Missouri Income Tax Exemptions for Government Employees
Through the years Missouri income tax treatment of government employee pensions has changed as directed by US Supreme Court decisions and through the
actions of the legislators and respective governors’ administrations. We have reached a situation which offers full income tax exemption to Missourians with
government pensions at or below the maximum Social Security pension level, currently approximately $37,000. The Social Security maximum is an inflation
adjusted figure subject to review and change annually.
Under current statutes all Missourians pay income tax on a progressive 11 step scale at the lowest level and culminating in a rate of 6 percent plus $315 for tax-
able income above $9,000. Taxation of government pensions is most recently impacted by two laws, HB 444 passed in 2007 and HB 82 passed in 2009.
HB 444
Persons with income from Social Security Retirement and Disability Funds and income from non-private retirement systems are authorized a tax exemption of
their pension income up to the maximum Social Security level. This exemption was phased in over several years from 2007 to 2011 and is now in full effect.
HB 444, passed in 2007, provided for this government pension tax exemption. It did include an income limitation: “Married couples with a Missouri adjusted
gross income less than $100,000 and single individuals with a Missouri adjusted gross income of less than $85,000 may deduct up to 100 percent of their public
retirement benefits, to the extent the amounts are included in their federal adjusted gross income.”
HB 82
HB 82, passed in 2009, provided for a blanket $6000 exemption for all government pensions. Also included was the following language:
14. In addition to all other subtractions authorized in this section, for all tax years beginning on or after January 1, 2010, there shall be subtracted from Missouri
adjusted gross income, determined under section 143.121, any retirement benefits received by any taxpayer as a result of the taxpayer’s service in the armed forces
of the United States, including reserve components and the national guard of this state, as defined in Sections 101(3) and 109 of Title 32, United States Code,
and any other military force organized under the laws of this state, to the extent such benefits are included in the taxpayer’s federal adjusted gross income and not
otherwise deducted from the taxpayer’s federal adjusted gross income in the calculation of Missouri taxable income. Such retirement benefits shall be subtracted
as provided in the following schedule:
(1) For the tax year beginning on January 1, 2010, fifteen percent of such retirement benefits;
(2) For the tax year beginning on January 1, 2011, thirty percent of such retirement benefits;
(3) For the tax year beginning on January 1, 2012, forty-five percent of such retirement benefits;
(4) For the tax year beginning on January 1, 2013, sixty percent of such retirement benefits;
(5) For the tax year beginning on January 1, 2014, seventy-five percent of such retirement benefits;
(6) For the tax year beginning on January 1, 2015, ninety percent of such retirement benefits;
(7) For tax years beginning on or after January 1, 2016, one hundred percent of such retirement benefits.
This language provides the basis for the potential of conflict between current Missouri statutes and the US Supreme Court decisions Davis v. Michigan Depart-
ment of Treasury and Barker v, Kansas. These two cases are part of the legal case history covered broadly under a legal principle known as the Doctrine of
Intergovernmental Tax Immunity established in 1819 with a unanimous ruling written by Chief Justice Marshall limiting the ability of states to regulate, through
tax policy, the operations of the federal government.
Davis v Michigan covers a situation where federal retiree pensions were taxed and state pensions were exempted from state income tax. The Court ruled that
the tax levied on federal pensions was discriminatory. It did allow that states could tax federal pensions if the taxes were applied in a non-discriminatory manner.
Barker v Kansas covers a situation where military pensions were taxed and state civilian pensions were exempted. While this situation is the reverse of the current
situation in Missouri there is important language in the decision which states there is no significant difference between military pensions and civilian government
pensions.
These two decisions allow for states to tax government pensions so long as taxation applies equally between state and federal pension systems and between military
and civilian government pensions.
Missouri income tax statutes seem to treat all government pensions equally with two exceptions; Section 14 of HB 82 provides, over a few years, an incremental
implementation of exemption for any military retirement benefits without provisions for the income limitation or the Social Security maximum which are applied
to taxation of all other government pensions... That would appear to create unequal treatment. One inequality applies only to those with government pension
income included in overall income above the $85,000 per individual and $100,000 per couple limit. Additionally there is discrimination to the detriment of any
government pension above the Social Security maximum.
It is important to note that language related to government pension sources seems to be drawn broadly to include all levels from local through federal.
Redress seems to be available through a request for a refund of past taxes and cessation of ongoing withholding of state income taxes. It appears tax refunds are
restricted by a three year statute of limitations which would allow refunds from 2012 through 2015 if filed timely.

I know your officers of the Missouri Federation have been working to finalize the plans for the 2016 Convention which will be held in Columbia, be-
ginning Tuesday, April 19 through Thursday, April 21. You will be getting additional information from the officers soon giving you the new program
they have been working on. I know they are hoping you will take advantage of their hard work by attending to get news on what is happening right

coverage reached new heights. Our Legislative team in National Headquarters is rated in the top 10 by the members of Congress on Capitol Hill. We are one of
the GO TO legislative teams.
Plans are also underway for the National Convention to be held August 22 – 26,
2016, in Reno, Nevada. This convention is being held at the Grand Sierra Hotel. This convention will determine two important resolutions that will affect the fu-
ture of NARFE. The first is whether or not National voting will change from delegates to the convention to one-member-one vote; and, the second will determine
whether Chapter dues will be mandatory for a person to be a member of NARFE.
If approved, either of these resolutions will have a big effect on the structure of NARFE. Every member needs to look at these carefully and let your delegate who
will be attending the convention what you believe your vote should be.
We will be studying these in their entirety during the 2016 Federation Convention in Columbia – another very good reason for you to attend.
I wish I had the time and space to go into a lot more detail because this organization is important to every Federal Annuitant and Active Employed Federal Em-
ployee. Everyone is important and anyone, whether a present member or not, may attend the Federation Convention where all of this will be discussed. Discus-
sions will be held both in person and from the National headquarters through SKYPE. Once again, plan to attend and bring a friend to learn more about what is
taking place right now in your world.
