LIFE INSURANCE

NEW! Effective July 1, 2021, the League has negotiated an additional $10k
increase to Basic Life/AD&D coverage for a total of $185K for members at
NO COST!
This may not be enough based on your specific needs. If something were to
happen to you, make sure your loved ones would be able to meet financial
obligations.
For an additional cost, members can enroll in additional coverage year-round
with Evidence of Insurability(EOI). A Statement of Health (SOH) form must be
completed and sent to MetLife for review and coverage approval.

• NEW 7/1/21! All officers are auto enrolled in $185K of Basic Life and
Accidental Death & Dismemberment (AD&D)*

What if I am not currently enrolled in the Long Term Disability (LTD) plan?
You can enroll in the LTD plan at any time during the year. However, you must
complete and return a Statement of Health form to MetLife to be considered for
coverage.
What does “Pre-Existing Condition” mean and how would that affect my claim?
The Pre-Existing Condition for your policy is 6/12.
The first number (6) refers to the period (in months), PRIOR to your effective date
of coverage, that is looked at to determine if you were treated for a condition. If
you were treated for a condition during this time, it is considered pre-existing and
your claim may be denied.
The second number (12) refers to the exclusion period. A claim submitted during
this period, following your effective date of coverage, will be denied if it is related
to a pre-existing condition.
When should I file my LTD claim?
We recommend starting the claim filing process as soon as possible to avoid a
delay in benefits once the 60-day Elimination Period has been met, even if you are
going to be receiving IOD or State Rate benefits.
If you have been injured on duty, your LTD benefit will become payable once your
one-year IOD pay and one-year State Rate pay has been exhausted.
Please note, pending IOD claims could result in an over payment of LTD benefits
which would require you to pay back some or all of your LTD benefit to MetLife.
If you experience an injury or illness off duty, your LTD benefit will become
payable once your 60-day elimination Period has been met.
Is there a waiting period before my benefit is payable?
Yes, there is a 60-day Elimination Period from the date of disability before your
benefit is payable. If you are receiving IOD or State Rate pay longer than 60 days
from your date of disability, the Elimination Period will be met as soon as IOD and
State Rate pay has stopped.

How much will I get paid?
Your benefit covers up to 66.67% of your covered monthly earnings from a
monthly minimum benefit of $100 to a monthly maximum benefit of $10,000.
Why did I receive a benefit payment less than 66.67% of my monthly earnings?
Your LTD benefit is limited to a monthly maximum benefit of $10,000. Your
disability benefit amount may also be offset by certain other income you might be
receiving while on disability, such as, another group disability plan from outside
employers working off duty. Please refer to your LTD policy to determine what
qualifies as ‘Other Income’.
How do I file a claim?
You can access the LTD claim form by logging into the LAPPL benefits website or
by contacting the LAPPL Insurance Department. The entire claim packet must be
completed and sent to MetLife to process a claim.

a. The Member Section can be completed and submitted to
MetLife by you and includes:
• Claim form
√ Be sure to sign pages 2, 3, and 4
√ If you answer “yes” to receiving income from other
sources, please be sure to provide details and/or
documentation

Please note: Any person who knowingly presents a false or fraudulent claim for payment
of a loss or benefit or knowingly presents false information in an application is guilty of a
crime and may be subject to fines and confinement in prison.

Why is there a delay with my benefit payment?
To process your claim accurately, MetLife must receive all documentation and
may request that additional information be submitted. Examples of additional
documents can include ongoing pay stubs, Injured on Duty pay, State Rate
notices, Medical information, Pension Award letters etc.
I’ve been receiving my disability benefit for 24 months, why am I receiving a
request for additional information?
During the first 24 months (known as the Own Occupation period), the plan pays
benefits if you are unable to perform the duties of your own job.
After 24 months (known as the Any Occupation period) the plan pays benefits if
you are unable to perform the duties of any job for which you may be reasonably
expected to perform. MetLife will need documentation that you are unable to
perform any work for which you might reasonably become qualified.
The Claims Examiner will contact your attending Physician(s) directly for medical
documentation; although they may ask you for updated information concerning
your medical condition, education, training, and experience. You will be notified
by MetLife when a final determination is made.

What if, after 24 months, it is determined I can return to work under another
occupation?
MetLife considers you to be partially disabled if you return to work and you are
unable to earn 80% or more of your predisability earnings.
You will continue to receive a monthly benefit from MetLife, subject to the Limit
on Work Incentive provisions, up to the maximum benefit period, so long as you
remain partially disabled as defined under the Plan.
If my illness or injury is sustained while not on duty, would I have to exhaust my
sick time?
The LTD policy does not require members to exhaust their sick time before a
benefit is payable. If a member elects to exhaust sick time while out on disability,
the LTD benefit will be reduced by the paid sick time.
If my injury is sustained off duty, will I get paid after the 60-day Elimination
Period? How much? Will I receive benefits from State Rate as well?
Yes, Long Term Disability benefits could be payable if you are eligible and
participating in the plan on the date of your disability, you satisfy the definition of
disability as stated in the policy, your claim is medically supported, and you have
satisfied the required ‘Elimination Period’.
Your benefit covers up to 66.67% of your covered monthly earnings to a maximum
benefit of $10,000 a month.
No, State Rate is only paid for claims injured on duty.

Why did I get a notice to pay back monies I received?
Benefit overpayments can occur for several reasons.
This includes (and is not limited to):

• You returned to work
• You received Other Income* or benefits MetLife was unaware of
• You were granted a retro pension
• Your sick/personal time was converted to IOD
* Please refer to the LTD policy for ‘Other Income’
When an overpayment is discovered, MetLife will send you a letter, explaining the
circumstances surrounding the overpayment and requesting full reimbursement.
A MetLife overpayment specialist will work with you on your repayment options.

