Resolution #Cl-84: charter amendment: Indebtedness. Introduced at the last meeting.

Mr. Roberts moved to adopt Eesolution #Cl-84, Section 19-720, Payment of indebtedness,
($225,000.00 to Unlimited). M:>tion was seconded by Mrs. Buckmaster. All concurr.
Motion carried.

Resolution #14-84: Tatoo Parlor, introduced and then adopted at the last meeting,
however, a majority of four (4) , quorum, was neeeed to officially adopt it, which
we did not have at the last meeting (3 ayes, 1 abstainence).
Resolution was read again.

Mr. Raum moved to adopt Resolution #14-84, Tatoo Parlor, which will prohibit them in
the Town. M:>tion seconded by Mrs. Buckmaster. Vote: all concur (including Mr. Simkins)
Motion carried.

Flood Insurance Elig~ pililty: This is to advise that the flood insurance eligibility
of .the Tovm has been increased from $35,000. to $245,000. as a result of the Town
Council adopting a Floodplain Management Ordinance (we adopted the county ordinance).

Water System: Mayor Gott advised that the Town has advertized for "Invitation to bid
for professional services" for a. potable water system. He stated that the appli-
cation requires more data and we are applying for a combination of grants and loans.

but under this program an ~dditional $375,000. is available to further this program.

Mayor Gott advised that interviews are being conducted for the applicants for the
position of inspector. He stated that he hopes to make a selection in several
weeks. The inspector will also be Housing and Building Inspector and Code Enforce-
ment Officer.

Stop Signs: are on order and we are receiving mixed reactions, however, as soon as
they are received, all corners will have them.

Mayor Schaefer Day: Mayor Gott advised that Mayor William Donald Schaefer of Baltimore
City will be our guest on Septerr1ber 25, 1984. He has offered us technical advise
and economic development assistance and other advise where possible. He has also
offered use of his and his staff's expertise which is'a valuable asset to the Town.
His interest is a valuable asset to us and our interest in waterfront revitalization
and the Chesapeake Bay Cleanup are Cornm:)n interests.

Mayor Gott announced a mosquito Control meeting to be held in the Town Hall on
Friday, September 14, 1984 at 7:30 P.M. by the Department of Agriculture.

A special meeting for8:00 P.M., September 20, 1984 was announced on the Bond Issue
of $225,000.00. It is necessary to pass a resolution for this purpose.

Announcement of the Southern Maryland Municipal Association meeting to be held on
Tuesday, Septelt1ber 25, 1984, in Indianhead was made and this is meeting for the
election of officers for 1984-85.

Announcement of the pre-bid conference on the bid for professional services to
furnish a potable water system for the town to be held on Sept ember 27, 1984
at 2:00 P.M.

Citizens Comments: Mrs. J. Rupard was thanked for her support and work on the
Bay Festival.
Mr. Peter Logan asked if the mosquito spraying had stopped and advised that the
driver should be asked to come either earlier or later in order to not spray the
children waiting for the school buses. Most of them have no place to go to get
out of the spray.

Mayor Gott advised that he was making a presentation in D.C. in "WAterfront Revi-
talization" in "Waterfronts '84" He advised the people that they will begin to
see physical evidence of the progress being made by next year.

Mrs. Ma:ry Locker asked about floodplain maps and applications. She was advised
that the application are available through owner's insurance representatives.

Mr. Vic Scuderi questioned the houses next to the Calvert and the number of
occupants in them.

MaY.or Gott advised that this will come under "Enforcement of Housing Code" and
the hiring of an inspector under the federal grants program.
Mr. Scuderi stated that everyone seems to be upgrading their property except these
owners.

Mr. Jay Loveless brought some lovely pictures taken at the BAy Festival.

Mayor Gott conducted the opening of the bids for the sewer rehabilitation program:

Mayor Gott advised that our engineers will be checking to see that all requirements

Minutes of the Special Meeting 131
Thursday_j'., September 20, 1984

Mayor Gott called the special meeting to order at 8:00 P.M. for the purpose of

l introducing and adopting Emergency Resolution #17-84, to provide for sale and
issuance of $225,000.00 sewe~ system Bond of 1984 for the design, construction,
re-construction, extension and improvement, etc. of development of sewer system
within Town and waste water treatment and disposal facility in the Town of
Chesapeake Beach.

Mayor Gott advised that attorneys Miles & Stockbridge were present to answer any
questions.

Present: Mayor Gott, Treasurer Robinson, Councilman Buckmaster, Jameson, Raum,
and Simkins, and Mr. Rudd.

Absent: Mr Roberts and Atty .Rymer.
Resolution #17-84 was read.
Question raised about how money would be paid off - front footage, levy taxes,
etc. at reasonable rates.

