Dear Bidder:
Enclosed you will find the Plans, Specifications and bidding materials for the 2016 & 2017
Landscape Maintenance and Mowing Services at the Deerfield Park District.
All pertinent information is included in the Plans and Specifications. Bidders are required to
visit all of the sites to examine conditions. A voluntary Pre‐Bid Meeting will be held at Jewett
Park Community Center, 836 Jewett Park Drive, Deerfield, IL 60015 on Thursday, February 4,
2016, 10:30 a.m. Please confirm your interest and attendance at this meeting by contacting

INVITATION TO BID
January 28, 2016
Sealed bids for the provision of the 2016 & 2017 Landscape Maintenance and Mowing Services
will be received by the Deerfield Park District at our office, 836 Jewett Park Drive, Deerfield,
Illinois 60015. Bids will be received until exactly 10:30 a.m. on Wednesday, February 10 and
then publicly opened and read. Bids submitted after the closing time will be returned
unopened. No oral or telephone proposals or modifications will be considered.
Proposals shall be submitted on the attached Form of Proposal and returned. All bids must
include a ten percent (10%) Bid Surety and a duly executed and notarized Bid Certification
under Section 33E‐11 of the criminal code of 1961, as amended, on the form provided by the
Deerfield Park District. Failure to provide Bid Certification within 48 hours of the bid opening
shall be cause for rejecting the bid. No bidder may withdraw their proposal after the hour set
for the opening thereof, or before award of contract, unless said award is delayed for a period
exceeding thirty (30) calendar days.
The Deerfield Park District may reject any or all of the bids on any basis and without disclosure
of a reason. The failure to make such a disclosure shall not result in accrual of any right, claim,
or cause of action by any unsuccessful Bidder against the Deerfield Park District.

SECTION I
INSTRUCTIONS TO BIDDERS
1. IDENTIFICATION OF PROJECT. The official name and location of the project shall
henceforth be known as:

