AN ORDINANCE AMENDING CHAPTER 70 “UTILITIES”, SECTION 70-172
“SERVICE CLASSIFICATION, GS, GENERAL SERVICE, COMMERCIAL

NONDEMAND AND INDUSTRIAL” TO PROVIDE FOR “LOW USAGE” AND “HIGH
USAGE” INDISTRIAL DEMAND CUSTOMER CLASSIFICATIONS, AND SECTION

70-175 “PURCHASED POWER COST ADJUSTMENT CLAUSE” TO CORRECT
TYPOGRAPHICAL ERROR

BE IT HEREBY ENACTED by the Town Council of the Town of Smyrna, a majority
thereof concurring in Council duly met, that the Town Code of the Town of Smyrna be and is
hereby amended as follows:

Section 1. Amend Chapter 70, Section 70-172. Service Classification, GS, General
Service, Commercial Nondemand and Industrial as follows by deleting the strikethrough and
replacing it with the underscored:

(d) Monthly rate. The monthly rate shall be as follows:

(1) Commercial. Non-demand defined as those customers that do not have a
demand meter installed since their monthly energy use has not exceeded
5,000 KWH for two consecutive months during a the immediately preceding
12-month period.

a. Customer charge .....See fee schedule

b. Energy charge: Summer (June through September) .....See fee schedule

Winter (October through May) .....See fee schedule

c. Electric heat/hot water customers on separate meter (October through
May only [grandfathered]) .....See fee schedule

d. Minimum bill for each meter, per month .....See fee schedule

(2) Industrial customers (demand). Low usage Demand industrial customers
means those customers whose energy use exceeds 5,000 kwh but does not
exceed 50,000 kwh for two consecutive months during the immediately
preceding 12-month period. High usage industrial customer means those
customers whose energy exceeds 50,000 kwh for two consecutive months
during the previous 12-month period. The monthly rates shall be as follows:

a.b. High usage industrial customer charge….See fee schedule
b.c. Energy charge, all kwh, per kwh .....See fee schedule
c.d. Demand charge (all kw). The demand charge for all kilowatts shall be

as follows:
1. Summer (June through Sept.) per kw .....See fee schedule
2. Winter (Oct. through May) per kw .....See fee schedule

d.e. Minimum bill for each meter, per month .....See fee schedule
Section 2. Amend Chapter 70, Section 70-175. Purchased Power Cost Adjustment Clause
(PPCAC) as follows by deleting the strikethrough:
PP = The total forecasted purchased power cost for the year, including purchased power

fuel adjustment charges.
Bas = The total purchased power expense per KWH included in the current retail base rates.
e Base = $0.05375 effective March 13, 1992.

Base = $.05 effective May, 1995.
Base = $.045 effective May, 1996.
Base = $.075 effective December, 2005.
Base = $.07686 effective January, 2008.
S Forecasted KWH sold.

SYNOPSIS
This amending ordinance provides for “low usage” and “high usage” industrial demand
classifications and qualifications of each: Low usage industrial customers means those customers
whose energy use exceeds 5,000 kwh but does not exceed 50,000 kwh for two consecutive
months during the immediately preceding 12-month period. High usage industrial customer
means those customers whose energy exceeds 50,000 kwh for two consecutive months during
the previous 12-month period.
