DEFINITION

An agreement between
two or more parties to
combine their assets, labor

or liabilities for the
purpose of making profit.

ALQURAN

ۚ ‫َف ِإن َكاُنوا َأْكَثَر ِم ن َٰذ ِلَك َف ُه ْم ُش َرَكاُء ِف ي الُّثُلِث‬

"But if they are more than two, they share a third"

Surah al-Nisa’ verse 12

HADIT
H

‫ عن النبي صلى الله عليه‬،‫ما رواه ابو هريرة رضى الله عنه‬
‫ انا ثالث الشريكين ما لم يُخ ْن‬:‫ "يقول الله تعالى‬:‫وسلم قال‬

"‫ فاذا خانه خرجُت من بينهما‬،‫احدهما صاحبه‬

The Prophet Muhammad (peace be upon him) said: “God the Most High
says, I am the third (partner) to two partners as long as one of them does
not betray the other; if they betray each other, I leave them” (Abu-Dawud).

Musharakah may be entered into by two or
more parties on a particular asset or

venture which allows one of the partners to
gradually acquire the shareholding of the
other partner through an agreed
redemption method during the tenure of
the contract. Such arrangement is
commonly referred to as Musharakah
Mutanaqisah.