2. CONTRACT DOCUMENTS The Invitation to Bid, the Instructions to Bidders, General
Requirements, Specifications, Site Maps, Form of Proposal, and the accepted Bid
Sheet comprise the Contract Documents.
Copies of these documents can be obtained in person from the office of the Deerfield
Park District, 836 Jewett Park Drive, Deerfield, Illinois 60015, free of charge.
3. EXPLANATION TO BIDDERS Any explanation desired by a bidder regarding the
meaning or interpretation of the Invitation to Bid, Drawings, Specifications, etc., must
be requested in writing and with sufficient time allowed for a reply to reach bidders
before the submission of their bids.
Any interpretation made will be in the form of an addendum of the Invitation to Bid,
Drawings, Specifications, etc., and will be furnished to all prospective bidders. Its
receipt by the bidder must be acknowledged in the space provided on the Bid Form or
by letter or telegram received before the time set for opening of bids. Oral
explanations or instructions given before the award of the contractor will not be
binding.
4. CONDITIONS AFFECTING THE WORK Bidders are required to visit the site and take
such steps as may be reasonably necessary to ascertain the nature and location of the
work, and the general and local conditions which can affect the work or the cost
thereof. Failure to do so will relieve Bidders from responsibility for estimating
properly the difficulty or cost of successfully performing the work.
5. BID GUARANTEE Where a Bid Guarantee is required by the Invitation to Bid, failure
to furnish a Bid Guarantee in the proper form and amount, by the time set for the
opening of bids, may cause for rejection of the bid, in the absolute discretion of the
Owner.
A Bid Guarantee shall be in the form of a bid bond, postal money order, certified
check, or cashier’s check made payable to the Owner. Bid Guarantees, other than
those stated, will be returned (a) to unsuccessful Bidders as soon as practicable after
the award of job, and (b) to the successful Bidder upon execution of such further
contractual documents and bonds as may be required by the bid as accepted.
The successful Bidder, upon being given a written “Notice of Award”, will have the (10)
calendar days to provide the required Insurance Policies or Certificates for same, and
commence with the work. Failure to comply with the conditions set forth in the
Contract Documents shall result in the termination of the contract for default. In such
event, the Contractor may be liable for any costs of performing the work which exceed
the amount of their bid, and the Bid Guarantee shall be available toward offsetting
such difference, if not previously returned to the Contractor.
6. PREPARATION AND SUBMISSION OF BID Before submitting proposal, each Bidder
shall examine carefully all documents pertaining to the work and visit the site to verify
conditions under which work will be performed.
Submission of bid will be considered presumptive evidence that the Bidder has visited
the site and is conversant with local facilities and difficulties, the requirements of the
bid documents and of pertinent State or Local Codes, State of Labor and Material
Markets, and has made due allowance in their bid for all contingencies. Include in bid
all costs of labor, material, equipment, allowance, fees, permits, guarantees,
applicable taxes, insurance and contingencies, with overhead and profit necessary to
produce a complete project, or to complete those portions of the work covered by the
specifications on which proposal is made, including all trades, without further cost to
Owner. Obtain all permits and arrange for all inspections. Pay all fees and costs
incurred.
No compensation will be allowed for any reason, if any difficulties arise which the
Bidder could have discovered or reasonably known prior to bidding.
All proposals must be made upon the Form of Proposal furnished by the Owner
attached hereto and should give the amounts bid for the work, in numbers, and must
be signed and acknowledged by the Contractor. In order to insure consideration, the
Proposal and Specification Booklet should be enclosed in an envelope marked “Bid
Proposal for the 2016 & 2017 Landscape Maintenance and Mowing Services” to be
received by 10:30 a.m. on February 10, 2016, showing the return address of the
sender and addressed to the Deerfield Park District, 836 Jewett Park Drive,
Deerfield, Illinois 60015.
Bids must be sealed, marked and addressed as directed above. Failure to do so may
result in a premature opening of, or failure to open, such bid.
The proposal submitted must not contain erasures, interlineations, or other
corrections unless each correction is suitably authenticated by affixing in the margin
immediately opposite the correction the surnames of the person or persons signing
the bid.
Modifications of bids already submitted will be considered if received at the office
designated in the Invitation to Bid by the time set for the opening of bids. Telegraphic
modifications will be considered, but should not reveal the amount of the original or
reverse bid. Unless called for, alternate bids will not be considered.
7. PRICES The prices are to include the furnishing of all materials, equipment, tools,
insurance, bonds, warranties, and all other facilities, and the performance of all labor
and services necessary for the proper completion of the work except as may be
otherwise expressly provided in the Contract Documents.
8. LATE BIDS AND MODIFICATIONS Late bids and modifications thereof received at the
office designated in the Invitation to Bid after the exact time set for opening of bids
will not be considered.
9. WITHDRAWAL OF BIDS Bids may be withdrawn by written or telegraphic request
received from bidders prior to the time set for opening of bids.
10. PUBLIC OPENING OF BIDS Bids will be publicly opened at the time set for the opening
in the Invitation to Bid. Their content will be made public for the information of
bidders and others interested, who may be present either in person or by
representative.
11. AWARD OF CONTRACT
A. Award of contract will be made to the lowest responsible bidder, or as outlined in
the specifications, and as determined by the Board of Commissioners of the
Deerfield Park District, whose bid conforms to the bid documents, drawings, and
specifications.
B. The Board of Park Commissioners may reject any or all of the bids on any basis
and without disclosure of a reason. The failure to make such a disclosure shall not
result in accrual of any right, claim, or cause of action by any unsuccessful bidder
against the Deerfield Park District.
12. CONTRACT AND INSURANCE The accepted Bidder shall enter into a written contract,
provide the Owner with copies of Workman’s Compensation and Public Liability
Insurance Policies or Certificates thereof, within ten (10) calendar days of the written
“Notice to Proceed” and prior to the commencement of work.
13. POSTPONEMENT OF DATE FOR OPENING PROPOSALS The Owner reserves the right
to postpone the date of presentation and opening of proposals and will give
telegraphic notice of any such postponement to each interested party.
SECTION II
GENERAL REQUIREMENTS
In addition to performing the requirements of said contract, contractors must meet the following
requirements:
1. SUPERVISION
Contractor shall maintain a supervisory foreman (preferably English speaking) on the job
site at all times. The Contractor shall enforce strict discipline and good order among his
employees at all times work is in progress. The Contractor shall not employ any unfit,
untrained or not skilled in the work assigned to him.
2. EQUIPMENT
Contractor shall supply all equipment required to perform the services under the contract.
It is the Contractor’s responsibility to keep equipment in proper working order and to run
periodic checks on equipment. The Contractor shall be solely responsible for the safe
condition and adequacy of all equipment.
3. NOTIFICATION REQUIREMENT
Landscape Contractor is required to notify the Park Operations Supervisor as to the
location or locations that crews are scheduled to work that day. Contact with locations
scheduled for the day must be via email or voice mail prior to 7:30 a.m. of that day.
Failure to notify Park Operations Supervisor may result in nonpayment for any work
that may have been completed that day.
4. SCHEDULING
A. PARKS – All work shall be scheduled with the approval of the Park Director, or
Landscape Operations Supervisor prior to the start of each month. Notification
of scheduled working day(s) shall be a minimum of 3 days before the start of
work. The initial Spring Clean‐up shall commence no later than the 3rd week of
April, unless weather conditions exist that may prolong the initial clean‐up.
The remaining visits shall be no earlier than 3 weeks from the prior visit to
a scheduled site. Approved days for completion, shall be consecutive
(ie. Monday, Tuesday or Thursday, Friday) unless weather conditions dictate
otherwise. Scheduled work may not commence before 7:30 am per village
ordinance.
B. RESIDENTIAL PROPERTIES – All mowing and periodic maintenance for
residential properties shall be preapproved before the start of the season by
the Park Director. The approved scheduled times shall be consecutive days and
will remain consistent throughout the length of the contract with the
exceptions of weather conditions that may arise. The initial Spring Clean‐up
shall commence no later than the 3rd week of April, unless weather conditions
exist that may prolong the work. Mowing days will be scheduled for Thursday
or Friday with exception to holidays, in which case, mowing shall take place one
day prior to the holiday. Scheduled work may not commence before 7:30 am
per village ordinance.
C. POOLS – All mowing and periodic maintenance for Pools shall be preapproved
before the start of the season by the Park Director. The approved scheduled
times shall be consecutive days and will remain consistent throughout the
length of the contract with the exception of weather conditions that may arise.
The initial Spring Clean‐up shall commence no later than the 3rd week of April,
unless weather conditions exist that may prolong the work. All visits are to be
scheduled between 7:30 am and 9:00 am. No work shall be permitted after
10:30 am.
5. INSURANCE
A. The Contractor is hereby notified that he is not to commence work until he has
obtained satisfactory insurance coverage. During the life of the contract, the
Contractor shall carry the following minimum insurance, which shall name the
Deerfield Park District as a primary, non‐contributory additional insured:
1. Workman's Compensation & Occupational Disease ‐ Statutory Limit
2. Comprehensive Public Liability Insurance
a. Bodily Injury ‐ $1,000,000 per person

