We have to take more effective steps to see that the membership is growing. Membership is
the energy for any association which is very important. First quarter, we could add 100 members,

our position in the National level, The JDN and MSN are to be strengthened more to have more
membership. On 24.06.2022, there is a JDN conclave at Leela Palace, Chennai where we have go
gather in large number and encourage the JDNs to join IMA.

Anburajan for any Nursing Home board related matters at any time. Service Doctors Wing, Guest

Dr. V. Rajesh Babu, Secretary, IMA TNSB AMS : The amount collected for credit hours have

unless we may have to stop TIMA for few months. Dr. B. Sridhar, Past State Secretary also added
the same point.

Dr. S. Karthik Prabhu, Chairman NHB : The procedure of handing over and taking over must be
brought in to the SOP, so there won't be any problem in the future. In case the public sector banks do

AGENDA15 : ISSUES FOR DISCUSSIONS:

(a) NMC:
Dr. P. Arulrhaj, Past National President, IMA HQs : Lot of regulations have come for RMPs. As
the regulations is put up in a public domain, there are lot of comments. First correction we informed
is, all are to register in IMR. Second correction is, the Doctor of the modern medicine only can
prefix Dr., not others. Third correction is regulation of our practice – we suggested for a single
registration. Any Doctors can have the First specialities. Another correction, the authorised person
only can collect the records from the hospital. The data belongs to the Doctor and his patient, if
someone wants, it is to be given by the concerned Doctors only. Push of generic drugs are not
accepted; Doctor must be permitted to write branded and generic with bracket. CPD programmes
through pharmaceutical companies must be accepted. Health is a state subject. Behaviour of the
Medical Practitioner is controlled by the concerned State Medical Council, not by National
Medical Commission.

Dr. N.R.T.R. Thiagarajan, Hony. State Secretary : The draft of NMC has been circulated to all
the IMA branches. We did not get any suggestion on the new draft by the NMC. However, the draft
sent by the state office can be mailed to the National IMA [email protected] and
[email protected] and immediately by the branches. The demand what we request is a
follows,

1. We modern medical practitioner will use the prefix Dr. only.

2. CPD The credit hours can be reduced to 20 in 5 years. Pharmaceutics companies should be
allowed to sponsor CPDs.

3. Renewals should be done on free of cost. The word renewal of license can be amended as the
updating records of the medical council.

4. It is clear that a RMP cannot solicit directly or indirectly. It is deliberately left unmentioned
whether the institutions like corporate hospitals can solicit patients directly or indirectly.

5. Generic drugs must be opposed.
6. Medical drugs must be allowed to be dispensed by the Doctors.
7. Maintaining digitised records of OP for 3 years will be opposed.
8. Intimating the patient on the change of appointment is not possible all the times.
9. Punishment for getting gifts will be opposed.

Dr. J.A. Jayalal, Immd. Past National President:
We stand for prefixing Dr. only.
One punishment for one act by NMC only.
Indian qualified system must be accepted by the NMC.

75

Standard format is to be followed in legal issues.
Any Doctor or organisation can get monitory benefits from the Pharmaceutical companies- will be
opposed.
Single unified number is going to come, will be opposed.

He insists the members to write their points to the NMC without fail.

Dr. Capt. G. Raghavelu, Past State President : When the state of Punjab can oppose the NMC
regulations, why not IMA TNSB oppose the regulations of NMC and abide only the State Medical
Council regulations.

Dr. K. Selvam, IMA Chennai Kodambakkam : Whether the OP records to be maintained for 3
years, it is clarified only the IP records to be maintained, unless it is a case of medico legal.

Having alcohol is wrong on duty, the influence of alcohol had during the off duty and
attending patient also wrong. The wording is to be correctly used, that does not affect the patient
and the Doctor.

Dr. K. Prakasam, Past State President : Primary number never be compromised.

