
many felt is too much for the property in question,

Public Safety: Mayor Hall advised that 72 calls had been received and answered and
that 35 reports were made.

Mr. Roberts asked what the Police are doing, he stated that he gave a list of
:municipal infractions to be enforced and nothing had been done on them in 60 days -
he cited instances of beer drir¢:ing in public, motorcycles on sidewalks, loitering
and etc., partying on top of a van in public street - he asked if the Town wanted
its o:rdinances enforced or not,

Mayor Hall asked that he bear with him for two weeks and a change would be seen
claiming that lack of police working made it difficult to handle some of the

incidents - couldn't let one man transport t dozen prisoners. He promised a

change. He advised that he had discussed. the matter with Chief Fender and proposed
holding the prisioners here until able to transport,
Mr Roberts pledged his cooperation 100% if something is done.

Permits: Mr, Strong asked if concrete which had been poured in gutter had been
removed arrl if man had been served with municipal infraction. It was suggested
that a letter be sent asking that it bee removed.

Sanitation: Mr. Hall advised that he had been attending the meetings in Chesapeake
Beach on the Twin Beach Sewer Project and that Step I had almost been finalized, and

that they were proceeding to Step 2 of the Project. He advised that at the last
meeting, questions about maintenace, who will shoulder burden of repair, how service
and users charges will be billed, etc were raised. Each Town and county will do its
own billing, and because of inequity in usuage, it has been recommended that meters
be installed on all conunercial apartments, motels, hetels, laundromats, etc. - that
way each will get a fair rate since some use much less than other businesses. He
advised that Gerala. Klien, atty. for Chesapeake Beach, suggested this and that he
is preparing an agreement - all three jurisdictions will have to ag:eee on arrange-
ment chosen. Next meeting will be July 2, 1980 He advised that '79 allocation
had been made and he hopes the 1980 allocation will be released._ He_adv~sed that the
pumping stations are to be revised and are included in the plan, that will try to
handle in reasonable way.

(Mr. Rymer arrived).

Discussion followed, Mr Strong asked how much of the county was to be servled
and stated that he did not like the idea of servicing whole area because of the
odor proplem, citing the Blue Plains Plant. He was advised that we have no choice,
state project, but that the plant will have J00,000 gal capacity and it is an up-
to-date plant and he did not think we would have an odor problem. He wa:s-(advised
that this was the most feasible solution of those proposed by the state.

Attorney Rymer and the Council commended the Civic League on the good job they did
painting the front of the Town Hall.

Notice of scheldule for 1980-81 of SMMA was given, no meetings in July, August,

L- December and January, nex; t meeting will be held here September 16, 1980, Conventd.on
in Ocean City June 23-27th.
Mr Roberts advised that he had received a sommons on the Lubbes' municipal infractions.

The clerk advised that she had :received a complaint from Mrs Lena Wood on sidewalk
in front of her property. The Mayor advised that he would speak to them about it.

A request was submitted for a +ape recorder by the Board of Appeals for their
meetings.

Mr. Roheri:ls moved to approve the :purchase of a tape recorder. Motion seconded by Mr,
Jenkins. Motion carried.

Mayor Hall advised. the Council that it was time for the appointment of the Board of
Supervisors of Elemtion for the November election and that he would ask that the
same members be reappointed.

Mr Jenkins moved that Mrs Lorena Ward, Margie Marshall and Lucile McLean be reappointed
to serve as Judges of Election for the ensu:eing election, with Mrs. Nellie Murphy and
I~rs. Irene Ashton as Alternate Judges. Mr. Robin.son meconded the motion. Motion
carried.

before Council and explain services they provide for Cable 'I'V,
Atty Rymer suggested that we invite several companies in to explain there services in
this endeavor.

Roads and Streets: Mr. Robinson advised that all the burned out lights had been

taken care of now.
He asked if anything had been done by our insurance on the claim for damages by
Mrs. Iadarola, He was advised that the bills had been turned over to the insurance

company.
Mr. Robinson advised that he would check all streets and alleys for any dangerous
and diseased trees. All rotted limbs and dead trees should be removed.

Licenses: Clerk advised that all licenses on Mrs. Morgan's properties were long
overdue. Police to handle matter with W~ C. Petrie. Chief Fender advised.

L Public Safety: Cb~ef Fender advised that 138 calls were received, 68 reports were
submitted. He further advised that they had lost a case in court because they did
®t have the ordinances with them on the municipal infraction ordinance. He stated
that this was an ernba.rrassment to them,
Chief Fender recommended tr.at the Town take out a maintenance contract with Southern
Maryland Communications - $JJ,OO per month on cruiser radios, which will cover all
i tams except, damage due to abuse, or weather, new crystals, or installations.

A request was made to have all revisions of ordinances which are approved printed.

Mayor Hall advised that a meeting was to be set up with our engineer, H. Sturdivant

July 17, 1980, at 7:30 P.M. and that we could have a meeting with our attorney

following it on the ordinanceJP~ .-

Mr. Roberts moved that service policy with Southern Md, Co:mniunications be adopted

tlr the radio cruisers maintenance. ($JJ,OO per month) Motion seconded by Mr.

Correspondence: Letter, 7-9-80, from County Commissioners advising that the Town
would receive a grant a~in in Fiscal Year 1981 in the amount of $55, .502. Also,

Mr. Roberts suggested that an air conditioner be purchased for the test room in
the sewer plant. He stated that it was very hot and the building only had a small

Mr. Rymerread new amendment proposed tq Article lV, Section 8 which he had been
asked to draft, regulating the closing of business establishments. Introduced as
Resolution #9-80, to be adopted at next meeting.

of the week. Resolution to be drafted by Attorney Rymer, who also wishes to discuss
the resolution with Atty. Lamson.

