Dear Friends, Greetings from IMA TNSB Most of you are aware of the fact that we had an order from our former DGP Dr.C.Shylendrababu. IPS regarding the guidelines to be followed by Police while registering cases of Medico legal Negligence. This news was very much flashed in most of the Newspapers and Television Medias. In his order he stipulated the following guidelines by quoting the reference from Supreme Court, High Court judgments and Government G.O.S. Whenever a compliant of death due to negligence on the part of Medical Practioners is received, the investigating officer should a. Make thorough enquiry and collect all oral and documentary evidences. b. Obtain the opinion of another competent Government doctor preferably from the Medical College Hospital. c. No case would be registered if the expert opinion did not confirm evidence of an offence of causing death due to negligence. d. Obtain Legal opinion of the Public Prosecutor if a criminality under 304(A) is made out with the available evidences as indicated by the expert medical opinion. e. The CoPs and SPs should personally review and weigh the evidences before registration of case. July 2023 03

We have processed and sent almost all the applications received till date to the IMA National Hqrs and you will all be getting the membership certificates from the IMA National Hqrs at the earliest. Wishing everyone a Happy Doctors Day and ours at the State with the Vice Chancellor Dr.K. Narayanasamy as the Chief Guest went on well with a lot of senior doctors being recognized for their service to the fraternity and community. We had very good participation from all over Tamilnadu for the grand event,thanks again to all for the tremendous participation. Almost all the branches are celebrating their Doctors Day Function in grand manner in their districts and congratulations to all the awardees in the Branch and State. There are a lot of Doctors Day Celebrations coming up this month and looking forward to participate in most of them.The application for the MarthuvaNatchachitiramAwards instituted by the Hindu Tamil have been circulated please do apply for the recognition. We have had a lot of interest in the starting of Paramedical Institutions and have already inspected and more than 100 have been recognized for providing the various courses and many more in various stages of accreditation. Congratulations to the State Paramedical Chairman Dr. P. Mannar Mannan, State Paramedical Secretary Dr. Gowrishankar and Dr. K. Thirumavalavan for their amazing work done during the last 1 and half years. An MOU has been signed for accrediting our Paramedical Courses under the National Skill Development Council and looking forward to the accreditation being given at the earliest. The CGP wing led by chairman Dr. P. Sengottuvan, Secretary Dr. Senthil Kumar and the rest of the office Dr. N.R.T.R. Thiagarajan, MD, Hony. State Secretary, IMA TNSB bearers of CGP again Congratulations to the entire team for the tremendous efforts in organizing and arranging for the Hybrid State Conference with distinguished speakers, topics and the active participation of more than 3000 members every day over the 5 day conference. The AMS Wing led by Dr. R. Kannan and Dr. V. Rajesh Babu again with a Hybrid mode had a lot of participation with more than 1000 members participating and congratulations to the entire team for having achieved this level of participation.The State Academic Committee led by Chairman Dr. S. Jayaramanhas again conducted so many CMEs and participation in this has been tremendous with good Speakers and Topics.Most of the CMEs done by our State and Wings and also branches are accredited for providing Credit points by the TamilnaduMedical Council and I am sure that most of your Credit certificates are being received in your respective emails. The work concerning this has become humongous with so much of participation and also programs so if there is any slight delay please put up with us as this work has become again humongous and we are under the process of streamlining the procedures to be adopted for accountability. The various court cases and notices have been appropriately responded to by the state office in consultation with our state Lawyer Adv. Anand David and are being followed in a meticulous manner. I would like to thank Dr. S. Karthik Prabhu and Dr. R. Anburajan and Dr. R. Rengaraj for following up on all issues that we are facing fromthe Hospital side and let’s hope that we can strive together to get to a logical end to these issues. Lot of hospitals have received a notice under the Apprenticeship Act by the Union Government and we have represented to the concerned office and hope to get an early solution to it. A case in the Delhi High Court concerning the appointment of nonmedical i.e.M.Sc in various medical specialities as teachers in Medical Colleges to the Union Government and NMC was objected to and due representation was given recently to the Union Health Minister and NMC that only doctors should be handling the teaching and not non-medical personnel. Again hoping for a favorable outcome. The other representations and problems that we were facing and have given representations are being followed up scrupulously and hoping for a logical end at the earliest. We are happy that the NEXT exams as a qualifying exam for the MBBS, Students who would have been put through undue stress and strain has been put off and suitable orders have been issued by the Union Government and NMC cancelling it indefinitely. The recent office order by our Tamilnadu DGP Dr. C. Sylendra Babu, IAS to the entire Police Department on guidelines to be followed in cases of Medical Negligence is a saviour for all of us in our fraternity as Police high handedness is the rule of the day and these are guidelines already given by the courts but not followed diligently by the police. We thank him wholeheartedly for this office order. Elections for the upcoming term of 2024 to 2025 to the State Office has been announced in this TIMA and please do show the same level of enthusiasm and participation in the elections and the election process and in serving our glorious Association. Please update your electoral rolls and send it at the earliest to the state office.

