Editorial

At the stroke of midnight on 1st July last year, a packed Indian Parliament ushered in
the country's biggest ever tax reform with a bang and ushered in the unified Goods and
Services Tax (GST) which subsumed in it multiple taxes and levies.

GST is a great example of cooperative federalism, where all the States decided to take a
unanimous decision in the interest of the nation, enabling a huge tax reform
implementation.

GST Council which constitutes representatives from all the states, Union Territories
and Centre has so far conducted 27 meetings and it is commendable on their part for
having arrived at the decisions on a consistent basis and with consensus despite the
differences in political philosophy between the political parties in different States.

Under GST, the grant of seamless credit across India has eliminated the cascading
effect of taxes and ushered an era of reduction in the cost of production of commodities
and transparency in the quantum of taxes paid by the supplier of goods and services.

However, post implementation of GST, we saw considerable difficulties faced by
taxpayers, resulting in frustration while filing returns as they were required to file
GST returns on a monthly and annual basis and a complex procedure to file returns
coupled with technical glitches in the GST Network, which made the process a nightmare
for taxpayers and the annual returns filing format is still a work in progress.

The GST law has also introduced the concept of anti-profiteering to ensure that the
benefits of GST are passed on to consumers, which has been a weak link in Indian tax
administration and has left to the market forces to decide what constitutes profiteering
and what is legitimate profiting as there is complete lack of clarity.

The anti-profiteering provision is being taken seriously by industry, as the law has
given adequate machinery to the taxman for penalising defaulters.

The general criticism of GST in India is mainly due to multiple tax rates, selective
denial of input tax credits, multiple returns filing in different States and not providing
businesses enough time for preparedness for GST implementation.

Other distinctive measures such as the reverse charge mechanism and invoice matching
are yet to be implemented and GST Network needs to be further strengthened and
software system should be well tested.

Overall, the Indian taxpayers and the Government have both traversed a difficult and
long terrain for GST in the last one year and one hopes that the journey might get
easier in the years to come as it may take a few years before the country can truly begin
to enjoy the full benefits of GST. It would be a journey which would be worthwhile for
the Indian economy.
