1.0 CONTRACT PARTICULARS

1.1 Instructions to Tenderers
Provide a fully compliant fixed price tender offer in accordance with the Tender Documents, of which this
document is a part. Submit a detailed breakdown of Tender as scheduled in Appendix A.
Appendix A comprises a live spreadsheet together with a frozen PDF. Complete the required cells within the
spreadsheet and submit the completed spreadsheet and a signed PDF copy as part of the tender submission.

1.2 The Site

Address: 15 – 29 Eyre Street, EC1, Clerkenwell, London

1.3 The Project Team
Refer to the project directory for list of the key project contacts and design team members.

1.4 Scope of Works
The Services Engineer’s Drawings and schedules indicate, but are not limited to, the following information:

• Location of plant and equipment
• Routes of pipework, ductwork and sundry distribution services
• Performance, capacity and physical data of all plant and equipment
• Recommended suppliers and manufacturers together with equipment references and identification
• Installation and fixing details (where appropriate)
• Incoming service locations and termination points
Except for materials or items of equipment which are specified as being supplied and/or fixed for the Works
by others, include within the Works for the design, manufacture, supply, delivery to site, unloading, storing,
distribution around site, installation, erection, connection, finishing and putting into service of all of the
materials, fittings, cabling and pipework and for testing, commissioning, operating & maintenance
instructions necessary to complete the Works in accordance with the requirements of the specification,
appendices and drawings.
The Works require the incorporation of the optimum value engineered building services solutions for
maximum cost effectiveness whilst also achieving durability of service and ease of retrofit installation. Ensure
all appointed sub-Contractors have relevant experience of such works.

Be entirely responsible for the efficient installation and performance of the Works and their guarantee for

the duration of the Defect Liability Period.

Install the Works such that they comply with this Specification and conform to the best principles of modern
practice. Carry out the Works employing fully competent tradesmen of the appropriate grades.

Include for fixing all equipment specified together with all necessary primary and secondary fixings and
support systems. Provide fixing details to the EA for approval prior to installation.

Provide all relevant method statements and job safety assessments to the Planning Supervisor as required.

1.5 Definitions
Within this Specification and associated documentation the following words have the meaning herein
assigned to them unless there is anything in the subject matter or content inconsistent with such
construction.

The ‘Employer’ means client.

The ‘Employers Agent (EA) means a representative of EA.

‘The Works’ means the works which the Employer has engaged the Contractor to perform as part of the
project and incorporating all labour, materials, equipment, apparatus, accessories and any other items
customarily provided and/or required for a proper and complete installation in accordance with this
Specification.

The ‘Site’ means the place as described in this Specification and the Tender Drawings, where the Works will
be carried out and the equipment and materials installed by the Contractor.

‘Tender Documents’ means:

• This Specification and Appendices
• The Invitation to Tender Letter
• The Schedule of Rates and Prices, where required
• The Tender Drawings
• The Employer’s Requirement document and associated drawings, specification and schedules.
• Programme & Cost Plan

The ‘Tenderer’ means any person or persons firm, or company invited to submit a firm price tender to
perform the Works and/or supply goods in connection with the works.

The ‘Contractor’ means any person or persons firm, or company under contract to perform work and/or
supply goods in connection with the works.

‘Working Drawings’ means drawings showing details of the Contractors proposals for the execution of the

works. The drawings will be in such detail as to enable the works to be installed.

‘Approval’ means approval in principle only and will not in any way invalidate the Contractor’s responsibility
for the installation, testing and commissioning in accordance with this Specification.

‘Contractor’s Equipment’ means tools, tackle, stores, and other such things brought upon site by the
Contractor and required thereon for the purpose of executing the contract but not for incorporation therein.

‘Commissioning’ means commissioning in accordance with the relevant CIBSE Commissioning Codes, IEE
Wiring Regulations, CEN, relevant British Standards and manufacturers’ instructions.

‘Tests’ means such tests as stated in this Specification or otherwise agreed between the EA and the
Contractor.

‘Demonstration’ means repeating the commissioning results obtained, in the presence of the EA and
showing the EA the operation of all plant and equipment under both automatic and manual control.

‘Record Drawings’ means the drawings prepared by the Contractor in order to provide the Employer with a
record of the works as constructed.

1.6 Form of Contract
The Form of Contract will be as detailed elsewhere in the Tender Documents. The Contractor will design
with design warrantee directly in favour of the Employer.

Carry out the works as described in the specification based on the form of contract proposed here.

The Employer will not accept any lack of inclusion in respect of preliminaries that are required to properly
carry out the works from any Contractor forming part of the construction team for the scope of works
required for this project e.g. Principal Contractor, Main Contractor, Sub-Contractor and Specialist Works
Contractors, including any direct works Contractors and Artisans and Tradesmen.

1.7 Tender Submission
This Specification forms part of the Tender documents which set out the Employer’s requirements.

The Tenderer is to apply the following general clauses equally and in every respect to the works described
in all sections of this Specification and shown upon the drawings including any additional work subsequently
instructed.

Complete Tender submissions in full, sign and return with all relevant Appendices to the Nominated
Consultant in accordance with the invitation to tender.

The Tenderer must also provide a Schedule of Makes and Types of all equipment included in the Tender and

a list of all Contractors they propose to employ on the project.

Upon appointment The Contractor must return a fully quantified Schedule of Rates summated to the
individual totals in the Tender Summary.

Responsibility for the accuracy and completeness of the quantities and descriptions will rest with the
Contractor and no adjustments will be made to the tendered price in respect of any inaccuracies. The
exclusion of any items in the Schedule of Rates will not relieve the Contractor of any obligations under the
Specification and Drawings.

The Employer is not bound to accept the lowest Tender or to reimburse any expenses incurred in the
preparation thereof.

Submit all Tenders electronically and by post using the formats indicated.

1.8 Principal Contractor
Carry out the works as Principal Contractor and allow for all project management services required to deliver
the Tender Documents under the CDM Regulations. Employ all necessary trades and specialist Contractors
to deliver the works to the Employer.

1.9 Programme
Allow to liaise with the Employers Professionals to develop a detailed project programme to carry out the
works. Within the intended programme of works be particularly vigilant over specialist supplier’s delivery
dates and sub contract work packages. Ensure that all programme dates are met and adequate liaison with
all parties takes place at the appropriate time.

1.10 Quotation References & Named Suppliers
Where quotation references and named suppliers are provided in the particular parts of this Specification,
these are provided to assist Tenderers identify the source of equipment, or service supply and the extent of
the overall provision and the general standards to be achieved. In particular, Quotation References and
named suppliers may not take account of the form of contract and other requirements of this Specification
such as commissioning and demonstration. It is the responsibility of all Tenderers to ensure that all suppliers’
quotations and sub-contracts are fully harmonised with the requirements of this Specification and all
Employers Requirements documents.

The responsibility rests with Tenderers to ensure that all the necessary interfaces and ‘on-costs’ associated
with Quotation References and named suppliers are allowed for within the Tender. This is to ensure that the
