Letter from the President

Dear Fall Conference Attendee:
Welcome to the 65th Annual Fall Conference. Today you will
have the opportunity to network with colleagues, connect with
suppliers, attend educational sessions and listen to an
exciting motivational speaker. Many of you have undoubtedly attended
previous ASBO MD&DC Fall Conferences and experienced these
activities before. To those of you in this group, I say thank you for your
continued participation and welcome back! To those of you who are new
to this event, I welcome you and take pride in telling you that you made a
wise decision choosing to attend.

To those who are new to our conference, I strongly encourage you to view
this not solely as a classroom type training event, but as a comprehensive
personal and professional enhancement experience. At today’s event you
have the opportunity to make contacts with exhibitors that you may have a
future need for services from, with colleagues that you may develop a
reciprocal relationship with whom you will exchange best practice ideas
and discuss challenging situations, and have the opportunity for positive
growth and inspiration from our keynote motivational speaker.

Many of you are here as part of the ASBO MD&DC Mentor program. This
program allows a veteran (Mentor) attendee to sponsor someone who has
not previously attended (Mentee) an ASBO MD&DC conference. This will
allow an even greater number of individuals to participate in the benefits
that ASBO MD&DC can offer to members and attendees.

Mentoring is not just an activity that active members can participate in at
the Fall Conference. It is a way for you to push your impact beyond today
by continuing to mentor those that are new to the SBO community.

No matter what your area of school business is, ASBO MD&DC has
educational and networking opportunities for you. Please take advantage
of what is available to you today and enjoy the conference!

Letter from the Executive Director

It’s hard to believe that ASBO is convening its 65th Annual Fall
Conference. That’s a lot of conferences and a lot of affordable
opportunities for continuing education and professional growth.
And the Fall Conference is just one of the many ASBO offerings
that keep School Business Officials knowledgeable about Best
Practices, coming regulations, changes in law, solutions to
operational problems, and new ways of doing business that are more
effective and efficient. Join a B.I.G (Best Idea Group) session to network with
colleagues in your field to learn about the innovative things they are doing, or
how they are coping with an unfunded mandate, or new regulations or
professional standards.
Are you a new School Business Official or a veteran who wants to learn
about another area of school business operations? Attend the full day
Foundations of School Business Management classes, taught by ASBO
members with extensive, practical experience in their field. And then there
are workshops and, coming soon, webinars to give you access to topical

Advancing the Position of Procurement in Public Organizations

While much of the current attention to Purchasing and Procurement is focused on the past three
decades the history of the function goes back to before the Roman Empire. While it’s important
to learn from history, it’s more important for Procurement Professionals to understand where we
are now, and where we want to go. This understanding is essential to advancing Procurement’s
position that it wants a seat at the table with the decision makers. In some cases, the seat may
be ascribed but it’s more likely to be achieved. This presentation will address where
Procurement has been, is and where it is going. It will also offer insights as to what it will take to
secure the elusive seat at the table.

Risk Management and Loss Reduction in the School Workplace Setting

The presentation and discussion will focus on reducing and controlling costs and expenses
associated with injuries in the school workplace by establishing programs to reduce the number
and severity of injuries and by putting in place a plan to meet such common post-injury
challenges as providing and monitoring medical treatment and return to work. Areas covered will
be transportation, food preparation and service, facilities maintenance and construction,
assaults, falls, stress and others. The session also covers the conflicts and overlap between and
among personnel policies, sick leave, FMLA and Workers' Compensation.

Implementing Professional Standards: Tips for Success

Professional Standards is a requirement of sponsors utilizing the school lunch program. It
requires minimum levels of credentials for hiring, as well as minimum amounts of training time
annually for all Food and Nutrition Services staff. This session will review the requirements of the
regulation and provide tips for getting training completed and tracking the training for audit
purposes. ( Professional Standards 3430 1 Hour Planning and Tracking Training).

Maryland School Construction– Current Challenges & Future Prospects

In April 2016, the General Assembly established the 21st Century School Facilities Commission
to review school construction policies and costs, and offer recommendations for improvements
to address the current needs of the state’s 24 school districts. It is hopeful that the Commission
will validate the challenges that LEAs face, and offer viable solutions to improving aging
facilities. In the interim, please join the panel as they discuss the current conditions throughout
the State, the adequacy of State and local funding, and short-term practices instituted to help
ease some of the current challenges, as well as the future of school construction in Maryland.

will discuss how Frederick County Public Schools uses social media platforms to collaborate with
the community and beyond.