Dr. S. Karthick Prabhu, Chairman NHB : As NMC is coming up with all the regulations which
blocks our income, we should formulate in structure of fee for each category of OP, if possible, Pan
Indian. Govt. should bring a policy for the Pharma company which should regulate the price of the
drug, we must oppose for the Doctors are blamed for every reason. It is better to make the country
alcohol free than brining regulation on having alcohol.

Dr. K. Vijayakumar, Past National President : As National IMA has not had any meeting, we
need not wait for National IMA, but we can go ahead of the decision what we take here. Whenever
a decision comes from National IMA, we can follow.

Dr. C.N. Raja, Vice President National IMA HQs. & Dr. K.M. Abul Hasan, State President
Elect 2023 : IMA TNSB can prepare a draft and send it to all the IMA Branches, which can be
signed and sent it to the NMC.

Dr. M.S. Ashraf, Past State President : We can write a letter to IMA HQs. to ask for some more
time for to take decision on NMC regulation. Seek for the legal opinion for how to approach the
problem. As, health is the state subject, we must sensitise Health Minister, Health Secretary in this
matter.

Dr. Abubucker, IMA Tirunelveli : In addition to write to NMC directly, we must write to TNMC
and request them to forward, so as to support our views with the help of Govt. bodies.

Dr. Mohamed Ibrahim, IMA Tirunelveli : The youngsters are not sensitised on this issue, the
students are not aware of what is happening in NMC.

Dr. Tamil Selvi, Secretary, IMA Tiruchirapalli : Thanking the office bearers for analysing the
NMC regulation and put up in a nut shell, she request all the branches to take the matter serious and
send the mails without fail. As the public also notice this issue and send their views, it is we should
send our views within the prescribed time.

Dr. M.S. Ashraf, Past State President : He presented the API's recommendation on NMC to the
SCM for further action.

76

(b) PURCHASE OF LAND:
Dr. V. Saravanan, Member Property Purchase Committee : We have chosen one property in the
Chennai Bangalore Highways near Chembarampakkam Lake in Papanchatram village with 3.42
Acres. It is within the budget of around 20 to 22 Crores. It is 27 KMs from Chennai Airport, no tolls,
we can reach the property within 50 Mnts. It is 2.5KMs from Poonamallee. The new Airport is
coming up near Pannur is 27 Kms. There are servant quarters, a shed and an office in it. Apart from
the 4 Lane highways, one private road belong to this property of 17 ft and a village road approaches
the property. Advantages of this land is on the highways, larger area, within our budget, scope for
healthy and useful projects for our members, scope for appreciation is very high, closer to current
and also new Airport, closer to Queens land and other promising business projects, Metro
expansion already in proposal and can plan for immediate revenue utilising the Go downs and
empty land.

We can have a very good standalone building for IMA Tamilnadu and also it should be a
landmark in the future. Now the document is with the Legal advisor for legal opinion.

Dr. R. Palaniswamy, State President : As Dr. V. Sarvanan said, this property is within our budget,
easily approachable, payments are through by cheque/DD only, brokerage may be 1 % on official
payment, Documents are with the bank on loan, once we pay the document will be released. We can
buy this property if it is found to be perfect legally.

Dr. T. Senthamil Pari, State President Elect : As we have seen 5 places, it is expected to show all
the places, discuss on the merits and demerits and come to the conclusion, that is more important. It
is replied by Dr. V. Saravanan that 4 places visited had already been shown by slides in the last SCM.

Dr. K. Vijayakumar, Past National President IMA HQs : We have to believe the committee
formed to purchase the property. As we have enough space, we can plan for flats for our Doctors,
Commercial place etc. which would fetch income. The resolution passed should not be brought in
for approval and considerations, but look for the financial viabilities and go ahead. Leaving FSS,
considering the PPLSSS, the committee should go ahead and make a big project, so as the younger
and future generation to enjoy.

