The Association for the Advancement of Civil Liberties (AACL) regrets the decision of the Supreme Court to overturn the landmark 1973 ruling of Roe v Wade in light of murders such as the one committed against Jennifer Rothwell in the State of Missouri on (or around) November 11th 2019. In other words, Jennifer Rothwell was considered "Missing" for some time after she was murdered. Jennifer Rothwell was also pregnant at the time of her murder. As a matter of principle, the Association for the Advancement of Civil Liberties (AACL) unequivocally condemns violence committed against women irrespective of their racial backgrounds, their sexual orientations, their religious affiliations, their national origins, their disability status and/or their pregnancy status.



According to records recently disclosed to the Association for the Advancement of Civil Liberties (AACL) by the City Clerk of Los Angeles, California; [1] “any official position of the City of Los Angeles with respect to legislation, rules, regulations or policies proposed to or pending before a local, state, or federal governmental body or agency must have first been adopted in the form of a Resolution by the City Council with the concurrence of the Mayor;” [2] the City of Los Angeles considers the ability to access safe and legal abortions as an important human right; [3] the City of Los Angeles is cognizant that “970 million women, representing 59% of women of reproductive age, live in countries that broadly allow abortion and 41% of women of reproductive age live under restrictive laws;” [4] the City of Los Angeles is cognizant that “legal restrictions on abortion do not result in fewer abortions and instead compel those seeking abortions to risk their lives and health by resorting to unsafe abortion practices;” [5] the City of Los Angeles is cognizant that “23,000 women die of unsafe abortions each year;” [6] the City of Los Angeles is cognizant that “women across the world have fought for the right to access safe and legal abortions for decades;” [7] the City of Los Angeles is cognizant that ”in the United States, the 1973 Roe v Wade Supreme Court decision affirmed the right to receive an abortion under the 14th Amendment;” [8] the City of Los Angeles is cognizant that “the 1992 Planned Parenthood v Casey Supreme Court decision upheld the right to receive an abortion, adding that any restrictions should be evaluated under an undue burden standard;” [9] the City of Los Angeles, California is cognizant that the United States Supreme Court overturned the landmark 1973 Roe v Wade ruling on June 24th 2022; [10] the City of Los Angeles is cognizant that the Supreme Court overturned the landmark 1973 Roe v Wade ruling after hearing oral arguments in Dobbs v Jackson Women’s Health Clinic; [11] the City of Los Angeles is cognizant that the impact of overturning Roe v Wade will be most felt by “marginalized groups who already face significant barriers accessing abortion care, particularly low-income women of color;” [12] the City of Los Angeles is cognizant that “8,000 to 16,000 more people will travel to California each year for abortion care;” [13] The City of Los Angeles have tasked their Administrative Officer to report “on the feasibility of allocating funding to help subsidize costs for persons from other states seeking abortion care; [14] the City of Los Angeles have tasked their legal representatives to “prepare and present a draft ordinance to prohibit any City resources, including but not limited to, time spent by employees, officers, or the use of City property, from being utilized to detain persons for procuring, providing, or aiding in abortion care in the City of Los Angeles;” [15] the City of Los Angeles have tasked their legal representatives to “prepare and present a draft ordinance to prohibit any City resources, including but not limited to, time spent by employees, officers, or the use of City property, from being utilized to cooperate with or provide information to any individual or out of state agency or department investigating persons who procure, provide, or aid in abortion care in the City of Los Angeles;” [16] the City of Los Angeles is cognizant that the U.S President can “direct the leaders of every federal agency to explore options to protect abortion rights, including the use of federal property and resources to increase abortion access such that reproductive care and abortion can occur on those properties and be exempt from the state’s abortion laws;” [17] the City of Los Angeles is cognizant that federal agencies such as the Department of Health and Human Services (HHS) can “encourage states to use their own Medicaid funds, which are not governed by the Hyde Amendment, to cover abortion services and expand other family planning services as well as pursue more aggressive enforcement of federal requirements which guarantee that Medicaid beneficiaries have the ability to seek family planning services from their provider of choice.”

