DEFINITIONS I
Adjuoct CAre: care provided to children whilst a parent remains on the premises.
Service: the child care service provided for parents,
Centre: the facility or sponsoring body which provides the child care service.
C(H)roinator: (Referred to as Director in Child Care Award). The person in charge of a
child care centre who bas responsibility for the day-to-day operation of the centre, whose
duties include-

The licensee shall enSUTe that there is present and on duty with children, the appropriate
number of persons according to the number and age of the children as in the table below
(a) where the majority of children are aged less than three years - in Column 2;

SECTION B: STAFFlNG I
CLAUSE 2
Appropriate staft'
For the purposes of Clause 1, an "appropriate penon" is either:
(a) a service employee, being a person employed by the licensee or by a person acting

employee engaged primarily in cleaning duties.
CLAUSE 3
Notification of staff
The licensee shall, within fourteen days oftbe engagement of a service employee, notify the
Director ofChildrens Day Care Services of that employee's appointment.
CLAUSE 4
Service Co-ordinator
(a) For the pwpose oftbis licence the licensee shalI appoint a service employee to be the
service co-ordinator.
(b) The licensee may appointment himself or herself to be the service co-orcli.nator.
CLAUSE 5
QUaJ..ifiC4tiODS of Co-ordinator
The co-ordinator referred to in Clause 4 must possess either:
(a) a Certificate in Child eire Studies issued by an Australian Institute of Tecbnology
(formerly T.AF.E.), or
(b) such relevant training/experience as the Director of Childrens Day Care Services
considers sufficient for the purpose ofsupervising children at an Adjunct Care Centre.
CLAUSE 6
C<t.qrdinator and ratios
For the purposes ofClause 1 where the number of children present at the centre exceeds
forty. the co-ordinator must Dot be included when calculating statf:child ratios under that
clause unless an office worker/receptionist is present and employed between the hours of
9.00am and 3.00pm.

CLAUSE 7
Absente of co-ordinltor
(a) Ifthe ro-ordirurtor is absent for more tban one week. the licensee Dlllst seek the
approval of tbe Director of Cbildreo.s Day Care Services Section to appoint an acting
co-ordinator.
(b) Notwithstanding CI811se 3 an acting co-<>rdinator under this clause need not posseM
the qualifications referred to in Clause 5, but must be a service employee.
CLAUSE 8
A&e of employees
The licensee shall ensure that for every service employee onder eigbkeD yean of age
there are at leut two employees who have attained the age of eighteen years present in the
centre.
SECTION C: THE MANAGEMENT OF THE CENTRE I
CLAUSE 9
SUoeryisiOD
The licensee shall ensure tha1:
(a) no child is left. without adeqoate supervision,
(b) a minimum of two staft' ( one ofwbom must hold a corrent Fint Aid Certifitate)
is present at all times when children are on the premises to ensure that an emergency
can be h.a.ndJed without leaving the group unsupervised,
(c) ensure that DO staff member is under the influence of drugs or alcohoJ when children
are OD the premises.
CLAUSE 10
Records
The licensee shall ensure that all records required under the Children's Services Act 1986
are accurate and are kept at the centre for a minimum or rIVe yean.
Note: Other agencies may require documents to be retained for longer periods.
CLAUSE 11
Arrival and departure of cbildren
The licensee shall ensure that
(a) the person who brings the child to the centre records in the centre's attendance book
the time of the child's arrival at the centre and signs the record,
(b) the person who receives the child from the centre records in the centre's attendance
book the time of the cbJld's departure from the centre and signs the record.
CLAUSE 12
Written permission
The licensee of the child care centre shall
(a) ensure that except by arrangement with, or by written approval from a parent or
guardian of a child at the centre, that child is not given into the care of a person other
than the one who brought the child to the centre;
(b) permit access by a parent or any person nominated by him or her in writing to that
parent's child at all times.
CLAUSE 13
Identification tags
The licensee shall ensure that an identification tag containing the fonowing information is
attached to each child who does not reguhrly attend the cen~ for the duration of his or
her time at the centre:
• Name of child;
• Name of parent or respolUible person on the prem.is~;
• AgeofchildiaDd
• Any relevant in'formation relating to the bta.lth of that child.
CLAUSE 14 ..1- •
Insurance
The licensee shall

(a) take out and maintain the foUowing policies of insurance in respect of the service and
its operation., namely:
• Worken' compensation;
• Public liability - to cover children in attendance at the service as well 118
members of the public;
• SpeciAl insurance to cover volunteers and roster parents where appropria.t~
and
• Insurance to cover children and staff on amnion!, if applicable.
(b) make available upon request by an officer ofChildrens Day Care Services. the
insurance policies and current premium receipts within a reasonable time,
(c) DOtify the Director of Childrens Day Care Services Section immediately any insurance
lapses for whatever reason.