Legal Services

Negotiations regarding salary, benefits, and working conditions is the main
responsibility of the League, but, as an additional benefit, the League assists
officers with legal problems. There are three primary ways that a League
member can seek legal assistance from the League. They are the Director
One Hour program, the Legal Plan, and requests through the Legal Committee.

Director One Hour Program
The League has panel attorneys that specialize in many areas of law. To name
a few: family law, estate planning, criminal defense, disciplinary, employment
law, civil litigation, discrimination, arbitration, writs, Worker’s Compensation,
personal injury, immigration, real estate, foreclosures, mortgage loans, estate
planning, retaliation, hostile work environment, disability pensions, copyrights,
trademarks, ranchises, small business, DUI, DMV hearings, probate, ADA
issues, landlord/tenant, bankruptcy, and construction law.
As a League member, the League will cover for a one-hour consultation with a
League approved panel attorney. The League is not involved with the actual
attorney/client relationship nor does it participate in any way with the legal
problem. It is only paying for the first hour. Any attorney time, or legal action,
after that first hour is the sole responsibility of the League member. Any
additional action must be arranged with a personal retainer agreement with the
attorney and paid for by the member.

Legal Plan
As a League member, you are eligible to join the Legal Plan. The Legal Plan
was started in 2000 with around 30% of the League membership joining. As of
July 2021, 97% of League members have enrolled in the Legal Plan. The
Department’s discipline system is our strongest recruiter.

Joining the Legal Plan costs $16 per pay period. It provides panel attorney
representation for all personnel complaint interviews, Boards of Rights, Skelly
responses where one or more suspension days are proposed, civil defense
in certain limited situations, criminal defense in certain limited situations,
appeals of Brady and ORWITS letters, Pitchess Motions in certain situations,
bench warrants and contempt proceedings for failure to appear
in on duty situations, grand jury subpoenas, and reimbursement for up to
30 suspension days per year (see the Legal Defense Plan Document on the
League website under the members tab for details).

NOTE: There is a rule that is sometimes misunderstood in the relationship 13
between Boards of Rights and suspension days. The Plan dictates that in
instance where the League hires an attorney for a Board of Rights, there is no
reimbursement for suspension days. You either get an attorney, or you get
reimbursement. The Plan does not pay for both. In an ordered board, there is
no decision to be made. You must got to a Board and an attorney must be
hired.

Legal Services cont.

However, where the situation is an opted Board (take the days or appeal to a
Board), there is a decision to be made. If you accept the suspension days, you
will be reimbursed. If you choose to challenge the suspension days, an
attorney must be hired and there will be no reimbursement for the suspension
days if the Board finds you guilty and recommends them. Choose carefully.
You should only go to a Board if you believe that you are not guilty. If you only
believe that the penalty is too harsh, you should opt for an Administrative
Appeal. ORS handles these and the object is to convince the chief that a
lesser penalty should be imposed. In an Administrative Appeal, unlike a Board
of Rights, the original penalty cannot be increased.
There is a reason that there is a 97% participation in the Legal Plan, and
very few complaints regarding Plan participation. That reason is the
professionalism and dedication of our Panel Attorneys. Many have decades of
experience handling LAPD cases and some are retired LAPD officers.

Legal Committee
If you believe that you have a legal case that the League should finance, you
may make an appointment to appear in front of the Legal Committee. The
Committee is comprised of League delegates who have volunteered and been
appointed to sit on the committee. It meets the first Tuesday of every month.
The committee will listen to your request and make a recommendation to the
League Board of Directors. The Board retains the final decision as to whether
to fund the case or not. One of the most typical requests is for a writ to
challenge a Board of Rights or Administrative Appeal decision to the superior
court, or later, to appeal the decision of the superior court to the appellate
court.
The Committee has guidelines that it follows. In evaluating their
recommendation, the Committee considers whether the case is in the course
and scope of the officer’s duties; does the case affect the League membership
as a whole; is this the kind of case that the League wants to use to set legal
precedence; and is this a prudent expenditure of membership funds? The
Committee then sends a recommendation to the Board of Directors. The Board
uses the same criteria to make the final decision to fund or not.
Conclusion
Providing personal legal services is not the primary service of the Protective
League. Which is negotiating salary, benefits, and working conditions for its
members. But providing legal services is a valuable supplement. Accessing
all three of the above plans starts with a phone call to the League Legal Unit at

assistance and a 24-hour hot line seven days a week to assist in times
of personal crisis. LAPPL’s MAP has been created to support you and

person, per incident, per year – and your household members too.

LAPPL’s online enrollment platform also includes the MyChoice mobile
app which allows members easy access to: view their benefit elections,
view beneficiaries, stay on top of important enrollment deadlines, store
images of your ID cards and much more!
Getting Started
Step 1: Log into your benefits portal account at www.lapplbenefits.com
and click on the MyChoice Mobile App icon. You will enter your cell phone
number and the link for the app will be texted to you. Enter your unique
access code when prompted.

Step 2: Download the MyChoice mobile app to your Apple or Android
mobile device. The link will be texted to you in Step 1. However, you can
also search for it in the App Store or Google Play.
Step 3: Launch the app on your device and input your Access Code from
Step 1. When you initially enter the app, you will be prompted to create a
4-digit PIN number for your security. If you ever forget your PIN, you can
simply request a new access code as in Step 1.

Off Payroll Updates

If you fall off payroll, you may be eligible to continue
your LAPPL benefits via direct bill. Please note, a $25
administration fee may apply.
Please contact the LAPPL Insurance staff as soon as
possible if falling off of payroll.
