TELEVISION SUBSCRIPTION AGREEMENT: I am
empowered to and do authorize Buckeye
Broadband (Buckeye) to enter the
property listed on the reverse to place
cable equipment and attach such
equipment to any structure. I will
indemnify Buckeye if entry is
unauthorized or if this warranty is
breached. I expressly agree to the
following. 1. I agree to delete all
personal information and data
("Content") from any returned equipment
and to retain all accessories such as
memory and SIM cards, and that Buckeye
has no liability as to Content on
returned devices.. 2.Service is subject
to Terms of Service available at
www.buckeyebroadband.com,including
without limitation those on mandatory
arbitration of disputes, waiver of jury
trial, and prohibition on class
actions. 3.I may terminate services at
any time unless I have entered into a
Residential Service Agreement, which is
subject to an Early Termination Fee. To
terminate service, I must return all
Buckeye equipment and give one day s
notice including the effective date of
termination. 4.Equipment installed to
the ground block is Buckeye property.
Equipment installed between the ground
block and receiver is treated pursuant
to The Cable Television Consumer
Protection and Competition Act of 1992
or superseding law; but if no federal
law applies, this equipment becomes a
fixture and will remain after service
termination. 5. I acknowledge receipt
of equipment listed on the reverse,
which is Buckeye property, may not be
moved to another address, and must be
returned upon demand. If I fail to
return it I am liable for liquidated
damages. 6. I authorize Buckeye to
provide firmware updates and release
Buckeye from liability arising from
such updates. Subject to the Terms of
Service, I may provide my own receiver,
which must be brought to a Buckeye
service center for configuration.
Buckeye does not support equipment it
does not provide. I am liable for
charges or damages if such equipment
malfunctions. 7. Work on interior
wiring must be pursuant to appropriate
technical standards. I will not
interfere with, or attach unauthorized
devices to, Buckeye s equipment or
network. I grant Buckeye access to
inspect and maintain any wiring and
equipment. I AM RESPONSIBLE FOR
PRESERVING, AND WILL NOT TAMPER OR
ALTER, ANY BUCKEYE PROPERTY.
POSSESSION, USE, OR ATTEMPTED USE OF
EQUIPMENT TO RECEIVE SERVICE EXCEPT AS
PROVIDED HEREIN IS ILLEGAL. I AM
RESPONSIBLE FOR ACTS OF PERSONS WHO
RECEIVE OR ATTEMPT TO RECEIVE SERVICE
UNLAWFULLY. VIOLATION OF THIS PARAGRAPH
MAY RESULT IN CIVIL AND/OR CRIMINAL
CHARGES, OR SERVICE TERMINATION
8.Buckeye is not responsible for
programming and is not liable for, and
its obligations are subject to, any
cause beyond Buckeye s reasonable
control including without limit: acts
of God; breakage or breakdown of
equipment; reasonable upgrades and
improvements; and inability to obtain
services or supplies at the normal
costs from normal sources. 9. I WILL
INDEMNIFY BUCKEYE AS TO ALL COSTS,
CLAIMS OR EXPENSES (INCLUDING ATTORNEY
FEES) RELATED TO VIOLATION OF THE TERMS
OF SERVICE. -Services are billed
monthly. Full payment is due as stated
on the bill. Failure to pay may lead to
a late fee and is grounds for
termination of service. To dispute
charges, Buckeye recommends following
the written process outlined in the
Terms of Service. -Unless labeled
otherwise Prepayment is a payment
toward the first billing(s) for
services, not a deposit. If service is
terminated before Prepayment is
applied, the balance will be returned
to me. -I can withhold payment only on
the disputed charges; if undisputed
charges are kept current, Buckeye will
not disconnect service. If Buckeye
determines charges are correct, I may
not continue to withhold payment and I
understand I should consult counsel or
a consumer protection agency if I wish
to continue disputing charges. SEE
