TIMESHARE EXIT COMPANIES ARE
FIGHTING PROPOSED LEGISLATION—

AND MAYBE THEY HAVE A POINT!

Timeshare exit companies are fighting the passage of a new Florida bill
that restricts the business of companies that meet the exit company criteria.
The American Resort Development Association Resort Owners Coalition
representing more than 1.5 million timeshare owners, strongly supports a bill
in the Florida legislature that they say allegedly provides consumers with many
of the same protections they are afforded when they originally purchased their
timeshare. Wesley Financial Group and Reedhein & Associates, which does
business as Timeshare Exit Team, and at least two other companies, operating
as exit companies, have hired lobbyists to fight the bill. Those in favor of the
bill say exit companies are against the bill because it eliminates their ability to
take upfront fees that in many cases are in excess of $5,000, until the service
they promise is delivered. The perspective of exit companies is that owners of
timeshares are not given recourse in ridding themselves of a timeshare because
the resorts do not provide their owners any way in exiting their timeshare
ownership. They contend that based on restrictions of timeshare resorts, they
are the only way of releasing people from their expensive timeshares that keep
increasing fees. The bill known as HB 435/SB 1430 defines what constitutes
timeshare exit assistance or relief services by requiring written agreements
prior to performing the promised exit services. It legislates the delivery of
important information to the consumer prior to entering into any agreement,
and provides consumers with a cancellation right. It also protects consumer
funds by prohibiting advance payment or requiring escrow of such funds
until promised services are completed, and it prohibits false and misleading
representations used to recruit consumers to engage in an exit company
