What are the DoT IP-I license
requirements for Documentation?

The Infrastructure Providers Category-I is a telecom-related license provided to certain
businesses that can provide assets such as dark fibers, Right of Way, duct space &
towers to the needful telecom business in the market. To procure such a license, the
applicant must be eligible to apply for DoT IP-I registration. Post-eligibility requirements,
the applicant must arrange all the required documents that must be submitted along
with the license registration application. So, in this article, we mention the following
guidelines for the Infrastructure Providers Category I registration that the applicant must
observe.

Eligibility for DoT IP-1 License Registration

Eligible Business Structure for DoT IP-1 Registration

The applicant for the IP-1 license must be an Indian company registered under the
Companies Act of 2013. If you have not applied for the required license, then you must
apply for the Company registration procedure with the Ministry of Corporate Affairs.

Foreign Equity

The Department of Telecommunications puts no restriction on the applicant company to
get the foreign equity level. The minimum equity level must be maintained at all times
throughout the registration process.

Registration Form

The Infrastructure License applicant company must submit the application for
registration in the prescribed form.

Right of Way

The IP-1 license applicant company shall make its arrangement for the Right of Way
(ROW).

Name Change

The applicant can apply for the change in its name, or the licensed IP-I is permitted
under the Companies Act of 2013. You must follow the due procedure for the name
change procedure as recommended by the MCA.

Response Time

The IP-1 license applicant company must be informed of the approval or rejection of
the application as far as practicable within 15 days of submission of the application.

Entrants

The registration for the IP-1 license provider must be on a non-exclusive basis without
any restriction on the number of entrants. The Department of Telecommunications puts
no restrictions on the number of entrants for IP-1 license applications.

Infrastructure lease or sale

The IP-I registered Company can provide dark fibers, Right of Way, duct space, and
towers on a lease / rent out / sale basis to the licensees of telecom services on mutually
agreed terms and conditions.

Agreement with other IPs

The IP-I registered Company must submit a copy of an agreement entered into with the
other service providers or IP-II to the DOT within 15 days of signing such contract.

Compliance

IP-I registered companies must provide for the use of infrastructure in a non-
discriminatory manner. The details must be elaborated. Otherwise, the Authority can
issue a summons for such compliance.

License Processing Fee

The IP1 license applicant company must pay a processing fee along with the
application of Rs. 5,000/- in the form of a Demand Draft/Pay Order payable at New
Delhi in the name of the Pay & Accounts Officer (Headquarters) DOT. The fee is non-
refundable.

Application Submission Procedure

The DoT IP applicant must submit the application to the Section Officer of the
Department of Telecommunications, Room No. 713, Sanchar Bhavan, 20-Ashok Road,
New Delhi-110 001.
