The Bulletin (ISSN 1072-8899), the official newsletter of The Skye Terrier Club of America, is mailed quarterly to STCA
Members, AKC- approved judges and the AKC library. Subscriptions are available to non-members for $20.00 (US) or
$30.00 (Foreign) per year. Single copies are available from the Editor at $3.00 per copy.

From the Editor’s Desk

With this issue I would like to give you a little history of the last 12 years of The Bulletin. With the Spring 2007 issue I
became the editor. At that time The Bulletin was a total black and white edition. For the Spring and Summer of 2007 the
format was changed a bit but it stayed as a black and white publication. However, with the Fall of 2007 we tried “spot
color” for the front and back part of the cover. The text was in color as was a color photo. The color seemed to go over
with great expectations that people would really enjoy having color as part of The Bulletin.

Next came the Spring issue of 2008 where we went to a full color cover for a couple issues before we also added color
pages to the inside of the cover. Within a few more issues we were able to gain enough support for color ads that we
went to the center spread and any other color pages advertisers wanted. The Bulletin has stayed this way to the present. I
think that by adding color to The Bulletin there were a great number of people that enjoyed receiving their issue.

However, the cost of not only the publication of The Bulletin but the mailing expense became an immense burden on
STCA with expenses to produce the publication were always in the “red”. STCA could not see a clear way to continue in
this manner so it was an unanimous choice to make The Bulletin also available online for those members and judges that
really didn’t want a printed version. By reducing the number of copies printed this enabled the publication to reduce it’s
expenses tremendously.

So here we are now on the threshold of 2019. What will the future of The Bulletin be? We have already taken a new
step in refreshing the look of The Bulletin by commissioning a graphic artist to do this issue of the cover since I do not
have the same ability with software to produce ads that a graphic artist can. Starting with the Spring 2019 issue this
graphic artist will also be available to do any artwork/ads for any advertiser that would like to commission her. Be sure
to inquire about this service.

With all this in my mind I have decided to step down as The Bulletin editor in the hopes that a new set of eyes can take
The Bulletin to what might be the next step in its evolution. Erin Shaw has offered to take over as Editor starting with the
Spring 2019 issue and I have offered to help her in anyway that I can.

I would like to take this opportunity to thank everyone that has supported The Bulletin and myself over the past 12 years.
It was a labor of love that I have for the breed and for the Skye Terrier Club of America to serve as Editor. Please offer
Erin the same support as she embarks on this new endeavor.

PRESIDENT’S MESSAGE

Reflecting on the STCA for the last few months as we come to a close for 2018 makes me want to catch my breath! It’s
been a busy time with several Specialties, and activities and I think we’ve had a fun and productive year! Multiple
Specialties with great entries, Supported Entries, Seminars, Raffles, the list goes on. Some events will be featured in this
issue of the Bulletin.

A couple of notable items of mention that are very encouraging signs for our endangered Skyes-
Of note, there were 5 (yes 5!) Junior Showmanship entries from different parts of the country entered at the Colorado
STCA National Roving Specialties this past August. I’m pretty sure this was unprecedented in our breed’s history, and
I’m over the moon excited to welcome a young generation showing Skyes! These lovely young ladies had virtually
everyone attending the shows charmed the entire weekend with their love for their Skyes, excellent handling skills, and
friendship they formed among each other. My goal now is to create a place for Junior’s within the STCA so these girls
and other Juniors in the future may become members and have a place to grow within the club, be mentored, and be
encouraged to continue with our breed.

Congratulations are in order! The Breed also has third Regional Club. The Columbine Skye Terrier Club has been
granted a regional Specialty by AKC in the Colorado region, so look for a Specialty in August 2019 by that ambitious,
fun and creative group! Memories of the Pie Bar and a fun time will be again on tap I’m sure for those who were lucky
enough to attend this past August! Oh, and Columbine has their 2019 Skye Terrier Calendar available. Contact me for
details.

Many thanks to Judith Tabler for offering to take over as the AKC Gazette Columnist for Skye Terriers, and many
thanks to our former Columnist Travis Wright for his many excellent articles .

The weekend of March 14-17, in conjunction with the Louisville, KY KC, The STCA will be conducting a Judges
Seminar for Skye Terriers, and will be supporting the entries for Skyes. We hope to see many of you there with your
Skyes!

Just a reminder when you’re sending in your dues, please consider a donation to one of our several committees. While
some dues collected is designated for committee use, it falls far short to fully fund the work we need to support each
committee so any additional donations are greatly appreciated. Especially of need this year will be restocking the
Education Committee for printing costs for “Breed Cards” that are constantly requested and sent free of charge, and also
additional education materials used at Judges Education events which we have scheduled.