Hello,

This is Michael A. Ayele sending this message though I now go by W. You may call me W. I am
writing this letter to file a complaint with the Office of the Missouri Attorney General. The basis for my
complaint is the manner in which the City of Creve Coeur Police Department processed my Sunshine
request on the subject of [1] Jennifer Rothwell's November 11th 2019 murder as well as [2] the public
health consequences following the decision of the Supreme Court to overturn the landmark 1973
ruling of Roe v Wade.

As you may be aware, I had filed a Sunshine request with the City of Creve Coeur on July 26th 2022
on the subject hereby described above. In my Sunshine request, I had made a request for a fee
waiver and expedited processing. Via e-mail dated July 27th 2022, the City of Creve Coeur informed
me that they had plans of charging me $57 (fifty seven) dollars for the Sunshine request I had
submitted to them. That same day, I informed them that I was not willing to pay the $57 dollars they
wanted me to pay them. I also told them that for me to consider paying the $57 dollars they wanted
me to pay them, they would have to disclose records detailing how city governments such as theirs
have a history of charging fees to Sunshine requests submitted on the subject of violence committed
against women (on the basis of their pregnancy). Ignoring the e-mail I had sent them on July 27th
2022, the City of Creve Coeur Police Department have disclosed records detailing a report that was
written about Jennifer Rothwell after she was declared "missing." The City of Creve Coeur has
disclosed these records on July 29th 2022. Via e-mail sent on that day, they again insist that I pay
them $57 dollars, thus the basis for this complaint I wish to file.

Consumer would like complaint resolved via: - Investigate business - Other: I believe it's within
the jurisdiction of the Missouri Attorney General to look into city government agencies
processing of a Sunshine request. As previously mentioned, at the time I had filed my
Sunshine request with the City of Creve Coeur, I had specifically made a request for a fee
waiver and expedited processing. However, the City of Creve Coeur have ignored my request
for a fee waiver and expedited processing. They are now demanding that I pay them $57
dollars even though I had never agreed to pay them fees at the time I had submitted my
Sunshine request. In my judgment, their actions constituted harassment of a representative of
the media and a member of the general public.

I wish for the Missouri Attorney General to [1] look into whether the City of Creve Coeur have a
documented history of charging fees in response to Sunshine request, where a request for a
fee waiver was submitted; [2] look into whether the City of Creve Coeur have a documented
history of harassing representatives of the media who have filed a Sunshine request with them;
[3] look into whether the City of Creve Coeur have a documented history of harassing
members of the general public who have filed a Sunshine request with them; [4] to inform the
City of Creve Coeur about their obligations to Sunshine requests submitted on the subject of
violence committed against women (on the basis of their pregnancy).

NARRATIVE

On 11/12/2019 at 2150 hours, I was dispatched to a Check the Welfare at

Olive Blvd and Fern Ridge Parkway. Dispatched advised the reporting party

found his wife's Hyundai Sonata off of the roadway with no one inside of

the vehicle. The reporting party last heard from his wife at 0630 hours

while she was on her way to work in Chesterfield. The reporting party saw

a cell phone inside the vehicle.

Upon my arrival, I observed a silver Hyundai Sonata off the roadway in
the grass on the north side of the Olive Blvd. I observed two white males
near a gray 2015 GMC Canyon (MSL GKAE77) parked on the shoulder.

I exited my patrol vehicle and I made contact with Beau Rothwell (W/M
12/18/1990) and Timothy Douglas (W/M 05/15/1987) who had entered the GMC
Canyon.

Rothwell stated he last heard from his wife, Jennifer Rothwell (W/F
11/20/1990), on the morning of 11/12/2019 around 0620 hours. Beau
Rothwell stated he had a missed call from Jennifer Rothwell at 0626 hours
while he was asleep. Beau Rothwell stated he didn't hear from Jennifer
Rothwell the rest of the day. Around 2030 hours, Beau Rothwell and
several of Jennifer Rothwell's coworkers started a group text message.
Jennifer Rothwell's coworkers, "Sarah" and "Rachel" stated Jennifer never
showed up to work today and did not call in. Beau Rothwell stated he
and Douglas decided to separately drive the area to look for Jennifer
Rothwell's car, see vehicle screen for further. Douglas located Jennifer
Rothwell's vehicle off the roadway and called Beau Rothwell. Beau
Rothwell then called 911 to report the incident.