Uniform Guidance Procurement Requirements

This session will include an overview of the procurement requirements under the Uniform
Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards
codified at 2 CFR part 200 (Uniform Guidance), which generally became effective on December
26, 2014. Under an amendment to these regulations, the compliance date for the procurement
requirements was delayed by two fiscal years after the general effective date of the regulations.
These regulations authorize recipients of Federal financial assistance to use their own
procurement procedures that comply with State and local law if those procedures also meet the
procurement standards in the regulations. The presentation will cover the minimum requirements
that must be met by local governments, including school districts that receive funding from the
U.S. Department of Education.

Changes Are Coming Under ESSA (1 CPE)

At the end of 2015, Congress passed the Every Student Succeeds Act (ESSA), reauthorizing
the Elementary and Secondary Education Act. This new law is a significant departure from No
Child Left Behind, giving flexibility to the States to determine where and how to turn around low
performing schools. This session will discuss the major changes to the law, and how those
changes will impact school districts and state educational agencies.

In multiple reports, the Office of Legislative Audits has reported that the traditional elements
used to determine payments to bus vendors fail to consider market conditions, actual costs, and
available discounts, resulting in higher payments than necessary for student transportation
services. This session will present competition techniques assisting in matching demand and
supply conditions, the ultimate market test, while creating and securing the best service that
meets your district’s need for the best market based price.

Why K12 Requires a Professional Enterprise IT Organization

The early 1990's were enormous growth years for instructional/educational technology in the K12
public education space. It was very common to see a math or science teacher leading the efforts
as the Supervisor of Information Technology (IT). Today, technology in education is an enterprise
IT operation, and demands IT professionals to lead and staff this complex function. Many public
school systems house some of the most complex enterprise IT operations with the most
widespread requirements of any others in their area. The skill-sets required to operate this
environment touch all of the major areas of modern IT. This presentation will highlight the key
areas of focus and how Carroll County Public Schools has worked to address these concerns.

the school system in January 2002 after working for 16 years in the educational software

Carroll County Public Network (CCPN) since its inception in 2003. * The CCPN was recognized by the Carroll

Technology Council as the Partner of the Year in 2012. CCPS and CCPN have also been featured nationally in

several publications including the Institute for Local Self-Reliance, EducationSuperHighway, and several

associated vendor White Papers. Gary serves as a Board Member of Maryland Research and Education

Network (MDREN) and Collaborative Solutions Maryland (CSM) and was selected as a Local School District

representative to the Partnership for Assessment of Readiness for College and Careers (PARCC) Technical

Architecture Committee and the Common Education Data Standards (CEDS) Race-To-The-Top Working

Group. He also serves on the National Association of Governor’s K12 Broadband Policy Academy working

group. Gary has served on several other statewide education and technology committees and he is active in

other educational, business, and technology related organizations including the Carroll Technology Council.

Gary was recognized by the Maryland Society for Educational Technology MSET – Formerly MICCA) in 2005,

received a Smart CXO Award from Smart CEO Magazine in 2012, and has contributed articles to several

publications. Gary earned his MS in MIS from the University of Baltimore’s Merrick School of Business in 1999.

He obtained his undergraduate degree from Towson State University in 1985. He graduated from Westminster

State Senate and Speaker of the House appointed him Chair of The 21st Century School
Commission. He is also a member of the Maryland Economic Development Commission,
which oversees the Department of Business and Economic Development. Knott chaired
BOMA Building of the Year Competition for 5 years from 1997 to 2002, served on
Maryland’s P-20 Arts Council as the only business representative, and is a board member of the Signal 13
Foundation, the Johns Hopkins Harriet Lane Foundation, the Baltimore Outward Bound Center and the Inner
Arbor Trust. Martin is President, Founder and Co-Owner of Knott Mechanical Inc. (KM) and a Founder and co
-owner of Wye River Technologies. KM is one of the Baltimore’s premier Commercial HVAC and Plumbing
service providers, working with more than 800 customers in 10 counties in Central Maryland providing service
to over 2500 buildings and 90 million sq. ft. of space. Johns Hopkins Healthcare and Comcast are among the

Mohanjeet (Mohan) Kohli works for Harford County Public School as an Assistant
Supervisor of Facilities Management within the Division of Planning and Construction. As a
degreed Mechanical Engineer, he initially worked in the private sector performing energy
analysis and management. Since then Mohan has worked in Facilities Management in
various roles for over 25 years, first in Higher Education and for the past 16 years in K – 12
Education.