Presence of parena
The licensee shall not accept a child at the service unless a parent of the child or person
responsible for the child is to be present at the premises to which the service is an adjunct.
CLAUSE 16
ACf lam and regulations
The licensee shall ensure that the service operates in accordance with all Australian Capital
Territory laws and regulations (mcluding, but not limited to, ACT Occupational Health and
Safety Act 1989, ACT Discrimination Act 1991 and relevant industrial awards).
CLAUSE 17
Tenure or licence
The licence hereby granted is not assignabJe by the licensee.
SEcnON c: HEALTH AND SAFETY MEASURES
CLAUSEll
Control of infection
The licensee shaD ensure that aD appropriate measures are taken to minimise the risk of
infection and the spreading of infection within the centre. These measures include but are
not limited to:
(8) refusing adm.issioa ofany child or penon suffering from an infectious illness, disease
Of' condition which might prejudice the health of other children or staff;

(b) displaying. in a prominent place at the centre, the lid of infed:ions illnesses, diseues
and conditions and exclusion periods contained in the I.nfectious Diseases poster,
(c) causing any child or person who appears to be suffering from any infectious illn~
disease or condition, which may prejudice the health of other children or staff to be
isolated and removed from the service as soon as poSSIble;
(d) seeking professiooal health advice from the ACT Board ofHeaJth regarding any
infectious illness persistently occurring in two or more children sharing the same staff
or playroom;
(e) promoting the developmeot of good penoo.. hygiene practices in both staff and
children including thorough handwashing with soap after toileting or changing a
nappy and handwashing before handling any f~
(f) prohibiting smoking in areas where children are being cared for or food is being
prepared;
(g) ensuring that staffiovolved in toileting children pay particular attention to any cuts
or broken skin 00 their hands and arms and protect such cuts and broken skin from
direct contact with body fluids by wearing disposable gloves~
(b) ensuring that all cases of external bleeding are dealt with carefully. (Disposable
gloves must be worn. Hands. lower a.rms and other body parts in contact with or
splashed by blood rmJst be thoroughly washed with soap and water);
(I) providing individual banging space in the bathroom area for a hand towel for each
child or alternatively providing disposable piper towelling for drying hands and a
covered waste disposal bin;
(j) ensuring that effective means for the exclnsion of flies, rodeo~ cockroacbes aDd
dust are provided including fly screening on cot rooms;
(k) carefully disposing of aU waste material with particular attention paid to sealing
contaminated waste in plastic bags. An outside garbage disposal area must be
provided.

CLAUSE 19

The licensee shaD ensure that the area used by the service is kept in a clean and hygienic
condition at aU times. These measures shall include but are Dot limited to:
(a) regular and thorough cleaning of the floors, bathroom area, walls, windows and
blinds;
(b) thorough maintenance of the garden and any saIld pit;
(c) wiping of tables, bench tops and chairs;
(d) ensuring satisfactory heating and ventilation of all areas;
(e) wiping down change bench or table after each nappy change with a diluted solution of
household disinfectant, made fresh daily. (This solution may be kept in a spray bottle
and shall be out of reach of children..)~
(f) washing of toys and equipment;
(g) adei/uaie procedures for cleaning, storing and labelling of individual children's rest
equipment.
CLAUSE 10
Maintenance and repain
The licensee shaD ensure that the area used by the service, both indoors and out, and its
equipment are rnainWned in a safe condition at all times. These measures shall include but
are not limited to ensuring that
~ Indoon
(a) all electriaJ outlets are covered or are of safety type;
(b) all electrical tords are out of reach of'chil~
(c) beating appliances which may be a hazard to cbi1dren have effective protective
barrien around them;
(d) clN.ning IUPpiia and other toxic materia& are stored out ofreach of cbildren;

(e) furniture and equipment is in good repair and suitable for the relevant age group
with rounded comers and free from splinters;
(f) glass at child level is protected by effective guards or is of the approved safety
variety;
(g) consistent with fire regulations, entrances to the centre are to be sufficiently
secure to prevent egress by u:nacrompanied children.
B. Outdoon
(a) the outdoor area referred to in Clause 28 is fenced to a height of 120c.m minimum
on all sides and gates are securely fastened with child-proof catches;
(b) equipment is sized to children's developmentalleve~ properly assembled and in
good repair,
(c) equipment does not have any dangerous parts such as exp<)sed screws or bolts.

