FROM THE PRESIDENT'S DESK

We Customs I am delighted to inform you that we are on the next level of
Brokers have bright stepping stone. Our esteemed organisation is marching on a
future only if we glory with its completion of 82 years. This long journey of our
see ourselves as a institution witnessed a lot of pendulum swings. During our
useful link in the journey, we graduated from being called as “Mukaddam” to
logistics and supply “Custom House Agent” to “Custom Brokers”.

Today, trade facilitation and improving ease of doing business
- Karunakar Shetty is at the heart of all endeavours’ of the CBIC. Digitisation have
become a central tool for attaining the stated objective.

With the changing times the modern day trade expects more
from us. Expectation ranges from being digitally enabled to
implementing the various initiatives that have been proposed
to improve our services. We continue to serve as pioneer
stakeholders, and engage as an extended arm for Indian Customs.
The current scenario as the trade evolves, we can be resourceful
in providing knowledge, and extending handholding support to
the relevant stakeholders. We are privileged to be dealing with
almost all the stakeholders across the logistics chain.

Friends, the advent of ICEGATE, saw the successful
implementation of SWIFT portal. We are witnessing success in
the implementation of E- Sanchit and Turant, as well. Both the
programmes initially saw some glitches, but at the end, these
initiatives emerged a win -win situation for the Government as
well as the trade.

With the pace the technology is brought to the use, I am sure,
the days are not so far, where assessment and examination will
be faceless. Proper compilation of documents will become our
important responsibility, if faceless transaction is to become a
reality.

In coming days we have to assume larger responsibilities.
My sincere request to one and all is to visualize a larger picture
with regard to our future prospects; Time and again I state that
we Customs Brokers have bright future only if we see ourselves
as a useful link in the logistics and supply chain.

I thank my entire team, Former Presidents, Advisors and secretariat
staff for being a support to me at all times. The glory that the
Association carries is the result of the hard work put behind by
my seniors, and the trust and blessings of all the members. We
seek your continued support to carry forward the legacy called
as “BCBA”.

Mr. Ashish Pednekar, President chaired the meeting and welcomed the Advisors & Members to the meeting.

The President extended his warm greetings to all the members present and thanked them for their co-operation
and support to the Managing Committee during the year 2017-2018. He thanked the colleagues on the Managing
Committee for extending their co-operation and appreciated the efforts put in by them in accomplishing tasks on
behalf of CB fraternity. He thanked the Advisors for their support and valuable advice from time to time.

Before commencement of the meeting, the Hon.Secretary informed about the sad demise of Advisor Mr.H.D.Mehta,
M/s.D.M.Mehta & Bros.and Mr. Vasudeo Ranchhodas of M/s.Vasudeo Ranchhodas & Co.

He expressed his condolence to the families of the deceased Members. Then the house observed two minutes
silence to pay homage to the departed souls.

President then requested Mr. Dushyant Mulani, Hon. Secretary to read the notice of the meeting. The Hon.
Secretary thanked the President and read the notice of the meeting.

The Hon. Secretary took up the minutes of the 32nd Annual General Body Meeting of the Association held
on 20th September, 2017 and asked the Members if there were any observations. No observation was received
from the house.

Thereafter the minutes of the Extra Ordinary General Body meeting held on 22nd August, 2017 were taken up and
the President asked the Members if there was any observation. No observation was received from the house.

The audited Income and Expenditure Accounts with Balance Sheet for the year 2017-2018 was considered by the
House.
As there was no observation, the audited Income and Expenditure Accounts with Balance Sheet for the year 2017-
2018 was adopted and passed unanimously by the house on being proposed by Mr. Yogesh C.Mehta of M/s.
Chandulal H Mehta and seconded by Mr.Jiten S.Nagda of M/s. J.K.Nagda.

