The most common contraventions of the
Employment Standards Act are:
Failure to pay wages within the time period required when employ‐
ment is terminated (Section 18 of the Employment Standards Act)
Failure to produce or deliver records to the Director of Employment
Standards (or delegate) when requested (Section 46 of the Employ‐
ment Standards Regulation)
Failure to pay wages at least semi‐monthly and/or within eight
days after the end of the pay period (Section 17 of the ESA)
Failure to meet the liability(ies) associated with length of service at
termination (Section 63 of the ESA)
Failure to pay overtime, or to pay it correctly (Section 40 of the ESA)
