MUJAHEED H. | Land Matters: Strata TitleLAND MATTERSSTRATA TITLEStrata Title is generally for properties in amulti-storey building and the land usuallybelongs to the owners of the property (i.e.developers). Strata Titles are basicallyseparate Individual Titles issued to units ofhouses, apartments or offices within adevelopment that shares common facilitiessuch as gated & guarded communities,security, car parks and facilities governed by a common owner. Under the Strata Title Act1985, developers are required to apply forthe Strata Titles on behalf of the purchasers. A deed of assignment is required to purchase a property or to provide security for loan, forexample, if the deal is a sub-sale, or to givesecurity for a loan. This will transfer therights, interests and title to the owner'sfinancier. When the Strata Title is issued, theperson who owns the property is able to usethe property like how it is used for anIndividual Title.STRATA TITLE?Under the Strata Titles (Amendment) Act2013, strata titles are to be issued uponvacant possession (VP) of the property. Thismeans that homeowners can expect toreceive their strata titles the moment thatthey are informed that vacant possession canbe obtained from the developer and alongwith their keys and other ownershipdocuments can be collected the moment thatthey are informed that vacant possession canbe taken from the developer.WHEN SHOULD THE STRATA TITLE BE ISSUED?Upon issuance of strata titles by the landauthority, the developer shall transfer thetitles to the purchasers within 30 days of thedate of issuance. MUJAHEED H. | Special Studies: DRPLaporan Cadangan Pemaju (LCP) is a technicalreport that explains and justifies a developmentproposal to be submitted by an applicant forplanning permission under section 21A(1) andLayout Plan section 21B of Act 172.The contents of a LCP must follow the provisionsof sections 21A(1) of the Town and CountryPlanning Act 1976 (Act172). The developmentproposal's concept and justification. A locationmap, key plan, site plan and contour plan.Particulars of land ownership and restrictions. Adescription of land including its physicalenvironment, topography, landscape, geology,contours, drainage and natural features on theproposed site. A survey of all existing trees,vegetation and building affected by thedevelopment. A land use analysis and its effecton adjoining land. It is essential that thedocument is well prepared and supported by allthe necessary requirements to ensure speedyapproval. It is therefore essential to plan ahead,in consultation with the LPA, what should beincluded in the document to ensure that theapplication can be dealt with expeditiously.The report consists of a written statement and aplan that aimed to:-Laporan Cadangan Pemaju (LCP)?What is1. describe the present condition of the land;2. describe the proposed development withconsideration on planning matters, such aszoning, planning standards and otherplanning requirements; and3. describe the proposed development and itseffect on the surrounding or the builtenvironment.Laporan Cadangan Pemaju will be one of thereferences in processing the application. Proposed Layout Plan;7. Fundamentals of Consideration. This partexplains aspects that have been givenconsideration to development projectproposals. On top of that, we had given the chance tocollaborate with other specialist consultant suchas Geo-technical Engineer, EnvironmentalConsultant, and Traffic Engineer to work alongwith them in order for me included the specificterm and advise for LCP writing from theirexpertise report such Geo-Technical Report, EIAReport & TIA Report.Moreover, beside obtain advice from the specialistconsultant on the LCP writing for local authorityapproval, in fact as Town Planner, we also givensome advice for the specialist consultant in theirreport writing for respective authority where inEIA report writing, we are giving our advice on theplanning and land matter part in order to assistantthe environmental consultant to complete theirreport for DOE approval. Environmental assessment isnow accepted as an essential part of developmentplanning and management. It should become as familiarand important as economic analysis in project evaluation.The aim of any EIA should be to facilitate sustainabledevelopment. Beneficial environmental effects aremaximized while adverse effects are ameliorated oravoided to the greatest extent possible. EIA will helpselect and design projects, programmes or plans with longterm viability and therefore improve cost effectiveness.It is important that an EIA is not just considered as part ofthe approval process. Volumes of reports produced forsuch a purpose, which are neither read nor acted upon,will devalue the process. The aim of the development is to determineis the road network surrounding a new development is able to support theadditional volume of traffic arising from the increased population and economicactivities in that development.The main functions of TIA study are:-1. To determine the existing traffic condition, future conditions without thedevelopment, and future conditions with the development in place;2. To estimate the traffic likely to be generated by the proposed development;3. To assess the impact of additional traffic on the existing and future roadnetwork system; and4. To identify roadway improvements and changes in the site plan of theproposed development necessary to minimize traffic impact.TIA is a technical appraisal of the traffic impact and safety implications relatingto a development. It is the process of compiling, analysing information on, anddocumenting the effect that a development is likely to have on the operation ofadjacent roads and transport networks. It contains the standardized step-bystep procedure to determine traffic and transport related impacts. Also, to assistdecision makers in reviewing the impacts and improves communication betweenthe different stakeholders involved. This assessment together with the supportof environmental impact assessment, development planning and management,land-use policy and resource consent will provide the vital information andknowledge during making decision for the development applications. The TIAreport convey the findings in the assessment clearly and concisely to provide thedecision makers the needed information. It provides information on theprojected traffic expected from a proposed development and evaluates theimpact of proposed development on the roadways in the immediate proximity ofthe proposed development. The impacts of development interventionstake different forms.