As Beau Rothwell spoke, he was crying and appeared upset.

I walked over to the silver Hyundai Sonata and observed no visible damage
to the vehicle. I saw tire impressions in the snow indicating that the
vehicle did not slide off the roadway due to snow/ice, but instead was
driven off the roadway. The vehicle was located approximately 15 feet
north of Olive Blvd. The vehicle was locked with no keys in sight. I
located a pink cell phone in the cup holder of the center console.

P.O. Worth, DSN 570, arrived on the scene.

I observed police caution tape tied to the driver side mirror of Jennifer
Rothwell's vehicle. This is often done by police officers after checking
on abandoned vehicles. I asked dispatch if any Creve Coeur officers from
day shift called out with the vehicle today. Dispatched advised that
Officer Begic, DSN 1149, called out a motorist assist on the Hyundai at
0926 hours on 11/12/2019, Incident #2368953. According to Officer Begic,
the vehicle was unoccupied and no items were seen inside of the vehicle.
Officer Begic tagged the vehicle with the crime scene tape for visibility
for snowplows.

Sgt Schultz, DSN 857, arrived on the scene and was briefed by P.O. Worth.

Sgt Schultz instructed P.O. Worth and I to take Beau Rothwell and Douglas
back to the Creve Coeur Police station for further investigation.

Rothwell and Douglas each drove their own vehicle to the station,
Rothwell followed P.O. Worth and Douglas followed me.

At the station, I escorted Douglas to the middle detective interview
room for further questioning. I turned on this department's video/audio
recording system for the interview.

During questioning, Douglas stated the following:
- Around 2030 hours on 11/12/2019, Douglas was told by his wife

"Sarah" that her friend and coworker, Jennifer Rothwell, never showed up
to work today and wasn't responding to any calls or text messages.

- Douglas stated he was put into a group text message with his wife
Sarah, Jennifer Rothwell's other coworker "Rachel," Beau Rothwell, and
himself.

- Douglas had the idea of checking the possible paths Jennifer
Rothwell would have taken to work.

- Douglas stated he drove in the area of North Outer Forty and
Interstate 64.

- Douglas stated he was driving westbound Olive Blvd near Fern Ridge
Parkway when he spotted a silver Hyundai that was off of the roadway.

- Douglas got out of his car and checked the vehicle which was empty.
- Douglas took a photo of the car and sent it to the group text
message in which Beau Rothwell confirmed it was Jennifer Rothwell's
vehicle.
- Douglas advised that Beau Rothwell then drove up to Olive Blvd and
Fern Ridge Parkway and that is where they called the police.

A/Sgt Mueller, DSN 960, came into the interview room and asked Douglas to
complete a voluntary written statement form. The statement was turned
into Det. Parker, DSN 393.

Detective Parker, DSN 393, and Lt Francis, DSN 413, arrived at the police
station, at this point I was relieved of my duties of interviewing
Douglas.

Later in the investigation, at approximately 0315 hours on 11/13/2019,
St Louis County K-9 Officer O'Brien, DSN 3991, and K-9 Yago, DSN 43,
attempted to locate a track of Jennifer Rothwell in the nearby area
assisted by Creve Coeur Officer Tapella, DSN 1127. The track resulted in
negative findings.

Det Parker will complete further investigation.

NARRATIVE

On 11-12-19 at approximately 2144 hours, I responded to assist PO MacKeen
#1136 with a missing persons report wherein we met the husband roadside
at Olive Blvd. at Fern Ridge Pkwy. Apparently, the reporting party/
husband and Douglas found his wife's car unoccupied parked off the
roadway.