It is with profound sadness that at the writing of this message I learned of the passing of a dear friend and our recent
Montgomery National Specialty Judge, Dr. Richard (Dick) Meen. The STCA sends our deepest condolences to Dick’s
family.

Wishing each and every member the Happiest of Holidays, a Merry Christmas, and all the best for a Wonderful, Happy
New Year!

My sincere appreciation and thanks to the Skye Terrier Club of America for inviting me to judge the National Roving Spe-
cialty in Colorado. I was delighted with the consistent quality of the entry of 38 Skye's. The hospitality was super and the
sportsmanship of the exhibitors was wonderful. Thanks for keeping the judges informed on transportation and the
events of the day.

One of the highlights of the Specialty was having five (5) entered in Junior showmanship. All of the Juniors handled their
Skye's with skill and loving hands. My hope is that these young exhibitors will continue showing their dogs. They all ap-
pear to have the support of the breeders and parents in this wonderful breed. Keep up the good work Juniors - we need
you to continue in our wonderful sport.

Winners Dog and Best of Winners - TALAKAN LADYBANK UNFORGETTABLE - Finished his CH at this show. He has
a profuse coat falling over his oval shaped body with and shows with an effortless gait. He is sturdy with a level back
line.

Reserve Winners Dog - ROYALIST YON'S HEART IN THE HIGHLANDS - a dog with sturdy bone and hard mus-
cle. He is long low and level with a proper Skye gait. An easy RWD.

Winners Bitch - GOLD RIVER SILVER BELLS AT ELSMOOR - has a long graceful neck carried high and proud, with a
free effortless gait. She is in lovely coat which is straight and flat with long feathering on the ears. A pretty picture.

Reserve Winners Bitch - ROYALIST PERFECT! JUST PERFECT FOR CABORUN - A young bitch that shows lots of
potential. She has style, elegance and dignity with a good head and strong legs.

Best of Breed - GCH DECRUY IN MONTANA BOHEMIA COKO, CGC,TK- A very eye-catching dog. Great style, ele-
gance and dignity with proper bone and muscles and an effortless gate. He has proper bone and muscles, with a won-
derful neck and shoulders flowing into a level backline. I was taken with him when he came in the ring.

Best of Opposite Sex to Best of Breed - GCH GOLD RIVER AS YOU LIKE IT - A lovely older bitch who showed with
head high and a long flowing tail. She is long and low with good height to body proportions.

Select Dog - GCH SEAMIST KNIGHT TO REMEMBER, BN, CGC - A dog that is proper in proportions with a lovely coat,
head, and tail carriage. A close competitor for BOB.

Select Bitch - GCH BUCKWHEAT'S KEEP FEELING FASCINATION - also wonderful breed type with lovely tempera-
ment and showmanship. Also a close competitor for BOS.

It was both a pleasure and a privilege to be able to adjudicate such a large entry of Skye Terriers and such a nice “entry”
of exhibitors who are juniors.

I found the overall quality of Skyes to be very good, with good toplines and proportion overall. Structure, especially the
fronts, varied widely, but rears were much better than I have seen in years past. I would have preferred stronger heads
on many of the males, but most were young dogs and that may come with age. I also would have preferred lower tail
carriages on a few of the dogs. A high tail carriage so takes away from the long, low, and level look. On the other hand, I
was happy to see that no tails were tucked or hanging limp.

Dogs
I was pleased with my very first puppy in the ring – a 6-9 month youngster not more than a few days over 6 months, and
thought to myself that if they get better with each class (and age), I’ll be very happy. This was a nice puppy, and with
some maturity will do well for himself. The classes did indeed hold their quality with 4 1-dog classes until we reached
Open Prick Ear. I found the first place dog to have the best front, neck, and proportion. His topline standing was a bit
weak, but on moving it was dead level, and that’s where it counts.

Bitches
I had 2 6-9 Bitches, one that looked like a littermate to the 6-9 puppy dog, but I’ve learned not to trust that is always the
case (it was as I found out later). Both nice puppies from Finland. Unfortunately, the other puppy in the class didn’t
really want to be examined on the table and the more we tried various approaches, the more stressed she became and I
had to excuse her. I’m sure she’ll be fine with a bit more work. It was the end of a very big day for a puppy.
My Winner Bitch Class was exciting to see, with 6 lovely bitches, 5 of them cream. My Winners Bitch
(from the 9-12 class) I felt had the best silhouette of the group – head, neck, and body proportion, and kept that while in
motion. My Reserve Winner Bitch was also nicely proportioned, with a strong head and a beautiful coat. I had 3 drop
eared dogs (of which she was one), and all were very nice.

