รายงานประจำปี ปีงบประมาณ พ.ศ. 2567 156 สำ นักงานอัยการสูงสุดAn Introduction to the Office of the Attorney GeneralBackgroundThe Office of the Attorney General (OAG) is the state attorney organ under the Constitutionof the Kingdom of Thailand 2017, Section 248. The Office of the Attorney General authority hasthree main functions : the works of criminal justice administrative, government interest protectionand public interest representation to service people. In 2024, there are 4,255 public prosecutors and 6,580 administrative officials.Authorities and FunctionsThe authority and functions of the Office of the Attorney General can be classified into three main parts, as follows:1. Criminal Justice AdministrationThis is to conduct criminal prosecution to protect state and public as well as to defendinnocent government officials who have been charged with criminal cases relating to the lawful performance of their duties. OAG a lso takes active role in international cooperation and plays a leading role in extradition. And mutual legal assistance in criminal matters (MLA) Under the Act on Mutual Assistance in Criminal Matters B.E. 2535, and the Extradition Act B.E. 2551, the Attorney General or the person designated by him is the “ Central Authority ” of Thailand.2. Government Interests ProtectionThis is to render legal opinions to government agencies and state enterprises as well as to review draft contracts both domestic and international, between private entities and government agencies or state enterprises. Furthermore, OAG is charged with the power to handle civil cases whereby the government agencies or state enterprises are parties.3. Public Interests RepresentationThis is to disseminate legal knowledge to the public in the fields of democracy, human rights, environment and other laws. These functions have been carried out both by personal instruction method and through mass media such as television, radio, and newspapers. In addition, OAG also renders legal aid to the poor and needy people, for example assisting them in lawsuits and conciliation process.The authorities and functions of the Office of the Attorney General will be continuously developed in order to effectively fulfill the role of the guardian of the law and the protector of public interests, especially with a view to coping with this new era of globalization and technological advance.

Around 14th to 18th centuries, at the Ayuthaya period, the King designated the new position named “Yok-Kra Bat”. “Yok-Kra Bat” acted as a judge in conjunction with the provincial governor. The role of “Yok-Kra Bat” was similar to the Prosecutor General in France according to the writing of M.de Lalubere, the French Ambassador under the mission of King Louis’ XIV who came to Ayuthaya in the reign of King Narai.In 1916 the name of “Yok-Kra-Bat” was changed to “Ai-Ya-Karn” by the Royal Decree of King Rama VI during the Rattanakosin period. For Thai language, public prosecutor is called “Ai-Ya-Karn”. In past, the public prosecutor worked at Public Prosecution Department under the Ministry of Justice. Later, the enforcement of the Constitution of Thailand was promulgated on 24th August B.E. 2550, Section 255 defined the new status of the Office of the Attorney General as the independent organization. Public prosecutors have powers and duties as provided in the Constitution and the law on powers and duties of public prosecutors and other laws. Public prosecutors are independent in considering and making order of cases as well as in performing duties fairly. The Office of the Attorney General has a secretariat with autonomy in personnel administration, budget and other activities, of which the superintendent is the Attorney General.Nowadays, the Office of the Attorney General is the state attorney organ under the Constitution of the Kingdom of Thailand 2017, Section 248.