I asked PO MacKeen if the missing person had a phone. PO MacKeen said it
was in the car still.

The Victim's vehicle was parked roadside in the snow approximately 15
feet off the roadway just north of Olive Blvd. I saw tire tracks in the
snow wherein the vehicle left the roadway. The tire tracks didn't appear
as though the tire impressions were caused by sliding or tire lock-up. I
looked over the vehicle and it didn't appear wrecked or damaged. I saw a
rose-gold colored, iPhone was sitting on the center console adjacent to
the gearshift.

I observed an additional set of tire tracks at the scene which was just
east of his wife's car and parallel to the roadway. The tire tracks
looked similar to the tire tracks on Beau Rothwell's GMC Canyon pickup.

I talked to Beau the husband of the missing Victim. He said the following:

-Asked if this was his wife's car. He said, "Yes."

-I asked him for her work info and pedigree. He provided it.

-Asked if she was having car trouble. He said, "No."

-Asked if she called you this morning. He said, "I missed a call from her
and tried calling her back but she didn't pick up. I called her near 0730
or 0800. She called near 0626 hrs and I missed that call."

-Asked did she leave a message. He said, "No."

-Asked did she text. He said, "No."

-Asked has she been distraught. He said, "No."

-Asked there been any discord in your marriage. He said, "No."

-Asked do you have kids. He said, "No."

-Asked if she has family close. He said, "She's got family in Illinois."
He said, "Her family lives in Kansas City."

-I Asked about communication with his wife. He said, "There were several
missed calls. There were three or four it looks like. She didn't leave a
voicemail, she never leaves a voicemail."

-I asked if they have any marital problems and I explained it was odd he
didn't get a voicemail or text. He didn't respond to the marital problem
part of the question. He only said, "She never leaves voicemails. She
just hates voicemails. I was surprised I didn't get a text either."

-I asked if she had another phone and again verified the time she tried
calling. He said she didn't have another phone and the time she tried
calling was near 0630 hours.

I saw there were tears in the husband's eyes. He appeared calm and not
hysterical or over-emotional.

I asked Beau and Douglas to separate and wait in their separate vehicles.

I briefed Sgt. Schultz who arrived on the scene.

I asked Beau to drive his own vehicle and follow me to the police
station.

At the police station, we spoke in Interview Room #138. I gathered his
work information:

He said he went to work near 0800 hours. He told me he went home sick
from work near 1030 hours. He said he tried calling her back near 0730
hours one time. He identified her car as a 20ll Hyundai Sonata, gray in
color.

He explained the following:

-They met at Mizzou and have been married since 2015.

-They dated for four years prior to getting married.

He gave me his wife's work information:

He gave me a timeline of what he and his wife did last night:

-Ate at home "Chicken Pot Pie"

-Watched Netflix the "Great British Baking Show" unknown time frame. When
I pried further for a more specific time frame of the show he replied, "I
can't recall", "I don't really know."

-Worked on an art project which was a countdown calendar for their
upcoming baby. He told me his wife was "six weeks pregnant."

I asked if his wife was getting morning sickness. He said, "She gets car
sick."

He explained his parents were divorced and live in Columbia, MO. He said
her parents live in Kansas City.

He told me his best friend is his wife's brother that lives in Marissa,
IL. He said, "I haven't thought of that since middle school (laughing)."

I told him my wife is my best friend. He said, "I didn't think about
Jennifer. Ya, she would be the best friend."

He said he has two sisters that live in Columbia, MO. He said his wife
works with Tim Douglas' wife. He said his wife's best friend is co-worker
Rachel Braun (Phone # 314-223-8305). He said Rachel has called hospitals
to see if Jennifer was a patient there.

I asked what do you think happened to your wife and asked him to guess.
He said, "I have no clue man. When I looked in the car I noticed her
purse was gone, so that makes me think, and it's locked so she didn't
take her purse and lock it. Um, I don't know."

Beau said his wife's black handbag was not in her vehicle and she keeps
it on the passenger front floorboard routinely. He said when she leaves
the car she "always takes it with her."

