Senthamilpari State President Mob: 9444408237 imatnsbpresident@gmail com 03 which says that “Provided that where the competent authority is of the opinion that is necessary (or) expedient so to do in the public interest, it may, for reasons to be recorded in writing, suspend registration of any private clinical establishment without issuing any notice”. Today private hospitals in Tamilnadu are facing an extraordinary and extremely dangerous situation of their establishments being closed down by the competent authority under CEA Actinvoking the above clause5(2). We would like to recall the meeting held between Government of Tamilnadu and IMA while seeking amendments to the act, exclusion or amendment of clause 5(2) was not discussed. So,it is a great setback for IMA and private hospitals of Tamilnadu that CEA is being used in an arbitrary manner to close down the hospitals without affording an opportunity of being heard and this could surely impede the very functioning of the hospitals and also discouragethe doctors starting new hospitals. Also, majority of the hospitals are multispecialty today, inadvertent error (or) acts in one department should not affect other departments, which would consequentlydistress the patients, consultants and employees. It is very undemocratic and involve violation fundamental rights of a citizen. In this regard we have to highlight a judgement from High court of Madras delivered in the writ petition No: 24312 of 2021 and W.M.P no 25626 of 2022 by the Honorable Justice Mr. N. Sathish Kumar, in a case of MTP done at an unauthorized hospital, which declares as follows “On a careful perusal of clinical establishment act, the provision in that act makes it clear that the competent authority has power either to cancel (or) suspend the registration of Dear friends, Greeting from IMATNSB Clinical Establishment ACT & Arbitrary Closure of Hospitals: The Tamil Nadu Private Clinical Establishments (Regulation) Act, 1997 has been enacted by the Government of Tamilnadu to provide for registration and regulation of all clinical establishments in the state with a view to prescribe the minimum standards of facilities and services. Recently we came to know that many of our member hospitals were closed without any notice by invoking the clause 5 (2) of the said act

When the statue provides only for suspension (or) cancellation of license, without resorting to the power available under law, when the clinic was established after approval, the competent authority cannot seal the premises, without resorting to the provisions available under law,permanently. As long as the petitioner is the medical practitioner her license has not been cancelled, she is entitled to continue her medical profession. Though she has violated certain provision of law for which she has been separately prosecuted and in the event of she being found guilty, the law will take its own course to punish her for such violation. But the question arises in this case is that having initiated the prosecution whether the petitioner (Doctor) still could be deprived of her profession permanently, without resorting any lawful measures as provided in both enactments (MTP act &CEA), either to cancel (or) suspend the license. Having not adopted such procedure the court is of the view that, permanent sealing of the premises established after approval will infact infringe the fundamental right of a person to carry out the profession” So, IMATNSB and Nursing HomeBoard of IMA request the Government of Tamilnadu either to repeal or amend the said clause 5 (2) in order to curtail the powers of the competent authority from acting in an arbitrary manner, and that the penal clause must be in the lines of imposing penalty only after giving adequate opportunities for explanation from clinical establishments. August 2023 05 Dear Seniors friends and colleagues, An update on the State affairs, We had a lot of Doctors Day Celebrations and hope all of you have had great celebrations in your branches. We are following up all the membership applications received upto date and those received in last month under the rebate will shortly be getting their numbers from the IMA National Hqrs. I would like to thank the IMA Puliangudi Branch led by Dr. Prakash Kanna for conducting the South Zone sports meet with lots of participation and also Tambaram branch for the north zone sports meet. We have had the PPLSSS and FSS Management Committee Meetings in Thiruvannamalai nicely hosted by the parent branch led by our Dr. S. Ganesan, FSS Finance Secretary. Lots of resolutions passed which will be updated by their respective teams. We are currently going to update the process and requirements of accreditation of Paramedical Institutions as the numbers have hugely increased, thanks to Dr. P. Mannarmannan, Dr. S. Gowrishankar and Dr. K. Thirumavalavan for their exceptional work over the past 2 years. The AMS Wing and the CGP wing too have done exceptional work thanks to Dr. R. Kannan, Dr. V. Rajesh Babu, Dr. P. Senguttuvanand Dr. Senthil who have all created records and benchmarks in terms of participation and quality of content. The current notification by NMC for action against doctors for not prescribing in generic names has been suitably replied by our National IMA and will be followed up with and ensure that that clause is dropped or withdrawn. Elections called for in our IMA State for the upcoming 2024 - 2025,there has been a nice response to serve our fraternity and association. All other issues in Courts and Government representations are being followed up and will