David Lever, R.A., D.A.
Educational Facilities Planning, LLC

As Executive Director of the Maryland Public School Construction Program from April
2003 to July 2016, David was responsible for management of State funding for capital
school projects, and collaborated with three other State agencies in the approval of the
programming, planning, design, and procurement of State-funded projects. Under his
leadership, his agency promoted high performance, innovative school designs and
construction methodologies, alternative financing approaches, and the integration of
school facilities with neighborhoods and community services. He has recently initiated a
practice to advise local boards of education, local, State governments, and private entities on K-12
educational facility matters. Dr. Lever was Director of Planning and Architectural Services for Prince George's
County Public Schools from 2001 until 2003, following four years as Capital Improvement Program Officer.
Previously, Dr. Lever had 24 years of experience in private sector construction, architectural practice, and
community planning. Dr. Lever has a masters degree in architecture from Harvard University and a doctorate
in urban design from Rice University. Since 1991 he has taught urban design and planning at Rice, the
University of Houston, and Virginia Polytechnic Institute National Capital Region.

Daniel May has worked as an engineer in several capacities in the HVAC business. Dan
graduated from Virginia Tech with a Bachelor of Science in Mechanical Engineering. He
began his career as a research and development engineer for Evapco, Inc. in Taneytown,
MD. From there Dan went to work for the Baltimore/Washington area Evapco representative
as an outside sales engineer working with engineers and contractors on various commercial
construction projects. From there Dan went to work for a design build mechanical contracting
firm for three years where he worked in business development and project management. For the past 12
years, Dan has been a sales engineer for Havtech, Inc in Columbia, MD where he works directly with building
owners, consulting engineers, and design build contractors.

Christopher Morton, Supervisor of Facilities Management, has been with Harford County
Public Schools (HCPS) 21 years. Education includes a Bachelor of Science in Business
Administration from Towson University. Christopher began his career with a mid-size
General Contracting Firm as an Estimator/Project Coordinator where he worked for 5 years
until he went to work for HCPS. He started at HCPS as the first Construction Project
Assistant, advanced to Assistant Supervisor of Planning and Construction before assuming the position of
Supervisor when the Facilities Department merged with Planning and Construction.

Irene Myers-Thompson

Irene has been with UnitedHealth Group since 1991. Her current role is Regional Wellness Director for Public
Sector. This role is dedicated to Public Sector and Key Account clients in the Mid-Atlantic region. Irene works
with employer groups to develop and evolve wellness plans for their employees. Plans are built upon the
customer’s goals, culture and expectations for wellness and health. Wellness plans include using data to
create onsite efforts to encourage healthy living and topic specific campaigns. Irene also has a passion for
educating employees about the wellness resources available to them as part of their UnitedHealthcare

Columbia police officers, teachers, fire fighters and other public employees in major civil
lawsuits, then in 1981 opened his own practice before the local and federal, lower and appellate
courts of Maryland, Virginia and the District of Columbia, as well as before the Maryland and
Virginia Workers' Compensation Commissions, the U.S. Department of Labor and the District of
Columbia Department of Employment Services. His practice includes representation and
defense of insurers, employers and self-insured employers in workers' compensation and civil liability claims,
negligence, false arrest, auto accident and other claims, as well as protection and prosecution of employers'
subrogation rights in civil litigation, all including both jury and non-jury trials. He also is asked to provide
opinions and representation in disputes concerning insurance coverage and employment law, and lectures
frequently in seminars on workers’ compensation in MD, DC and VA. Both his firm and Mr. O’Connell have
received the highest rating (AV) from Martindale Hubbell in expertise and ethics. He is a member of the
Defense Research Institute, the DC Defense Lawyers Association and the Association of Compensation
Insurance Attorneys, in which he served as president for three years.

Brandon Oland

Brandon Oland is in his fourth year as the Web Experience Coordinator for Frederick County Public Schools
in Maryland. He oversees the FCPS Maryland social media accounts. Prior to working for FCPS Maryland, he
served as a digital and social media editor at the Carroll County Times, a community newspaper in the
Tribune family. He earned the company's Innovator of the Year award two years in a row for his social media
contributions. Brandon strongly believes that all organizations can benefit from having an active social media
presence.

Andy Onukwubiri, R.A.,
Supervisor Capital Programs
Prince George’s County Public Schools

Andy Onukwubiri has been actively involved with Maryland Public Schools Design and
Construction service for nearly 20 years. He is currently serving as the Supervisor of
Capital Programs for Prince Georges County Public Schools. Prior to his current
position with Prince Georges County Public Schools, Mr. Onukwubiri served as the
Design & Construction Program Manager for Queen Anne's County Public School s
for 17 years. Prior to joining Queen Anne’s County Board of Education, Andy spent nine years with a private
architectural firm in Silver Spring and Baltimore and five years with DC Public Schools as a Project Manager.
Andy’s significant accomplishments include managing several award winning projects for Queen Anne's
County such as Sudlersville Middle Schools, Matapeake Elementary & Middle Schools,. Due to Andy’s
accomplishment in school facility design and construction, he was appointed a member of the Maryland State
advisory committee on school facility design and classroom acoustics. Andy is a graduate of Howard
University School of Architecture.