It is always a thrill to see the Veteran Dog and Bitch classes even though there was only 1 of each sex. Both Skyes were
happy to be back in the ring.

The Best of Breed judging was very exciting and I had to take a panorama photo of the entire class which went around 3
sides of the ring! After sorting through all the specials, 2 stood out to me who would go Best of Breed and Select Dog.
Then to have to decide between the two. I finally selected GCh Seamist Knight to Remember BN CGC who had impres-
sive strength to his head and body, nice proportion, and very good structure overall. My Select Dog, GCh Decrux in
Montana Bohemia Coko CGC TKN was also a very nice dog, again good in proportion, which to me is paramount in a
Skye. Best of Opposite Sex went to Ch Buckwheater’s Keep Feeling Fascination. I was happy to be able to award 3
Awards of Merit, too, because they all deserved to be recognized.

A Lawyer Looks at Breeder Contracts - Tips for both the Breeder and the Puppy Buyer

INTRODUCTION:
I am an actively practicing attorney with my own law firm in Seattle, Washington, and my Bernese Mountain
Dogs are my very helpful office assistants. Over many years of mixing my legal practice with my Berner obses-
sion, I've reviewed a number of Breeder contracts, and I've had both breeders and puppy buyers come to me
for help when they've ended up in a contract dispute. While the best solution is to avoid having the dispute in
the first place, whether you are a breeder selling puppies, or a puppy buyer looking for that perfect addition to
your family, the contract you have can help save you disagreements and disappointment down the road.

This article is NOT intended to provide legal advice since laws can vary from state to state, and individual
situations also require individual solutions. My goal is to share a few tips and suggestions to help you use and
understand the benefits of a good contract, and most importantly, to help you avoid the pitfalls that can come
with miscommunication and misunderstandings.

WHY HAVE A CONTRACT WHEN YOU BUY OR SELL A PUPPY?
The topic of Breeder Contracts is not something that can easily be covered in one article, and that doesn't
even get to the issues related to Stud Dog Contracts and other types of Breeding Agreements. Who knew just
getting a dog could be so complicated?

FROM THE BREEDER'S PERSPECTIVE - A good contract helps explain what you expect from a puppy buyer,
and provides some protection from people who might mistreat or misuse the puppy you place with them. If
your contract is TOO restrictive or unreasonable, however, you invite the Buyer to go down the road to the
Back Yard Breeder or Puppy Miller who will sell them that cute puppy with a smile, no questions asked.

FROM THE BUYER'S PERSPECTIVE - A good contract is an indication that the breeder has done her home-
work and cares about the dogs she breeds. The contract should help you understand what the breeder expects
from you, and what you can expect from the breeder for the life of your dog. If you are not comfortable with
what the Breeder wants you to sign, ask questions! Make sure you get any explanations or changes to the
contract in writing as well. Don't sign what you don't understand or don't agree with.

RED FLAGS ~ As a Breeder - If a Buyer doesn't want to sign your contract or questions the need for one - this
is someone who is likely not going to respect your wishes down the road. You need to find homes that are
compatible with your goals and expectations as a Breeder.

As a Buyer - if the Breeder doesn't have a contract or tries to tell you that contracts don't mean anything, this
suggests the Breeder isn't promising you anything and likely hasn't done all the research and health certifica-
tions that a good Breeder would want to tell you about. Don't expect this Breeder to provide you any help or
support down the road. Without a contract, the Breeder owes you nothing and she is not standing behind the
puppy she bred. You can do better.

A CONTRACT = CLEAR, CONCISE, COMMUNICATION
CLEAR = Format your contract so it's easy to read using tools like paragraph headings, numbering, or bullet
points for emphasis. Put key points in separate paragraphs so they stand out. Important topics will get lost if
they are buried in long-winded paragraphs and pages of dialog.
CONCISE = Unless you are writing a contract for a complicated breeding or showing arrangement, you really
don't need a novel-length contract. A document that is solely focused on the critical points of what both
Breeder and Buyer promise will be much more effective than a long winded history of the kennel or the breed
with the important information lost somewhere in the middle.
COMMUNICATION = Both parties need to understand what the contract means. If you are the Breeder, be
open to questions and be ready to explain. If something isn't clear then you can revise the Contract to make it
easier to understand. If you are the Buyer, ask before you sign and make sure you know what the Breeder ex-
pects of you when you walk away with that puppy! Communication will hopefully continue for the life of the
puppy…but it has to start before you sign on the dotted line.

