2023 Aggrey-Fraser-Guggisberg Memorial Lectures 18 PROFILE OF LECTURER Justice Professor Henrietta Joy Abena Nyarko Mensa-Bonsu, is a Justice of the Supreme Court of Ghana. Before her appointment to the Bench in May 2020, she was a Professor of Law at the University of Ghana School of Law, and served as Director of the Legon Centre for International Affairs and Diplomacy (2012-2018), being the first female to do so. She is a Past President of the Ghana Academy of Arts and Sciences, having been elected to Fellowship in 2003. She has had a distinguished academic career spanning more than three decades at the University of Ghana since joining the University of Ghana as a Lecturer in 1985. She rose through the ranks to attain the rank of Professor of Law in 2002. Justice Professor Mensa-Bonsu has researched and published extensively on Criminal Law and Criminal Justice (particularly Juvenile Justice), Family Law; Children’s Rights; and International Affairs. She has also served on a large number of academic Committees of the University of Ghana, as well as chaired many Committees of Enquiry at the University of Ghana. She has served on the Hall Councils of Volta Hall and Akuafo Hall and was the first female Senior Tutor of Akuafo Hall. At the time of her separation from the University of Ghana, in 2020, she was an Assessor for the Humanities at the College of Humanities; Member of the Appointments and Promotions Committee of the College of Humanities and Alternate Assessor for the Appointments Board of the University. She has undertaken a number of high level national and international assignments. Her national assignments include membership of the National Reconciliation Commission (2002-2004); Police Council; and the Ayawaso West Wuogon Commission of Inquiry into Electoral violence (2019). In 2017, she was Ghana’s candidate for a seat on the International Criminal Court. She has served on a number of Boards of Corporations, both public and private, such as the Ghana Broadcasting Corporation and New Times Corporation; and was a non-executive Director of Standard Chartered Bank. Among the high profile international assignments she has undertaken are: the OAU’s Committee of Eminent Jurists on the Lockerbie Case; (2001-2002); and the AU’s Committee of Eminent Jurists on the Hissene Habre Case (2006). In 2007- 2011, she was appointed the Deputy Special Representative of the United Nations Secretary-General for Rule of Law (DSRSG RoL) in the United Nations Mission in Liberia (UNMIL) with the rank of Assistant-Secretary-General. For four years, she


2023 Aggrey-Fraser-Guggisberg Memorial Lectures 19 had the privilege of leading the United Nations family on efforts to reconstruct the Rule of Law sector of post-conflict Liberia. In 2015, she was appointed by the UN Secretary-General to the High Level Independent Panel on Peace Operations (HIPPO). She has, since 2012, served as a Civilian Mentor to the ECOWAS Senior Mission Leadership Courses; United Nations’ Senior Mission Leadership Courses; and the UN Police Commanders Courses, all of which prepare principal leaders of peacekeeping missions for service in the field. She has also presented a number of papers at conferences focusing on UN Peace Operations, in Geneva, Montreal, Berlin and Addis Ababa; and currently serves on the Advisory Board of the Division of Peace of the United Nations Institute for Training and Research (UNITAR). She is a member of the Board of Trustees of Methodist Church, Ghana; and the Law and Polity Committee. Professor Mensa-Bonsu has been a Visiting Lecturer at a number of reputable Universities in Europe and North America and was the 2014 Diplomat-inResidence at the School of Public and International Affairs of the North Carolina State University. She was the University of Ghana Alumni Association Lecturer for 2014 and the S.H., Amissah Lectures of the Lay Movement of Methodist Church, Ghana in 2013. Justice Prof. Mensa-Bonsu has earned a number of academic awards including MaCallien Prize for Best Graduating Student in Volta Hall (1980); McDougal Fellowship (Yale 1984); Junior Fulbright Fellowship (1991); and ACU/UNITWIN Fellowship for Women (1995). Her non-academic awards and citations include: University of Ghana Award for Meritorious Service (joint recipient 1999); the Association of Lions Clubs International Presidents’ Excellence Award (1998); Ghana Women of Excellence Awards 2019; West African Peace Fellow, WANEP, 2019; and NUGS Prestige Award for Peace, Advocacy, Academic Excellence & Institutional Advancement. (2019). Justice Prof. Mensa-Bonsu was educated at Wesley Girls High School; University of Ghana where she was one of the first two women to graduate with First Class in Law (LL.B); and Yale University, USA where she read for a Masters Degree in Law (LLM) and was called to the Ghana Bar in 1982. She is married with children and grandchildren.


