story of the compilation the Code of the Tree Great Seals. When we survey
the judicial decisions during this period, we can conclude that the Thai
legal profession had an admirably high degree of judicial sophisti­cation10.
This had a great positive influence on the legal development at the time
Thailand began to receive Western law.

III. Reception of Modern Western Law

Even though some serious doubts have been expressed about the
use of the words “modern” and “tradition” in the study of contemporary
law, I believe that there is no reason to shun such useful terms, for the
modern Western world is an undeniable fact and the aspiration of the
Third World to modernize is also understandable11. The process of legal
modernization of non-Western countries by Western law is truly a serious
problem to us.

1. THE EMERGENCE OF MODERN WESTERN LAW

By modern Western law we mean the legal systems of European
countries in the nineteenth century after a long history of evolution. It first
revealed itself in the legal system of the Romans, and evolved further through
the middle-ages and the Renaissance to the emergence of modern states.
This was inclusively called “the classical era of natural law” by Bodenheimer
(1981:31-33). In the Age of Enlightenment in the eighteenth century the

application of the creative ideas produced in the preceding ages was seen,
as epitomized in the famous French Civil Code, which established the
modern system of law.

It was this modern system which was carried along to the East by
merchants and naval forces. The impression of the modern system on the
Eastern mind was deep and soul-searching. Several superior qualities of the
Western legal system made the Eastern mind feel the necessity of reception.
We shall illustrate briefly some charcteristic points of them.

1. The modern Western legal system was based on the particular
system of jurisprudence originated in the Roman genius, refined by the
Glossator and Post-Glossator Schools, and enriched and rationalized by
eminent jurists of the classical era of natural law. In witnessing the
emergence of legal rationality we may say, in Max Weber’s terminology,
that, with the advent of the nineteenth century, Europe completed the long
process of legal development. The heterogeneous pre-modern law was, by
means of the modern doctrice of natural law and the idea of Enlightenment,
transformed into a really modern law, rational, effcient and humane. The
driving force of this transformation was the jurisprud­ ence of Roman times,
nourished with the developing Western ethos by the legal profession. It is
only in Western culture that the jurist and his craft have enjoyed a place of
honour in society. The jurisprudence developed by the legal profession made
the Western law easier to enforce, teach and furthermore to be implanted
in other countries.

2. The emergence of the modern nation state, with the doctrine of
sovereignty, made it possible for the modern concept of legislation to
become the driving factor in the formulation of law by human authority. As

able to improve their administration more effectively. The society which
had been slowly growing could be reshaped in its various fields in a
relatively short period. The modern Western society was progressive and
full of hope and confidence in the virtue of human legislation.

3. The modern European states developed an effcient administra­tive
and judicial system and expanded their operations into every part of their
territories, however remote form the centre.

4. Since the beginning of the modern period, the idea of liberalism
an individualism led to the reform of private law in accordance with
the principles of equality, the dignity of man, freedom of contract, the
inviola­ble right to property, and others. This further led to rapid progress
in economic life, from poverty without amenities, to affluence. The
individual began to really enjoy freedom and dignity respected by the state.

5. After the traumatic experiences of religious wars, and the
Inquisition from the fifteenth to the seventeenth centuries, Europe was able,
by virtue of its spiritual and intellectual resources, to redeem itself through
a series of enlightened and enlightening reforms, which included the
abolition of the slave trade and cruel punishments. Thus the society and law
in Europe in the nineteenth century became fully rational, humane and
efficient, and totally different from that of previous ages.

In summary, the modern European legal system, accompanied by
mature jurisprudence, was rational and systematic, and easy to impart to
other countries. It was quite reasomable that the non Western countries
received it as a whole, whether voluntarily or not. Nevertheless it should
be understood that a variety of problems occurred in the process of
reception, and are pressing even today in the receiving countries.

2. PROCESS OF RECEPTION

When the independent countries in the East like China, Japan and
Thailand began to feel the pressure of the West, they realized the necessity of
modernizing themselves after Western models. In the moderni­zation process,
they had to face the problem of determining which part and to what extent
of the Western culture, including law, they should receive, as well as what
ot their own culture they should retain. The problem sometimes led to
bitter divisions of opinions in many countries, especially in China and Japan,
where struggles between the conservative and progressive took place. As
each country has cherished certain cultural traditions which its people feel
obliged to retain at all costs, the problem was so much more serious.