Mr. Roberts moved t.ha t the amendment to the curfew ordinance, Resolution #10-80,
setting the time at 10:00 P.M., 7 days week that all youngsters must be off the
streets (under 18 years old) be adopted. Motion seconded by Yir. Robinson. Motion
carried with affirmative vote of lJ. members present.

Discussion on Soper license i 1) in order to use the toilet facility in the front
building for business in rear, garage1 he must obtain a ruling from the P. W. Admin.
and 2) to exxpand the non conforming use to the two stalls in the front building,
he must apply to Board of Appeals by Special Exception for approval (up to 50% of
square footage).

License application for front building retained with ap~ication for SE by l'lr, Soper,
has not been presented to council for approval.

claim of Iadarola satisfactorily.

License: A new license, Bric-A-Brae, Consignment Shop, to be located in N. B. Motel
building, to be operated by Wanda Grierson$--».(Bl. J, Lot 125'16, 17). Clerk advised
that Fire Marshal Gott had inspected the buiading and recommended that the fire
e:stinguishers be inspected, which was done, 8/28/80 and that Mr. Roberts had recommended
that a temporary JO day licenses be issued until painting and other recommendations
could be met. (fix sign, remove electric sign, clean up trash of tenants, etc,)

Application for a new license by William Soper for New and Used Auto Parts Sales
was submitted for Block 2 Lot 14, (front building).

Mr. Roberts advised that the appli.aation was to be HELD~ that use of the bath
facility for the use of the non conforming use (garag;} in rear was approved,
but a :ruling had to be made by the Board of Appeals and that no work was to be
conducted in this bui 1ding until application for Special Exception (extension of -

non conforming use) had been completed and submitted to the Board.

on any of the licenses for the apartments and rooming house, 1980.

Fublic Safety: Chief Fender advised tat 10.3 calls had been received for July and

123 calls for August, with 'J3 and 60 reports being made respectively.

He further advised that Jack Ward and Jack Nutter each resigned for personal reaLons
this week (Ward - 9-11-80 and Nutter - 9-5-80). He _a.sk~d that Caldwell and Henning

Mr. Jenkins requested that Chief Fender furnish a new list of officers and their

Sanitation: Mr. Roberts advised that miscellaneous ma_tters had been handled. -

an air conditioner had been pur cbssed and installed in laboratory. He advised that

Greenwell and Shaillett have beemttending school to up date their lic_enses since

September 3, 1980. We are required by state law to have licensed men operate the

sewer :plant and will still peed the employees after the new sewer regional plant is

:h operation,

Chief Fender advised that in addition·.to the report he had given, he wished to advise

that the police training commission had approved an in-training school to be held

here beginning October 18, 1980.

He further advised that an adult drug education program was being set up and that

booklets were being published and distributed. (Very nice booklets sponsored by
the A.merican Legion Post 206.) He said that he hoped to have the fir:Bt presentation

next month.

Old business: The transportation workshop of SHA is to be held in Prince Frederick

Mayair Hall advised that Mrs. Puglisi had requested to have her sewer service rate
changed from commercial to residential since she no longer operates a business.

\ Mr, Robinson advised that Callis had removed_ all the bathrooms in the bingo and

that he had still been charged for sewer service, Biscussion.

Mr. Roberts advised that Mrs. Puglisi and Mr. Callis should write a letter requesting

what they want and since no permits were issued for the removal of bath facility in
the bingo, the Town has no way of knowing they have been removed. Furthermore, the
buildings must be inspecroed before charges will be removed. An official requett must
be sent to Town for our records.

l Mrs, Thelma Sherbert asked the Mayor and Town Council if they were aware of the

L problem on Chestnut Avenue, if house was a boarding house and if it were licensed. (No

license).
The Mayor advised that he and the police did know and Chief Fender advised that she
sould get restitution after it came to trial. The Mayor explained that youths were
distm~bing the peace and he had talked to them ard did not believe there would be
any further problem.

Mr. Charlie Miller requested that something be done about the racetrack on Bay Avenue.

He advised that he had lost a dog, which couId have been a child just as well. He

stated that cars were always squealling their tires and going at speeds in excess of

60 miles per hour. He advised that,. them had been three serious accidents in the past

month on this route on the county line. He ~equested radar to be set up, also, the

installation of a speed bump 1 4 way traffic_sign or light.

It was agreed that the Ordinances on Elections would be printed as isf to be ~evised
at a later date, 'I'he sections on Plumbing Code, Sewer Policy Manual, Pez-so ne.L System
Act, and Zoning Ordinance would be reviewed later.

Atforney Rymer advised that he had reviewed the curfew ordinance with Judge Bowen and
\ States Attorney Lamson and they saw no problem with the ordinance as we have it.

Mayor Hall advised that Mrs. Fowler had written requesting that the people next

ave thrown.on her property. She also asked if she would be allowed to install

he had discussed installation of septic system with county - if it per'cs , OK with

to issue permanent license.

License of W. C. Petrie - still operating without a license and all taxes are also
delinquent.

Mr. Roberts advised that Chief Fender see Town attorny and take action immediately.
Question of residents - no bluff, pay up or else - eviction. If wish to operate, then
get a town license.

Chief Fender will issue a warning in writing 10/10/80 and also will see Attorn@y,·Rymer
on further action.

Longfellow operatinn of Freddie's has not obtained his license since opening

for busd ne se , October 1, 1980.

Soper - no licenses, still pending until Public Hearing on Special Exception for an

extension of non-conforming use and to seek relief from Town zoning Ordinance,
scheduled for November 6, 1980.
