Product Catalog

Terms and Conditions

1. Payment: A credit application form must be completed to establish an account with our company. Our trading terms are Nett 30 days. Pre-payment is
required unless credit terms are established.

2. Freight Charges: Freight charges will be billed directly from Applied Medical to the customer unless otherwise stated. The customer must provide the
name of the courier and the account number should they wish to utilise their own delivery method.

3. Delivery: Applied Medical will endeavour to provide products within 48 hours of receiving a purchase order. In the event that the product is not in stock
or is on backorder the customer will be notified and advised of an expected delivery time.

4. Prices are subject to change without prior notice. All applicable taxes will be charged.

Returned Goods Policy

1. Unused product can be returned to Applied Medical within thirty (30) days of the shipping date and must be received at Applied Medical within thirty
(30) days of the date a Return Goods Authorization (RGA) number was issued. The product must be returned in the original saleable condition to
receive credit. A 20% restocking and handling fee will be charged unless the product was shipped in error by Applied Medical.

2. An RGA number must be issued by Applied Medical’s Customer Relations department prior to returning any product to Applied Medical. Please include
the RGA number on the outside of the shipping carton.

3. Credit value will be issued for authorised returns at the invoice purchase price upon final disposition of the product inspection at Applied Medical.
Please include a copy of the original packing slip or invoice with any returned product.

4. Applied Medical requires notification by the customer of any used product being returned for evaluation. A Customer Experience Report (CER) must be
completed in full and submitted to Applied Medical within 24 hours of product use. Used product returned to Applied Medical must be decontaminated
and packaged for safe handling. Applied Field Representatives are prohibited from picking up product that does not meet these criteria. Credit value
will be issued for returned product that does not meet specifications upon evaluation by Applied Medical.

5. Product received at Applied Medical that does not meet all of the above conditions will be returned to sender at sender’s expense.

important warranty information

1. Limited Warranty. Applied warrants that the Product will: (i) conform to the written specifications furnished to the Purchaser; and (ii) comply at the
time of shipment with the then-applicable requirements of the U.S. Food, Drug and Cosmetic Act and regulations promulgated thereunder.

2. Warranty Claims. For any Product that does not comply with the Limited Warranty set forth above, Applied will, in its sole discretion: (i) replace the
Product at its sole expense; or (ii) refund the full purchase price of the Product. Applied’s obligations under this section are subject to Purchaser’s
compliance with all instructions and requirements regarding the use of the Product.

3. Exclusion of other Warranties and remedies. Except as provided above, Applied excludes all other warranties, whether express or implied, by operation
of law or otherwise, including without limitation any implied warranties of merchantability or fitness for a particular purpose. In no event shall Applied
be liable for any incidental or consequential loss, damage, or expense, directly or indirectly arising from the use of any Product. Applied neither
assumes, nor authorizes, any other person to assume for it, any other additional liability or responsibility in connection with the Products. IN NO EVENT
SHALL APPLIED’S LIABILITY UNDER THIS LIMITED WARRANTY EXCEED THE PURCHASE PRICE OF THE PRODUCT.