After the period of half a century, Japan proved to be the most
successful country, and became counted among the most developed, while
China, even after the great dislocation caused by political, economic and
social upheavals, has still not succeeded in modernization. However, even
in Japan which is said to have completed her modernization, the problems
of reception of Western law and preservation of traditional culture have still
remained. In order to solve the problem, the resounding motto given by one
of the great reform leaders in the last decade of the Manchu Dynasty, Chang
Chi-Tung, “Chinese learning for foundation, Western learning for application”
sound relevant even today. It probalbe represents a common consensus of
the East.

As for Thailand, there were contradicting desires to preserve the
national cultural tradition and at the same time to achieve an enormous
progress. The most important personage representing the both desires was
King Mongkut (1851-68). The King employed his great intellectual capacity

and authority over the people to determine the course of the country. We
are now proud to say that His Majesty succeeded in the task. His philosophy
in this matter was well expressed in his letter to Mrs. Anna H. Leonowens
in 1862, who was invited to Thailand to work as a governess in the Royal
Court for his children.

“...And we hope that in doing your education on us and our children
(whom Englishmen call inhabitants of a benighted land) you will
do your best endeavour for knowledge of English language, science
and literature, and not conversion to Christ­ianity; as the followers
of Buddha are mostly aware of the power­fulness of truth and
virtue, as well as the followers of Christ, and are desirous to have
facility of English language and literature more than new religions.”
(Leonowens, 1870: V-VI).

It is to be noticed that the word “religion” means national culture
in the cultural context of Thailand. The concern to retain national culture
as expressed by the King is agreed to in general as an idea highly beneficial
to Thailand, allowing modernization to proceed smoothly without disruptive
violence. A real modernization was carried out during the reign of King
Rama V (1868-1910). In a German encyclopaedia, Thailand under his reign
was depicted as follows:

“The progressive-minded King created a modern army and navy,
built the railway system, established ocean-going shipping lines,
and turned his kingdom into a modern state in all respects like any
European state without blindly imitating the European institutions.
As such, even though Thailand did not introduce the constitution

or the representative government, it had to be accepted that Thailand
was one of the best governed states in the world, This was because
the King had performed all the moral duties required of him in
accordance with the ideal of an Oriental monarch.” (Ploetz, 1960 :
971)

3. FROM ENGLISH, THROUGH FRENCH, TO GERMAN

LAW

In Thailand, English common law was first received during the
reign of King Rama V. English legal principles were taught in the Law
School of the Ministry of Justice which was established by Prince Rabi,
known as the Father of Thai Law. They were also employed by the Thai
court in adjudicating disputes when considered necessary and suitable. In
practice, the reception of English law was piecemeal, on a case-by-case
basis. The cases where the Thai court could employ English legal princi­ples
were those where traditional Thai law was never found, or was obsolete and
unsuitable in the circumstances. Traditional Thai law as described in the
Code of the Three Great Seals and others still formed the main source of
the Thai legal system.

After about half a century of such reception of English law, at the
end of the reign of King Rama V, an important change occurred in the
development of Thai law. The Thai government decided to create a complete
code by appointing a Legislative Council in 1897 to draft the Criminal Code,
and another in 1909 to draft the Civil and Commercial Code. The completed
Civil and Commercial Code, Part I and Part II, which was drafted by French
legal advisors, was promulgated in 1923. The decision to draft it, and its

the Thai legal system, for it meant altering the model of reception from
English common law, which had been chosen half a century earlier, to
Continental French law, which is strikingly different in juristic methods and
thinking. In fact, it was promulgated to test the reaction of the legal profession
itself. Eventually the Code was repealed two years after its promulgation,
to be replaced by a new one.

