PROCEEDINGS OF THE WASHINGTON COUNTY BOARD OF SUPERVISORS MEETING
MONDAY, JUNE 29, 2015

Chairperson Jack Seward, Jr. called the meeting to order at 9:30 a.m. in the Courthouse chambers in regular session.
Items on the agenda were: public hearing regarding County Code of Ordinances; fireworks permit application – Marion
Avenue Baptist Church, Washington; approval for adoption of proposed County Code of Ordinances – first reading;
appointment of miscellaneous commission, board and committee members; acknowledgement of the completion of ER-
C092(86)58-92, Wayland Rd Culvert Extension; personnel change request – Public Health; fireworks permit application
– Fred Witt, Washington; Business Property Tax Credit applications – Assessor; Disabled Veterans Tax Credit –
Assessor; Resolution 15-24 disbursement of county funds – Auditor; Resolution 15-25 for appropriations authorization
for FY 2015-16 – Auditor; Resolution 15-26 designation of assigned funds for FY 2015-16 – Auditor; Resolution 15-27
disbursement of county funds – Auditor; Resolution 15-28 interfund operating transfer – Auditor; Resolution 15-29
interfund operating transfer to Secondary Road Fund – Auditor; Resolution 15-30 Notice of Property Tax Abatement –
Treasurer; FY 2015-16 Rural Solid Waste Disposal contract with Mark’s Sanitation Service; FY 2015-16 lease
agreement with Hillcrest Family Services; designation of Marquetta Huffman as Mental Health Advocate for
Washington County. Supervisors Richard Young, Bob Yoder, and Stan Stoops were also present. Supervisor Abe
Miller was absent.

Others attending were: Sally Hart, KCII Radio; Linda Wenger, Washington Evening Journal; Dan Ehl, Kalona News;
Jeff Garrett, County Treasurer; Jacob Thorius, County Engineer; Danielle Pettit-Majewski, County Public Health
Director; Bobbie Wulf, County Mental Health/Disability Services Director; Sue Rich, County General
Assistance/Veterans Affairs Director; Shawn Showers, County Attorney; Cyndie Sinn, County IT/Budget Director;
Amber Williams, Board of Supervisors Administrative Assistant; and citizens Dennis Stalder, Dawn Jones, and Jeff
Johnston.

All motions were passed unanimously by those supervisors present unless otherwise noted.

On motion by Yoder, seconded by Stoops, the Board voted to approve the agenda as published.

On motion by Young, seconded by Stoops, the Board voted to open a public hearing regarding the Washington County
Code of Ordinances. Auditor Dan Widmer informed the Board that in order for counties to comply with the provisions
of Section 331.302, Code of Iowa, a code of county ordinances must be compiled and maintained. Furthermore, at least
once every five years, the board of supervisors shall compile a code of ordinances containing all of the county
ordinances in effect. Changes to the list of ordinances over the last five years include zoning, election precincts, local
option sales and services tax, floodplain management, parking regulations, and all-terrain and off-road utility vehicles on
County roadways. Widmer stated his office had received no public comment and there was no comment from those
gathered. On motion by Seward, seconded by Stoops, the Board voted to close the public hearing.

On motion by Stoops, seconded by Young, the Board voted to approve, and authorize the Chairperson to sign, an
application for a fireworks permit from Mike Griswold, Washington, on behalf of Marion Avenue Baptist Church,
Washington, for July 1, 2015 from 8:00 p.m. until 10:30 p.m. with no rain date. The display will take place at 2610
Nutmeg Avenue, Washington. Sheriff Jerry Dunbar expressed no objection to the application.

On motion by Young, seconded by Yoder, the Board voted to consider adopting proposed Washington County
Ordinance 15-1 to readopt the existing Code of Ordinances of Washington County, Iowa, as the Code of Ordinances of
Washington County, Iowa, 2015, and to identify this motion as the first reading of proposed Washington County
Ordinance 15-1.

On motion by Seward, seconded by Stoops, the Board voted to make the following appointments:

Jeff Johnston, Crawfordsville, was reappointed to a 3-year term on the Washington County Veterans Affairs
Commission, effective July 1, 2015 to June 30, 2018.

Jim Zieglowsky, Washington, was reappointed to a 5-year term on the Washington City Board of Adjustment, effective
July 1, 2015 to June 30, 2020.

Mardi Knerr, Washington, was appointed to complete an unexpired 5-year term on the Washington City Board of
Adjustment that began July 1, 2014 and will end on June 30, 2019.

Kent Dallmeyer, Washington, was reappointed to a 6-year term on the Washington County Civil Service Commission,
effective August 16, 2015 to August 15, 2021.

Abe Miller, Brighton, was reappointed to a 3-year term on the Washington County Mini Bus Board, effective July 1,
2015 to June 30, 2018.