Dr. V. Saravanan : It is already discussed to construct apartments for our Doctors and a convention
centre where we can have our programmes and well as to let out for others.

Dr. Mohan Prasad, President, IMA Madurai Branch : Once it is decided by the SCM, we should
go ahead. He also asked whether any problem would come when the lake overflows, it is replied by
the State President that the property is on the higher place and there wont be any problem. He also
welcome the move of purchasing this particular land, suggesting to create commercial area to get
income regularly.

Dr. Sasiraj, President, IMAThanjavur Branch : It is difficult to pay the whole amount by white,
as the guideline value and the market value is different, we have to deal carefully. The purpose of
the project, funding and the brokerage etc. may be explained to the members.

Dr. Bhoopathy John, IMA Chennai Kodambakkam : Construction of a Bus Stand is in front of
the proposed site, a town ship coming on. Hence, it is a very good property, we can go ahead.

Dr. S. Kanagasabhapathy, Past State President : As the project is already approved, we need not
to discuss again and again, however the property may be registered and go ahead.

Dr. S. Karthick Prabhu, Chairman NHB : Being a property having 6 lane roads, high way etc.,
we can have the service apartments, hotels, bars etc.

77

Dr. K. Prakasam, Past State President : As it was already approved by SCM and the past State
Presidents council, we can go ahead. We have to be look into the litigations, EC, reserve fund in
PPLSSS etc.

Dr. Gunasekaran, Past State President : While taking amount from the PPLSSS, we have to take
the amount with an approval of the PPLSSS Management Committee only. It is better if the SCM
could explain the members about the mobilising the fund.

Dr. R. Palaniswamy, State President : We are planning to take only 12 Crores out of 18 Crores
from PPLSSS, the reserve will be Rs. 6 Crores. Rs. 5 crores out of Rs. 6 Crores from IMA TNSB,
Rs. 1 Crore will be reserve. We take Rs. 2 Crore from Rs. 3 Crores in NHB, Rs. 1 Crore will be
reserve. PPLSSS Management Committee has given approval to grant amount to purchase
property.

Dr. B. Sridhar, Past State Secretary : Instead of paying huge amount to income tax, it is a good
idea to buy a land for IMA. Mobilising amount may be clarified to the members to avoid
unnecessary spreading wrong message among the members. He gave an idea to invite contribution
from the branches, so that they should also feel, it is our project.

Dr. K. Thangamuthu, PPLSSS Legal Committee Chairman : Based on the Supreme court
verdict, it was felt during the last SCM that the CPA is not applicable to us. Hence, we have decided
to give Rs. 20.00 Crore to buy land for IMA. As the CPA was not applicable, it was felt, sparing the
amount may not be the problem. Whereas the Supreme Court order has just come after the last
SCM that CPA is applicable to Health sector. The compensation to be paid to the patients are much
more than previous time. The meagre amount leaving for PPLSSS and taking rest of the amount for
the purchase of land will lead to the crisis in the future. Also, management of properties are concern
in IMATNSB.

Dr. R. Palaniswamy, State President : The management of the property will done promptly by us
and the forth coming office bearers. Guest houses are maintained well. We will manage whatever
may come, let us move positively.

Dr. S. Karuna, IMACoimbatore : The same committee which is now can continue to maintain the
properties. A good sports complex may be built in the proposed new property, for the welfare of the
society.

Dr. D. Mageshwaran, IMA Vellore : The amount planned to be taken from PPLSS is to be
replaced, as the situation may become bad in the days to come. Generate income from the property
and replace the amount taken from PPLSSS as early as possible, it is like a loan we are taking from
PPLSSS. State President assured the members that the State Office will take care of any
eventualities may come to PPLSSS for the shortage of amount.

Dr. C.P. Shanmugasundaram, IMA Coimbatore : It is better to buy a land which appreciates the
value. We should have a master plan how to manage the amount, what are we going to plan in the
new property etc.