Penny Opalka, SPHR, SHRM-SCP, CCP, CBP
Sr. Benefits Manager
Frederick County Public Schools

Penny is the Sr. Benefits Manager with FCPS since June 2016. In her current role she
manages the FCPS benefit programs, including retirement, group health and welfare as
well as wellness initiatives. She has over 25 years of experience in Human Resources,
Benefits and Compensation providing strategic leadership and guidance to executive
leaders. Penny implements wellness initiatives to improve employee health and well-
being. She includes financial and retirement planning as these are also important aspects to employee
wellness. She encourages programs that reduce costs, improve care gaps, reduce and strategize risk of
populations that drive overall medical costs down. Penny’s work experience is diverse and expands retail,
manufacturing, healthcare and most recently education. She has worked in both union and non-union
environments.
Penny holds a Bachelor of Science degree in Business Management from Phoenix University.

Ron Petracca
Senior Counsel
U.S. Dept. of Education, Office of the General Counsel

Ron Petracca is Senior Counsel to the General Counsel at the U.S. Department of
Education. He assists the General Counsel by leading the Office’s Discretionary Grants
Practice Team and providing advice on a variety of legal and policy issues involving
innovative programs and initiatives, services to English learners, and the work of the
Institute of Education Sciences. He joined the Office of the General Counsel in 1981 and
worked in the Division of Educational Equity and Research until 2012. Mr. Petracca also worked as a Special
Assistant United States Attorney in 1990-1991. He graduated from the State University of New York College
at Cortland in 1978 and received his law degree from the Catholic University of America in 1981.

Merril E. Plait, PE
Administrator, Office of Engineering & Construction
Baltimore County Public Schools

Mr. Plait graduated from the University of Florida with a BS in Civil Engineering. He has
nearly 35 years of experience in the Baltimore / Washington area, to include local school
construction, land development, storm water management, and environmental engineering
projects. In 2007, Merril joined Baltimore County Public Schools to oversee the renovation
of 19 middle schools. He now serves as the administrator of the Office of Engineering and
Construction, where he leads a staff of more than 40 professionals, to include architects, engineers, planners
and other design professionals to implement the $125,000,000/year capital improvement program for the
school system.

Jeffrey Proulx
Supervisor of Food and Nutrition Services
Washington County Public Schools

Jeffrey Proulx is currently the Supervisor of Food and Nutrition Services for the
Washington County Public Schools. Jeff has been with Washington County Public
Schools for the past eight years and holds a Masters of Business Administration Degree
from Mount St. Mary’s University and a Bachelor’s Degree in Hotel, Restaurant and Institutional Management
from the Pennsylvania State University. Jeff has been active in ASBO and the School Nutrition Association in
both Maryland and Pennsylvania where he worked previously for six years, holding many association
positions at the state and local level and is SNS credentialed and level III certified with SNA. Jeff’s passion is
to work on legislative and lobbying efforts to support the great work being done in schools across the country
every day. Jeff is also the President-Elect of the Maryland School nutrition Association.

Eric B. Schwartz
Staff Attorney
Charles County Public Schools

Eric is the staff attorney for Charles County Public Schools, where he represents the
superintendent on legal matters and advises the board of education and staff members
on legal, policy, and legislative issues. Previously, he served as the Deputy Executive
Director for the Maryland Association of Boards of Education. He has written numerous
publications on legal matters relating to public education and he has given
presentations at national and statewide conferences. In addition, he has presented on
legal issues to local school systems in every county in Maryland and to thousands of board members,
superintendents, central office personnel, principals, assistant principals, and other public school
employees. He currently serves as the President of the Maryland Council of Local School Board
Attorneys. Eric holds a Masters degree in education from the University of Pennsylvania, where he also
completed his undergraduate work, and he is an honors graduate from the University of Maryland School of
Law.

Renee Spence
Executive Director
Public School Superintendents Association of Maryland (PSSAM)

Renee Spence recently retired from the Maryland State Department of Education (MSDE) as
the Director of Government Relations after 20 years of service as the legislative liaison
working directly with the General Assembly. Renee obtained her B.A. in Elementary
Education from Loyola University as well as her Masters of Special Education from Loyola
University. Renee has worked for 35 years in public service and education enhancing the
lives of children, youth and families by creating the kind of public policies that create educational
opportunities. She worked with the original Thornton Commission on school funding, which gave her a great
understanding of school finances. Renee knows that the adequate funding of education will be reviewed over
the next two years with action required by 2017 and believes that her background and knowledge on this
issue will prove beneficial to the local school systems.

