Decisions

Article 1: Allow PRECISE ELECTRIC MANUFACTURING (CAMBODIA) COMPANY

LIMITED., represented by Mr. WIDHOON, CHIAMCHITTRONG, Thai nationality, holding passport

number AB1536086 issued on 27 June 2018, to establish a factory for Transformer Manufacturing and

Switchboard Assembly located at Tor Teng Village, Anlong Tnoat Commune, Krakor District, Pursat

Province.

Article 2: The factory owner shall install the factory signboard as stated in Article 18 of the Law on

the Amendment of Law on the Management of Factory and Handicraft and as determined in the instruction

on the naming of factory and handicraft.

Article 3: All arrangements in the factory shall comply with Article 4 of the Law on the Amendment

of Law on the Management of Factory and Handicraft, the machinery layout plan filed with the MISTI and

other technical regulations set by the MISTI.

Article 4: Before starting the factory operation, the factory owner shall inform the MISTI at least 15

(fifteen) days in advance and request for the Certificate for Factory Operation which is valid for 3 (three)

years from the MISTI.

Article 5: The factory owner shall display the Prakas on the Opening of Factory, Certificate for

Factory Operation and other approval letters in the factory, where they can be seen easily in accordance

with Article 16 of the Law on the Management of Factory and Handicraft.

Article 6: The factory owner shall request for approval from the MISTI on the change of address,

production expansion, branch opening, change of factory’s name, addition of new product(s) and change

of factory owner in accordance with Article 12 of the Law on the Management of Factory and Handicraft

and Articles 13 and 18 of the Law on the Amendment of the Law on the Management of Factory and

Handicraft.

Article 7: The factory owner shall manage the factory by him/herself. In case of authorizing a third

party to manage the factory on his/her behalf, the factory owner shall notify in writing to the MISTI. In this

case, the factory owner shall be responsible for all operations of the factory and its product quality before

the law and its customers in accordance with Article 5 of the Law on the Management of Factory and

Handicraft.

Article 8: The factory owner shall provide accurately and regularly the monthly data and report to

the General Department of Industry in the first week of the following month, with the form determined by

the MISTI in accordance with Article 19 of the Law on the Amendment of the Law on the Management of

Factory and Handicraft.

Article 9: The factory owner shall be responsible in managing all types of industrial wastes and

industrial security in accordance with Chapter 3 of the Law on the Management of Factory and Handicraft

and the Law on the Amendment of the Law on the Management of Factory and Handicraft.

Article 10: The factory owner shall cooperate with the competent official of the MISTI in conducting
the inspection in accordance with Article 37 of the Law on the Amendment of the Law on the Management
of Factory and Handicraft effectively.

The factory owner shall report to the MISTI as soon as possible for any changes of risk level, or any force
majeure, which seriously affect the factory’s usual operation in accordance with Article 41 of the Law on
the Amendment of the Law on the Management of Factory and Handicraft.

Article 11: The factory owner shall notify in writing to the MISTI at least 1 (one) month before its
final ceasing of operation. In case the factory ceases its operation for 12 months or does not provide the
monthly data and report for 3 (three) months continuously, this will be considered as the final ceasing of
operation in accordance with Article 15 of the Law on the Amendment of the Law on the Management of
Factory and Handicraft.

Article 12: Any conditions in this Prakas are subject to change or amendment in accordance with the
Law on the Management of Factory and Handicraft and the Law on the Amendment of the Law on the
Management of Factory and Handicraft. This Prakas can be revoked according to the Article 39 of Law on
the Amendment of the Law on the Management of Factory and Handicraft and other conditions stated in
this Prakas.

Article 13: The factory owner shall comply with the Law on the Management of Factory and
Handicraft and the Law on the Amendment of the Law on the Management of Factory and Handicraft and
other regulations related to the industrial sector. In case of violation, the factory owner shall be penalized
by the law in force.

Article 14: General Director of Industry, relevant Departments’ Directors, Chief of Pursat Provincial
Department of Industry, Science, Technology & Innovation and the factory owner as stated in the Article
1, shall implement this Prakas accordingly.

Article 15: This Prakas is legally valid from the date of signature.