Dr. P. Manivannan, PPLSSS Secretary : The land proposed is within our budget, vacant land, on
the high ways. When there is no litigation, it is better to buy the land. Let us not leave the good
opportunity which has come now, we all the wings and schemes can contribute and buy. The vacant
land can be utilised to park the Trucks on rent and earn money out of it. He announced Rs. 1.00 Lakh
from his account for this project.

78

Management Committee of PPLSSS has approved to grant an amount half of the land cost,
to IMATNSB to buy a land. As a Secretary PPLSSS, he is concerned over the expenditure in future
and IMATNSB should ensure to support PPLSSS when there is a Crisis.

Dr. S. Karthick Prabhu, NHB Chairman : There is no end to the problems, so long we practice,
the problems are going to be there. We will over come the problems. We need not to think and feel
IMA TNSB is differ from other wings and schemes, all the wings and schemes are under IMA
TNSB. We need not working to spend the amount from the wings and schemes, IMA TNSB is there
look after its wings and schemes.

Dr. Seetharaman, IMA Coimbatore : Leaving the adequate fund for any compensation in
PPLSSS, rest can be utilised to buy a property.

Dr. Janarthan, IMA Coimbatore : Congratulating the members involved in this project, he said
the amount loaned from the schemes and wings can be paid back at the earliest.

Dr. K. Kuthalingam, IMA Nagercoil : PPLSSS is not a separate body, it is part and partial of IMA,
we need not to worry about the schemes.

Dr. Jeevanandam, IMA Kancheepuram : It is an excellent project. EC to be checked for
minimum 45 years. Legal opinion must be taken from the team of lawyers.

Dr. Bhoopathy John, IMAChennai Kodambakkam : We should motivate every member of IMA
TNSB to contribute, so as to feel it is the property of IMAwhere they are the member.

Dr. J.A. Jayalal, Immd. Past National President, IMA HQs. : Expressing happy over the plan to
purchase the land for IMA TNSB, he said,we are going to celebrate the 100th year of IMA, we
should have a project of 100th year. Focusing on the Centenary year, IMA HQs. is having a separate
account for the 100th year project, where the share amount of every member is added. We should
have a long term vision to built a very good monument. All the suggestions can be taken and go ahead.

Dr. K.M. Abul Hasan, State President Elect 2023 : Expansion is important for any organisation,
same time safeguard our fund. Purchasing land will certainly give a positive message that IMA
TNSB is growing. We the forthcoming State Presidents will push forward this project. He suggested
the members to name this project something like NEW IMA TNSB HQs. PROJECT. Time to time
project report must be placed in the SCM. We can purchase the land and contribute for building.

Dr. R. Palaniswamy, State President : Majority of the opinion is to go for the purchase of the land.
The land would cost around Rs. 20 Crores. We will take the legal opinion and move forward. It is
decided to purchase the land. It has also decided in the State Council Meeting, whenever PPLSSS
need fund for the compensation request, IMA TNSB will be there to support financially during the
Crisis.

( c) DOCTORS DAY CELEBRATION:
Dr. R. Palaniswamy, State President : IMA TNSB Doctors day celebration on 2nd July at Green
park Hotel, Vadapalani, Chennai. He requested and invited all the members to attend the meeting
where the Health minister, Health Secretary and other dignitaries to participate.

AGENDA16 : QUESTION HOUR
Dr. K. Thangamuthu, PPLSSS Legal Committee Chairman:

1. In National agenda, page 6, 7a says that the incumbent President cannot contest for the
same post again. Even the branch has registered in the society differently, it is to abide the

79

National agenda only. The President Elect for National IMA is for one year only, the same
is applicable to the branches as well.