CLAUSE 21
FintAid Kit
The licensee shaIJ ensure that a First Aid Kit is maintained on the premises, out of reach of
children. The kit shal1 contain materials as specified in AttAcbment A. These materials
shall be kept in proper condition at all times.
CLAUSE 22
Telepbone
The licensee shaD ensme that there is ready access to a telepbone located within the
premises.

CLAUSE 23

The licensee shall
(a) ensure that every service employee has been adequately instructed in the procedures
t.o be followed in case of fire and that a fire drill is carried out at the centre at least
annually. (Note: It is also importan to ensure that pareou are ![Ware oflhe fire safety
procedures to prevent chaos and confusion in the event of evacuation);
(b) arrange for the annual testing and inspection by an approved Fire Protection Company
of aD fire extinguisbing appliaDtt:4I within the centre~
(c) ensure that the area IlSed by the service is inspected annually and approved by
omcen of tbe ACT Fire Brigade; and
(d) ensure that a Fire Safety Repor1 is done by officers of the ACT rife Brigade before
the centre, or an extension to the centre begins to operate, or before an area not
specified in the current licence is to be used.
SECTION D: THE BUILDING AND FACaITIES
CLAUSE 24
SOlce mJuirements
The licensee shaD provide not less than two square metres o( indoor plsy spa(e for each
child at the centre, together with not less than two point four (2.4) sqOAl"'e metra of cot
spau per cot at the centre.

(a) flooring in material approved by the Director ofChild.rens Day Care Services Section
and free of splinters;
(b) furniture and fittings specifically designed or modified for children's use;
(c) a range ofage-approp.ute indoor and outdoor play equipment available for
regular use by the children.

Sleepiu& Facilities
The licensee shaD provide four separate, age appropriate cots or beds for every multiple of
eight children or part thereof under the age of eigbteen months cared for at the centre for
longer tfutn three boun.. A cbange of sheds must be provided for each cot afteT a child
has slept in it.
CLAUSE 27
Kitchen (acilities
The licensee shall provide a refiigerator, a sink and equipment for beating babies' bottles.
CLAUSE 28
Bathroom and Toilets
The license shall provide
(a) a change area, in or adjacent to the indoor play space referred to in Clause 25,
containing at least one change bench when babies aged up to eighteen months are
being cared for at the centre;
(b) ODe child-sized flub toilet with open- fronted seat for every multiple offrfteen
cbildren or part thereof. (Adult-sized toilets are acceptable and it is recommended
that they have a stable platform approximately twenty centimetres high. fifty
centimetres long and thirty centimetres wide around the base to make them accessib1e
to children).

(c) one band basin and tap or one spray tap and trough for every multiple offifteeo
cbDdreo or part thereof. The handbasin or trough must be approximately sixty
cerrt:imetres above the floor. A bathroom must have Dot less than one hand basin or
spray tap. Adult basins or troughs are acceptable and it is recommended that they
have a stable platform approximately twenty high, fifty centimetres long and thirty
centimetres wide around the base to make them accessJble to children.
CLAUSE 29
Outdoor PtAy Areas
Where from time to time individual children are present at the centre for more than three
houn c.ontinuously, the licensee sh.alI provide an outdoor play area
(a) which cootains Dot less than tbree square metres of play space for each child;
(b) which is property drained so as to avoid standing waters; and
(c) which C<)otains at least two items o( age-appropriatc outdoor equipment.

The licensee shaD ensure there is a balance ofopportunities for activity and rest, indoor and
outdoor play and a variety of play materials and experiences from which the cbiJdren may
select.

for extended periods.

WIth respect to discipline the licensee shall ensure that each child is
(a) guided towards self control and appropriate social skills~
(b) given positive reinforcement for responsible behaviour.
(c) not subjected to, or threatened with any form of corporal puoishment or any
humiliating or frightening techniques;
(d) not kept apart from other cbildreo for extended periods;
(e) oot subjected to having food withbeld as a punishment;
(f) not overly regimented with regard to choice of activities.
