CONDIZIONI DI VENDITA

1) PAGAMENTI: in caso di ritardato pagamento verranno addebitati gli interessi di mora di legge in base al D. LEG. 231/2002 e verranno sospesi gli eventuali ordini in corso.
2) ORDINI: non si accettano ordini inferiori a EURO 500,00. Ogni ordine viene accettato salvo venduto e potrà essere evaso anche parzialmente a seconda delle disponibilità.
Le spese di imballo sono da considerarsi gratuite.
3) SALDI D’ORDINE: il sistema informatico mantiene memorizzata la lista degli articoli inevasi in fase di ordine, e la fa preparare direttamente una volta disponibile con
l’ordine successivo del cliente (o se questo tarda, fa preparare una spedizione con il solo saldo d’ordine). Il cliente che non è interessato a ricevere i saldi degli articoli inevasi
deve darne avviso quanto prima all’azienda.
4) PATTO DI RISERVATO DOMINIO E RISOLUZIONE DEL CONTRATTO: Il compratore acquista la proprietà della merce solo con l’intero pagamento dell’importo I.V.A compresa, e
degli eventuali oneri e spese accessorie.
Le vendite avvengono rispettando il patto del riservato dominio ai sensi dell’art.1523 e seguente del c.c..
L’incompleto pagamento darà diritto al venditore di richiedere la risoluzione del contratto e la restituzione della merce e quanto già pagato resterà acquisito al venditore a
titolo di indennità, salvo il diritto di richiedere il risarcimento per i maggiori danni.
5) PREZZI: sempre e soltanto FRANCO NOSTRO MAGAZZINO di SAN PIETRO IN CASALE (BO).
6) TRASPORTO: il trasporto del materiale potrà essere effettuato in due modi:

6.2). . . . . . . . . . . . . . . . . . . . . . . . . . . In PORTO FRANCO CON ADDEBITO IN FATTURA con corrieri con noi convenzionati. In tal caso la merce é da noi assicurata, ed il costo è
incluso nelle spese di trasporto. E’ responsabilità del cliente notificare sulla lettera di vettura eventuali danni, ammanchi o scondizionamenti dell’imballo.
7) RISERVE: Tutta la merce INVIATA CON CORRIERI CON NOI CONVENZIONATI viaggia assicurata ‘ALL RISKS’, ma per avere il rimborso di eventuali mancanze, danneggiamento
di articoli, etc… al momento della consegna della merce, il cliente dovrà controllare che tutti i cartoni siano integri, e che abbiano il nastro adesivo e la reggetta riportanti
il logo Lineaeffe. Se uno dei due elementi indicati è mancante o è stato danneggiato, significa che il cartone è stato manomesso.
Al momento della consegna, nel caso in cui il cliente riceva pallet filmati con pellicola trasparente o nera, dovrà contare il nr. dei colli e verificarne lo stato in presenza del
corriere che ha effettuato la consegna.
L’ORIGINALE DELLA FATTURA PER LA VERIFICA DEL NR. DEI COLLI E’ CONTENUTO NEL COLLO NR. 1 DELLA SPEDIZIONE.
In caso di anomalie controllando il nr. dei colli e/o lo stato della merce, il cliente dovrà accettare la merce elevando RISERVA INDICANDO L’ANOMALI RISCONTRATA, e non
una riserva generica, la quale non sarà accettata dal corriere e quindi non verrà aperta nessuna pratica di rimborso.
Attenzione: riserve emesse dopo la consegna della merce non valgono nulla e non ci permetteranno di richiedere il rimborso per il danno subito.
IMPORTANTE: LA RISERVA DOVRA’ ESSERE INDICATA SIA NELLA COPIA DEL DOCUMENTO DI TRASPORTO DEL CLIENTE CHE IN QUELLA DEL CORRIERE
8) RECLAMI: non si accettano reclami trascorsi 8 gg. lavorativi dalla consegna della merce. Tuttavia in caso di danneggiamenti provocati dai
corrieri, nulla verrà risarcito in mancanza di riserva sul documento accompagnatorio.
In ogni caso, trascorsi 8 gg. lavorativi dalla consegna della merce non sarà possibile richiedere il rimborso al corriere del materiale mancante o danneggiato. In caso di
riserve il cliente dovrà contattarci immediatamente, fornendoci l’elenco del materiale mancante o danneggiato permettendoci di dare corso alla pratica assicurativa.
Appena riceveremo il rimborso da parte dell’assicurazione, ri-invieremo il materiale o emetteremo nota di accredito a favore del cliente.
9) GARANZIA SUI PRODOTTI: La garanzia sui prodotti acquistati è di 2 anni dalla data della fattura di acquisto LINEAEFFE, come da D.LGS 24/2002 e 206/05 attuativi della
direttiva europea nr. 1999/44/CE.
TUTTI I RESI PER SOSTITUZIONE GARANZIA, OLTRE A VIAGGIARE A VOSTRE SPESE, DOVRANNO ESSERE ACCOMPAGNATI DA COPIA DELLO SCONTRINO DI VENDITA CHE ATTESTI
LA DATA DI VALIDITA’ DELLA GARANZIA. QUESTI RESI SARANNO LAVORATI SOLO UNA VOLTA RICEVUTI E CONTROLLATI IN AZIENDA.
A GARANZIA SCADUTA OGNI RIPARAZIONE O PEZZO DI RICAMBIO SARA’ FATTURATO AL PREZZO ATTUALE DI MERCATO.