Dr. J.A. Jayalal, Immd. Past National President : The agenda applicable to State President also
applicable to the branch President. If at all, the Branch wants to change it, the branch should pass it
in their GB, then by the State GB and brought to the Central working Committee for approval.
When a constitution of branch was not approved by the CWC, then the National Constitution is
applicable to the particular branch. There was also a precedence, that is to be honoured. One
member one post is the constitution of National IMA, it does not say the President cannot contest
for Secretary. Leader is known by his followers. If a leader cannot create another generation of
leaders cannot be a leader. He insisted that IMA should create second and third generation leaders,
then only IMABranch will grow.

Dr. K. Prakasam, Past State President : The past President becoming the Secretary, cannot be
accepted, he or she may be nominated for the Chairman or for the Standing Committees. One
should not hold many posts; posts must be shared by different people.

Dr. K. Kuthalingam, IMA Nagercoil : Where the members are not ready to hold the post, nothing
wrong in holding the same or the same post by the incumbent President. Laws are for the people and
people are not for law.

Dr. R. Palaniswamy, State President : We are bringing an amendment that the branches having
more than 200 members, where the Past President cannot contest again.

Dr. C.N. Raja, Vice President, IMA HQS. : It is disgrace, a big IMA branch cannot have
contestant for the President post. New faces are to be allowed to contest. He also emphasised that
the IMATNSB should strict into One man one post, one should not hold several posts.

2. As per central IMA Constitution, the Election Commission Chairman must be elected. Our
constitution says that the Election Commission Chairman must be nominated by the State
President,

Dr. J.A. Jayalal, Immd. Past National President : IMA TNSB Constitution 2013 is approved by
IMAHQs. where the post of Election Commission Chairman is nominated by the State President.

Dr. S. Kanagasabhapathy, Past State President : Nomination of Election Commission
Chairman and members is the provocatory rights of the State President. The same have been
brought in the draft constitution.

3. As per our constitution, the Internal Auditor has to be nominated in the Annual General
Body. He insisted the Internal Audit Committee is to be elected among the members.

The State President said, the proposal of conducting election for the post of Internal auditor for state
office in in the draft constitution.

AGENDA17 : REPORTS OFTHE IMASCHEMES :
FSS :
Dr. B. Venkatesan, Chairman FSS : 72nd Management Committee Meeting and 17th AGM Held at
Nagercoil on 29.05.2022. FSS II: W.e.f 01.07.2022, the upper age limit increased to 55. NFD: Age
group from 51-55is fixed as Rs. 55000/-. 5thAnnual Fraternity Contribution for the next operational
year from 01.07.2022 to 30.06.2023 is fixed as Rs. 12000/-, as pre Covid times.

80

FSS I: Claim amount remain same, ie. Rs. 18,00,000/- (200 x active members). Exit after 20 or 25
years. On consulting various financial consultancies, it is decided not to exempt the contribution
after 20 or 25 years for the following reasons:

1. We have lot of senior members; we need more new numbers to exempt the seniors.

2. 1/3rd of the existing members become honorary members, i.e 5 years from the dt. of
implementation, of exit policy, the remaining 2/3rd members will be forced to pay the 50
annual contributions for the death of the existing members, and also for the Honorary
members. As per experts, the scheme won't be viable if we exempt the members after 20 or
25 years., hence exit policy not implemented.

Chairman request the members to add 1000 new members to FSS. Show Cause Notice will
be served to the members those who damage the name of FSS. Show Cause Notice/Legal notice to
the authorised signatories, ie FSS Secretary and the FSS Treasurer during the time of the scam and
disciplinary action. Management Committee recommends to advertise the recovered property
from the scam and sell it soon. Also, we are considering to extend the time for the members to pay
their premium, so as to reduce the deletion.

State President Dr. R. Palaniswamy appreciated the services of the office bearers of FSS.
He also requested the branch President and Secretaries to encourage and add more members to FSS.

Dr. Solomon Jaya, Secretary-FSS : FSS I : 42 Death claims have been paid. The next AFC may
come down. He requested the members to pay the premium timely, so as to avoid deletion. The
unwanted messages in the social media may bring down the new entry of members, maybe avoided.
The unnecessary court cases may be avoided. If we work jointly, we can reduce the AFC still low
and to serve our family better.