b. Property Damage ‐ $1,000,000 per accident
3. Comprehensive Automobile Public Liability Insurance

The Contractor shall furnish proof of proper insurance coverage by furnishing
the Owner with an insurance certificate and any required endorsements
indicating that he has insurance in force. All policies of insurance shall provide
for at least 10 days prior written notice of cancellation to the Owner.
B. INDEMNIFICATION. The Contractor shall indemnify and hold harmless the
Owner and it's agents and employees from and against all claims, damages,
losses and expenses (including attorney's and consultants’ fees) arising out of
or resulting from (i) a breach of any obligation which is described herein or on
any other contract or bid document, by contractor, any subcontractor or
anyone for whose acts any of them may be liable, regardless of whether or not
it is caused in part by a party indemnified hereunder: or (ii)
personal injury, death, property damage or destruction relating in any manner
whatsoever to the Contractor’s performance of the work under this Contract.
Nothing herein shall be construed to limit the Contractor’s scope of
indemnification to the limits of insurance herein described, those limits
representing only minimum requirements sufficient to commence work. Not
in limitation of the forgoing duty of indemnification, the Contractor shall also
fully indemnify the Owner for all claims, damages, losses and expenses
(including attorneys’ and consultants’ fees) arising out of or resulting from any
physical injury or death suffered by Contractor’s employees in the course of
performing the work under this contract.
C. PROTECTION OF PROPERTY. The Contractor shall be responsible for protecting
and safeguarding property and the work throughout the construction period,
and shall bear the cost of repairing damages that are a result of his negligence.
6. ILLINOIS HUMAN RIGHTS ACT. Contractors must comply with the provisions of the
Illinois Human Rights Act dealing with equal employment opportunities (Section 2‐105,
775 ILCS 5/2‐105) including equality of employment opportunity and the regulations of
the Department of Human Rights of the State of Illinois and also must provide for the
adoption and implementation of written Sexual Harassment Policies. The contract with
the successful bidder will provide for this requirement. The statutory provisions setting
forth what such policies shall include as a minimum under the Act are on file with the
District and available to the bidder upon request.
7. ASSIGNMENTS AND SUBCONTRACTS. Nothing contained in the contract documents
shall create any contractual relation between any subcontractor and the Owner. Before
commencing, the Contractor shall submit to the Owner a certified list of his
subcontractors. The bidder will be required to establish to the satisfaction of the
Owner, the reliability and responsibility of the proposed subcontractors.
8. CHANGES IN THE WORK. No extra work shall be allowed or paid unless a written
proposal is made and accepted by the Owner in writing.
9. PAYMENT. The Deerfield Park District should receive invoice for services from the
previous month no later than the 5th of the month. Payments will be approved by the
Board of Park Commissioners in accordance with the local Government Prompt
Payment Act.
10. DISCHARGE OF EMPLOYEES. If any person employed by the Contractor on the work
shall appear to the Owner to be incompetent or conducts himself in a disorderly or
improper manner, such person shall be removed from the work immediately on the
request of the Owner.
11. FINANCIAL STATEMENTS
Prior to an award of contract, contractors may be required to submit financial
statements of their present and past conditions, and such other business information
as may be requested.
12. PUBLIC CONTACT
On occasion, the contractor’s employees may be contacted in some manner by
residents or park users. The employees shall be instructed to politely inform the
citizens to direct their comments and/or questions to the Deerfield Park District Office
at 836 Jewett Park Drive, or call (847) 945‐0650.
13. FAILURE TO PERFORM
It shall be understood that if, in the opinion of the Deerfield Park District, the
contractor is not meeting the requirements of these specifications, written notice will
be given to the contractor and if issues are not resolved in the allocated amount of
time, the Park District reserves the right to reduce the monthly fee paid to the
contractor or terminate the agreement within thirty (30) days of written notice.
14. LENGTH OF CONTRACT
This contract shall cover the period of time from April 1, 2016 through November 30,
2017.

SPECIFICATIONS
SCOPE OF SERVICES
The successful contractor shall furnish all materials, labor, equipment to provide weekly
and monthly landscape maintenance services for properties owned and maintained by
the Deerfield Park District. Landscape, mowing and maintenance services are to begin in
April, and run through November, 2016 & 2017.