Andrew Hora of Riverside, Rebecca Bush of Washington, and Karolyn Skubal of Ainsworth, were each appointed to 3-
year terms on the Washington County Land Use and Planning Commission, effective July 21, 2015 to June 30, 2018.

Steve Swaffer, Brighton, was appointed to a 5-year term on the Washington County Land Use and Planning
Commission, effective July 21, 2015 to June 30, 2020.

Teresa Fleming, Kalona, was appointed to a 6-year term on the Kalona Library Board, effective July 1, 2015 to June 30,
2021.

Terri Adam, Wellman, was appointed to a 6-year term on the Wellman Library Board, effective July 1, 2015 to June 30,
2021.

On motion by Young, seconded by Yoder, the Board voted to acknowledge the completion of the Wayland Road culvert
extension project ER-C092(86)58-92 and authorize the Chairperson to sign pertinent documents. This action will enable
final payment to be made to the contractor.

On motion by Yoder, seconded by Young, the Board voted to approve, and authorize the Chairperson to sign, a
personnel change request from Public Health for Susan Mitchell whose employment will end July 8, 2015.

On motion by Young, seconded by Stoops, the Board voted to approve, and authorize the Chairperson to sign, an
application for a fireworks permit from Fred Witt, Washington, for July 4, 2015 from 8:30 p.m. until 11:00 p.m. with no
rain date. The display will take place at 2447 275th Street, Washington. Sheriff Jerry Dunbar expressed no objection to
the application.

On motion by Seward, seconded by Stoops, the Board voted to approve, and authorize the Chairperson to sign, the list of
2014 Business Property Tax Credit applications with the exception of Robert C. and Debra D. Yoder and Washington
County Ambulance.

On motion by Seward, seconded by Stoops, the Board voted to approve, and authorize the Chairperson to sign, an
application for a 2014 Business Property Tax Credit from Robert C. and Debra D. Yoder. The vote on the motion: Aye-
Seward, Stoops, Young; Absent-Miller; Nay-none; Abstain-Yoder.

On motion by Seward, seconded by Yoder, the Board voted to approve, and authorize the Chairperson to sign, an
application for a 2014 Business Property Tax Credit from Washington County Ambulance. The vote on the motion:
Aye-Seward, Stoops, Yoder; Absent-Miller; Nay-none; Abstain-Young.

On motion by Young, seconded by Stoops, the Board voted to approve, and authorize the Chairperson to sign, a
Disabled Veterans Homestead Tax Credit for Thomas Richard Stacy, Washington.

On motion by Yoder, seconded by Stoops, the Board voted by way of roll call vote to approve Resolution 15-24 as
follows and to authorize the Chairperson to sign Resolution 15-24 on behalf of the Board of Supervisors.

RESOLUTION 15-24
FOR DISBURSEMENT OF COUNTY FUNDS

BE IT RESOLVED by the Board of Supervisors of Washington County, Iowa, that funds budgeted for Fiscal Year 2015-2016 for payments listed below shall be
disbursed by the County Auditor to the agencies at the intervals indicated herein:

follows and to authorize the Chairperson to sign Resolution 15-26 on behalf of the Board of Supervisors.

RESOLUTION 15-26
Designation of Assigned Funds for FY 2015-2016

WHEREAS, the Washington County Board of Supervisors acknowledges its responsibility to plan for certain repair projects or equipment purchases, and

WHEREAS, the Board recognizes it is fiscally responsible to allocate across time such monies secured through property taxation for future expenditure on said
projects or purchases, and

WHEREAS, the Board wishes in FY 2015-2016 to designate in the beginning cash balance of the budget the amount of $ 520,685 as assigned capital with the intent
of future expenditure as follows:

On motion by Stoops, seconded by Yoder, the Board voted by way of roll call vote to approve Resolution 15-28 as
follows and to authorize the Chairperson to sign Resolution 15-28 on behalf of the Board of Supervisors.

RESOLUTION 15-28
FOR INTERFUND OPERATING TRANSFER

WHEREAS, it is desired to authorize the County Auditor of Washington County, Iowa to periodically transfer sums from the General Basic and General
Supplemental Funds during the 2015-16 Fiscal Year, and,

WHEREAS, said operating transfers must be in accordance with Section 331.432, Code of Iowa, 1995, as amended, and,

WHEREAS, said operating transfers were budgeted and appropriated in the maximum amount of $177,000 for Fiscal Year 2015-16, and as may be amended from
time to time by the Board of Supervisors.

NOW THEREFORE BE IT RESOLVED by the Board of Supervisors of Washington County, Iowa, that the County Auditor shall order a transfer from the General
Basic and General Supplemental Funds to the Capital Projects Fund at any such times as it is necessary to maintain sufficient balance in the Capital Projects Fund to
accomplish the purposes as contained in the Washington County Budget for the Fiscal Year ending June 30, 2016.

