Senthamilpari, State President Mob: 9444408237 imatnsbpresident@gmail com 03 Warning signs for Modern Medical Practice Warning Sign No: 3 Violence on Doctors and Hospitals: Violence in healthcare sectors has nowadays increased manifold. Workplace violence includes physical and non-physical such as psychological violence, intimidation and cyber harassment, among others. Violence against healthcare professionals has potentially destructive social effects. It affects either the health care system or undermines the quality of the work environment, ultimately the situation will adversely impact patient care and safety only. A multifocal approach, encompassing the legislation of central law to take action against violence on health care sectors and its implementation, data collection, training of healthcare workers on handling critically ill patients and communication with attenders, public awareness,is required in order to successfully address the issue of violence against health sector. Warning Sign No: 4 Next Examination: There are two examinations, Level I and level II. Level I exam will be for P.G entrance and to pass M.B.B.S course. MCQS methodology should be followed in the exams which can be acceptable for competitive examinations such as P.G. entrance which would assess the best among the rest. But to pass M.B.B.S minimum acceptable standard is enough. Same exam for both is not acceptable and justifiable. This will force the medical students to go to training centres for the exam and undergo work stress. Next Level II: This is for getting a license to practice after an internship. This exam is not at all required because the students appear for examinations periodically with practical as per the standards prescribed by NMC and also, they have to concentrate on final year subjects with clinical importance (Medicine, Surgery, O&G and Paediatrics). In this situation, imposing them to prepare for another examination with MCQS will put them under more stress and push them towards training centres without concentration on internship. In these circumstances the next exam II should be considered as redundant and to be abolished. IMA headquarters is working on that matter and giving proper representation to the government to bring in necessary modifications in the new education policy. If it is not materialized, we along with young doctors and medical students will be prepared to agitate against the integration of medical systems, mushrooming of medical colleges, violence against healthcare centres and next examination. We had already shown our unity and solidarity in the R to H bill of Rajasthan and won. In all we have to unite and win the above issues to save our future generation and healthcare systems. Dr.P.Giri gave a talk on physicians roll in preparing for the unexpected in CKD patient. The Chairperson was Dr.V.Chiranjeevi. 95 candidates attended the CME. IMA-AMS Quarterly report submitted by Dr.R.Kannan, Chairman, IMA AMS in the State council meeting held in Madurai on 19.03.2023. On 26.03.2023, the third session of IMA-AMS Critical care workshop was conducted at Royal Care Hospital, Coimbatore.The Hands on Workshop was attended by 30 participants. On 27.03.2023, Black Day was observed in support of Rajasthan IMA against Rajasthan Government Draconian Right to Health Bill by IMA AMS. Amemorandum was submitted to District Collector Coimbatore. We are going to start a workshop-LAPIMA, a workshop on Laparoscopy,will be started from 15.04.2023 and conducted 5 sessions in Gateway Hospital, Coimbatore. We are going to start a Workshop-SONIMA, a structured basic Gynecology ultrasound training programme from May 21st 2023. A live hands on sessions of gynecology ultrasound will be conducted with 2 days 8 hour session in a span of 15 days.

The Paramedical institutions are requested to complete the syllabus as per the Curriculum supplied at the earliest and prepare for the exam. They may forward the list of students to the State office by June 17 along with the necessary exam fee and other details. The institutions due for renewal (for the year 2022-23), may not be allowed to write exam, until completed by this month. Hence, they have to contact the State Office/ the officer nominated for the inspection and complete the same at the earliest. The exam will be held in the common exam centres, which will be conducted/ supervised by the branch Presidents and Secretaries of the branches. The Institution heads are requested to provide exam hall if requested, also send your staff as invigilators to the nearest paramedical centres. The Branch Presidents and Secretaries are requested to provide the IMA Halls for the exams to be conducted, also supervise the smooth conduct of examinations. The Principals/Faculties meet 2023 was held on 18.03.2023, where it is decided to have a separate website for IMA TNSB Paramedical Wing, which is in process. The website would provide the details of the courses conducted by IMA TNSB Paramedical Wing. The academic activities would be looked after by the Academic Committee of the Paramedicdal Wing, consists of few Doctors and the few Principals of the Paramedical Institutions. The next Zonal meeting is planned at Hosur for the west zone Paramedical institutions on 28.05.2023. There will be certain sports activities for the west zone students in Erode, before the zonal meeting. The affiliation of Paramedical Courses with Skill Development Council is in process, hoping to get the same at the earliest.