10) RESI: non accettiamo resi se non autorizzati. Tutti i resi dovranno essere spediti in PORTO FRANCO a noi.
IN CASO DI RESO PER ACCREDITO DI MERCE SENZA DIFETTI ED IN OTTIMO STATO, ANDREMO A DETRARRE DAL VALORE DELLA NOTA DI ACCREDITO IL COSTO DEL TRASPORTO, SE
LA MERCE CI SARA’ INVIATA IN PORTO ASSEGNATO E NON IN PORTO FRANCO.
Per i resi effettuati dopo l’anno solare dalla data della fattura di acquisto non si potrà richiedere il recupero dell’IVA (DPR 26.10.72 N.633 ART.26).
TUTTI I RESI VERRANNO SVALUTATI DEL 20% PER SPESE DI MOVIMENTAZIONE.
NON SARANNO ACCETTATI RESI E/O RICHIESTE DI ACCREDITO E/O SOSTITUZIONI DI MATERIALE SUPERATI I 2 ANNI DALL’ACQUISTO DEL PRODOTTO.
I resi merce dovranno essere effettuati in cartoni chiusi, ben imballati ed imbancalati, non in cartoni di scarto o fatiscenti, altrimenti saranno rispediti al mittente con
relativo addebito delle spese di trasporto. All’interno del collo del reso dovrà essere presente il documento di reso (DDT) per effettuare il controllo del materiale inviato: sul
DDT di reso dovranno apparire i codici degli articoli e le relative quantità per permetterci un controllo accurato del materiale.
RESI MERCE DOVUTI A DIFFICOLTA’ DI PAGAMENTO: questi resi verranno svalutati del 20%, il costo del trasporto sarà stornato dalla nota di accredito e eventuale materiale
non presente nell’attuale catalogo subirà una ulteriore svalutazione del 10%.
TUTTI GLI ARTICOLI DOVRANNO ESSERE RESI NELLA LORO CONFEZIONE INTEGRA, SENZA ETICHETTE E SENZA PREZZI. NEL CASO NON VENGANO RISPETTATE QUESTE
INDICAZIONI EVENTUALI COSTI DI PULIZIA E RICONFEZIONAMENTO SARANNO ADDEBITATI IN BASE ALLE ORE DI LAVORO PER SISTEMARE L’ARTICOLO.
11) ANNULLAMENTO ORDINE DA PARTE DEL CLIENTE A MERCE PRONTA: in caso di annullamento ordine da parte del cliente a merce pronta, imballata e fattura, nella
spedizione seguente sarà addebitato il costo orario per la ricollocazione degli articoli a magazzino.
12) RIPARAZIONI E RICAMBI: Eventuali piccole riparazioni sugli articoli resi saranno da noi effettuate e l’articolo verrà rispedito al cliente con l’ordine successivo.
Le riparazioni richieste su prodotti danneggiati a causa di un errato uso dell’articolo saranno da noi effettuate ed addebitate in base ai ns. costi.
Eventuali ordini di soli ricambi fatti dopo l’invio dell’ordine di merce saranno inviati con relativo addebito di trasporto e di tutte le spese.
13) CONTROVERSIE: in caso di contestazione la legge applicata è quella italiana. Il foro competente è quello di BOLOGNA.

TERMS OF SALE

1) PAYMENTS: in case of late payment we shall debit interests on arrears based upon Italian law by decree n.231/2002, and all pending orders waiting for the delivery will
be stopped.
2) ORDERS: we cannot accept orders below EURO 500,00 each order is accepted based upon existing goods availability and partial deliveries are authorized in
consequence of available stock – cartons are free of charge.
3) DELIVERY OF THE PENDING ORDERS: our system keeps stored the list of the items not delivered together with the main order, and arrange the delivery of these items
together with the next order of the customer (or, it will organize a delivery of these items only if the new order will delay). The customer who is not interested in getting
the back orders has to inform the company immediately.
4) RETENTATION OF TITLE and THE CANCELLATION OF THE CONTRACT: The buyer will purchase the goods property only after full payment of total amount including VAT and
additional costs and fees. Lineaeffe sales are made under respect of retention of title, ref. art. 1523 Italian Civil Code. The incomplete payment will give Lineaeffe the right
to ask for the cancellation of the contract and restitution of all goods.
Partial payments already made will be kept by Lineaeffe as compensation, given its right to apply for refunds of other fees.
5) PRICES: always and only: FREE (FRANCO) OUR WAREHOUSE S.PIETRO IN CASALE (BO).
6) TRANSPORT: we advice customers to use their own forwarding agents and paying transport collect. Goods will travel at customer risk.
In case we pre-pay transport with our forwarding agents amount will be debited on invoice and goods always travel insured ALL RISKS, and the costs are included on
transport fees. The customer should notify on the delivery note damages shortages and breakages.
7) NOTIFICATIONS AFTER THE DELIVERIES: As said, all goods travel insured ALL RISKS but to get the refund in case of shortages or damaged
goods. At the delivery the customer has to check that all cartons are closed with our tape and our strap (both of them have Lineaeffe logo on). If
one of these two elements is missing or damaged, it means that the goods have been tampered with.
At the delivery, in case the customer receives pallets covered by a transparent or black film, he has to count all the cartons and verify them together with the driver that
arranged the delivery.