On motion by Seward, seconded by Young, the Board voted by way of roll call vote to approve Resolution 15-29 as
follows and to authorize the Chairperson to sign Resolution 15-29 on behalf of the Board of Supervisors.

RESOLUTION 15-29
INTERFUND OPERATING TRANSFER TO SECONDARY ROAD FUND

WHEREAS, it is desired to authorize the County Auditor of Washington County, Iowa, to periodically transfer sums from the General Basic Fund and the Rural
Services Basic Fund to the Secondary Road Fund during the 2015-2016 Fiscal Year, and,

WHEREAS, said operating transfers must be in accordance with Section 331.432, Code of Iowa, 1995, as amended, and,

WHEREAS, said operating transfers were budgeted and appropriated for Fiscal Year 2015-2016, now

THEREFORE BE IT RESOLVED by the Board of Supervisors of Washington County, Iowa, that:

Section 1. The total maximum, transfer from the General Basic Fund to the Secondary Road Fund for the Fiscal Year beginning July 1, 2015 shall not
exceed the sum of $ 177,207.00; and the total maximum transfer from other Rural Service Basic Fund to the Secondary Road Fund for the
Section 2. Fiscal Year beginning July 1, 2015 shall not exceed the sum of $ 1,796,543.00.
Section 3.
Section 4. Within ten days of being notified of the apportionment of current property taxes, and state replacements against levied property taxes, the
Section 5. General Basic and Rural Services Basic Fund, the County Auditor shall order a transfer from said fund(s) to the Secondary Road Fund.
Section 6.
The amount of the transfer required by Section 2, shall be equal to 4.5651 % of the apportionment of collected property taxes in the General
Basic Fund and 59.5799 % of the tax apportionment of the Rural Services Basic Fund.

Notwithstanding the provisions of Section 2 and 3 of this Resolution, total transfers to the Secondary Road Fund shall not exceed the amounts
specified in Section 1.

Notwithstanding the provisions of Section 2 and 3, the amount of any transfer shall not exceed the available fund balance in the transferring
fund.

The County Auditor is directed to correct the Auditor’s books when said operating transfers are made and to notify the County Treasurer and
County Engineer of the amount of said transfers.

On motion by Young, seconded by Stoops, the Board voted by way of roll call vote to approve Resolution 15-30 as
follows and to authorize the Chairperson to sign Resolution 15-30 on behalf of the Board of Supervisors.

RESOLUTION 15-30
WASHINGTON COUNTY BOARD OF SUPERVISORS

Notice of Property Tax Abatement

WHEREAS, parcel WACWS 11-17-151-008 owned by Francisco J. Leyva and described as a building on leased land was assessed as real estate on January 1st of
2011, 2012, and 2013 (covering the 3-year period from July 1, 2011, through June 30, 2014 – payable in fiscal years 2013, 2014, and 2015), and,

WHEREAS, the Washington County Assessor has determined that the home was removed sometime in calendar year 2013, and,

WHEREAS, the Washington County Treasurer unsuccessfully attempted to obtain a personal judgment because the whereabouts of Francisco J. Leyva are unknown,
and,

WHEREAS, section 445.16 of the Code of Iowa requires the board of supervisors to abate tax, interest, and costs that the county treasurer determines to be
impractical to collect.

NOW BE IT THEREFORE RESOLVED, by the Washington County Board of Supervisors to abate the $90 tax appearing on receipt 317658, $90 tax appearing on
receipt 417689, and $10 tax appearing on receipt 517724 for parcel WACWS 11-17-151-008 as well as any accrued penalty and costs. The county treasurer is hereby
instructed to make adjustments to records as necessary.

On motion by Stoops, seconded by Yoder, the Board voted to approved, and authorize the Chairperson to sign, a
contract with Marks Sanitation, Washington, for rural solid waste disposal. The term of the agreement is for a period of
one (1) year beginning July 1, 2015. The agreement may be extended for one (1) year by mutual consent.

On motion by Yoder, seconded by Stoops, the Board voted to approved, and authorize the Chairperson to sign, a
contract with Hillcrest Family Services (Lessee) for rental of office space at 2175 Lexington Boulevard, Building 2, to
be used by Lessee to provide mental health services. The agreement is for the time period of July 3, 2015 through June
30, 2016, unless a 90-day notice is given by either party. Per the agreement, Lessee agrees to pay $1,810.67 per month
which includes utilities with the exception of telephone and internet access.

On motion by Seward, seconded by Stoops, the Board voted to acknowledge Marquetta Huffman, who has been the
Mental Health Advocate for Washington County, to continue in her capacity of Mental Health Advocate for Washington
County.

At 10:25 a.m. on motion by Young, seconded by Yoder, the Board voted to adjourn.
