In fact, in India way back in 1996 in the historic judgment of the Indian Council of
Enviro-Legal Action v. Union of India [(1996) 3 SCC 212], the Apex Court for the first
time applied and defined the ‘Polluter Pays Principle’ where the polluter is absolutely
liable to compensate for the harm and pollution caused to the environment. According
to this principle, the polluter has to not only compensate the victims of pollution but
also compensate for the restoration of environmental degradation caused.

Thereafter, the concept of climate compensation was further defined and affirmed
in the judgment of Vellore Citizens’ Welfare Forum vs. Union of India [(1996) 5 SCC
647], that the polluter pays principle and the precautionary principle forms an intrin-
sic part of the environment laws of India.

As an amplification of this very concept of climate compensation, in a first at the
global level, the ‘loss and damage’ fund is being created as a down payment for the
future as a dedicated fund to help developing countries, particularly those most vulner-
able to the impacts of climate change to deal with climate related losses and damages.

Based upon the concept of Common but differentiated responsibilities (CBDR), a
fundamental principle which was agreed upon years ago even in the 2015 Paris Agree-
ment that rich nations must bear a larger burden of tackling climate change since they
emitted more greenhouse gases over the decades, the result of which has to be suffered
by the developing or under-developed countries.

I hope we become a meme someday! That is the fastest way
to become popular. There are certain factors to be kept in
mind. You need to do moment marketing through memes
which engage the audience but at the same time are not
very offensive. The important thing here is to know where
to draw the line as after a period, memes can become of-
fensive. One has to be mindful while deploying this.

There is much conversation around phygital mar-

keting. Do you see the digital part overtaking the

physical part at some point?
Right now, we must be clear that traditional or physical
marketing is also doing very well. The current need is to bal-
ance both physical and digital. Many brands either depend
wholly on digital or spend disproportionately on physi-
cal. This is because lead generation still happens through
hoardings, billboards, radio advertisements and other
traditional ways. This may change in the next few years
but not right now.

What are some of the challenges that marketers

are facing today?
The first is to be able to market to your clientele the technol-
ogy that has come into the world. Many brands are still not
comfortable with the disruption we are seeing. They still
tend to sway away from it not only because of the resistance
to change but they are content with the current outcome.
More efforts will have to be made to get more brands to be
comfortable with what digital has to offer.

We must get be cautious with the comfort of the budget.
When there is enough money to spend, the human ten-
dency to experiment and try newer things that may not be
very popular yet is lesser. It is fine to do the tried and tested
but experimenting ushers in innovation. Overall though, it
is a great time to be in marketing. There are many new ways
of looking at doing business and engaging consumers. Due
to tech availability, we can easily test multiple variations of a
campaign on different channels and know what is working
and what is not.

On spending trends…
The market is looking much better than it was last year.
Even though we hear a lot about revenge spending and
pent-up demand, which is the case, there is a lot of cautious
spending happening as well. This may continue given some
of the broader economic changes that we are seeing.

What are some of the tenets that you followed in

There are many products and too much clutter at the
moment. The market sometimes seems to be saturated.
How does one reach out or connect with the audience
against this backdrop? In a country like ours, when one is
looking to connect with the audience, the most important
thing is to resonate emotionally. That’s what we have per-
sonally done as a brand. In some cases, brands with excel-
lent products may not be able to connect with audiences
due to the lack of reach on digital or offline platforms. But
for us, this has been mission-critical.