Section 6 of the Medical Termination of Pregnancy. Rules, 2003, reads as follows: (1) A place approved under rule 5 may be inspected by the Chief Medical Officer of the District, as often as may be necessary with aview to verify whether termination of pregnancies is being done therein under safe and hygienic conditions. (2) If the Chief Medical Officer has reason to believe that there has been death of, or injury to, a pregnant woman at the place or that termination of pregnancies is not being done at the place under safe and hygienic conditions, he may call for any information or may seize any article, medicine, ampoule, admission register or other document, maintained, kept or found at the place. (3) The provisions of the Code of Criminal Procedure, 1973 (2 of 1974), relating to seizure, so far as it may, apply to seizure made under sub-rule (2). 10. Above section deals with Inspection. Rule 7 of the Medical Termination of Pregnancy Rules, 2003 deals with the cancellation or suspension of certificate of approval in the event of violation. The Medical Termination of Pregnancy Rules and Act, do not provide the source of power to completely seal the hospital. Admittedly, the petitioner is a medical practitioner and her clinic was establish edunder Tamil Nadu Clinical Establishment Act, 1997, after approval, which is also not disputed. Section 5 of the said Act deals with Suspension or cancellation of registration, which reads as follows: “5. April 2023 been convicted under any of the provisions of this act for three times in the aggregate, the competent authority shall cancel the Certificate of Registration and the clinical establishment shall not be permitted to apply for fresh registration. (1-A) The competent authority may, suo-moto or on complaint, issue a notice to any private clinical establishment to show cause why its registration under this Act should not be suspended or cancelled for the reasons mentioned in the notice. (2) If after giving a reasonable opportunity of being heard to the clinical establishment, the competent authority is satisfied that there has been a breach of any of the provisions of this Act or the rules made there under or the conditions of registration, it may, without prejudice to any other action, that it may take against such Private clinical establishment suspend its registration for such period as it may think fit or cancel its registration: Provided that where the competent authority is of the opinion that it is necessary or expedient so to do in the public interest, it may, for reasons to be recorded in writings suspend the registration of any private clinical establishment without issuing any notice.” 11. On a careful perusal of the above provision makes it clear that the competent authority has power either to cancel or suspend the registration of the clinics. Whereas in this case, the competent authority has not suspended the licence of the hospital. When the statute provides only for suspension or cancellation of licence, without resorting the power available under law, when the clinic was established after approval, the respondent cannot seal the premises without resorting the provisions available under law permanently. As long as the Petitioner is a medical practitioner, her licence has not been cancelled, she is entitled to continue her medical profession. Though she has violated certain provisions of law for which she has been separately prosecuted and in the event she being found guilty, the law will take its own course to punish the Petitioner for such violation. But the question arises in this case is that having initiated the prosecution whether the petitioner still could be deprived of her profession permanently, without resorting any lawful measure as provided in both enactments, either to cancel or to suspend the licence. Having not adopted such procedure, this Court is of the view that, permanent sealing of the premises established after approval will in fact infringe the fundamental right of the person to carry out the profession. 12. Though the learned Additional Public Prosecutor relied upon the Division Bench judgment of this court in W.A.Nos.1758 and 1759 of 2022. The above case is with regard to the temporary suspension of registration of the licence granted to the hospital which was challenged before the Division Bench. The Division Bench after considering the provisions of the Act has held that temporary suspension of the licence of various hospitals committed various violations including extraction of oocyte from the minor girl cannot be set aside. Therefore, the above judgment is not applicable to the fact of this case. But here it is not the case of suspension of registration of licence granted under the Tamil Nadu Private Clinical Establishment Act, 1997. Whereas, the authorities have straightaway sealed the premises. Such thing is not permissible without the source of power under statute. 13. Accordingly, the Order of the Respondent sealing the premises Permanently, is set aside and the Respondents are directed to de-seal the premises forthwith. 14. In the result, the Writ Petition is allowed. No costs.