He described her phone as a rose gold iPhone. He said when he calls her
it goes straight to voice mail.

He said they went to bed near 8, 9, or 930PM-ish.

I asked if he knew the sex of his baby. He said, "Nah it's only six
weeks." He added, "I think at 8 weeks you can get a test to determine
probability if it's a boy or girl." I asked, "You guys pretty excited
about this baby huh." He said, "Ya we've been trying since January.

Told ourselves if it got to a year we'd seek fertility. Ten months after
trying we got pregnant."

He told me about him going to work and not feeling well. He said, "My
head is kind of foggy, you know I think it's sinus thing, I don't know if
it's flu or what." He said, "My buddy at work told me to go home."

He said the last phone call he made was on his cell phone and it was to
his project manager at work.

He showed me text messages he sent to his wife:

- 1744 hours: "We going to cook for dinner"
- 1842 hours: "Have you left yet"
- 1902 hours: "Guess I'm eating alone"
- 1945 hours: "I'm started to get worried"

He said, explaining about his wife's workday, "She leaves when she gets
her work done type of thing."

I asked if I could get him a water. He said, "A water would be great."

I asked to pat him down for my safety. He said, "Of course" and put his
arms up. I patted him for weapons but found none. I asked, "Are you a
gun guy?" He said, "No." I asked, "Do you hunt?" He said, "No." I told
him I was going hunting with my son this weekend. He said, "Too cold for
me (laughed), cold early, got to get up so early, oh man." I told him we
go to Mark Twain. He said, "Ok, Mark Twain Lake, Ya I used to go water
skiing up there with an (indiscernible)."

I left the interview room for water.

He sat quietly in the interview room and lacked any emotion.

I re-entered the interview room with water and a Mountain Dew.

I asked if he called the hospitals or anything. He said, "Jennifer's
friend Rachel who is also a co-worker was making those calls. Rachel,
Tim, Sarah....." group chatted via text.

He said he received a text from her Co-Worker Rachel at 840PM that she
wasn't at work all day long. He said he didn't know if Jennifer called
into work.

He advised the group text planned to search for his missing wife. He said
really it was just he and Tim that looked for her. He told me Tim went

one way to her work and he went another. He said Tim located his wife's
car near 930pm.

I asked for information about his phone.

He advised the PIN number to his phone was: 181819. He said his carrier
was T-Mobile.

I asked, "Is tonight the first time you've been by the car?" He squinted
his eyes at me and said, "Uh, what do you mean." I said, "Is tonight the
first time you pulled behind the car with Tim? " He said while squinting
at me, "Uh, Ya." I said, "Is tonight the first time you were roadside
with the car you found tonight?" He said, "Ya, Yes."

He said, "Tim found it (car) at 930pm is when he texted me." He said
Tim and him never met, it was all arranged by text. He explained they re-
traced the way she traveled to work and that Tim went the Olive route and
he took Hwy. 270.

I asked him to make a written statement of what he's told us to this
point.

He said, "Maybe, I feel like I would need a lawyer for that (laugh) or
something, uh sorry."

I said, "Just for a written statement?"

He said, "Ya I know," and then said "Ya I don't know. I was trying to
answer all the questions as simply as I can. I do kinda want a lawyer
(laugh) we're going down a lot of rabbit holes."

I said, "I'm just asking to put your statement in a written statement.
Do you want a lawyer is what you are saying? You're not a suspect of any
wrongdoing right now, your wife's just missing. Unless you know something
else."

He said, "I get what you're saying."

I said, "I'm just trying to clarify with you. Do you feel you need a
lawyer?"

He said, "I would feel more comfortable with one before I make a written
statement."

I said, "That's kind of vague though. Right now you're just reporting
your wife missing and I'm trying to ascertain your help, ascertain last
time you have seen her, what else you guys have done to locate her,

for all I know she's ok unless you think something different or know
different. Do you feel you need a lawyer?"

He said, "I would be more comfortable with one."