Mr. Jarreson moved to adopt emergency Resolution #17-84 to provide for sales and
issuance of Sewer System Bonds of 1984 in amount of $225,000.00. Motion seconded
by Mr. RAum. Motion carried. (all concur) .

Resolution #18-84, Market Feasibility Study" introduced.
Discussion followed: area and beach revitalization could draw from beyond the North/
Chesapeake Beach area. Various types of enterprises were discussed - resort/
conference center/complex, normal retail business and hotel/motel types. All of whicb

l_J will offer employment and revenue opportunities. Mayor announced interest of several
(2) developers in annexation.

Mayor Gott reminded everyone on Mayor Schaefer's greatly anticipated visit 9/25/84.

Minutes, Special Executive Meeting, Tuesday, October 9, 1984

Mayor Gott called the special executive meeting to order to discuss the possibility
of the acquisition of property of Longfellow which is now in bankruptcy and which _~..,.,
the Town needs and cannot afford to loose.

Present: Mayor Gott, Treasurer Robinson, Councilmen Jameson, Raum, Roberts, and
Simkiins and Mr. Rudd.

Absent: Councilmember Buckmaster and Atty. Rymer.

Mayor Gott advised that Mr. Longfellow was in bankruptcy and that until this month
had made all monthly payments on this property (Block 11, Lot 7 =Freddie's Tavern)
in amount of $1073.44. However, September 24, 1984 he had been unable to make the
payment. He advised that the mortgage is in the amount of $86,000. and at 6%,
which we wish to assume. He advised that Mr. McMahon, first mortgagee, has requested
the court rescind the order in favor of him, claiming it was his only source of in-
come.

Mayor advised that the first mortgage must be paid and that the courts are requestlling
$125,000.- sale price. Liens to many creditors, internal Revenue, Md. State Taxes,
and mortgage holder. Internal Revenue and Md. State must be satisfied.

Mayor Gott said he hoped to get the Md. State Tax to be waived, and the realtor
wi~l settle for $4,000.00. He advised that he had talked to Comptroller Goldstein
and they will waive $7,000.00 of $10,800. which is owed, which brings amount the
Town has to pay down to approximately $112,000.00 He advised figures are flexible
and will have to be confirmed. He said we Im.1st pay the monthly $1073.44 in escrow
each month and will request a deferred settlement until fiscal '85 with imnediate
occupancy - if possible.

Mayor advised that we will take money from reserved fund, which will be paid back
to these accounts. Must alway? keep a reserve fund.

He advised that the building has 4,000 sq. ft. and 1800 sq. ft is usable with a
minimum of work and fresh paint. We have need for 1000 sq. ft and could lease
other out to re-coop our expenses. The rear needs work but not at this time.

Mayor stressed that we must move quickly to aequire the property before Oct. 24,
payment is due. Must consurrate deal as soon as possible.
Mr. Simkins moved that the Town start proceedings imnediately to acquire the Long-
fellow property. Motion seconded by Mr. Roberts. Motion carried. (All concur) .

Thursday, October 11, 1984

Mayor Gott called the meeting to order at 8:00 P.M.

Present: Mayor Gott, Treasurer Robinson, Coajcilmernbers Buckmaster, Jameson,
Raum, Roberts, Simkins,and Mr. Rudd .

. Absent: Attorney Rymer and Vacancy.

Minutes of the previous meeting were read.
Mr. Roberts moved to approve the reading of the minutes. Motion seconded by Mrs.
Buckmaster, Motion carried.

Treasurer report for month of September 1984 was read.
Mr. Roberts moved to approve the reading of the Tresurer' s report. Motion seconded
by Mr. Raum. Motion carried.

Cable 'IV: Mayor Gott advised that the Town signed a franchise agreement with Penn
Comnunications (non-exclusive franchise) and the are in the process of acquiring
rights from utility company, 'Which is time consuming, and they anticipate pro-
viding service in the spring. He advised that we have since been approached by
Rite Cable 'Who has been given the county franchise, as the newspaper announced, and
they are interested in coming into the beaches.
He'further advised that 'When this was put out on bid Rite Cable did not come for-
ward and put in a bid. This is a decision the Town~Council:made and_we~do have a non-
exclusive franchise and other franchises can be awarded.

Wood jetty:Mayor announced that the contract had been awarded in July, however, he
has had no contact with the contractor and is planning to send a letter to him.
If nothing affirmative is received that we will give him so many days to respond
before voiding the contract.

Sewer Rehab: plans are proceeding. Tri State Grouting was low bidder and we
should sign contract in 1-2 weeks. Should be ready to begin in 1-2 weeks after
signing the contract.

Sewer Expansion: contract has been sfB_9t to EPA for their approval. We should get
it beack soon and then we can proceed.

Sto:rm Water and flood control: plans have been sent to Corp of Engineers and

DNR, then they must come back to us before we can begin. Hope to begin by spring.