THE ORIGINAL OF THE INVOICE TO VERIFY THE CARTONS NUMBER IS INSIDE CARTON NR. 1 OF THE DELIVERY.
In case of anomalies the customer has to accept the goods but in the same time has to INDICATE ON THE DELIVERY NOTE THE PROBLEM HE FOUND and not making a generic
reserve, because it will not be accepted by the forwarder and for this reason we will not obtain the refund for the problematic goods.
Important: Notification on the customer’s copy of the delivery note done after the delivery of the goods are not valid with it, we will not be able to ask for the refund to
the forwarder.
IMPORTANT: THE NOTIFICATION MUST BE INDICATED BOTH ON THE COPY OF THE CUSTOMER AND ON THE COPY OF COURIER.
8) CLAIMS: we cannot accept claims after 8 working days from customer’s receipt of goods. Damages, breakages, losses, created by forwarding agents must be notified to
the forwarding agents on copy of the travelling documents and sent to us by fax.
Anyway, after 8 working days from the delivery of the goods it will be not possible to ask for the refund for shortages or damaged goods to the forwarder. In case of
notifications on the delivery note, the customer has to contact us immediately, with the list of missing or damaged items, to be able to open an insurance practice with the
forwarder. As soon as we get the refund from the forwarder, we will deliver the goods again to the customer or we will issue the credit note.
9) WARRANTY: The warranty on the purchased products is 2 years from the date of the invoice issued by Lineaeffe, as per the D.LGS 24/2002 and and 206/05 effecting the
European Directive nr. 1999/44/CE.
ALL RETURNS FOR WARRANTY REPLACEMENT, IN ADDITION TO TRAVELING AT YOUR EXPENSES, MUST BE ACCOMPANIED BY A COPY OF THE SALES RECEIPT WHICH CERTIFIES
THE VALIDITY DATE OF THE WARRANTY. THESE RETURNS WILL ONLY BE WORKED ONCE RECEIVED AND CHECKED IN THE COMPANY.
FOR EXPIRED WARRANTY EVERY REPAIR OR SPARE PART WILL BE INVOICED AT THE CURRENT MARKET PRICE.
10) RETURNS: cannot be accepted unless clearly authorized by us. All returns are to be sent FRANCO our warehouse.
IN CASE OF RETURN FOR CREDIT NOTE OF GOODS WITHOUT PROBLEM, IN PERFECT CONDITIONS, THE TRANSPORT COSTS WILL BE DEDUCTED FROM THE TOTAL AMOUNT OF THE
CREDIT NOTE IN CASE OF DELIVERY WITH TRANSPORT AT OUR CHARGE
For the returns arranged after one year from the date of the invoice, it will not be possible to require the VAT refund (DPR 26.10.72 N.663 ART. 26).
ON THE VALUE OF THE GOODS SENT BACK WE SHALL DEDUCT A 20% FOR HANDLING CHARGES.
AS THE WARRANTY ON THE PRODUCTS IS VALID FOR 2 YEARS (SEE POINT 9) IT CANNOT BE ACCEPTED RETURNS AND/OR REQUEST OF CREDIT NOTE AND/OR SUBSTITUTION OF
GOODS AFTER 2 YEARS FROM THE PURCHASE OF THE PRODUCT.
The returns of the goods must be arranged into well done cartons, well closed, on pallets and not inside defected cartons, otherwise we will return these cartons back to
the customers debiting the transport costs.
Inside the carton the customer has to include the list of the goods he is returning back to us, to be able to check the goods without fail.
RETURNS OF GOODS DUE TO PAYMENT PROBLEMS: on the value of these return of goods we will deduct a 20% for handling charges, and we will deduct the transport costs
from the credit note too. In case of returned items that are not included into the actual catalogue, we will deduct from the value of these items another 10%.
ALL ITEMS MUST BE RETURNED IN THEIR ORIGINAL PACKAGE, WITHOUT LABELS AND WITHOUT PRICES. IF THESE INDICATIONS ARE NOT COMPLIED WITH, CLEANING AND
RE-PACKAGING COSTS WILL BE CHARGED ON THE BASIS OF WORKING HOURS TO PLACE THE ARTICLE.
11) CANCELLATION OF ORDER BY THE CUSTOMER WITH READY GOODS: IN THE EVENT OF CANCELLATION OF ORDER BY THE CUSTOMER FOR READY, PACKED AND BILLED
GOODS, IN THE FOLLOWING SHIPMENT WE WILL CHARG THE HOURLY COST OF THE RECOVERY OF ITEMS IN STOCK.
12) REPARATIONS AND SPARE PARTS: Small reparations on the returned items will be arranged by us and the items will be sent back to the customers together with his
next order. Necessary reparations requested on damaged products due to an improper use of the item will be made by us and charged to the customer according to our
costs. Orders of spare parts only, made after the sending of the main order of goods, will be delivered but with the relative charge of transport costs and all expenses.
13) CONTROVERSIES AND DISPUTES: if there are any objections the law applied is Italian law. The competent court is the court of BOLOGNA.

LINEAEFFE SpA and HOLDING FERRARI Srl CONSTANTLY WORK TO IMPROVE AND TO DEVELOP THEIR OWN PRODUCTS. THEREFORE THEY HAVE THE RIGHT TO MAKE ANY
APPEARANCE, TECHNICAL OR PRICE CHANGEMENT TO ANY OF THE ITEMS SHOWN IN THIS CATALOGUE, WITHOUT PRIOR NOTICE.