MENTORING OR MICROMANAGING?
Some breeder contracts I have reviewed take micromanaging to a whole new level. Telling the puppy buyer
what to do with every single aspect of the dog's life can go beyond helpful to obsessive. I suspect that many
judges would simply laugh at contracts that have such a restrictive list of requirements that the buyer has little
say in the dog's day to day life, and would throw the whole contract out the window.

As a Breeder - you ARE selling the dog to someone else. If you want the Contract to have meaning, don't
make it unreasonable. At some point the Buyer is going to make decisions about the dog's daily life including
food, activity, socialization and health - and no judge is going to take someone's dog away from them because
they didn't feed the brand of kibble that the Breeder put in the contract. If you don't trust the Buyer to take
care of the dog, then don't sell them a dog in the first place.

SEPARATING REQUIREMENTS FROM RECOMMENDATIONS
A suggestion to Breeders for keeping the Contract clear and concise - and avoiding unreasonable micro-
managing - is to give the Puppy Buyer two different Documents. One document is the CONTRACT, and the
other document is a list of RECOMMENDATIONS. The Contract should focus solely on those items that are non-
negotiable - what I call the "Deal Breakers". A Deal Breaker is something you are willing to fight over, and
something you would ask a judge to enforce if you could. Deal Breakers might include things like spay/neuter,
non-breeding, OFA x-rays and health clearances at a certain age, and listing the dog in Berner-Garde. Recom-
mendations might include things like feeding a certain food, going to puppy class, limiting certain activities at
certain ages. The Contract can refer back to the list of Recommendations as well, but the truly critical points in
the puppy purchase are separated from the day to day advice on raising and training a dog.

What constitutes a "Deal Breaker" or a Recommendation will vary from Breeder to Breeder, but if you stick to
the true DEAL BREAKERS in your Contract, and put all the great advice into a separate list of Recommenda-
tions, the Contract will be much more powerful and it will be clear to any Puppy Buyer what things are simply
not subject to compromise. In the painful event of a serious dispute, a court is more likely to enforce terms
that are clearly spelled out as essential to the Breeder's agreement to sell the puppy in the first place. Not
everything is a Deal Breaker - Remember, if the contract is too overbearing and unreasonable, it likely won't
be enforceable.

ENFORCING THE CONTRACT - STICKS AND CARROTS -
As a Breeder - What can you do to make it more likely that your Contract will be followed - and how can you
enforce the terms of the contract if it's not? Of course, avoiding a dispute is the best way to go if possible
since going to court is expensive and inconvenient at best, and a horrible nightmare in addition to being ex-
pensive at worst (I can say that since this is what I do for a living --)
Some breeders use the "carrot" approach and provide incentives for Buyers to meet the terms of the Contract
such as spay/neuter requirements and OFA x-rays. Incentives can include things like a financial rebate when
the Buyer provides proof that the puppy has been neutered, or the Buyer provides copies of OFA x-rays or
other health certifications. Some Breeders that want to encourage certain activities with the dogs they breed
also offer financial incentives or rebates for titles earned.
Since the "carrot" approach doesn't work for everyone, the "Stick" can also come into play where a specific
penalty is spelled out in the contract. Most courts will recognize what is known as "liquidated damages" - a
specific monetary penalty that the parties agree in advance will be imposed if the terms of the contract are
breached. The amount of the penalty must be clearly spelled out in the contract, and the amount can't be un-
reasonable or excessive. For example, if the contract is for the sale of a Bernese Mountain Dog for $2000, then
courts are unlikely to impose a $25,000 penalty for the failure to xray the dog since the amount of the penalty
is many times the value of the dog. But - if the penalty is for breeding the dog in violation of the contract, then
a higher financial penalty would make sense, since otherwise an unscrupulous buyer could breed the dog and
still make money by selling the puppies. If you want to use the "stick" approach by imposing a financial pen-
alty, a good local lawyer could give you guidance on what would be considered an appropriate penalty in your
area.

Another big "stick" to help enforce the contract is to specify that if there is a dispute and the Breeder has to
bring legal action to enforce the contract, the Buyer will pay attorneys fees. One tool that I have used in
breeder's contracts is a provision that any contract dispute will be handled in the court system where the
breeder lives. Other options that might be available in your state to make it easier to enforce a contract in-
clude options like arbitration or small claims court. Having a local attorney help you write your contract will
give you the best tools for enforcement since the ability to collect attorneys fees and other enforcement tools
can vary from state to state.