With 200+ participants, with filled lecture hall & 8+ wonderful workshops, it was a huge success. Big congratulations to the Entire Team MSN and JDN TN. Keep up the same enthusiasm and make our flag fly high among the rest of the state in the country. After the successful conduction of our BOOTCAMP, I met our new VC and explained everything and requested his support to conduct inside Government Medical Colleges. Doctors Day Celebrations: I participated in the IMA TNSB Doctors Day Celebration at Hotel Hyatt, Chennai on 02.07.2023, IMA TNSB honours 60 Doctors with Awards. I have put forth two demands to VC one is about Boot Camp and another is to give a slot to IMA in the foundation course conducted for I year MBBS students. I have participated in Vellore IMA for Doctors Day Celebrations on 16.07.2023 as the Chief guest and spoke on Power of Doctors. HOSPICON 2023: Attended HOSPICON 2023 at Mumbai on 08.07.2023. I also participated in the Nation’s Voice on Next on 13.07.2023, Zoom and I made 3points very clear. 1. Unless we have uniform standards of education and infrastructure in all medical colleges in our country, Uniform examination is not acceptable. 2. Indian medical graduates don’t need licentiate exams as they were selected by NEET and studied in the medical colleges under NMC control. 3. NEXT and PG entrance marks should not be combined. NEET PG should go on separately. Combining both doesn’t have any advantages and it’s a waste exercise. We should oppose NEXT whenever it comes on these grounds. In Minimum Wages still the revision Committee has not started even after sending many representations and meeting the Labour officials. So Meeting our Chief Minister will be making sense. We are happy to inform you all that our NHB’s (South) 130th Zonal Conference & 77th Management Committee & General Body Meeting will be happening at Tirunelveli on August 20th 2023, which is hosted by IMA Tirunelveli. Recently some of Hospitals received a Show cause notice from Board of Apprenticeship Training (Southern Region). When it was brought to our notice, we the Office Bearers of NHB IMA TNSB & Office Bearers of IMA TNSB had a consultation under the leadership of our State President Dr.T.Senthamil Pari. We requested our Legal Advisor Advocate Anand David to guide us in this regard. We also had some talk with the Officials in the Board of Apprenticeship Training (Southern Region) over phone and our Legal Advisor went to their Office in person and collected all the needed information for our perusal. So we like to bring to your notice about the importance of the Apprentices Act and its applicability to us. In India, The Apprentices Act, 1961 was formed with the initiative to provide training to qualified workforce in various trades and promote new skilled manpower. The Act aims to serve as a connector between potential employees and the employer. Our Members should know about the Apprenticeship Acts Applicability, Criteria for Eligibility, period, Stipend & Reimbursement This Act is applicable to the whole of India and to all sectors including manufacturing and service. Establishment having workforce (regular and contract employees) of 30 or more number of workers - shall be mandatory to undertake Apprenticeship Programs in a range from 2.5% -

Eligibility to get registered as apprentices: A person shall not be less than 14 of age, and for designated trades related to hazardous industries, not less than 18 years of age. The period of Apprenticeship shall vary from 6 months to 3 years and there is no obligation on the part of the employer to offer permanent employment at the end of the apprenticeship training. As envisaged under the Act, the apprentices are entitled to a stipend. To claim reimbursement the apprentices engaged under the Act are to be paid full amount of stipend by the employers and later raise a claim on quarterly basis. The claims are generated online. The final examination was conducted in 25 common examination centres with external invigilators. Thanks to the Branch Presidents and Secretaries and the Hospitals heads,who hadarranged the Examination centres. We also thank the Paramedical faculties who had travelled to different places and helped the Paramedical Wing to conduct the exam smoothly. Chairman, Secretary and Joint Secretary of Paramedical Wing were on surprise visit to different examination centres and monitored the examination. Answer sheet corrections are being done at IMA TNSB State Office at Tambaram. The result will be released in August 2023. The admission for 