CONDITIONS DE VENTE

1) PAYEMENTS : en cas de payements tardif, le client verra débités les intérêts moratoires selon la loi italienne n. 231/2002, et les commandes suspendues seront annulées.
2) COMMANDES : aucune livraison ne sera pas effectuée pour des commandes inférieures à EURO 600,00. Chaque commande sera acceptée sauf vendu et elle pourra être
livrée même partiellement selon la disponibilité des articles. Les frais d’emballage sont gratuites.
3) RESTE À LIVRER : le système automatique tient mémorisé la liste des articles qui n’ont pas étéS livrés avec la commande, et il va l’insérer directement avec la commande
suivante du client. Si cette commande n’arrive pas tout de suite, le système va préparer une livraison avec le seul R.A.L. Si le client n’est pas intéressé à recevoir le reste à
livrer des commandes, il doit le communiquer avec urgence à la maison.
4) RÉSERVE DE PROPRIÉTÉ ET RÉSILIATION DU CONTRAT : le client devient propriétaire de la marchandise seulement au moment où il a terminé complètement le payement
y compris les éventuels TVA et frais accessoires. Les ventes se passent en respectant le pacte de la réserve du propriété selon la loi italienne n° 1523 et suivante. Le
payement incomplet donnera à la maison le droit de demander la résiliation du contrat et la restitution de la marchandise le montant déjà payé restera propriété du
vendeur à titre d’indemnité, sauf le droit de demander une indemnisation pour les dommages. La propriété des marchandises vendue sera transférée à l’acquéreur
seulement au moment où le prix aura été entièrement payé. L’acquéreur s’engage à prendre toutes mesures aux fins de protéger et individualiser les marchandises livrées.
Il est interdit à l’acquéreur d’incorporer, de donner en gage ou de revendre les marchandises vendues jusqu’à ce que le prix n’ait été intégralement payé, sauf autorisation
expresse du vendeur.
5) PRIX : toujours en PORT FRANCO DE CHEZ NOTRE MAGASIN À SAN PIETRO IN CASALE.
6) TRANSPORT : PORT DÛ avec un transporteur de Votre confiance. La marchandise voyage à risque et péril du client. Avec le PORT FRANCO AVEC DÉBIT EN FACTURE avec des
transporteur avec qui Nous avons des conventions. Dans ce cas-là la marchandise est assurée par Nous, et le coût de cette assurance est inclus parmi les frais de transport.
Le client a la responsabilité d’indiquer sur la lettre de voiture des éventuels dommages ou manques de l’emballage.
7) RECLAMATIONS : Toute la marchandise voyage assurée « ALL RISKS », mais pour obtenir le remboursement des éventuels manques ou dommages noté au moment de
la remise le client doit contrôler que tous les cartons soient intègres, et que le ruban adhésif et le feuillard aient le marque LINEAEFFE S.P.A. Si un de ces deux éléments
manque ou est endommagé, cela signifie que le carton a été mainmis. Au moment de la remise, au cas où le client reçoit des palettes avec une pellicule transparente
ou noire, il devra compter le numéro des cartons et en vérifier l’état à la présence du transporteur qui a effectué la remise. L’ORIGINALE DE LA FACTURE POUR LA
VÉRIFICATION DU NUMÉRO SE TROUVE DANS LE COLIS N° 1 DE LA LIVRAISON. En cas d’anomalies notée en contrôlant le numéro des colis et l’état de la marchandise, le
client devra accepter la marchandise AVEC RÉSERVE DU PROBLÈME TROUVÉ, et pas une réserve générique, laquelle ne sera pas acceptée par le transporteur et donc aucun
remboursement ne pourra être effectué. Attention : réserve émise après la remise de la marchandise ne sont pas valables et ne Nous permettrons pas de demander le
remboursement pour le dommage subis.
IMPORTANT : LA RÉSERVE DOIT ÊTRE INDIQUÉE SUR LA COPIE DU DOCUMENT DE TRANSPORT DU CLIENT ET DANS LA COPIE DU COURRIER.
8) RECLAMATIONS : des réclamations reçu après 8 jours à partir de la remise de la marchandise ne seront pas accepté. En tout cas, en concernant des dommages
provoqués par les transporteurs seront remboursé seulement avec une réserve sur le document qui voyage avec la marchandise. Une fois les 8 jours passés, ça ne sera pas
possible de demander le remboursement au transporteur pour le matériel manquant ou endommagé. En cas de réserve, le client doit Nous contacter immédiatement,
en Nous fournissant la liste du matériel manquant ou endommagé, et en Nous permettant de commencer la procédure de remboursement. Dès que Nous recevons le
remboursement de la partie de l’assurance, nous allons envoyer à nouveau le matériel ou bien Nous allons émettre un Avoir à faveur du client.
9) GARANTIE DES PRODUITS : la garantie sur les produits est de deux ans à partir de la date de la facture d’achat LINEAEFFE S.P.A., selon la loi italienne 24/2002 mise en
place par les directives européennes 199/44/CE.
TOUS LES RETOURS POUR LE REMPLACEMENT OU REPARATION EN LA GARANTIE, DOIT VOYAGER À VOS FRAIS, DOIVENT ÊTRE ACCOMPAGNÉS D’UNE COPIE DU REÇU DE VENTE
QUI CERTIFIE LA DATE DE VALIDITÉ DE LA GARANTIE. CES RETOURS NE SERONT PRIS EN CONSIDERATION QUE UNE FOIS REÇUS ET VÉRIFIÉS ICI DANS NOTRE MAISON.
