Among these, themost pressing concern is theClinical Establishments Act (CEA), particularlyClause 5(2)(a), which empowers authoritiesto close a hospital suo motu, without any priorenquiry or an opportunity for the hospitalmanagement to offer an explanation. Thisprovision is clearly against the principles ofnatural justice. In any allegation of breach ofduty, it is imperative that both parties are givenan equal opportunity to be heard before anyverdict is passed.Earlier, enquiry committees includedrepresentatives from both IMA and TNMC.Unfortunately, of late, many JDHS offices haveindeed disheartening to observethat some of our own fraternitytend to change their stance oncethey assume administrativeroles. IMA proposes to take upthis issue on a war footing toensure that the “suo motu”clause is removed and that everyaggrieved hospital is given a fairchance to explain its position.We will also firmly insist thatIMA and TNMC representativesare reinstated in enquirycommittees, as was agreedearlier.Equally concerning is the manner in whichmaternal audits are presently conducted. Theseaudits are often carried out with a preconceivednotion of negligence on the part of the treatingdoctor. The immediate response has frequentlybeen the closure of inpatient services and thedirection to undergo refresher courses orretraining. This approach is extremelydemoralising to an already malignedprofessional. Years of experience and hardearned reputation are questioned in the publicdomain, casting serious doubts on professionalbeen excluding these representatives. It is competence. Local IMAs should insist thatthe police register a case under Act 48 of 2008.At the state level, IMA plans to meet theconcerned authorities and demand immediateregistration of FIRs and filing of charge sheetswithin 48 hours.All office bearers of local branches are urgedto be thoroughly familiar with the provisions ofthis Act. Please be assured that the state officestands firmly behind you to guide, support, andprotect your actions.During this period, I had the opportunity tovisit Perambur (Chennai), Kanchipuram,Meenakshi Madurai, Coimbatore, Erode, andTirunelveli for the installation functions of thosebranches. We strongly demandthat maternal audits be conducted by qualifiedteaching professionals from the same specialtyand that professional associations, including IMAand government associations, be permitted tomonitor the process. It is of utmost urgency thatour organisation engages the government on thiscritical issue without delay.Last year, IMA TNSB filed a petition in theHon’ble High Court seeking details of auditsconducted in relation to CPA cases, with the longterm objective of working towards capping ofcompensation. The High Court has since calledfor data from district courts. The present teamplaces on record its appreciation for the initiativetaken by the previous team and assures that thisimportant work will be carried forward with fullcommitment.In several parts of the state, hospitals andhealthcare providers are increasingly comingunder attack by unscrupulous elements. In thiscontext, IMA TNSB wishes to inform allbranches of the following measures: An Action Committee has been constituted atthe state level, comprising senior leaders and therespective Zonal Vice Presidents. Branches mustimmediately report any emergency situation totheir zonal leader, who should in turn alert thezone coordinators. The state office will be puton immediate alert. Every branch should constitute its own CrisisManagement Committee to respond swiftly toground realities. It is advisable to obtain a writtenrequest from the affected doctor or hospitalbefore initiating action. The committee mustensure complete cooperation from the affectedparty and confirm that no private settlement ortruce is entered into without informing thecommittee. Any such backdoor attempts shouldbe promptly reported to the state office.