Steven Spillan
Brustein & Manasecit, PLLC

Steven Spillan joined Brustein & Manasevit, PLLC in January 2006. He assists clients with
federal grants management and various federal education programs, including the
Elementary and Secondary Education Act, the Carl D. Perkins Career and Technical
Education Act, the Workforce Innovation and Opportunity Act, the Higher Education Act, the
Federal Funding Accountability and Transparency Act, and the Family Educational Rights
and Privacy Act. Mr. Spillan also works with the Legislative Director monitoring the federal
budget process, education legislation, and important administrative actions to keep clients informed of
activities in Washington that can affect their federal programs. Mr. Spillan received his J.D. from the Catholic
University of America’s Columbus School of Law in May 2011. He earned his Bachelor of Arts in Political
Science from American University in 2005. Mr. Spillan is admitted to practice law in Maryland and the District
of Columbia.

Anita Stubenrauch
Transportation Analyst
Carroll County Public Schools

Anita Stubenrauch is the Transportation Analyst for Carroll County Public Schools. Her professional
background includes working as an analyst for Howard County Public Schools and as a scientist and project
manager for several environmental and physical science organizations. Ms. Stubenrauch holds several
degrees, including Chemistry, Computer Science, and a graduate certificate in Geographic Information
Science.

Peter Wathen-Dunn
Senior Attorney
U.S. Dept. of Education, Office of the General Counsel

Peter Wathen-Dunn is an attorney in the Office of the General Counsel at the US Department of Education
and has practiced law at the Department for over 34 years. He provides advice on a number of subject
matters, including grant law, protection of human subjects, appropriations matters, the Federal Funding
Accountability and Transparency Act (FFATA), the Cash Management Improvement Act of 1990, the
Paperwork Reduction Act of 1995, and OMB Circulars regarding internal controls and independent audits.
Regarding grant law, Mr. Wathen-Dunn provides advice on matters relating to the OMB Circulars A-102 (the
Common Rule) and A-110 (now codified at 2 CFR Part 215), and the cost principles now located in 2 CFR
Parts 220, 225, and 230. Mr. Wathen-Dunn is a principal of the Discretionary Grant Practice Team of OGC
and is leading the OGC team preparing comments on the OMB proposal to consolidate grant guidance in Title
2of the Code of Federal Regulations. From 2002 through 2004, Mr. Wathen-Dunn also served on the drafting
team that standardized provisions in the selected items of cost for the three sets of OMB cost principles and
was active in the P.L. 106-107 process, providing significant legal assistance to the Pre-Award Work Group in
preparing the proposal to establish Title 2, Grants and Agreements, in the CFR. Among his other
accomplishments, Mr. Wathen- Dunn took the lead in drafting the Department’s Handbook for the
Discretionary Grant Process, which contains the internal procedures used by the Department to manage that
process.

Winship Wheatley

An attorney, Mr. Wheatley’s experience combines extensive private legal practice with
over thirty years of management level duties in the student transportation industry. He
retired from active school service with Anne Arundel County Public Schools, Annapolis,
Maryland in 2007 as Director of Transportation and currently represents key industry

John Woolums, Esq.
Director of Governmental Relations

Mr. Woolums is the Director of Governmental Relations with the Maryland Association of
Boards of Education. Since 2001, John has conducted the Association's state and federal
lobbying activities for Maryland's 24 school boards. He is a 1995 graduate of the University
of Maryland School of Law and a member of the Maryland Bar. Since 2006, he has
coauthored and coedited the Maryland School Law Deskbook. Mr. Woolums is a 1987
graduate of Miami University in Oxford, Ohio. Upon graduation he worked for five years as a
legislative aide to U.S. Senator Barbara Mikulski. Following graduation from law school, he worked with a
Washington, DC law firm in 1996 and as committee counsel to the Maryland House of Delegates
Environmental Matters Committee in 1997. Prior to joining MABE, Mr. Woolums was the associate director of
the Maryland Association of Counties from 1998 to 2001. Mr. Woolums has presented at national and
regional conferences, including: National School Boards Association, National Council of School Attorneys,
American Association of School Personnel Administrators, Association of School Business Officials (MD-DC),
Maryland Council of School Attorneys, Public School Superintendents Association of Maryland, Maryland
Negotiation Service, Maryland Education Coalition, Advocates for Children and Youth, Eastern Shore of
Maryland Education Consortium, and Maryland Association of Counties.
