AL Habbai Health, Safety and Environmental regulations contained in
the company manual intended to establish the standard of operation
for construction sites. These regulations have been developed from
international practice.
The Health, Safety and Environment Regulations Manual have been
framed to regulate the working conditions of any workmen working
under all parties involved in construction activities. Each site shall
provide a safe access, egress and safe place of work to all his
employees engaged in construction work to protect them from
accidents, occupational health hazards.

AL Habbai Control’s Policy Statement on Enforcement of Regulations
A. The purpose and method of enforcement:
The ultimate purpose of Al Habbai contracting is to ensure that duty
holders manage and control risks effectively, thus preventing harm.
1. The purpose of enforcement is to:
i. Ensure that duty holders take action to deal immediately with risks.

II. Promote and achieve sustained compliance with their regulations.
2. Al Habbai Contracting has a range of tools at their disposal in seeking
to secure compliance with the regulations. Inspectors may offer duty
holders information and advice, both face to face and in writing. This
may include warning a duty holder that in the opinion of the inspector,
they are failing to comply with the regulations. Where appropriated,
inspectors may also serve improvement and prohibition notices, with-
draw approvals, issue formal cautions.
3. Giving information and advice, issuing improvement or prohibition
notices are the main means which inspectors use to achieve the broad
aim of dealing with serious risks, securing compliance with health and
safety regulations and preventing accidents. A prohibition notices stops
work in order to prevent serious personal injury. Information on improve-
ment and prohibition notices shall be made publicly available.
4. Every improvement notice contains a statement that in the opinion of
an inspector an offence has been committed.

5. Investigating the circumstances encountered during inspection or
following incidents or complaints is essential before taking any enforce-
ment action.

B. The Principles for enforcement of regulations
Al Habbai Contracting believes in strong, fair and effective enforce-
ment of health, safety and environmental regulations. It will follow
the following principles:


1. Proportionally

Proportionality which relating enforcement action to the risks.
I. In practice, applying the principle of proportionality means that
Al Habbai Management shall take particular account of how far
the duty holder has fallen short of what the regulations require
and the extent of the risks to people arising from the breach.
II. Where duty holders must control risks so far is reasonably practi-
cable, Al Habbai Management consider protectively measures
taken by duty holders, shall take account of the degree of risk on
the one hand, and on the other the measures necessary to avert
the risk. Unless it can be shown that there is gross disproportion
between these factors and what the risk is insignificant in relation
to the cost, the duty holder must take measures and incur costs
to reduce the risk.
III. Al Habbai Management will expect relevant good practice to
be followed. Where relevant good practice in particular cases is
not clearly established, health and safety regulations effectively
requires duty holders to establish explicitly the significance of the
risks to the determine what action needs to be taken.
IV. Some irreducible risks may be so serious that they cannot be
permitted irrespective of the consequences.


2. Consistency:
I. Consistency of approach does not mean uniformity. It means
taking a similar approach in similar circumstances to achieve
similar ends.

II. Duty holder managing similar risks expect a consistent approach
from Al Habbai Management in the advice tendered the use of
enforcement notices, approvals and in the response to incident.
III. Al Habbai recognizes that in practice consistency is not a simple
matter. Inspector face with many variable including the degree
of risk, the attitude and competence of management, any
history of incidents or breaches involving the duty holders, previ-
ous enforcement action, and the seriousness of any breach,
which include any potential of actual harm arising from a
breach of regulations. Decisions on enforcement action are
discretionary by the enforcer.
IV. Al Habbai Contracting Shall have arrangement in place to
promote consistency in the exercise of discretion, including
effective arrangements for liaison with other enforcing authori-
ties.

3. Transparency:

I. Transparency means helping duty to understand what is
expected of them and what they should expect from Al
Habbai Management. It also means making clear to duty
holders not only what they have to do but, where this is
relevant, what they don’t. That means distinguishing
between statutory requirement and advice or guidance
about what is desirable but not compulsory.

II. When inspectors offer duty holders information, or advice,
face or in writing, including any warning, inspectors will tell
the duty holder to what to do to comply with regulations,
and explain why. Inspector will, if asked, write to confirm
any advice.

III. In the case of improvement notices the inspector will
discuss the notice and if possible, resolve points of differ-
ence before serving it. The notice will say what needs to be
done, why, by when, and that in the inspector’s opinion a
breach of the regulations has been committed.

IV. In the case of a prohibition notice the notice will explain
why the prohibition is necessary.