The new Civil and Commercial Code, Book I and Book II, was
drafted on the lines of the Japanese Civil Code, which was modelled after
the German Civil Code. Here was another important moment of change, for
the model of the new Code was altered from French to German, which
differed from each other in several important points, although they belonged
to the same Civil Law System12. Its promul­gation in 1925 was at the beginning
of the reign of King Rama VII. The Civil and Commercial Code, Book III
and Book IV, was promulgated in 1928 and 1930 respective­ly. The Civil and
Commercial Code, Book V and Book VI, was promulgated in 1934 in the
reign of King Rama VIII. The Code, completed under the reign of three
successive Kings, was a great edifice of codification, and still valid today13.

4. JURISTIC IMPLICATION OF THE RECEPTION

In connection with the reception process described above, it must
be remarked that one very important aspect of the difference between the

French Civil Code and the German Civil Code was, though rarely noticed,
attributable to the spirit of the age. The French Civil Code was promulgated
at the turning point between the eighteenth and nineteenth centuries, while
the German Civil Code appeared roughly 100 years later. The spirit of the
former was the product of the jurisprudence of the two preceding centuries,
when the great system of natural law was fully developed and embodied in
the Napoleonic Code. Law became an arti­culated, fixed system, with the
emphasis on certainty of the law, that is, the spirit of jus strictum. It meant
that the spirit of jurisprudence became similar to that of the Renaissance.
Law became a machine of logic, ready to be employed by lawyers
indiscriminately. Their only role was to press to button of deductive logic
and to let the machine automatically work out the prearranged conclusion.
Law was in this way divorced from morality.

At the end of the nineteenth century, the pendulum of the legal
spirit had swung the opposite way. The belief in the perfection of the legal
system began to yield to the pursuit of desired purposes and the protection
of individual interests. Natural law with changing content was propagated;
sociological jurisprudence was invited. The sign of the ge pointed clearly
to a new spirit of jus aequum. The German Civil Code included some ideas
of this spirit in its provisions, for instance, on good faith, public order, good
morals, and prohibition of abuse of right (Wang, 1956). A code composed
of such substantial elements may truly be called, to use Roscoe Pound’s
terminoloty, a “maturity of law” (1926: Ch.1).

IV. Conclusion

The reception of Western law in the East in the nineteenth
century meant the reception of legal systems at different stages of development
in a totally different culture. The Eastern countries were not only receiving
new systems of law but also totally new ways of thinking of law, such as
the idea of state sovereignty with its accompanying legislative power.
Receiving those new ideas, the Thais availed themselves of a dynamic
power and instrument of change, and succeeded in transforming their
society and legal system from traditional to modern.

In this process, however, they inadvertently abandoned their
age-old traditional conviction in the immutable law of justice and equity
over which no human law could prevail. It was unfortunate that the
reception occurred in the nineteenth century when the spirit of jus strictum
was dominating the age, with only a little of the spirit of jus aequum
supplemented in later codifications as in the German Civil Code. The Western
positivistic jurisprudence was hurriedly imparted to the East. The spirit of
jus strictum was fortified by an over-confidence in the omnipotence of law
and the fallacy of modern constructivism (cf. Hayek, 1976, I: 14-15). It was
not possible for the new-born legal profession, trained under such a
jurisprudential spirit, to develop a fruiful organic connection between the
received Western law and the indegenous cultural milieu. If we understand
the jurisprudential spirit in legal development in the three main categories
mentioned earlier: Volksrecht, Juristenrecht and Satzungsrecht, and employ
them properly in treating vaious systems of law, it would be possible to
develop a method of interpretation and application of law sufficiently to
take full account of the jurisprudential techniques and cultural backgrounds.

The modern fallacy of the omnipotence of law must be overcome,

and the limitation of law as an instrument of social control must be
recognized. The Thai traditional legal system has the wisdom of the
autonomous legal domain: an area where the written law of the state dare
not tread, for the sensitive and delicate nature of internal relationship is one
with which the rough hand of the law is not appropriate to deal. This, along
with other similar social institutions in the East, is a product of a true
wisdom after many centuries of experience. The wisdom was old in its
origin, but is still relevant to contemporary problems of our society. The
time may be ripe for a new synthesis, and the old wisdom may be put into
its rightful niche with refreshed energies for the future development of
society.