I said, "I'm like that's a vague statement."

He said, "Ya, I would like a lawyer if that's what you're getting at."

I told him I needed to speak with my boss and exited the interview room.

I re-entered the interview room with Det. Parker #393. I tried to make
sure I understood his request for a lawyer and if it was just for a
written statement or speaking to us.

He clarified, "I would like legal counsel."

Det. Parker seized his phone and truck keys as evidence.

The interview was recorded using the built-in police department's video/
audio system.

NARRATIVE

This is supplement #2 written under Rpt #19-2645 which reflects

additional investigation reference the missing person case involving

Jennifer Rothwell and the cancellation of entry #M074394259.

On 11/13/2019, I received a CD which contained audio of Beau Rothwell's
(see additional party screen) 911 call to the West Central Dispatch
Center (WCDC). The CD was entered into evidence using the Etwist system
and annotated on the property screen of this report.

Later that afternoon, I received a telephone call from my supervisor, Lt.
Francis DSN 413, directing me to cancel the missing person's entry on
Jennifer Rothwell (see victim screen). It should be noted Lt. Francis
and Det. Parker responded to the station yesterday evening (11/12/19) to
assist patrol with this missing person case.

It was explained that the St. Louis County Police Department Crimes
Against Person's Division would take over primary investigation of the
case. Det. Taylor requested the entry be removed from Creve Coeur so a
new entry could reflect Rothwell missing per the St. Louis County Police
Department. The entry was canceled via WCDC. Refer to St. Louis County
Police Department Report #19-53681 for additional information.

NARRATIVE

On 11/12/2019 at about 2230 hours I was called in to assist with this
missing person incident.

I learned that the missing person was Jennifer Rothwell

I learned that Jennifer was married to Beau Rothwell who was present at
the police station and had already been interviewed by P.O. Worth.

I learned that Beau Rothwell had arrived at the police station with a
Timothy Douglas who was helping him search for Jennifer's car.

I spoke to Officer Worth who stated that Beau Rothwell was exibiting
signs that he has information about this case that he is not sharing.
P.O. Worth stated that tire tracks at Olive and Fern Ridge Parkway appear
to match the tires on Beau Rothwell's vehicle, and make it appear as
though Beau Rothwell was at Olive and Fern Ridge Parkway more than once
which is contrary to his statement.

I seized Beau Rothwell's telephone and truck key as evidence and later
released it to Detective Jason Whiteside of the St Louis County Crimes
Against Persons Division when it was determined that the majority of this
incident likely occurred in St Louis County Venue.

I interviewed Timothy Douglas.

Douglas stated the following:

-Douglas stated his wife Sara works with Jennifer Rothwell.

-Douglas stated he plays video games remotely with Jennifer Rothwell.

-Douglas stated he learned from his wife Sara at about 8:45 PM that
Jennifer missed work and was not answering her phone.

-Douglas stated he organized a search for Jennifer's car with Beau
Rothwell.

-Douglas stated he started at Jennifer's job and drove a route toward her
home.

-Douglas stated he found Jennifer's car in the area of Olive and Fern
Ridge Parkway.

-Douglas stated he notified Beau who notified police.

NARRATIVE

This supplement reflects the discovery of a missing video recording
mentioned in supplement #1.

During an audit of video evidence, it was recently discovered that the
video of the interview between PO Scott Worth and Beau Rothwell was
missing (purged).

In October 2019 the Creve Coeur Police Department moved into a new
building. Apparently the new video recording system purges videos after
60 days unless it is saved to a disc or jump drive. The recording system
in the old Police building saved the video files automatically on a
server and they could be retrieved at any time. Officers were not made
aware of the video system differences and numerous videos of interviews
were purged.

On 7/16/21 I contacted APA Tom Smith at 314-615-2537. Mr. Smith is
handling the Jennifer Rothwell homicide case for the State of Missouri. I
made Mr. Smith aware of the missing video. A copy of this report will be
forwarded to Mr. Smith upon approval.

Any further information will be added in a supplement.