Agenda no.3: To receive and adopt the Committee’s Annual Report for the year 2017-2018.
The Annual Report of the Hon.Secretary for the year 2017-2018 was considered. President informed that we have
forwarded the Annual Report to Members by courier and asked whether any one had any observations on the same.
As there were no observations from the Members, the Annual Report for the year 2017-2018 was adopted
unanimously by the house, on being proposed by Mr. Dayanand G. Kalav of M/s.D.K.Clearing & Shipping Agency
Pvt. Ltd. and seconded by Mr. Manish Shah of M/s.Shrilcon Shipping & Logistics.

The Hon. Secretary requested Hon.Treasurer, Mr.Sanjeev Harale to brief the Members on the appointment of

with regard to the increase in the audit fee, ROC returns etc from Rs.1.06 lakhs to Rs1.45 lakhs. Mr.Shiv Kumar
Gupta mentioned that it is was too high. President asked for suggestions. He replied that Rs.1,20,000/- was
UWHſEKGPV /T &WUJ[CPV /WNCPK KPHQTOGF VJCV DGECWUG QH NQV QH EQORNKCPEG VQ DG HQNNQYGF YKVJ VJG KPVTQFWEVKQP QH
GST etc. the audit fee has increased. The amount of Rs.1,45,000/- was approved by the house. On being proposed
by Mr. Rajiv Desai of M/s. Dawn India and seconded by Mr. Naresh Udeshi of M/s.Atlantic Customs Brokers,
M/s.B.M.Mehta & Co. were appointed as Auditors for the year 2018-2019 on a remuneration of Rs.1,45,000/-.

It gives me immense pleasure to welcome you all to be a part of 33rd Annual General Meeting on behalf of the
entire Managing Committee.
Friends as you all are aware that I am towards the end of a wonderful tenure as the President of this Association,
I would like to thank each one of you, the Board of Advisors, Past President, Managing Committee, Customs
and other Government departments, Trading Partners, Secretariat staff of the Association and my family for their
continuous support.
The existence of this Association as a strong union for betterment of custom brokers’ fraternity was only possible
by the team effort put behind by my team who always stood behind as a strong pillar. I would personally like to
acknowledge each and every member of my team for their individual and collective effort that has made working
for common goal a lot easier.

I want to say here that during the recently held elections, there were differences amongst the contesting Members
but after the elections, we all are friends again and I request all colleagues to leave behind the hard feelings and

I had received an advice yesterday morning from one of our senior member, Mr Tushar Jani to keep all members
under one roof and help small member companies. Tushar bhai, I promise that my team and I shall endeavour to
do so.

Now, I would like to give roadmap of my next one year plan :

1. First of all, we will have the FIATA World Congress, 2018 in September, 2018. We as BCBA will do our best
to make it a grand success. I request all members present here to attend the FIATA World Congress,2018 in
large numbers from Mumbai. This will give a very good opportunity for our BCBA members to meet and
interact with the foreign delegates from all over the world. Today every one is looking at India, our country
and wants to have business relations with Indian Freight Forwarders. Friends, I urge you all to be there in New
Delhi from 26th September to 29th September, 2018. Let me inform you that FIATA World Congress will be

2. One area which needs urgent attention where our members suffer for no fault of them : we have seen many a
times various customs investigative agencies make a CB party in the show cause notice despite no involvement
of a CB. We will devise a process whereby we can help such members. And as an extension of the same,
OCP[ C VKOGU KV KU FKHHGTGPEG KP VJG QRKPKQP KPVGTRTGVCVKQP D[ VJG QHſEGT QH VJG KPXGUVKICVKXG CIGPEKGU KP HCXQWT

brought to the attention of the Association, with legal support.

