PREFACE Simplify Notes Occupational Safety and Health for Process Engineering is designed to impart understanding of the self-regulatory concepts and provisions under the Occupational Safety and Health Act (OSHA) in Malaysia. Special thanks to Ketua Jabatan Kejuruteraan Petrokimia Politeknik Kuching Sarawak, En. Khalid Husseine bin Tuah especially in facilitating the completion of this book. The purpose of this book is to stress the responsibilities of workers in implementing and complying with the safety procedures at work. Understanding of notifications of accidents, dangerous occurrences, poisoning and diseases. Objective of Occupational Safety and Health (OSH) • DEFINITION-The promotion and maintenance of the highest degree of physical, mental and social well-being of workers in all occupations (ILO,WHO) • AIM-Prevent illness, injury, and disease due to working conditions (OASH) • CONCEPT-OSH is a basic human right for safety at workplace -OSH means providing a working environment which is conducive to safety & health. 4


OSH legislation • OSHA in Malaysia is an Act which provides the legislative framework to secure the safety, health and welfare among all Malaysian work forces and to protect others against risks to safety or health in connection with the activities of persons at work. • Gazetted on 24th February 1994. • The Act contains 67 sections, divided into 15 parts and appended with 3 schedules. • The first three parts state the objects of the Act and provide the infrastructure for appointment of officers and the National Council (Majlis Kebangsaan). • Part IV(4) to VI(6) provides the general duties for those who create the risks e.g. employer, self-employed person, designer, manufacturer, supplier, etc. and those who work with the risks i.e employees. 5

Objectives of Occupational Safety & Health Act 1994 (Act 514) • Secure the safety, health and welfare of persons at work against risks to safety or health arising out of the activities of persons at work. • Protect person at a place of work other than persons at work against risks to safety or health arising out of the activities of persons at work. • Promote an occupational environment for persons at work which is adapted to their physiological and psychological needs. • Provide the means whereby the associated occupational safety and health legislation maybe progressively replaced by a system of regulations and approved industry codes of practice operating in combination with the provisions of this Act designed to maintain or improve the standards of safety and health. 7

1.3 INCIDENT PREVENTION 13


Concept incident and accident • DEFINITIONAccident is an event that has unintentionally happened, that results in damage, injury or harm. Incident/Near miss is an event that has unintentionally happened, but this may not result in damage, harm or injury. “Therefore, every accident can be an incident. However not all incidents can be termed as an accident” Incident Prevention is a process investigates developing a safe workplace to minimize the possibility @ zero possibility of being injured at the workplace 14


INCIDENT VS ACCIDENT “The Bhopal disaster or Bhopal gas tragedy was a chemical accident on the night of 2–3 December 1984 at the Union Carbide India Limited (UCIL) pesticide plant in Bhopal, Madhya Pradesh, India. 2.1 CONCEPTS OF OCCUPATIONAL SAFETY AND HEALTH MANAGEMENT SYSTEM (OSHMS) Definition- • A OSHMS is a systematic approach to managing safety and health activities by integrating occupational safety and health programs, policies, and objectives into organizational policies and procedures. • OSHMS is a set of safety and health program components that interact in an organized way. POLICY • An OSH policy is a written document which expresses the organization’s commitment to employees health, safety and well being • It is a foundation for the efforts taken to provide a suitable working environment • policy and standards are guidance or management information documents • any company has a social and legal obligation to provide a safe and health working environment to all his employees. ACT 514 OCCUPATIONAL SAFETY AND HEALTH ACT 1994 PART IV-GENERAL DUTIES OF EMPLOYERS AND SELF EMPLOYED PERSONS Duty to formulate safety and health policy. Except in such cases as may be prescribed, it be the duty of every employer and every self-employed person to prepare and as often as may be appropriate revise a written statement of his general policy with respect to the safety and health at work of his employees and the organization and arrangements for the time being in force for carrying out that policy, and to bring the statement and any revision of it to the notice of all of his employees. 34


A Good Policy • The policies provided must be tailored to the specific organization. • The policy statement must have the employer's certification. A certification that can be in the form of the employer's signature and name or stamp and so on is required to confirm that the employer agrees and is responsible for all statements stated in the policy. • The policy statement should be dated. The date, signature and name of the person responsible for the policy statement are crucial in the effort to review the policy and ensure it is relevant. The need to review policy becomes a legislative necessity Reasons why occupational safety and health policies are provided. I.it is mandatory through the provisions of the law (section 16, OSHA 1994). 2.2 ORGANIZING-ROLE OF MANAGEMENT Safety And Health Committee “Section 30 of OSHA 1994 stated that every employer shall establish a safety & health committee at the workplace” OSHA 1994 OBJECTIVE a)To enhance cooperation and consultation between employers and employees in improving safety and health at workplace b)To establish a two-way communication channel to provide information related to occupational safety and health c)To increase the interest and motivation of all groups d)Management and employees in issues related to occupational safety and health 36

PLANNING & IMPLEMENTATION Standard Operating Procedure (SOP) • A standard operating procedure (SOP) is a set of step-by-step instructions compiled by an organization to help workers carry out complex routine operations. • SOPs aim to achieve efficiency, quality output and uniformity of performance, while reducing miscommunication and failure to comply with industry regulations.