Mayor Gott advised that Mayor Schaefer and members of his staff were here on 9 /25/84
and they were irrpressed and supportative of our goals. They have pledged us use
of their staff and expertise in our waterfront revitalization. After his visit,
Mayor Schaefer contacted Dr. Torrey Brown, DNR, and told him we needed to acquire
the pier and sandbeach as -e.flese were the focal point of the waterfront revitalization.
He also invited us to cane to Baltimore City and work with his people.

Resoltution #18-84, Market Feasibility Study:

Mr. Roberts moved that Resolution #18-84, Market Feasibility Study, be adopted.
Motion seconded by Mr. Jameson. Motion carried.

Introduction of Resolution #19-84, North Beach Documentary - history of Town in
filiil. To be done in phases with three premires - local, state and national.

8:30 P.M. - Mayor Gott advised that the bid opening on Bond Issue was scheduled

for this period.
Mayor Gott advised that lawyers from Miles and Stockbridge were present to answer

j : Agreed to purchase $225,000.00 Town of North Beach Sewer System

L Bonds of 1984 at the effective rate of Interest of 85% of Mercantile

Bank.shares Corporation Prime Rate to be adjusted annually July 1st.

Conditions in Resolution #17-84 as adopted on issuance of bond issue.
Not regulated under FDIC
No other bid was received and Mayor Gott said he knew no reason why the bid would
not be accepted: He advised that because the Town is a government entity we must
advertise to assure that the Town gets the best interest rate available.

Mayor Gott advised that the Town had had a bid opening on our ad for professional (engineer)
services for design and construction of a p:?table water system for the Town.
He stated that 16 bids were received and they were high - $143,000. and low at $36,300.00.
He advised that these will be reviewed and checked to be certain all meet all require-
ments of FHA, grant and loan agreements.

Chesapeake Bay Initiatives: application for grant for st onnwater and flood control
being made. Also, from another source for $375,000.00 for gazebo, pier, and sandbeach.

Land acquisition: Mayor Gott advised that we are still waiting at state level - DNR.
He further announced that the Town has entered into a contract to purchase Freddie's
Bar for additional office space and usuage. He advised that the exact amount is not
available at this time, but it will be $105,000. _#115,000.00. He advised that he is
negotiating with the Comptroller of M:l. to waive $10,000.00 of state taxes owed - hopes
to accomplish this.

Introduction of Resolution #20-84 to accept the sale of the sewer system bonds of
$225, 000. 00 of the Town of North Beach of 1984 to Calvert Bank and 'Prust; Company at
effective rate of interest of 85% of Mercantile Bankshares Corporation Prime Rate, etc.

Mr. Roberts rnoved to adopt Resolution #20-84 to adopt the bid of Calvert Bank and Trust
to purchase $225,000.00 Town of North Beach Sewer System Bonds of 1984 at tenns stated.
MOtion seconded by Mr. Raum. MOtion carried. All members concurring.

Citizeris Comments: Mrs. J. Ruppard asked where Town got rnoney to buy Freddie's and
d1driot have TIDney to repair jetty? She said she could not understaand this.
Mayor Gott advised that rnoney is allocated in this year's budget to repair the jetty
and it will be done - contractor was supposed to have begun but we have not been able
to contact him. Already signed contract for repair of the jetty. He also advised
that the Town is able to assume an approximate $86,000.00 mortgage at 6% plus other
liens and taxes at approximately $17 ,000.00,;' He advised that the Town will pay off
from reserve fund, which will be paid back, also is requesting the State of Maryland
to waive taxes of $10,000.+ by letter. He is also requesting cash settlement be
deferred until July 1, 1985 with immediate occupancy. He further advised that the
Town will use approximately 30% of building for office space and lease approximatley
60%.

Mayor Gott advised that the building was not being bought for recreational purposes, etc.
Mrs. Rupard stated that we could not keep expending and not see anything.

Mayor Gott advised that money is being spent, but it is not visible at this time. The

engineering study and design for all the projects are in the various planning \
stages and these are very expensive items, however, these come first. The
physical evidence will not be visible to you for another year - but much is being
done on these matters every day.
Mayor Gott advised that with or without this purchase, the Town must look ahead
and plan for the future and additional office space is part of this future.

Mr. Pete Logan asked about property on corner and ownership and size of property.
Mayor advised that it belonged to Irrra Gross (Pop Brown).

Mrs. J. Matthews asked about location of new pumping station and was advised
that three would be built: 1/ next to old one on playground, 2/ rehab of one at
Bay Avenue, and 3/ new one Oak and Greenwood Avenue.
Should be completed within one year.

Jay Loveless asked about sewer work and was advised that two contracts would be
going simultaneously - sewer rehab would begin soon with repairing of lines and #3
pumping station, rehab, leaks, depressions, roots, etc. and manholes.rebuilt.

