Title Insurance? Title Insurance protects people from losses that happen after they buy real estate. Title insurance agents look for defects in the title that need correction before the landowner sells it to you. Types of Policies What will I pay? What does it cover? TDI sets the title insurance premium rates based on the property’s sale value. This rate includes costs for title examination, closing, and issuing the policy. Unlike traditional insurance policies, you pay a title policy premium once, at the closing of the sale. OWNERS POLICY The owner’s policy protects you from the covered risks listed in the policy and remains in effect as long as you or your heirs own the property. The price of the policy is usually included in closing costs and covers you up to the value of the property at the time you bought the policy. LOAN POLICY The loan policy protects the lender’s interest in the property up to the amount of the principal on your loan and is effective for the life of the loan. www.FairTexasTitle.com Terms in Title Glossary for terms used in Real Estate AMENDMENT: A modification to an existing contract, mutually agreed to by all parties. APPRAISED VALUE: An evaluation of a property’s value based on a given point in time that is performed by a professional appraiser during the mortgage origination process. The appraiser is usually chosen by the lender, but the appraisal is paid for by the borrower. CD/CLOSING DISCLOSURE: A five-page form that provides final details about the mortgage loan you have selected. It includes the loan terms, your projected monthly payments, and how much you will pay in fees and other costs to get your mortgage (closing costs.) CLOSING COSTS: Costs the buyer must pay at the time of the closing in addition to the down payment, which may include points, title charges, credit report fee, document preparation fee, mortgage insurance premium, inspections, appraisals, prepayments for property taxes, deed recording fee, and homeowners insurance. CLOUD ON TITLE: A claim or encumbrance that impairs the title to real property. COMMITMENT: The document by which a title insurer discloses to all parties connected with a particular real estate transaction all the liens, defects, and burdens and obligations that affect the subject property. DEED: A written instrument by which title to land is conveyed. DEED RESTRICTIONS: Limitations in the deed to a property that dictate certain uses that may or may not be made of the property. ESCROW FEE: A fee charged by the title company to service the transaction, to escrow, and cover documents. EARNEST MONEY: Down payment made by a purchaser of real estate as evidence of good faith. EASEMENT: A right to use another person’s real estate for a specific purpose. The most common type of easement is the right to travel over another person’s land, known as a right of way. In addition, property owners commonly grant easements for the placement of utility poles, utility trenches, water lines or sewer lines. HAZARD INSURANCE: Real estate insurance protecting against fire, some natural causes, vandalism, etc. depending upon the policy. HOA ASSESSMENT FEES: Charged by the homeowners association as set out in subdivision restrictions. HOMEOWNERS INSURANCE: Protects the property and contents in case of loss; must be for at least the loan amount or for 80% of the value of improvements, whichever is greater. LEGAL DESCRIPTION: A description of land recognized by law, based on government surveys, spelling out the exact boundaries of the entire piece of land. LEIN: A monetary claim against a property. LOAN TITLE POLICY: Required by the lender to insure that the lender has a valid lien; does not protect the buyer. ORIGINATION FEE: A fee the buyer pays the lender to originate a new loan. OWNER’S TITLE POLICY: Owners title insurance provides protection to the homeowner if someone sues and says they have a claim against the home from before the homeowner purchased it. When you purchase your home, you receive a document most often called a deed, which shows the seller transferred their legal ownership, or title to their home, to you. Title insurance can protect you if someone later sues and says they have a claim against the home from before you purchased it. Common claims come from a previous owners failure to pay taxes or from contractors who say they were not paid for work done on the home before you purchased it. POWER OF ATTORNEY: A written authorization by a person to another person to act for him on his behalf. REALTOR: A real estate broker or an associate who holds active membership in a local real estate board that is affiliated with the National Association of Realtors®. REALTOR FEES: An amount paid to the REALTOR as compensation for his/her services. SURVEY: Confirms lot size and any encroachments or restriction violations.

Once your lender authorizes us to close escrow, we will contact you or your real estate agent with the great news! • How Do I Get My Keys? Your agent will handle the key exchange. Typically, this occurs after your lender allows us to record your transaction. • What You Get in the Mail After Closing After closing you will receive your final Settlement Statement - keep in a safe place for your taxes. Also you will receive your Title Policy and your recorded deed showing you as Owner. Lastly, you will receive a packet of information from your Lender. • Transfer Utilities Before you move in you will want to contact the utility company to transfer utilities into your name. The final bill is not handled in escrow so be sure to work directly with the utility company so you are not billed for those services. • Making Your First Payment You should receive your coupon booklet directly from your Lender in a few weeks. A title commitment is the title company’s promise to insure the property after closing. This document contains the same terms, conditions, and exclusions that will be in the final policy. The commitment is divided into four sections called “schedules.” Below are brief descriptions of each schedule: Schedule A contains basic information, including the effective date, the proposed policy coverage amount, the name of the current record title owner of the property, and a legal description of the property. There may be a problem if the amount, owner, or legal description differs from the contract terms. Likewise, if the effective date is well before the closing, the buyer may wish to request an update to ensure that the information is current. Schedule B lists the standard exceptions that the title policy will not cover. It also lists matters specific to the transaction, including restrictive covenants, easements and rights-of-way, and mineral reservations. Any one of these items may seriously impair the usefulness of the property, so buyers should carefully review Schedule B and copies of any documents referenced there. Some buyers tend to skim over Schedule B. This is a mistake. Schedule C lists the requirements that must be satisfied for the issuance of the title policy. For example, the title company may require information regarding the marital status of one of the parties, copies of records from probates or bankruptcies, clarification of homestead status, or a new or updated survey. You will also find descriptions of mortgages, mechanic’s liens, tax liens, judgments, lawsuits, assessments, and other encumbrances affecting the title. The seller is primarily responsible for resolving exceptions in Schedule C. Schedule D discloses basic information regarding ownership of the underwriter and the title company. Schedule D will also show the total policy premium, and a breakdown indicating how the premium is divided among the various parties who may be responsible for examining title and issuing the policy. HIDDEN COSTS OF Buying Option Money: Option Money is a small amount of money that asks the Seller to hold your home until you get through the option period where you can back out if you would like. During this time most Buyers get a home inspection completed. Option Money should be provided to the Seller and is typically between $100-$250. Earnest Money: Earnest Money is an upfront deposit that later gets applied to your down payment or closing costs. It lets the Seller know you are seriously considering purchasing the home. This money will be sent to the Title Company. The usual amount of the Earnest Money is between 1-2% of the purchase price. Inspection: A Home Inspection will take a few hours and can cost up to $500. This is a very important thing to do as the report will show you what sort of condition the home is in. Down Payment: A Down Payment is the amount of money a buyer pays at closing to fund a home purchase, usually expressed as a percentage of the total home price. The required down payment amount varies depending on the type of loan, ranging from as little as 3% for an FHA loan to more than 20% for some conventional loans. Mortgage insurance is required for borrowers with a down payment of less than 20%. Down payments are usually paid via cashier’s check or wire transfer and must be paid at closing. Closing Costs: Closing Costs include escrow fees, attorney fees, possible survey fees, and document preparation fees. Appraisal: The mortgage company will require an Appraisal before lending on the home. Typically Appraisals are $400-$700. www.FairTexasTitle.com