DANS LE CAS QUE LA GARANTIE EST EXPIRÉE CHAQUE RÉPARATION OU PIÈCE DE RECHANGE SERA FACTURÉE AU PRIX DU MARCHÉ ACTUEL.
10) RETOURS : Nous n’acceptons pas de retours s’ils ne sont pas autorisés. Tous les retours devront être livrés à Nous en PORT FRANCO. EN CAS DE RETOUR POUR AVOIR DE
MARCHANDISE SANS DEFECTS ET EN TRES BONNES CONDITIONS, NOUS ALLERONS A DEDUIRE LE VALEUR DU TRANSPORT DU NOTE DE CREDIT, SI LA MARCHANDISE SERA
NOUS ENVOYÉ AVEC TRANSPORT A NOTRE CHARGE ET PAS EN PORTO FRANCO. Pour les retours effectués après l’années solaire de la date de la facture d’achat le client ne
pourra pas demander la récupération du TVA (DPR 26.10.72 N. 663 ART. 26). TOUT LES RETOURS SERONT DÉVALORISÉS DU 20% POUR FRAIS DE MOVIMENTATION. DES
RETOURS OU BIEN DES DEMANDES D’AVOIR ET/OU SUBSTITUTIONS EN GARANTIE NE SERONT PAS PRISES EN CONSIDERATION APRÈS DEUX ANS À PARTIR DE LA DATE DE LA
FACTURE D’ACHAT. Les retours de marchandise devront être effectué dans des colis fermés, bien emballés, et non dans des cartons gravement endommagés, cassés où les
cartons seront re-envoyés au client en lui débitant les frais de transport. À l’intérieur du colis du retour devra être présent le document de retour pour pouvoir
effectuer un contrôle du matériel livré. RETOURS DE MARCHANDISE DÛ À DES DIFFICULTÉES DANS LES PAYEMENTS : ces retours seront dévalorisés du 20%, les frais du
transport seront ristournés de l’avoir et l’éventuel matériel qui n’est plus présent dans Notre actuel catalogue sera dévalorisé ultérieurement du 10%.
TOUS LES ARTICLES DOIVENT ÊTRE RETOURNÉS DANS LEUR IMBALAGE INTÉGRE, SANS ÉTIQUETTES ET SANS PRIX. SI CES INDICATIONS NE SONT PAS RESPECTÉES, LES FRAIS DE
NETTOYAGE ET DE REMBALLAGE SERONT FACTURÉS SUR LA BASE DES HEURES DE TRAVAIL POUR ARREGLER L’ARTICLE.
11) ANNULATION DE COMMANDE PAR LE CLIENT AVEC MARCHANDISE PRÊTE : en cas d’annulation de la commande par le client avec la marchandises prête, emballées et
facturées, à l’expédition suivante sera facturée le coût horaire pour la relocalisation des articles dans l’entrepôt.
12) PRÉPARATION ET RECHANGE : des éventuels petites réparations pour les articles retournés seront effectuées par Nous etl’articles sera envoyé à nouveau au client avec la
commande suivante. Les réparations demandées sur des articles endommagés à cause d’une utilisation erronée seront effectuées par Nous et dument débitées selon nos
couts. Deséventuels commandes uniquement de rechanges envoyées après la livraison de la marchandise seront effectuées avec le
débit du transport et des relatives frais.
13) CONTROVERSIES : en cas de contestations la loi appliquée est celle italienne. Le tribunal compétent est celui de BOULOGNE.

CONDICIONES DE VENTA

1) AGOS: en caso de retraso en el pago serán cobrados los intereses pasivos corrientes según la Ley D.LEG. 231/2002 y
los pedidos pendientes serán bloqueados.
2) PEDIDOS: no se aceptan pedidos de importe inferior a 500.00 EUROS. Todos los pedidos son aceptados excepto vendido y podrá ser entregado parcialmente según
la disponibilidad. Los gastos de embalaje son gratuitos.
3) ARTICULOS PENDIENTES DE ENTREGA: nuestro sistema informático memoriza el listado de los artículos que no han sido enviados en el pedido, y los hace preparar
automáticamente a penas están disponibles junto al siguiente pedido del cliente (en el caso en que éste tarde en realizarse, prepara un solo envío con los artículos
pendientes de entregar). El cliente no quiera recibir los pedidos pendientes de entrega debe comunicarlo a la empresa cuanto antes.
4) PATTO DI RISERVATO DOMINIO (normativa sobre la cesión de la propiedad ) Y RESOLUCIÓN DEL CONTRATO: el comprador adquiere la propiedad de la mercancía solo con
el pago total del importe, I.V.A. incluido (cuando previsto), y de eventuales gastos adicionales. Las ventas se efectúan respetando el PATTO DI RISERVATO DOMINIO según la
ley art. 1523 y siguiente del Código Civil.
El incumplimiento del pago total da derecho al vendedor a pedir la resolución del contrato y la restitución de la mercancía. El importe ya pagado quedará en manos del
vendedor en concepto de indemnización, excepto derecho a pedir resarcimiento por daños mayores.