Dr. K. Selvam, IMA Kodambakkam : Is there any court case against FSS?, It is replied that there
is not court case, but a lawyer notice received, which is replied.

Dr. S. Kanagasabhapathy, Past State President : In 301 section 2, they can assist the prosecution,
they can act according to the Public Persecutor or Asst Public Prosecutor, they cannot act
independently, they can give a written statement. It is also come in the WhatsApp that the case will
be in filed against 302, which awards punishment, they are misguiding the members. They go to
income tax office & Registrar of Society etc. Noting is going to be happen in the case. There is no
civil suit filed, the document what they have is the PPT presented in Trichy, which is not a valid
document.

Dr. N.R.T.R. Thiagarajan, Hony. State Secretary : We have given 3 Show Cause Notices and we
will send a circular to the branch Presidents and the Secretaries regarding this.

Dr. R. Palaniswamy, State President : The property acquired through the court at Pallavaram is
for sale and is published in the TIMA. There are buyers who ask for very meagre amount, where we
are unable to accept. The building may be given on rent till we get a better rate.

Dr. C.N. Raja, National Vice President IMA HQs. :The property at Pallavaram was accessed by
the qualified accessor and registered. We cannot sell less than the said amount, it may be given on
rent till we get the reasonable rate.

Dr. G.S. Vijay Chander, Past Vice President: Appreciating the FSS Office for the good work
done, he thanked the State President for issued Show Cause Notice to then the Secretary and the
Treasurer of FSS. This action should have been done then, certain action must have taken by IMA,
so the members have the confidence on IMA. Similar notices are to be given to other office bearers
too.

81

Dr. C.N. Raja, National Vice President IMA HQs. : The amount misappropriated under different
office bearers is mentioned in the report of the fact-finding team with due diligence.

Dr. T. Senthamil Pari, State President Elect : The Show cause notice may be issued to other
office bearers as well. The amount what found out by the Fact-finding team and the auditor and the
period of scam is clear, act accordingly.

Dr. K. Kuthalingam, IMA Nagercoil : I happened to meet a member who is publishing matters
regarding on WhatsApp and advised him to help IMA, writing positive about the schemes and not
to publish the wrong things, so the name of IMA is lowered. There is no doubt IMA activities will
flourish in the days to come.

Dr. C.P. Shanmugasundaram, IMA Coimbatore : It is a good sign that the AFC is reduced to give
hope to the members. The period for paying the premium may be extended, so as not deleting any
members. To avoid paying more income taxes, certain schemes may be introduced which will be
useful to our members.

Dr. Bhoopathy John, IMA Kodambakkam : Don't delete any defaulters, make them life
members is the success story of FSS, may be with little penalty. Regarding the property in
Pallavaram, wait till we get a reasonable rate, till the time it can be rented out.

Dr. Bharathy Selvan : The FSS Scheme is to be properly planned to grow better. My intension is
that IMA and FSS should grow. Dr. Gunasekaran of Chidambam was unable to pay the premium for
last 3 years and he said, the FSS is not implemented properly. The head of the system is to convince
the members to run the scheme better.

Dr. K. Prakasam, Past State President : There is no intension to delete the members from FSS.

If we decrease the claim amount, many persons may drop out, we are not bringing down the claim
amount. If required, the policy may be changed with the support of the members.

Dr. Rajesh Babu, Secretary-AMS : Standardised PPT can be prepared and send to all the
branches. New movie can be prepared.

Dr. K. Kuthalingam, IMA Nagercoil : The office bearers should find out the way to make the
members to pay the premium without fail.

Dr. C. Thangamuthu, IMA Gobichettipalayam : The deletion can be reduced by giving grace
period. He thanked the State Secretary for issuing Show Cause Notices, which will bring
confidence on our system.
