Adopt a Planter Program

Have you noticed the attractive trees, shrubs and plants in the large clay planters along U.S.
17-92 in DeBary? The planters are sponsored by your friends, neighbors, civic groups and
businesses in DeBary who have chosen to show their community pride through the City’s
Adopt a Planter Program. The City encourages individuals and organizations to consider
adopting a planter. By working together, we can greatly enhance the city’s appearance for both
residents and visitors.

Answers to the most frequently asked questions about the program are listed below. Please
contact DeBary City Hall at (386) 668-2040 ext. 305 for additional information.

What Is The Purpose of the Program?

The Adopt a Planter Program was established in 2006 as a component element of the City’s
Beautification Plan to enhance the appearance of the US Highway 17-92 in the downtown
area. It is governed by the City’s Streetscape Advisory Committee.

Who Can Adopt a Planter?

Volunteers who may adopt the planters include individuals, families, civic groups, churches,
neighborhood associations, businesses, and other groups.

What is The Sponsor's Responsibility?

It is the responsibility of the sponsor to care for the adopted planter, including the purchase
and placement of plants, weeding, fertilizing, mulching, and watering as necessary.

What is the Adoption Term Commitment?

The sponsorship agreement is for a 24-month period, which may be extended if Streetscape
Advisory Committee determines the appearance of the planter has improved the quality of the
environment.

What Plants Should Be Placed in the Planter?

A list of 46 best suited understory trees, shrubs, grasses, and plants is available at City Hall.

Which Planters Are Available for Adoption?

Generally, if a planter does not have an affixed plaque, it is available for adoption. Contact City
Hall for a complete list of available planters.

Are You Interested in Adopting a Planter?

Please contact City Hall for additional information on the Adopt a Planter Program, including a
complete list of guidelines, suggested plant materials, and an application. All applications are
subject to approval by the City Manager.

ADOPT A PLANTER AGREEMENT

Planter No. Planter location:

To enhance the environment and the appearance of the City of DeBary,

requests permission to become a Planter Sponsor and participate in the Adopt a Planter program. By this

agreement between the City of DeBary and , known as the Planter Sponsor, the

right to maintain a planter is granted as described below:

1. Planter will be maintained under and in accordance with the City of DeBary’s Adopt-A-Planter
conditions attached to this agreement and incorporated herein by reference.

2. The Planter Sponsor shall abide by all regulations relating to the maintenance, safety, and all other
conditions as required by the City regulations for the Adopt-A-Planter program.

3. It is expressly stipulated that this agreement is a license for permissive use only.

4. The Planter Sponsor will, at all times, assume all risk relating to, and indemnify, defend and hold

harmless City of DeBary, its Council, agents, employees and representatives against any and all
claims, lawsuits, losses, damages, responsibility, liability, attorney’s fees, costs and expenses arising

from, allegedly arising from or related to, the exercise or attempted exercise by the Sponsor, its
employees, agents, contractors and representatives, of the Sponsor’s obligations, rights and

privileges in this agreement. This paragraph 4 shall survive termination of this agent.

5. The Planter Sponsor agrees that City of DeBary may terminate this agreement at any time the Planter
Sponsor does not comply with the conditions in this agreement or at any time the City determines
the work is unsafe or causes a conflict with traffic. The City of DeBary reserves the right to revise or
discontinue this program at any time.

6. As to all relationships with the City of DeBary, the Planter Sponsor and all persons performing work

under this agreement shall at all times and for all purposes be independent contractors and not

employees. The Planter Sponsor performing work under this agreement shall have no claim to
workers’ compensation or other employee rights or privileges granted to City of DeBary employees

by operation of law or by City of DeBary.

PROGRAM GUIDELINES

The City of DeBary Adopt a Planter Program is a component of the City’s Beautification Plan to
enhance the aesthetic environment of US Highway 17/92.

This Program establishes a partnership between volunteers, residents and/or businesses, by working
together in the efforts to beautify the City’s main thoroughfare.

Through an adoption, volunteers have the responsibility of purchasing, installing and maintaining flora
in the planter as stipulated in the agreement between the volunteer and the City of DeBary according to
the following guidelines:

1. Only approved volunteers may adopt a planter. Participants must have an approved
application on file through the City of DeBary. Each application is subject to an approval
process; acceptance is not guaranteed. If an application to adopt a planter is approved, the
volunteer shall be known as a Planter Sponsor.

2. Planter Sponsor(s) will enter into an agreement with the City of DeBary for a 24-month
period. At the end of 24 months from the date of the agreement, this period may be extended
if it is a consensus of the City of DeBary’s Streetscape Advisory Committee that the
appearance of the planter has improved the quality of the environment. If the appearance of
the planter does not meet approval by the DeBary Streetscape Advisory Committee, the City
reserves the right to terminate Planter Sponsorship.

3. Commitment by the Planter Sponsor(s) to maintain the planter so the contents are
consistently attractive throughout all seasons of the year.

4. Planter Sponsor(s) is responsible for providing adult supervision for participants who are
seventeen (17) and under.

5. Planter Sponsor is required to maintain adequate drinking water while performing
maintenance on the planter.

6. It is prohibited to possess or consume alcoholic beverages while performing maintenance on
the planter.

7. Planter Sponsor is prohibited from either subcontracting or assigning its duties and
responsibilities to any other group, organization, or individuals.

8. The Adopt a Planter agreement between the City of DeBary and the Planter Sponsor shall
also contain the names of other individuals, if any, who would assist the Planter Sponsor in
the maintenance of the planter and be known as Planter Helpers. Please list any names that
may be helpers; this does not mean that these helpers have to participate.

9. The Planter Sponsor is responsible to ensure all guidelines are followed in the maintenance
of the planter.

10. If the Planter Sponsor makes any changes, such as address or telephone, it is his/her
responsibility to notify the City of DeBary, in a timely manner, with the updated information.

11. The City of DeBary Streetscape Advisory Committee shall be responsible for placing a sign
on the planter with an inscription selected by the Planter Sponsor. Telephone numbers,
addresses or logos are not allowed.

The safety of all Sponsors and Helpers working on planters is very important to all parties and it is
highly recommended the safety precautions listed below be observed.

SAFETY

 Sponsors should have water and a safety kit available at all times.

 Participants should wear appropriate clothing, i.e., bright clothes and hard-soled shoes.

 Each participant must wear a safety vest. Vests are available at City Hall and should be returned
upon conclusion of agreement.

 Where possible, work should be performed from a minimum of two (2) feet from the pavement.
Work is not to be performed from the road surface.

 Horseplay is strictly forbidden.

 Alcoholic beverages or illegal drugs are strictly forbidden while performing maintenance of the
planter.

 Maintenance of planters should be performed only during daylight hours.

 The Planter Sponsor shall have a copy of all the information, telephone numbers and safety
guidelines provided to all participants.