5) PRECIOS: siempre y solamente FRANCO NUESTRO ALMACÉN de SAN PIETRO IN CASALE (BO)
6) TRANSPORTE: PORTES DEBIDOS con su transportista de confianza . La mercancía viaja bajo su responsabilidad
PORTES PAGADOS CON CARGO EN FACTURA con transportistas asociados con nosotros. En este caso la mercancía viaja asegurada por nosotros, y el coste está incluido en los
gastos de transporte. El cliente tiene la responsabilidad de notificar en el albarán de entrega del transportista eventuales daños, faltas o embalajes dañados.
7) INDICACION DE INCIDENCIA: Toda la mercancía viaja asegurada “ALL RISK” pero para obtener el reembolso de eventuales faltas de mercancía, artículos dañados, etc., el
cliente tendrá que controlar (en el momento de la entrega) que todos los bultos se encuentren en perfecto estado, y que tengan la cinta adhesiva y los precintos con el logo
LINEAEFFE. Si falta uno de estos dos elementos o se encuentra dañado, quiere decir que el bulto ha sido forzado. En el momento de la entrega, en el caso en que el cliente
reciba los palets recubiertos con película transparente o negra, debe contar el número de bultos y verificar su estado en presencia del transportista que ha efectuado la
entrega. EL ORIGINAL DE LA FACTURA/DOCUMENTO DE ENTREGA PARA VERIFICAR EL NUMERO DE BULTOS SE ENCUENTRA EN EL BULTO NR. 1 DEL ENVIO. En el caso en que se
encuentren anomalías controlando el número de bultos y el estado de la mercancía, el cliente tiene que aceptar la mercancía especificando en el documento de entrega la
INCIDENCIA ENCONTRADA (no es suficiente una reclamación genérica, ya que no será aceptada por la empresa de transporte y no da derecho a ningú reembolso). Atención:
las indicaciones de incidencia notificadas después de la entrega de la mercancía no son válidas y no nos permiten pedir un reembolso por el daño sufrido.
IMPORTANTE: LA ANOTACION INDICADA AL TRANSPORTISTA DEBERA ESTAR INDICADA EN LA COPIA DEL DOCUMENTO DE TRANSPORTE DEL CLIENTE Y DEL TRANSPORTISTA.
8) RECLAMACIONES: No se aceptan reclamaciones después de los 8 días laborables de la entrega de la mercancía. En el caso de daños por culpa de los transportistas
no podremos reembolsar nada si no está indicada la INCIDENCIA EN EL DOCUMENTO de entrega. En cualquier caso, después de los 8 días laborables de la entrega de la
mercancía no será posible pedir el reembolso al transportista de la mercancía que falta o que ha sido dañada. En caso de incidencia el cliente tendrá que contactarnos de
inmediato comunicandonos los artículos que faltan o que han sufrido daños para poder iniciar el proceso con la aseguradora. A penas recibiremos el reembolso por parte
de la compañía de seguros volveremos a enviar el material que faltaba o emitiremos documento de abono al cliente.
9) GARANTIA DE LOS PRODUCTOS: La garantía de los productos comprados tiene una duración de 2 años a partir de la fecha de la Factura de compra de Lineaeffe como
indicado en el D. LGS 24/2002 y 206/05 actuativos de la directiva europea. 199/44/CE.
TODAS LAS DEVOLUCIONES PARA SUSTITUCION EN GARANTIA, A PARTE DE SER DEVUELTOS A COSTO DEL CLIENTE, TENDRAN QUE ESTAR ACOMPAÑADAS DEL COMPROBANTE
DE VENTA QUE ACREDITE LA VALIDEZ DE LA GARANTIA. LAS DEVOLUCIONES SERAN PROCESADAS UNA VEZ QUE LA EMPRESA LOS HAYA RECIBIDO Y CONTROLADO. UNA VEZ
QUE LA GARANTIA HAYA EXPIRADO, CUALQUIER REPARACION Y/O REPUESTO SERA FACTURADO AL PRECIO ACTUAL DEL MERCADO.
10) DEVOLUCIONES: no se aceptan devoluciones si no son autorizadas. Todas las devoluciones tendrán que ser enviadas a nosotros con PORTES PAGADOS . Por los artículos
devueltos después del año natural a la fecha de la Factura de compra no será posible pedir la recuperación del IVA (DPR 26.10.72 N. 663 ART. 26).
TODOS LOS ARTICULOS SERAN DESVALORIZADOS DEL 20% POR GASTOS DE MOVIMENTACION.
DADO QUE LA GARANTIA DE LOS PRODUCTOS ES DE DOS ANOS (VER PUNTO 9), NO SERAN ACEPTADAS DEVOLUCIONES Y/O PETICIONES DE ABONO Y/O SUSTITUCIONES DE
ARTICULOS DESPUES DE LOS 2 ANOS DE LA FECHA DE COMPRA DEL PRODUCTO. Las devoluciones tendrán que ser efectuadas en bultos cerrados, bien embalados y en
palets, y no en bultos de descarte o dañados: en este caso tendremos que volverlos al remitente con el consiguiente cobro de gastos de transporte. Dentro del bulto de la
devolucion tendrá que estar el documento de devolución para el control de la mercancía enviada. DEVOLUCIONES DEBIDAS A DIFICULTADES DE PAGO: estas devoluciones
serán desvalorizadas del 20%, los gastos de transporte serán deducidos del documento de abono y si hay material que está descatalogado (con referencia al catálogo en
vigor) serán desvalorizadas de un 10% adicional.