update as and when we start getting results. We have got our GST number last month and we have started paying through our GST this month onwards. We have received summons from the GST Office to appear with all our accounts since 2017 January and are under the process of submitting and will have to pay what is due as instructed by our National Hqrs. I used this opportunity to impress upon the power that is hidden in every doctor. We should unleash the power to impact the society and the country. National Mental Health Helpline: I am so disturbed to see so many young doctors died by suicide due to very stressful & toxic environment. I always say that we should make a system of Mental Health Helpline a 24 x 7 service for stressed & burnout medicos, Hopefully we will be launching it soon, as we have already prepared the roadmap for it. Trip to Makkah & Medina: I have performed a UMRA Pilgrimage to Makkah & Medina for 8 days and I had prayed for the Health, Prosperity, and peace for all our members. FSS Membership Drive: We had taken a historic decision in FSS to limit AFC paying term to 25 years and hence many members would become honorary in 2029. So, we will have to aggressively work for teaching the membership of 15000 by December 2024. I have been forming a group of people who would take up this task. Each member of the team will be given a target of joining 50 members each before December 2024. Workshop on Job Opportunities in UK: For the first time IMA JDN & MSN are organising this event and our Health Minister had agreed to be the Chief Guest. Large number of MBBS graduates are coming out every year and we should ensure that all of them get a respectable career. That is why we are doing this workshop and I will work hard to establish IMA JDN is the Employment Exchange for Junior Doctors of our country. CEA Currently CEA section 5 , clause 2 is a big issue which is killing our Hospitals literally, we have made a representation with the help of our State President Dr.T.Senthamil Pari in Tamil and English, we are going to meet the ministers and if possible our Chief Minister and to force them to remove the clause from the section 5 which states that the Hospital can be closed without any prior information. Almost 15 hospitals in Tamilnadu are closed using this act, so we are acting vigorously to get this removed. We are going to follow these steps We are planning to send the representation which is made ready in English and Tamil through Register post addressing Chief Minister and copy to Health Minister and Health Secretary our State President is going to form a committee with IMA TNSB, NHB Officials and NHB District Coordinators who are having good Rapo with MLA’S , MP”s and Officials to do lobbying soon. Within a month this committee will be contacting the MP’s, MLA’s, Officials, Minister & Chief Minister to make them understand our problem. To orient our members regarding this issue. Plan to meet the media and express our grudges Protest (Tharna) is the next step we can include all Branch Presidents and Secretaries Parallely we will collect legal advice and we will go legally if needed. This step should be the last. If we go legally first we cannot do any other thing This is what we have planned and it will be executed. We will keep you updated on this regularly. Minimum Wages Regarding Minimum Wages There was a Interim Committee which was formed but till now they have conducted only one meeting. After that no other meeting was conducted. We have sent plenty of representations to Labour Minister to add the Member of IMA TNSB and NHB in the committee, but it didn’t happen. Now time has come to form a new committee, so in this we have to insist to add our names. Insurance Regarding Insurance from GI council they have said that they will form a committee comprising of IMA leaders. It is under the process. Training for the Second and Third year students are in progress. Admissions for the first year students are in progress, will be closed by20.08.2023, late admissions may be granted for few more days. The institutions are close the admissions at the earliest and start the classes at the earliest, so as to have 240 days of class in a year. Necessary training materials will be issued on receipt of the admission forms only. The institutions which are due for renewal are to apply for renewal immediately. No student will be admitted without the proper approval of IMA TNSB Paramedical Wing. Institutions must ensure sufficient & qualified faculties, class rooms and training aids. It may be possible to fulfil the all the requirement of the intuition, unless they meet the minimum training requirement and norms under IMA TNSB Paramedial wing. Institutions are requested to comply the rules and regulations of IMA TNSB Paramedical Wing. The first Academic Committee of IMA TNSB Paramedical Wing has been planned for 27-08-2023 at NRT College, Theni, where the volunteer faculties are invited to develop the plan of action for the academic year 2023-24. There are certain experts invited to address and help the training programme as well. Also, there is a principals meet on 27.08.2023 at NRT College, Theni, followed by the South Zone meeting for the faculties and the students. Sports meet for the south zone students conducted on 20.08.2023 at Virudhunagar, lot of students participated in it. Very good arrangements, thanks to the Joint Secretary Dr. K. Thirumavalavan who took lot of effort to make it success.MOU between HSSC and IMA TNSB Paramedical Wing have been signed already and waiting for further concurrence from HSSC.