20 2023 Aggrey-Fraser-Guggisberg Memorial Lectures ABSTRACTS TO LECTURES LECTURE I “WE ARE WATCHERS OF A BEACON, WHOSE LIGHT MUST NEVER DIE” – CONTEMPORARY MUSINGS ON THE MARCH FROM THE GHANA WE HAVE, TO THE GHANA WE DESIRE. Abstract ‘Resilience’ is the capacity to withstand stress and return to one’s shape after being stretched. In today’s world, it means a state or institution’s capacity to withstand threats to its survival, and even to thrive in difficult terrain. The myriad of challenges facing the state in these times require a measure of state resilience purposefully cultivated and intentionally nurtured. Ghana’s current state is the Ghana we have. Our dream of what Ghana could be, is the Ghana desire. In between these two states, are the threats either in our neighbourhood or from within, which could affect even what we have, and derail our march to the Ghana we desire. In this first lecture, I identify some of the socio-economic phenomena which pose an existential threat to Ghana. These include: rapid urbanisation occasioned by rural-urban migration; changes to our demographic profile and its associated problems; and growing inequality. These internal distortions, make us more vulnerable to external threats from the subregion, and must cause us to take active steps, mostly envisioned under the 1992 Constitution, to address them in order to protect the Ghana we have, so that we might progress to the Ghana we desire. I also discuss the positive effect and influence of the use of technology, as well as the challenges occasioned by these new technologies, adapted for peaceful and not-so-peaceful, uses respectively. I conclude with recommendations on what needs to be tackled in the immediate future, to face off the threats to the Ghana we have, and ensure our march to the Ghana we desire.


2023 Aggrey-Fraser-Guggisberg Memorial Lectures 21 LECTURE II “YEN ARA ASAASE NI” REMIX – TUNING UP THE CONTRIBUTION OF LAW IN THE GHANA WE DESIRE. Abstract This second Lecture focuses on the constitutional framework in general, and issues arising thereunder, in particular. Through the lens of state-resilience, I share ideas on some constitutional issues that have featured in public discourse this past decade. As advocacy and agitations for constitutional review have increased in tempo, so has the need to address the average citizen’s appreciation of the issues at stake. For this reason, I discuss the nature of a constitution, its purpose, and its beneficiaries; and also reflect on the challenges our ethnic, religious and class diversity pose for us in our efforts to build one nation out of these many peoples. I then highlight the basic underpinnings of our Constitution, such as the principles of the rule of law and how these support state-resilience. I also discuss the citizen’s duties and note that it is the part of the bargain of democracy that is much less popular than its converse: rights. I make the point that sustaining constitutionalism and democratic governance is not just about enjoying human rights, but also about performing reciprocal duties, such as honouring one’s tax obligations. Finally, I also examine issues that are pertinent to some categories of vulnerable citizens - the aged and persons with disability - towards whom we have a duty of humanity. Such persons require more support of the State, and from the State, to enjoy their human rights – a fact which the Constitution itself recognises with appropriate provisions. Is the State doing enough in this regard, beyond passing a Disability Act? Are State agencies doing their utmost to assure their welfare? I conclude with the position that the Constitution, even in its current state, is capable of serving its purposes as it has done these thirty past years. However, Constitutions do not implement themselves and so we must do our part, first to sustain its integrity, and then support its institutions to deliver on their mandate, so that, harnessing the technologies of our time, the State can continue to play its role in providing a fulfilling life for all its citizens.


22 2023 Aggrey-Fraser-Guggisberg Memorial Lectures THE AGGREY-FRASER-GUGGISBERG MEMORIAL LECTURES The Aggrey-Fraser-Guggisberg Memorial Lecture Series was instituted in 1957 to commemorate the contribution made by the three persons memorialized to the founding of Achimota College, now Achimota School, and more generally to the advancement of education and particularly higher education in Ghana. The three persons honoured by the lectures are: James Emman Kwegyir Aggrey A native of Anomabu in Ghana, Aggrey was a great African visionary and spokesman for racial harmony and equality. He was the first Vice-Principal of Achimota School. His outstanding contributions are symbolized in shield of the school, the black and white piano keys which stand for harmony among the black and white races. Alexander G. Fraser The first Principal of Achimota College, Fraser was a humane, courageous and far-sighted Scottish educationist who brilliantly advocated education in what was then the Gold Coast in the days of skepticism about the educational potential of the African. Gordon Guggisberg Guggisberg was perhaps the best administrator that Britain ever sent to govern a West African colony. Far in advance of the official colonial thinking of his day, he gave concrete expression to the ideals which formed the basis of Ghana’s present progress. Under his vigorous sponsorship, Achimota School grew to become one of the most distinguished educational institutions in Africa. Railways, major roads and a major hospital were also constructed during his tenure. The Aggrey-Fraser-Guggisberg Lecture Series, which is often delivered annually, is a major event in the life of the University of Ghana and indeed of the country. Choice of theme and the topics to be treated are entirely up to the discretion of the lecturer, who is invariably very distinguished in his or her field of endeavour.