TODOS LOS ARTICULOS TENDRAN QUE SER DEVUELTOS EN LA CONFECCION ORIGINAL, SIN NINGUNA ETIQUETA NI PRECIOS. EN CASO NO VENGA RESPETADA ESTA INDICACION,
LOS POSIBLES COSTOS DE LIMPIEZA Y EMBALAJE SERAN ADEBITADOS EN BASE A LAS HORAS DE TRABAJO EFECTUADAS PARA ARREGLAR EL ARTICULO.
11) ANULACION DEL PEDIDO POR PARTE DEL CILENTE: EN CASO EL CLIENTE DESEE ANULAR EL PEDIDO CUANDO LA MERCANCIA YA SE ENCUENTRA LISTA Y FACTURADA, CON
EL SIGUIENTE PEDIDO, LE SERA COBRADO EL COSTO DEL TIEMPO UTILIZADO EN RECOLOCAR LOS ARTICULOS EN EL ALMACEN.
12) REPARACIONES Y REPUESTOS: Eventuales pequeñas reparaciones en los artículos devueltos serán efectuadas por nosotros y el artículo será de nuevo enviado al cliente
con el pedido siguiente. Las reparaciones solicitadas para los productos dañados por un uso erroneo serán efectuadas y cobradas según nuestros costes. Eventuales pedidos
de solamente repuestos hechos después del envío de la mercancía serán enviados con cargo de transporte y de todos los gastos.
13) DESACUERDOS: en caso de objeción se aplicará la ley italiana. El foro competente es el de Bologna.

Zahlungen: Im Falle von verspäteter Zahlung werden wir Verzugszinsen nach italienischem Recht, n.231/2002, erheben und alle ausstehenden Lieferung an den Kunden
stoppen.
2) Bestellungen: Bestellungen unter einem Warenwert von 500,00 EURO kommen nicht zur Auslieferung. Jede Bestellung wird auf der Grundlage bestehender
Warenverfügbarkeit zusammengestellt und Teillieferungen sind zugelassen – Kartons sind gebührenfrei.
3) Versand: Ware, die nicht in der Hauptlieferung enthalten ist, wird von unserem System erfasst und der nächsten Bestellung hinzugefügt. Sollte sich die neue Bestellung
verzögern, wird die Ware gesondert verschickt. Kunden, die nicht an Rückstandslieferungen interessiert sind, haben dies dem Unternehmen bei Auftragserteilung
unmittelbar mitzuteilen.
4) Eigentumsvorbehalt und Aufhebung des Vertrages: Der Käufer wird erst nach vollständiger Bezahlung der gesamten Rechnungssumme incl. aller anfallenden Kosten für
Transport und Verpackung Eigentümer der Ware. Der Verkäufer behält solange voll umfänglich das Recht auf Eigentumsvorbehalt
5) Preise: Diese gelten immer und ausschließlich ab unserem Lager in S. Pietro in Casale (BO).
6) Transport: Wir bitten unsere Kunden ihre eigenen Spediteure zu nutzen. Das Versandrisiko liegt beim Kunden. Im Falle einer Lieferung durch unsere Spediteure werden
die anfallenden Kosten auf der Kundenrechnung verbucht. Der Versand ist mit allen Risiken versichert. Die Versicherungskosten sind in den Transportkosten inbegriffen.
Der Kunde sollte alle Schäden, Mängel oder Brüche auf dem Versandschein notieren und vom Spediteur gegenzeichnen lassen.
7) Reklamationen nach Erhalt der Lieferung: Nach Punkt 6 sind Lieferungen inkl. aller Risiken versichert. Um einen Versicherungsanspruch beschädigten Ware geltend
machen zu können, muss der Kunde bei Erhalt der Lieferung die Ware auf Schäden kontrollieren und überprüfen. Alle Kartons müssen durch Gurte und Bänder mit dem
Aufdruck Lineaffe verschlossen sein. Sollte einer dieser beiden Voraussetzungen fehlen oder beschädigt sein, wurde die Ware beim Transport manipuliert. Empfängt
der Kunde die Ware auf Paletten, die durch transparente oder schwarze Folie gesichert wurde, muss er die Kartons in Anwesenheit des Spediteurs auf Vollständigkeit
und Schäden überprüfen. Das Original der Rechnung zur Überprüfung der Warenlieferung befindet sich im Karton Nr. 1. Im Falle von offensichtlichen Schäden bzw.
Abweichungen hat der Kunde die Wareannahme so zu bestätigen, dass diese auf dem Frachtschein festgehalten werden, indem die beschädigte Ware/Kartons genau
beschrieben sind. Damit wird die Grundlage für einen Regressanspruch beim Spediteur geschaffen, welche als Voraussetzung für die Transportversicherung unabdingbar
ist. Wichtig: Schadeno.Beldungen auf der Kopie der Frachtpapiere, die nach dem Erhalt der Ware erfolgen, können nicht geltend gemacht werden da der Spediteur hier
nicht in Regress genommen werden kann.
WICHTIG: DIE MELDUNG FÜR DEN SPEDITEUR MUSS IN DER KOPIE DES TRANSPORTDOKUMENTS DES KUNDEN UND DES SPEDITEUR ANGEGEBEN SEIN.
