Compliance audit

• Effective audit execution depends on:

Concentrating on particular process that has Halal practices implication
Choosing correct location (visit all location)
Sampling for information / evidence
Questioning techniques (question directly the staff who actually carry out the task)

Compliance Audit

• The auditor has the right to access into the entire premise:
a. auditor is authorized to snap photos for evidence purposes;
b. copy of the audit report shall be given to the applicant for
action; and
c. auditor can conduct follow-up audit after the corrective action
has been implemented for verification purposes.

4) Final Evaluation

Auditors meeting:-
- Discuss findings and observations
- Determine if there is any non conformances
- Categories of non conformances
- Prepare Corrective Action Request (CAR)
- Prepare for closing meeting

Non Conformances

• An evidence of a failure or non-fulfilment of specified requirements.
• NCRs are raised in the event of:-

Not meeting specified clauses of a standard

Not meeting a part of a procedure

Not meeting other recognized specification

Actions, MPPHM 2014, p.49-52)

Minor Offence

i. Technical offence which can be given warning by the Inspection
Officer for the corrective action:

a. premise cleanliness b. equipments’ c. workers’ hygiene d. environmental
cleanliness cleanliness

e. pest control f. other offences related g. food handler who h. failed to produce
to hygiene and does not have anti- documents requested
sanitation Typhoid vaccination;
by the inspection
officer;

i. changes and additions of raw material manufacturers which
has halal certification. Manufacturers continue production
without informing in writing to JAKIM/ MAIN/ JAIN.

Minor Offence: Action

ii. Action:
a. a copy of the Malaysia Halal Certification Monitoring Notice (Notis
Pemantauan Pensijilan Halal Malaysia) and Non Confirmance Notice
(Notis Ketidakakuran Pensijilan Halal Malaysia) will be issued.
b. warning for immediate remedial action or within 14 days or any
duration deems relevant;
c. Inspection Officer conduct follow-up inspection after the due date
(if necessary). If the company failed to do the corrective action
within the stipulated time, Notice of Malaysia Halal Certificate
Suspension (Notis Penggantungan/ Penarikan Sijil Pengesahan Halal
Malaysia) will be issued and the halal certificate will be suspended;
and
d. the status of the suspended halal certificate will be determined by
the Halal Certification Panel.

Major Offence

Technical offence which can lead to suspension of the Malaysia Halal Certificate by
the inspection officer and need to be presented to the Halal Certification Panel for
the final decision.
a. changed/ additional supplier/ producer which does not obtain halal certification

from JAKIM/ MAIN/ JAIN;
b. changed/ additional supplier/ producer which does not obtain halal certification

from a recognized halal certification body overseas;

c. using Malaysia Halal Logo on products which are not certified;

d. forged halal certificate or misuse of Malaysia Halal Logo;

e. lend or give the original halal certificate to other company or premise;

f. alter the information on the Malaysia Halal Certificate;

Major Offence

g. change or add to the ingredients which have been declared in the application
form without written consent from JAKIM/ MAIN/ JAIN;

h. None or not enough Muslim worker in the processing area/ kitchen as required
in the procedure;

i. use and display of expired Halal certificate;

j. tools/ elements of religious worship are placed in the processing area/ kitchen;

k. does not comply to any related Malaysia halal standard; and

l. failed to comply with corrective action for minor offence.

Major Offence: Action

ii. Action:

a. Malaysia Halal Certificate shall be suspended;

b. Malaysia Halal Certification Monitoring Notice (Notis
Pemantauan Pensijilan Halal Malaysia), Malaysia Halal
Certification Non Conformance Notice (Notis Ketidakakuran
Pensijilan Halal Malaysia) and Notice of Malaysia Halal
Certificate Suspension (Notis Penggantungan/ Penarikan Sijil
Pengesahan Halal Malaysia) will be issued to the company;

Major Offence: Action

c. report on suspension will be presented to the Halal Certification
Panel for final decision whether:
- re-inspection is required; or
- the halal certificate will be returned; or
- the halal certificate will be revoked.

d. if a company failed to comply to corrective action by the Halal
Certification Panel, the halal certificate will be revoked; and

e. JAKIM/ JAIN may list down companies with suspended halal
certificate in the halal portal.

Serious Offence

i. Offences which involves Syariah and Technical matters which lead
to revocation of the Malaysia Halal Certificate by the inspection
officer and need to be presented to the Halal Certification Panel for
the final decision.

ii. Shariah offences are offences involving Shariah laws as follows:

a. confirmation of haram b. using haram material c. mixing/ storage of halal d. storage of halal product
status by JAKIM/ MAIN/ JAIN/ after receiving Malaysia and haram material with haram product;
together;
other Islamic authority Halal Certificate;
agencies on product/
ingredient/ equipment and
other miscellaneous;

e. equipments used are f. processing of improper g. use of stunner which
interchangeable between slaughtered or improper may cause death of

halal and haram; dead animal; and animal or hayat mazboh.

Serious Offence

iii. Technical offence is an offence which does not involve Islamic laws,
as follows:

a. relocation of premise/ b. change of c. unauthorized d. stunning for animals
factory without management and name slaughtermen and the is not in accordance

informing JAKIM/ MAIN/ of company without halal checker; with the requirement of
JAIN; informing JAKIM/ MAIN/ the standard;

iv. Action:

b. notices on monitoring and revocation of halal certificate will be
issued to the company;

c. report on revocation of halal certificate will be presented to the
Halal Certification Panel for the final decision;

d. JAKIM/ MAIN/ JAIN may list out the companies which have
their certificates revoked in its halal portal; and

e. in the case of any outlet having its halal certificate being
revoked due to serious offence, halal certificates from all other
outlets shall also be revoked.

5) Closing Meeting

• Also called exit meeting.
• All relevant members should attend.
• It is a presentation of the audit findings and the conclusion to the

auditee management to ensure that audit results are clearly
understood.