WHAT'S IN IT FOR THE PUPPY BUYER - PROMISES, GUARANTEES AND SUPPORT
As a buyer who might feel overwhelmed by all the requirements the Breeder has in the contract - the question
is - what's in it for ME? Buyers should be looking at the Contract to see not just what the Breeder requires
them to do, but what has the Breeder promised to do for them? Is there any kind of Health Guarantee - for
example, what will the Breeder do if the puppy is diagnosed with hip or elbow dysplasia? What does the

Breeder promise or require if the Buyer is unable to keep the dog for any reason? What kind of support, if any,
does the Breeder offer for the life of the dog? The contract is not just a list of what the Buyer promises to do,
but it should also include what the Breeder promises to do as well. Buyers should look for responsible breeders
who stand behind the dogs they breed by promising support and a willingness to take the dog back for the life
of the dog.
TIMING IS EVERYTHING - WHEN IS THE CONTRACT REVIEWED/DISCUSSED?
The most important time to look at a contract is BEFORE you fall in love with the puppy. Breeders should pro-
vide their contract to puppy buyers in advance so they can weed out potential buyers who are not compatible.
Buyers should read the contract before they experience puppy blindness that will impair their ability to read
and understand what the breeder requires. And a good contract does not replace open, honest communication
- but a good contract is also part of that open, honest communication. Make the contract you use - or the con-
tract you sign - the foundation for a long, happy Breeder/owner relationship.

Board of Directors Teleconference Meeting Minutes

August 28, 2018

Call to Order and Roll Call
The Secretary called the meeting to order at 8:06 PM, EDT, in the absence of the President Karen Turnbull and the Vice-President
Michael Koss. All other Board members were present.

Review and Approval of Minutes of Last Meeting
The Secretary reported that the minutes of the July 17, 2018 Board Meeting would be mailed to the Board for review and a vote
within the next week. At this point the Vice President Michael Koss joined the meeting and assumed the chair in the absence of the
President.

PRESIDENT’S REPORT – No report was provided.

SECRETARY’S REPORT - The following tasks were performed since the last meeting:
· Arranged for MCKC Specialty Ring Stewards
· Reviewed Statistics for Annual Awards Dinner Booklet and arranged for calligraphy
· Finished and finalized 2018 club Roster
· Provided medallions for Greeley Roving Specialty Shows
· Reviewed donor contributions to various club funds and prepared ad for MCKC catalog to recognize contributions
· Reviewed MCKC Specialty show premium list
· Reviewed MCKC Specialty show trophy list and sent to trophy committee for final review
· Prepared a cover letter for and worked with Elaine Hersey and Karen Turnbull to finalize the MCKC Specialty show week-
end package – this was sent then sent out to the membership on MailChimp by Michael Pesare.

AKC DELEGATE’S REPORT – The next Delegates Meeting will be held September 24-25, 2018.

TREASURER’S REPORT –
· Paid judges fees and expenses for Greeley specialty show
· Paid for Canfield supported entry trophies
· Paid Summer Issue Bulletin expenses for printing and mailing and also expenses for printing and mailing 2018 Rosters
· Ten members donated to one or more special STCA funds and their contributions will be recognized in the Montgomery
K.C. catalog and the Winter 2018 issue of The Bulletin.

COMMITTEE REPORTS – No reports submitted.

UNFINISHED BUSINESS
· 2018 Colorado Roving Specialty Show Wrap Up – It was agreed that the Colorado back to back Roving National Specialty
Shows and weekend events was a great success. Of particular note were the large entry for both shows (39) and a big Jun-
ior Showmanship entry (5). The Columbine Skye Terrier Club also held a successful “A” Match and plans to now apply to
AKC to become licensed.

MCKC Weekend Update – The MCKC information package was sent out via MailChimp and also uploaded to the STCA Face-
book page and Website.
· National Animal Interest Alliance (NAIA) Conference, October 26–28, in Orlando, Florida – Erin Shaw has agreed to at-
tend the NAIA Conference on behalf of the STCA. On a motion by Stephen Hersey and second by Ellen Lehman it was
approve to pay the $175 registration fee.

NEW BUSINESS
· Trophy Reimbursements For Supported Entries – Following discussion, on a motion by Stephen Hersey and second by
Sarah Stevenson, it was agreed to allow reimbursements up to $150 to pay for trophies for supported entry shows. It was
further agreed that designation of supported entry shows for the 2019 show year will be discussed at the next meeting.

NEXT MEETING DATE: It was agreed that the next Board meeting will be held on Friday, October 5, 2018 at the Holiday Inn,
Lansdale, PA following the STCA Annual Meeting and Awards Dinner.

ADJOURN: On a motion by Stephen Hersey and a second by Pat Flanagan, the meeting was adjourned at 8:41 PM EDT.