8) Mängelrüge: Fehlende und durch Transport beschädigte Ware muss innerhalb von 8 Werktagen nach Anlieferung schriftlich gerügt werden. Nach Ablauf dieser Frist
können wir keine Reklamation, die durch den Transport entstanden ist, akzeptieren. Durch Spediteure entstandene Schäden, Brüche oder Verluste müssen auf dem
Frachtschein festgehalten und uns per Fax innerhalb 8 Tagen gemeldet werden, da nach Ablauf dieser Frist auch kein Anspruch mehr an den Spediteur gerichtet werden
kann. Im Falle einer Mängelrüge beim Spediteur auf dem Frachtbrief ist der Kunde dazu aufgefordert uns sofort mit der Liste der beschädigten bzw. fehlenden Ware zu
kontaktieren, um einen Versicherungsanspruch gegenüber des Spediteurs geltend machen zu können. Sobald wir die beschädigte Ware vom Spediteur erhalten haben,
werden wir die Ware erneut an den Kunden liefern oder eine Gutschrift ausstellen.
9) Garantie: Die Garantie auf die gekauften Produkte beträgt 2 Jahre ab dem Datum der ausgestellten Rechnung von Lineaffe nach D. LGS 24/2002 und 206/05, wirksam
nach der europäischen Richtlinie Nr. 1999/44/CE.
FÜR DEN GARANTIEAUSTAUSCH, ALLE RÜCKGABEN MÜSSEN MIT DEM KASSENBON BEGLEITEN WERDEN, DER DIE GÜLTIGKEIT DER GARANTIE BESTäTIGT (TRANSPORTKOSTEN
TRAEGT DER KUNDE). RÜCKSENDUNGEN WERDEN NUR EINMAL BEARBEITET, NACHDEM DAS UNTERNEHMEN SIE ERHALTEN UND UEBERPRUEFT HAT. MIT ABGELAUFENER
GARANTIE, WIRD JEDE REAPARATUR ODER JEDES ERSATZTEILE ZUM AKTUELLEN MARKTPREIS ABGERECHNET.
10) Rückgabe: Eine Rücksendung von Ware kann nur nach Rücksprache mit uns erfolgen und muss von uns genehmigt werden. ALLE RUECKSENDUNG VON WARE DIE
KEINE QUALITEAT PROBLEME HAT WERDEN WIR VON DER GUTSCHRIFT DEN TRASPORTKOSTEN ABZUZIHEN (in den faelle die wir den trasporkosten von der rucksendung
bezhalt haben). Alle Retourwaren sind an unser Lager zu senden. Bei einer Warenrückgabe, die ein Jahr nach dem Rechnungsdatum stattfindet, können wir die MwSt.
nach DPR 26.10.72 N.663 Art. 26 nicht erstatten. Außerdem werden 20 % Bearbeitungsgebühr des Warenwertes einbehalten. Nach 2 Jahr vom Einkaufsdatum (gilt der
Rechnungsdatum) werden wir keine Rucksendung und/oder Gutschrift und /oder Austausch des Produkte akzeptieren. Die Warenrücksendung darf nur auf Paletten, in gut
verschlossenen und gesicherten Kartons stattfinden, andernfalls sind wir gezwungen, die Ware an den Kunden zurücksenden und die Transportkosten in Rechnung stellen.
Die Auflistung der zurückgegebenen Waren muss sich innerhalb des Kartons fefinden, um die Ware ohne Schwierigkeiten überprüfen zu können.
Rückgabe bei Zahlungsverzug: Bei Rücksendung der Ware behalten wir uns das Recht vor, eine Bearbeitungsgebühr in Höhe von 20 % und die Transportkosten von der
Gutschrift abzuziehen. Bei einer Rücksendung von Waren, die nicht im aktuellen Katalog enthalten ist, werden wir außerdem weitere 10 % in Abzug bringen.
ALLE ARTIKEL MÜSSEN OHNE ETIKETT ODER PREISE IM ORIGINALPAKET ZURÜCKGEGEBEN WERDEN. FALLS DIESE ANGABE NICHT RESPEKTIERT WIRD, WERDEN DIE KOSTEN
FUER DIE REINIGUNG UND VERPACKUNG BERECHNET AUF DER GRUNDLAGE DER ARBEITSSTUNDEN.
11) STORNIERUNG DER BESTELLUNG: FALLS DER KUNDE DIE BESTELLUNG STORNIERT MOECHTE; UND DIE WARE SCHON ABHOLBEREIT IST; MIT DER NAECHSTEN BESTELLUNG
WERDEN DIE KOSTEN DES LAGERPERSONALS BERECHNET WERDEN.
12) Reparaturen und Ersatzteile: Kleine Reparaturen an den zurückgegebenen Artikeln werden von uns ausgeführt und zusammen mit dem nächsten Auftrag an den
Kunden zurück gesendet. Notwendige Reparaturen an beschädigten Produkten, die auf Grund einer unsachgemäßen Benutzung entstanden sind, werden von uns
ebenfalls durchgeführt und dem Kunden in Rechnung gestellt. Die ausschließliche Bestellung von Ersatzteilen nach der Haupt-Warenlieferung kann nur gegen Berechnung
der entstehenden Aufwendungen für Material, Verpackung und Transport erfolgen.
13) Gerichtsstand bei Rechtsstreitigkeiten: Grundlage für alle Rechtsstreitigkeiten ist das italienischen Recht, wobei der Gerichtsstand BOLOGNA ist.