Water System: Mayor advsied that we will not be adding to Chesapeake Beaches system,
we will build our own system, but valve tying them in for emergency only to Ches. Beach.

Question on existing wells: State rules and regulations to be followed, may keep
wells but may not be tied into the water system. To be permi.t.t.ed for watering lawns,
etc.

Mayor Gott advsied that we had attended meeting of the SMMA in IndianHead and he
had been elected to be President for nex year. Mr. Rudd was elected Secretary and

z. Krebeck of La Plata was Vice President. Next meeting, November legislative dinner.

Mayor Gott called the regular meeting to order at 8:00 P.M.

Minutes of the previous meeting were read and Mayor Gott asked that the minutes be
corrected to show that it was not a factual statement that "wells would be permitted"
once the water system is installed.

Wood jetty: Mayor Gott explained that the work has begun but can only proceed at

low tide and that he needs at least four working days at low tide.

Discussion on completion time and if not done in reasonable lenghth of time, a "

letter will be sent to the contractor no payment will be made before completion.

Cable TV: Mayor advised that company is negotiating with the utility companies
for use of their lines and January is scheduled for starting construction date.

Sewer Rehab. Mayor Gott advised that a pre-construciton meeting had been held
this week and that the work should begin on Tuesday for this three month project.

Sewer Expansi:on P'l'."oject: meeting to be held tomorrow and we are still waiting
for EPA approval before we can begin the project. Project should take one year.

Mr. Janeson moved to adopt Resolution #19-84, Documentary on the Town of North
Beach by the Humanities Council. Motion seconded by Mr. Raum. Motion carried.

Introduction of Emergency Resolution #21-84, Shoreline Improvement Assistance,
to repair, re-deck and rehabilitate the pier and construct approximately 700 feet
of boardwalk and approximately 1000 sq. feet air pavilion and which grant application
must be submitted by November 30, 1984.

Mr. Roberts moved that Emergency Resolution #21-84, Shoreline Improvement Assistance,
be adopted to make application for the grant before the deadline, November 30, 1984.
Motion seconded by Mr. Raum. Vote all in favor. Motion carried.

Introduction of Resolution #22-84, Ordinance for Designation and Preservation of
Historic Districts in North Beach.

Design of Water system is being prepared by McCrone Engineers, Inc.

Old Business:

Wood jetty: Mayor Gott advised that it had been completed 12/8/84 and this

should help preserve the beach.

Sewer Rehab: men are working cleaning and sealing lines, re-grouting and making

other repairs, removing roots and eliminating infiltration from storm

water and other sources. (McCrone)

Sewer Expansion: plans for extension line into the county and main line to the

plant in Chesapeake Beach and construction of pumping station are

Seawall, Atlantic and 7th Street North: in bad condition, engineering and desig..!}

seawall.

Tax Differential: Mayor advised that the county had established a committee
to study the tax differential bet we en the towns and the <count y and
the best formula for deriving it.
Mayor advised that he had requested that the same formula be used for
the next two year3the decision will be made by the Commissioners.

Town Center Master Plan: County has designated $19,000.00 for study of the

Town Center Master plan, North Beach/Chesapeake Beach to Route 260 and

north to the Anne Arundel County line and the power lines along Boyds

Turn Road. Study will inclsue grownth anticipated, impact on

recreation, highways, education, etc.

Market Study: application for $10,000. Grant for this from DNR willshow best

business and revenues generated and needs. Grant has been approved.

Proposals are due 1/9/85. ·f

Mayor Gott presented Resolution #22-84, Historic District, which had been intro-

duced at the last meeting.

Mr. Jameson moved to adopt the ordinance on designation and preservation of
historic districts, Resolution #22-84. Motion seconded by Mr. Roberts. Motion
carried.

Resolution #23-84, intrCJuced to amend/revise Zoning/Housing Code, Elimination
or Repair of Unsafe Buildings Ordinances to establish one Board of
Appeals to serve the needs of all codes. Establish a 5 member board
(at least three (3) residents and two (2) members with building
industry experience. Quorum shall require three (3) members, and
three (3) affirmative votes required for action.

Members serve a three (3) year term of office after first appoint-
memts on a alternating basis.

Introduction of Resolution# 24-84, change the penalties and violation section -\
,·,~ of the Zoning Ordinance/Housing Code/ /Elimination and/or Repair of
Unsafe Buildings where they become a misdemeanor instead of a municipal
Infraction. Fines to be increased from $500.00 to $1,000.00.

Introduction of Resolution #25-84 to adopt a revision of license fee schedule.

Mrs. Buckmaster advised that some of the swings on the playground needed repairing

and suggested that a letter be sent to P. Catlett requesting t~at the monies in the
North Beach Recreation Association be returned to the Town Recreation Fund so the
repairs could be taken care of.