2023-24 is going on. The Paramedical institutions are requested to finish the admission by 31.10.2023. The next academic year2023- 24 will commence on 01-08-2023. Admissions are to be done with the norms of IMA TNSB Paramedical Wing. No alteration in the admission later. Necessary training material will be supplied on receipt of the admission forms. Institutions are requested to start teaching the students, based on the Curriculumbook issued, without waiting for the books from IMA TNSB. As we need to prepare the students for HSSC exams, the high standard of training is expected at every training centre with qualified faculties. The South Zone Sports meet is proposed to held at Virudhunagar on 20.08.2023 (Sunday), it is requested all the South zone institutions toget prepared and take part in large. There will be an Academic Committee meet to discuss various aspects of training programme for the year 2023- 34 shortly. Convocation ceremony also to be planned for the passed-out students. MOU between IMA TNSB Paramedical Wing and HSSC have singed, the outcome would be intimated. There are 19 new intuitions have come forward to join IMA TNSB Paramedical Wing, necessary Inspection/Approvals are in process. 06 intuitions have rejoined into IMA fold again. So for in 29th AFC there has happened 43 deaths till date. Still 227 are yet to pay for 28th AFC. An extended grace period is given for them to pay until Sep 30th 2023. We had a savings account in FSS I AFC. Where we were earning interest to the tune of Rs 1 lakh. But outgo was about Rs.10 lakhs by way of DD commission for an average of 100 deaths per year and 200 DD’s of Rs. 9 lakhs each. This account has since been converted to the current account from now on. (1st July onwards). We need not pay even a single rupee as a DD commission. In this way, we could save around 10 lakhs per year. In FSS II, new membership recruitment in 5th AFC was 34, and total deaths that happened in 5th AFC were 23 and 116 and are yet to pay the 5th AFC They have been given time till Sep 30 to pay up. The 6th AFC payment, both online as well as by DD, has picked up from the 1st of july 2023 , so far around 692 have already paid their dues. Also , I visited the Krishnagiri Branch on May 25 and explained about the benefits of FSS and doubts regarding the Scheme have been explained. Also, on June 9th myself and the Finance Secretary visited the Dharmapuri Branch and explained about the Scheme. I continued to visit Tirupur as well as Rasipuram IMA Branches in subsequent weeks and explain the members about the benefits of the scheme and clear about the doubts regarding the Scheme. We are getting ready for IAC on the 30th July and the Management Committee Meeting on Aug 13th at Thiruvannamalai.

PPLSSS new was 70 (22+19+29) But we outperformed in PPLSSS renewal 584(85+123+376) HPS 12/ compare to 8 in first 3 months FBS 3/ 2 in January to March Highlight is ,we have deposited 45lakhs in PPLSSS and 15 Lakhs in HPS, totally 60 lakhs in FD (in highest interest) from our scheme. Few FDs with nearby renewal date were merged. As usaul, we are weak in FBS. Many FBS claims which were pending due to transit of office andmedicolegal conclave is cleared. There are about 17 cases in whichFIR has be done against our doctors. Our legal team quashed the FIR in 3 cases and they are working out in other cases also. Similarly whenever possible, we are planning to go for defamation suit against the culprit either individual or media. Members should give necessary inputs for these issue. As we know, the DGP’s ORDER on the action of police on doctors in disputes in the treatment of patients really landmark for doctors. First our branch leaders should be aware and insist the local police to follow it in case of crisis. But at the same time,judiciary has increased in award to 1crore at district level. So we should work out a new plan to give more amount by PPLSSS and HPS in case of failure. We hope that everyone accepts it is the change we need in the scheme. Similarly, we need to increase the amount of claim in FBS also. Unless we change in strategy, the scheme will not improve further. Regarding the guest house, particularly in the JVL plaza guest house, we have improved a lot. We worked out a “ROOM BOOKING APP” so that members can know the status ofavailability of rooms and book the room through online. Even though it is to be officially launched by state president, members can try to use it and give feedback to us. Shortly we are planning to implement online payment for PPLSSS, HPS, FBS.