3. To improve the operational yield of customs broker : Mr Dushyant Mulani, our incoming Vice President has

elaborate ideas on this matter and has a roadmap for the same. We will work To improve the operational yield
of customs broker.
4. Training of our staff; this is a continuous process. All my past Presidents have given great importance of
training for our staff. My team and I shall continue to introduce new courses for them so they remain with the
upto date knowledge.
5. Apart from these priority areas, we face various challenges in our day to day working with various stake
holders. Our Association, BCBA is a large body which is well respected by private and public entities. We
will have better professional relations with all of them to resolve issues faced by our members.
With this I would like to conclude my address. But before I conclude, I thank and once again express my gratitude
to all members of the Association, our Advisors, all Managing Committee Members for always being with me and
supporting and guiding me in the times of need and challenges. I also thank the Secretariat staff for their whole

Courier Committee:

Regarding Courier clearance matter, BCBA has represented with CBIC and Commissioner of Customs, Special
Cargo regarding denial of free access to clear courier consignments.

Based on the effective representation by BCBA, the Commissioner of Customs, Special Cargo issued Note vide F
No Air/Cus/50/CC/211/2010 dated 7.2.2019 whereby the consignments were permitted for transfer to Air Cargo
complex within 24 hours upon request made by importer / CB. This has helped Custom Brokers to undertake the
clearance of Courier consignments at Air Cargo Complex, Mumbai instead of Courier Cell.

Further representation on this issue is also in progress with Central Board of Indirect Taxes & Customs (CBIC).

Baggage & Postal Committee

Upon successful representation by the Association, the JN Customs Authorities issued necessary instructions, as
per the Minutes of the meeting of JN Customs PTFC meeting held on 24th September 2018. All UB containers
were now directed to D Scanner instead of R Scanner, thus reducing delay to a considerable extent. This has saved
considerable time for clearance of consignments being cleared through UB Centre.

The Association effectively represented with Speedy CFS Authorities for providing UB shipment invoices / proforma
online. This saved a lot of time as CB employees had to physically go to the counter and request for a proforma
copy which used to take couple of hours to be generated.

BCBA effectively represented with Speedy Authorities for passenger and CB’s coming to UB Centre along with
basic amenities. The same has now been provided.

matter with FSSAI and an order was issued in July 2018 that this practice will not be continued anymore.

Stamp Duty Committee

2. The issue of Stamp Duty refund was also discussed in the meeting. BCBA suggested that the refund should go
directly to the CBs a/c since the CB is paying the Stamp Duty and not to ask for NOC from the Importer.

3. Stamp Duty portal i.e. GRAS system was not working and Members were unable to make stamp duty payments
for import shipments arrived at all ports due to which members could not take delivery of their consignments.
Association escalated the matter to GRAS authorities and the issue was resolved.

4. The day to day issues of Stamp Duty of our Members were addressed and resolved successfully.

Liasioning with State Government

This Committee is chaired by President, Mr. Karunakar Shetty.

BCBA had represented the law and order issues with the Asstt.Commissioner of Police,
Port Division, Nhava Sheva. On the request of the Association, Asstt.Commissioner
of Police formed a Co-ordination Committee and invited BCBA to attend meetings at
Nhava Sheva. BCBA Managing Committee members attended two meetings wherein

Mr. Kiran Rambhia, Sr. Vice President is incharge of Disciplinary Committee.

The Committee’s aim is to safeguard the members from the dispute arising between
the Custom Broker and their Client.
Few members had approached the Association to seek guidance and intervention
to solve the dispute with their client. This Committee is handling the issue and the
same are under positive process.
Few cases were reported to the Association between Shipping and members
which were resolved by this Committee
BCBA would like to advise its members to have a proper signed contract in place
before accepting the business of Importer/Exporter in order to safe guard their
payments, statutory and operational obligations.

It is a matter of great satisfaction that members are more vigilant and the number
of complaints being received have reduced.

Tax & Policy Review Committee

This committee is chaired by Vice President, Mr. Dushyant Mulani with able guidance
of President Mr. Karunakar Shetty Implementation of GST has now progressed to
consolidation phase in our country. The Association has been representing issues faced
by member in GST with Authorities on regular basis.
